Children's Court (Fees) Regulations 2005

The regulations centre on a small set of legal and administrative concepts that govern fee imposition, reduction, exemption and enforcement. These concepts appear repeatedly and determine how the schedule operates in practice.

Fees and Schedule 1: Regulation 4 requires that the fees in Schedule 1 be charged for matters listed in s 53 of the Children’s Court Act, and distinguishes between fees payable by ordinary individuals (Column A) and reduced "eligible individual" fees (Column B) where a reduced fee is specified (reg 4(1), 4(2A)). Schedule 1 is structured in divisions (General; Civil jurisdiction; Criminal jurisdiction) and includes items and notes that are given regulatory force (reg 4(2)).

Eligible individual and eligible individual fee: The regulations define "eligible individual" (reg 3; expanded in reg 8). The eligible category is partly automatic (holders of specified Centrelink or DVA concession cards; recipients of youth training/ABSTUDY/AUSTUDY allowances; legal aid recipients; see reg 8(2)(a)-(e)), and partly discretionary (the Court or a registrar can direct a person is an eligible individual under reg 9B(1)). The eligible individual fee is the Column B amount in Schedule 1 for the relevant item (reg 4(2A)(b)).

Waiver and exemption mechanisms: Exemptions are listed in regulation 5 and include FVRO/VRO applications under the Restraining Orders Act 1997, prohibited behaviour order applications under the Prohibited Behaviour Orders Act 2010, civil proceedings under the Criminal Law (Mental Impairment) Act 2023, statutory exemptions, and persons under 18 on the day the fee would otherwise be payable (reg 5). Regulation 6AA imposes mandatory waiver obligations for certain application copy and transcript fees in FVRO/VRO contexts and specifies when the waiver applies (reg 6AA(2)-(5)). Regulation 9 gives broader discretionary waiver power where waiving a fee would assist efficient Court operation.

Administrative decision‑making and review: Registrars are the primary decision‑makers for fee questions (reg 10(1): disputes as to the fee payable are to be determined by a registrar). The Court provides summary review of registrar determinations (reg 10(3)). The registrar or Court may direct an applicant to provide further information when considering an application to be recognised as an eligible individual (reg 9B(2)).

Payment timing: In civil jurisdiction matters, the fee must generally be paid before an application or document is filed, issued or otherwise dealt with or before other Court action taken by an officer (reg 7(2)(a)-(b)). Regulation 10 exempts fee determinations and reviews from fee payment.

Recovery and enforcement: Any unpaid fee is a debt to the State and recoverable by action (reg 11). Several fee items relate to enforcement conduct: service fees (Schedule 1 Division 1, item 2), enforcement officer travel (item 3), execution of warrants and related custody fees (Schedule 1 Division 2, item 2), and the note references enforcement officer as defined in the Civil Judgments Enforcement Act 2004 (reg 3). Regulation 6 specifies that in certain public prosecutions or where a State body is represented by the State Solicitor’s Office, prescribed fees are payable only upon conviction or making of a restraining order and recovery from the accused/respondent (reg 6(3)).

False statements and compliance risk: Regulation 9C criminalises knowing or reckless false or misleading statements in applications under these regulations, with a $1,000 fine, and provides for revocation of eligible status and orders for payment of the difference in fees (reg 9C(1)-(3)). This establishes both a deterrent against fraudulent claims and an enforcement route for the Court to recoup differential fees.

Interaction with other statutes: The regulations incorporate and operate alongside a number of other Acts. They use definitions and cross‑references to the Restraining Orders Act 1997 (FVRO, VRO, respondent defined, reg 6AA), the Criminal Procedure Act 2004 (prosecution notice; s 71 applications, regs 6A and Schedule 1), Civil Judgments Enforcement Act 2004 (enforcement officer definition, reg 3), Social Security Act 1991 (Commonwealth) for allowance definitions relevant to eligibility (reg 8(2)(c)), the Legal Aid Commission Act 1976 for legal aid; Criminal Law (Mental Impairment) Act 2023 for an express fee exemption (reg 5(c)), and the Road Traffic (Authorisation to Drive) Act 2008 for a Schedule 1 civil item (Division 2, item 3).

Administrative notes in the Schedule: Several Schedule items include operative notes that change charge mechanics, for example service attempts covered (Schedule 1 Division 1, item 2 note), limits on travel fee charging when multiple processes are executed together (item 3 note), and that transcript and copy fees are payable for indictable matters dealt with summarily (item 7 note). Regulation 4(2) gives these notes the same effect as if they were provisions in the regulations.

Collectively, these concepts form a system that routes fee collection and concessions through registrars, presiding judicial officers and the Schedule, sets dollar levels for many discrete activities, and provides statutory mechanisms for exemptions, waivers and dispute resolution.

The regulations allocate fee liability and administrative burden across several categories of persons and public entities. The principal affected groups are:

• Individual litigants and respondents who use the Children’s Court , private litigants are the primary payers of fees listed in Schedule 1, Column A unless they qualify as an eligible individual (reg 4(2A)(a), Schedule 1). Examples: filing a prosecution notice (Schedule 1, Division 3, item 1(a) , $160.50 for ordinary individuals), requesting transcripts (Schedule 1, Division 1, item 7), obtaining certified copies (Schedule 1, Division 1, item 6(c)), or service of documents (Schedule 1, Division 1, item 2 , $114.50).

• Eligible individuals , people who hold specified Centrelink or DVA concession cards, recipients of youth training/AUSTUDY/ABSTUDY allowances, legal aid recipients in respect of the proceedings, and persons approved by the Court/registrar after application (reg 8(2)(a)-(f), 9A-9B). Eligible individuals pay the lower Column B fees where a reduced fee exists (reg 4(2A)(b); e.g., prosecution notice $48.10 , Schedule 1, Division 3, item 1(a)).

• Applicants for FVROs and VROs and respondents to such applications , regulation 5 expressly exempts applications under the Restraining Orders Act 1997 for FVROs and VROs from fees (reg 5(a)), and regulation 6AA requires waiver of certain copy and transcript fees for applicants and respondents in defined circumstances (reg 6AA(3)-(5)).

• The State and public agencies , the State potentially bears short‑term cost where proceedings are instituted by police or public officers, or where the State Solicitor’s Office acts for a board or body; in those circumstances prescribed fees are payable only upon conviction or the making of a restraining order and recovery from the accused/respondent (reg 6(3)). That delegates financial risk to the State until recovery occurs.

• Court officers and registrars , registrars are given decision‑making and administrative duties: determining fee disputes (reg 10(1)), directing eligible individual status on application (reg 9B(1)), requiring further information (reg 9B(2)), waiving certain fees (reg 9) and implementing mandatory waivers under reg 6AA. These duties create workload and discretion for court staff.

• Enforcement officers , several Schedule items impose fees tied to enforcement officer activity (definitions at reg 3; Schedule 1 Division 1, items 2 and 3; Division 2, item 2). Enforcement officers or the State recover travel and attendance fees, and those fees may be charged to the person subject to the enforcement action where recoverable.

• Legal aid organisations and lawyers , the regulations treat legal aid recipients as automatically eligible in relation to the proceedings for which aid is granted (reg 8(2)(e)). Lawyers and firms will manage payment and recovery processes for clients, including making applications under reg 9A for eligible status and advising on waivers and refunds.

• Bodies and boards represented by the State Solicitor’s Office , reg 6(3)(b) specifically contemplates that where the State Solicitor’s Office acts or appears on behalf of a board or other body, the relevant prescribed fees are payable only upon conviction/making and recovery from the accused/respondent. That shifts upfront fee exposure.

The mechanics produce concrete distributional effects. Individuals who are not eligible for Column B rates typically pay higher fees for identical services. Some fees are identical for both columns (for example, Schedule 1 Division 1, item 2 , service fee $114.50 in both A and B), which matters for low‑income litigants who gain no concession in those categories. Regulation 5 extends fee exemption to certain family‑violence and mental‑impairment matters and to minors, thereby relieving those classes from payment obligations. Registrars’ discretionary power to waive fees for efficiency (reg 9) and the automatic/administrative eligible‑status routes place procedural tasks on Court staff and create an avenue for applicants to reduce their fee burden.

The regulations also affect litigants’ litigation strategy. The requirement to pay fees before filing in civil proceedings (reg 7(2)) can be a gatekeeper to access for those not eligible or unable to pay, encouraging use of the eligible‑status application route (reg 9A-9B), seeking judicial waiver (reg 9), or seeking legal aid (reg 8(2)(e)). Where fees are payable only upon recovery (reg 6(3)), the State initially shoulders the charge and pursues cost recovery from the convicted person or respondent, which may affect resource allocation for police and prosecuting agencies.

Finally, compliance obligations and exposure to penalty (false statements offence, reg 9C) are directed at applicants who seek eligible‑status relief or misstate circumstances; that criminal sanction and the potential for revocation and an order to pay the difference are enforcement levers the Court may use to deter abusive claims.

The regulations assign specific administrative duties to registrars and the Court, set payment obligations for applicants and litigants, and confer rights such as review and refund. These are the material duties and rights created or recognised:

Duty to charge and pay fees: Subject to the regulatory exemptions and waivers, the Court must charge the fees in Schedule 1 for the listed matters and an individual must pay the applicable fee (reg 4(1), Schedule 1). For civil jurisdiction matters, an applicant or other person must pay the fee before filing, issuing or otherwise dealing with an application or document, and no other Court process is to be done until the fee is paid (reg 7(2)(a)-(b)). This establishes a duty on the Court to require payment and on applicants to provide payment at defined procedural moments.

Registrar duties: Registrars must determine disputes about fee applicability (reg 10(1)). They may direct persons to provide further information when considering applications to be recognised as eligible individuals (reg 9B(2)). They have discretion to waive fees that would assist efficient operation of the Court (reg 9). Regulation 6AA imposes a mandatory duty on registrars to waive specific application and transcript fees in defined FVRO/VRO circumstances when requested by the applicant or respondent who has not previously obtained a copy (reg 6AA(3)-(5)).

Court duties: The Court or a presiding judge or magistrate may order refunds of the difference between the amount of a fee paid and the amount that should have been payable under the regulations (reg 9D(1)). The Court may hear summary reviews of registrar determinations under reg 10(3). The Court may also direct an applicant to be an eligible individual under reg 9B(1) where satisfied on financial hardship or interests of justice grounds.

Duty to provide information and truthfulness: An applicant seeking eligible individual status may be required by the Court or registrar to provide further information (reg 9B(2)). Regulation 9C(1) creates a duty not to make false or misleading statements in an application or in response to a request for further information; contravention is an offence with a $1,000 fine and carries administrative consequences (reg 9C(1)-(3)).

Rights of applicants and affected persons: A person affected by a registrar’s determination about fees may seek a summary review by the Court (reg 10(3)). Applicants for eligible‑individual recognition have a right to apply in the approved form and are entitled to have the Court or registrar consider their application (reg 9A(1)-(3), 9B(1)). Persons may be refunded by the Court or registrar in specified circumstances (reg 9D(1)-(2)).

Fee waiver and exemption rights: Regulation 5 establishes that certain categories of people are not required to pay fees at all in specific matters (e.g., FVRO/VRO applications under the Restraining Orders Act 1997) (reg 5(a)). Regulation 6AA creates a right for applicants and respondents to have the registrar waive copy of application and transcript fees in circumstances where no decision has been made, the application was dismissed, or an interim order exists (reg 6AA(2)-(5)). Regulation 6A allows a registrar to waive a fee for an application to set aside a decision under Criminal Procedure Act 2004 s 71 where failure to appear was caused by a clerical error by the Court (reg 6A).

Recovery and enforcement rights/duties: The State has the right to recover any unpaid fee as a debt by action in a court of competent jurisdiction (reg 11). Where a direction recognising someone as an eligible individual is revoked for false statements, the Court or registrar may order the person to pay the difference between the amount they paid and what would otherwise have been payable and can make enforcement orders (reg 9C(3)-(4)).

Procedural timing obligations: Fees for transcripts carry urgency‑related pricing; the Schedule sets time bands (within 1, 2, 4, 7, 14 days or running basis) and per‑page rates (Schedule 1, Division 1, item 7). Those seeking expedited transcripts bear higher per‑page costs, which imposes a payment duty on parties wanting faster access.

Operational notes taken as provisions: Regulation 4(2) gives Schedule notes operational effect. Those notes include that the service fee covers up to three attempts at service at the same address (Schedule 1 Division 1, item 2 note), and that where multiple processes are executed at once, only one kilometre fee is chargeable (item 3 note). The Court and registrars must therefore observe those minutiae when charging.

Overall, the regulations both burden applicants with payment duties and confer limited protective rights (eligibility categories, waivers and refund routes) and administrative review. The duties on registrars to make determinations, grant waivers in specified cases and manage eligible‑status applications are material administrative roles with implications for registrar workload and discretion.

The regulations create direct criminal/penal exposure for false or misleading representations in the eligible‑status application scheme, set civil enforcement mechanics for unpaid fees, and specify operational enforcement fees for use of enforcement officers. The key enforcement and penalty provisions are:

Criminal offence for false or misleading statements: Regulation 9C(1) makes it an offence for a person who makes a statement or representation in an application under these regulations, or who provides further information in relation to an application, if the person knows or has reason to believe the statement is false or misleading in a material particular. The penalty is a fine of $1,000. This is a direct penal sanction aimed at deterring fraudulent attempts to obtain reduced fees or exemptions.

Administrative and financial consequences following revocation: Regulation 9C(2)-(3) allows the Court or a registrar to revoke a direction recognising someone as an eligible individual if satisfied the person contravened reg 9C(1), after giving the person an opportunity to make a written submission. If a direction is revoked, the Court or registrar may order payment of the difference between the fee that was paid and the fee that would otherwise have been payable and may make an order to enforce payment (reg 9C(3)). Regulation 9C(4) further permits orders relating to future conduct of the matter or effect of actions taken until the sum ordered is paid.

Unpaid fees as a state debt: Regulation 11 declares any unpaid fee to be a debt due to the State and expressly permits recovery by action in a court of competent jurisdiction. That is a civil enforcement mechanism that allows the State to pursue unpaid fees as debts, including interest and costs as recoverable under the enforcing court’s rules (the regulation itself does not prescribe interest or costs rates).

Enforcement officer related fees and mechanics: Schedule 1 contains several items that remunerate or recover costs associated with enforcement officer activities. Item 2 prescribes the fee for service of process ($114.50) and the note states it is payable whether or not service is successful and covers up to three attempts at the same address (Schedule 1 Division 1, item 2 and note). Item 3 provides per‑kilometre travel fees for enforcement officers when travel is necessary to execute warrants or serve process (metropolitan $2.65/km; outside metro $3.00/km , Schedule 1 Division 1, item 3). Division 2, item 2 sets fees for execution of arrest warrants and custody conveyance and for custody duration charges. These items provide the statutory basis for charging persons for enforcement activity and recovering costs.

Procedural enforcement: Where proceedings are instituted by police or public-sector officers, or where the State Solicitor acts for a board or body, regulation 6(3) states the appropriate prescribed fees are payable only upon conviction and recovery from the accused or upon making of a restraining order and recovery from the respondent. That provision effectively postpones enforcement of fee liability until a later stage and makes recovery contingent on successful conviction or order. In practice, the State would incur upfront costs and attempt recovery from a convicted person or respondent; if recovery fails, the State bears the residual loss, unless the State takes civil recovery steps under reg 11.

Waiver and refund enforcement: The Court and registrars have authority to refund fees where overpayment or error occurred (reg 9D(1)-(2)), and to waive fees in specified circumstances (reg 6AA; reg 9; reg 6A). Those powers act as mitigants to rigid enforcement and can reduce litigation over fees. However, improper use or misstatement in applications may attract the penalty in reg 9C.

Dispute and review enforcement process: Determinations by registrars about fees are subject to summary review by the Court (reg 10(3)). Regulation 10(4) specifies no fee is payable for the registrar’s determination or the Court’s review. This procedural route is an internal administrative enforcement check against incorrect fee imposition.

In summary, enforcement under these regulations operates on two axes: criminal/administrative for false claims (reg 9C), and civil recovery for unpaid fees (reg 11), with operational cost recovery for enforcement officers and an administrative framework of waivers, refunds and reviews to mediate disputes.

The regulations operate in a network of statutory cross‑references. They do not function in isolation; instead they embed into the Children’s Court’s procedural and jurisdictional framework and interact with several Commonwealth and State statutes. Important statutory interactions in the text include:

Children’s Court of Western Australia Act 1988: The regulations are made under the Act’s fee‑making power (regulation 4 refers to fees in respect of matters referred to in the Act section 53). The Schedule fills in the numerical and procedural details that the Act delegates to subordinate legislation. Any change to s 53 or amendment to the enabling Act may affect the scope of fees that may lawfully be prescribed.

Restraining Orders Act 1997 (State): Regulation 5(a) exempts applications for family violence restraining orders (FVROs) and violence restraining orders (VROs) under the Restraining Orders Act 1997 from fees, and regulation 6AA cross‑refers extensively to FVRO and VRO procedures and definitions (reg 6AA(1)-(5)). That creates a direct interaction: specific processes under the Restraining Orders Act are removed from fee obligations or receive waivers. Regulation 6(2) also uses the Restraining Orders Act respondent definition for interpretation.

Criminal Procedure Act 2004 (State): The regulations treat prosecution notices and certain applications under the Criminal Procedure Act 2004 as fee‑charged items (Schedule 1 Division 3, item 1; regulation 6A relates to applications under Criminal Procedure Act 2004 s 71 to set aside a decision). The definition of "prosecution notice" is drawn from Criminal Procedure Act 2004 s 3(1) (reg 3). This ties fee obligations to prosecution processes and gives a registrar discretion to waive fees where absence was due to a Court clerical error (reg 6A).

Civil Judgments Enforcement Act 2004 (State): The regulations adopt the defined term "enforcement officer" from the Civil Judgments Enforcement Act 2004 s 3 (reg 3). Schedule 1 items 2 and 3 create fees for services by enforcement officers and kilometre travel, which will interface with the enforcement regime under the Civil Judgments Enforcement Act for the abilities and duties of enforcement officers.

Criminal Law (Mental Impairment) Act 2023 (State): Regulation 5(c) explicitly exempts civil proceedings under the Criminal Law (Mental Impairment) Act 2023 from fees. That is a targeted statutory interaction that relieves a defined class of proceedings from the fee regime.

Legal Aid Commission Act 1976 and legal aid schemes: Regulation 8(2)(e) recognises that an individual who has been granted legal aid under the Legal Aid Commission Act 1976 or a comparable scheme is an eligible individual for the purposes of paying reduced fees. That cross‑reference integrates the fee regime with legal aid eligibility and practice.

Commonwealth statutes and benefits: Regulation 8(2)(a)-(d) and (b) draw on Centrelink and Department of Veterans’ Affairs concession cards and Commonwealth student allowance definitions, including the Social Security Act 1991 (Commonwealth) s 23(1) for youth training and AUSTUDY allowances. The regulations therefore import Commonwealth administrative eligibility determinations into the State fee regime as an objective route to reduced fees.

Road Traffic (Authorisation to Drive) Act 2008 (State): Schedule 1 Division 2 item 3 prescribes a fee for filing an application for an extraordinary licence under Road Traffic (Authorisation to Drive) Act 2008 s 27, showing that fees under the Children’s Court regulations cover specific non‑criminal processes created by other State Acts where the Children’s Court exercises jurisdiction.

Prohibited Behaviour Orders Act 2010 (State): Regulation 5(b) exempts applications under the Prohibited Behaviour Orders Act 2010 from fees, aligning the fee regime with that Act’s public policy choices.

Civil procedure and recovery law: Regulation 11 makes unpaid fees a debt due to the State and recoverable by action. Recovery procedures will therefore intermesh with civil procedure rules and with the Civil Judgments Enforcement Act for enforcement mechanics.

Administrative law and judicial review: Registrar determinations and Court summary reviews (reg 10) will be subject to the usual administrative law constraints (procedural fairness) and judicial review remedies where appropriate. Although reg 10 contemplates internal review, external judicial review avenues may still be available under common law and the Judicial Review Act where jurisdictional error or denial of procedural fairness is alleged, though those external remedies are not addressed in the regulations themselves.

Overall, the regulations operate by importing eligibility benchmarks from Commonwealth social security/DVA/education regimes, coordinating with other State Acts by exempting or charging particular processes, and integrating with enforcement regimes for execution and debt recovery. The effect is that the Children’s Court fee system will depend operationally on external administrative determinations (e.g., Centrelink cards) and on the substantive outcomes of other statutory proceedings (e.g., conviction or making of a restraining order under reg 6(3)).

The compilation table attached to the regulations records a history of amendments from the original 2005 instrument through to 2025. The text of the regulations also shows where specific provisions were inserted or amended and cites the relevant amendment instruments. Key amendment milestones and their mechanical impact in the regulations are:

• Original instrument: Children’s Court (Fees) Regulations 2005 published 28 April 2005, commencement 1 May 2005 (compilation table). That instrument introduced the initial schedule and framework.

• 2006-2015 incremental adjustments: Multiple amendment regulations between 2006 and 2015 updated fees and administration; the text shows regulation 3 was amended on 23 June 2006 and again in 2016 (reg 3 note). Changes across these years reflect periodic fee adjustments and administrative changes, listed in the compilation table.

• 2016 Attorney General Regulations Amendment (Fees) Regulations Pt. 2 , effective 4 July 2016 (compilation table). The regulations were amended in 2016 and, notably, regulation 8 (eligible individual definitions) was inserted at Gazette 14 Jun 2016 p. 1857-8 (reg 8 inserted: Gazette 14 Jun 2016 p. 1857-8). This introduced the eligible individual scheme as currently configured (reg 8).

• 2017-2018 changes: Amendments include specific fee changes and the addition of waiver and fee relief mechanisms across 2017 and 2018. The Attorney General Regulations Amendment (Family Violence Restraining Orders) Regulations 2017 and the Justice Regulations Amendment (Fee Relief) Regulations 2018 show policy adjustments concerning family violence and fee relief (compilation table). Regulation 6A was inserted by SL 2022/145 r. 4 but earlier instruments prepared the ground for fee relief policy.

• 2018 transcript fee reforms: Attorney General Regulations Amendment (Transcript Fees) Regulations 2018 and 2019 (compilation table) altered transcript fee mechanics; the Schedule now contains urgency bands and per‑page rates (Schedule 1 Division 1, item 7).

• 2022 amendments: SL 2022/145 (Attorney General Regulations Amendment (Fee Waiver) Regulations 2022) inserted regulation 6A allowing registrars to waive application fees under Criminal Procedure Act 2004 s 71 in cases where the failure to appear was due to a Court clerical error (reg 6A inserted: SL 2022/145 r. 4). This amendment introduced a narrow administrative correction power.

• 2023-2024 amendments: Various fee and exemption changes continued (compilation table entries for 2023 and 2024). Most recently, SL 2024/174 (Court Fees Regulation Amendment Regulations 2024) inserted regulation 5 (Exemptions) as shown by the note "[Regulation 5 inserted: SL 2024/174 r. 4.]" in the text. That amendment added explicit exemptions for FVRO/VRO and Prohibited Behaviour Orders, civil proceedings under the Criminal Law (Mental Impairment) Act 2023, and persons under 18 (reg 5).

• December 2024 amendment: SL 2024/254 inserted regulation 6 amendments and added the mandatory waiver regime later expanded; the text shows regulation 6 was amended by SL 2024/254 r. 4 and regulation 6AA was inserted by SL 2024/254 r. 5. Regulation 6AA (Certain application and transcript fees must be waived) is a recent insertion requiring mandatory waivers in defined family violence contexts.

• 2025 changes: SL 2025/111 (Attorney General Regulations Amendment (Fees and Charges) Regulations 2025) produced a notable rework of Schedule 1, including the heading inserted at r. 4 and a revised structure dividing fees into Divisions 1-3 and updating many amounts (the Schedule contains 2025 rates and structural headings marked "[Heading inserted: SL 2025/111 r. 6]"). The compilation table cites SL 2025/111 published 25 June 2025, commencement 1 July 2025.

The amendment history shows iterative policy adjustments: periodic indexation or restructuring of fees, targeted fee relief and waiver measures (notably for family violence proceedings), and procedural fixes (reg 6A). The cumulative effect is a layered instrument where important new policies (exemptions for FVRO/VRO, mandatory waivers in reg 6AA, eligible‑individual scheme in reg 8) have been grafted onto the original 2005 framework.

Users should consult the compilation table dates and transitional provisions in the amending instruments (not reproduced here) when applying the regulations to matters spanning amendment dates, because fee amounts and entitlements can change with amendment commencement dates (compilation table lists commencement dates for each amending instrument). The text shows the State periodically revises both the quantum of fees and the social policy settings (for example, exemptions for family violence matters in 2024).

The regulations, as reproduced here, do not record any case law or judicial decisions interpreting their provisions. The text contains no references to reported cases or judicial determinations. Regulation 10(3) contemplates internal review by the Court of registrar determinations in a summary manner, but the regulations themselves do not record outcomes of such reviews.

Practical implications for practitioners and researchers:

• There is no litigation history contained within the instrument. For precedent on how courts have applied the fee provisions, registrars’ decisions and Court summary reviews, one must search court databases, tribunal decisions, and published judgments. The instrument does not supply case names or prior determinations.

• Common areas likely to produce litigation or review include disputes about eligibility for Column B rates (reg 8, 9A-9B), claims of financial hardship or interests of justice, challenges to a registrar’s exercise of discretion to waive fees (reg 9), and revocation decisions following allegations of false or misleading statements (reg 9C). Given the statutory criminal offence in reg 9C, cases could arise concerning the mens rea standard "knows or has reason to believe" that a statement is false or misleading.

• Fee recovery actions under regulation 11 will be pursued as ordinary civil debt actions. Litigation about recoverability might raise questions of jurisdiction, limitation periods and whether the State’s statutory declaration that the unpaid fee is a debt is sufficient foundation for recovery in a given cause, but that is a matter for ordinary civil litigation practice.

• Challenges based on administrative law (procedural fairness, jurisdictional error) could be pursued where registrars or the Court purport to make decisions outside their statutory scope. The regulations provide internal review under reg 10 but do not limit external judicial review remedies available under the common law or relevant statutes.

Recommendation to practitioners: Because the instrument contains no recorded litigation, counsel and practitioners should check Westlaw/LEXIS/AustLII and unreported decisions for any cases addressing reg 9B, reg 9C revocations and fee recovery proceedings under reg 11. For matters affected by recent amendments (for example reg 6AA and reg 5 exemptions), practitioners should verify commencement dates in the compilation table to confirm which rules apply to their client’s matter.

The regulations have several operational, procedural and substantive features that may trip up practitioners and litigants if not attended to. The following caution points draw directly from the text and explain the concrete mechanism and consequences:

1. Fee payable before filing in civil matters: Regulation 7(2) requires payment of the fee before filing, issuing or otherwise dealing with an application or document in the civil jurisdiction. Practitioners who attempt to file without payment can have the filing refused or delayed; the regulation creates a procedural gate. If a client is eligible for a reduced fee or exemption, ensure eligible‑status is established or fee waived before attempting to file.

2. Eligible individual requires documentary evidence or Court direction: Some classes of eligibility are automatic if a person holds a specified Centrelink/DVA card or receives certain benefits (reg 8(2)(a)-(d)), but reg 8(2)(e) and reg 9B allow the Court/registrar to direct someone is eligible on grounds of legal aid, financial hardship or interests of justice. Regulation 9A requires applications for such direction to be in an approved form and states no fee is payable in respect of the application itself (reg 9A(1)-(3)). Practitioners should not assume a client is eligible without documentary proof or a registrar’s direction.

3. Criminal offence and financial exposure for false claims: Regulation 9C makes false or misleading statements in the eligible‑status process a criminal offence carrying a $1,000 fine. The Court may revoke eligibility and order payment of the difference between the lower fee paid and the ordinary fee, and enforce that order (reg 9C(1)-(3)). This creates dual exposure (criminal fine and civil repayment) for misstatements. Always verify supporting documentation before lodging an eligible‑status application.

4. Some fees are identical for eligible individuals: Several Schedule items have the same charge in Column A and Column B (for example service fee Schedule 1 Division 1, item 2 , $114.50 in both columns; warrant execution and conveyance fees Schedule 1 Division 2, item 2(a)(b) , $211.00 and $209.00 respectively, same in both columns). Being an eligible individual does not guarantee reduced costs across all fee types; check the Schedule item to determine whether reduced rates apply.

5. Service fee covers up to three attempts at same address: Schedule 1 Division 1, item 2 note states the fee is payable whether or not service is successful and covers up to three attempts at service at the same address. Multiple addresses or more than three attempts may trigger further costs , the note is operational and binding because regulation 4(2) gives notes effect as regulatory provisions. Practitioners should plan service strategy accordingly.

6. Travel and enforcement‑related fees can add up: Schedule 1 Division 1, item 3 charges per‑kilometre travel fees for enforcement officers and item 5(b) charges hourly rates plus reasonable expenses for officers attending out of their base. Item 3 note prevents double charging for kilometres when multiple processes executed at the same time and place, but complex enforcement activity can produce significant fees, especially outside metropolitan areas (higher per‑kilometre rate). Verify likely enforcement activity and consider cost recovery prospects.

7. Fees for transcripts are time‑sensitive and costly if urgent: Schedule 1 Division 1, item 7 imposes higher per‑page charges for faster production (e.g., 1‑day delivery attracts 12.60 per page plus a base 30.50 for ordinary individuals). A running service attracts an even higher per‑page rate. Parties needing early transcripts should expect noticeably higher costs and should budget accordingly.

8. Postponed state liability in public prosecutions: Regulation 6(3) defers fee liability in the criminal jurisdiction and restraining order proceedings instituted by police or public officers (or where the State Solicitor acts for boards) until conviction or order and recovery from the accused/respondent. This can lead to the State initially meeting administrative fees and then seeking recovery; in practice, recovery may be unsuccessful, creating a net cost to the State. Practitioners representing victims or private applicants should not assume immediate fee obligation falls on the State except where reg 6(3) applies.

9. Waiver rules limited and conditional: Regulation 6AA mandates waiver of certain application or transcript fees only in narrowly defined FVRO/VRO situations and subject to the applicant/respondent having not previously obtained the copy or transcript (reg 6AA(3)-(5)). Regulation 9 allows waiving on grounds of Court efficiency, which is discretionary. Don’t expect automatic waiver beyond the specific circumstances set out in reg 6AA and 5.

10. Refund and revocation powers are potent: A judge or magistrate may order refunds where a fee paid exceeded the correct amount (reg 9D(1)), and registrars may refund sums paid in error (reg 9D(2)). Conversely, revocation under reg 9C can lead to retrospective liability for the differential amount and enforcement orders (reg 9C(3)-(4)). Practitioners must track fee payments and ensure eligibility determinations are accurate and defensible to avoid reversal.

11. No fee for review of fee determinations: Regulation 10(4) provides that no fee is payable for a registrar’s determination about fee applicability or for a Court review under reg 10(3). This is a practical relief route; however, the merits of the challenge remain subject to the Court’s summary review procedures and potential consequences under reg 9C if fraud is alleged.

12. Amendments affect which rules apply: The compilation table lists multiple amendments with varied commencement dates. For matters that straddle amendment commencements, ensure the applicable version of the regulations and fee quantum is determined by reference to the relevant instrument and commencement date. The Schedule in the reproduced text includes 2025 rates and newly inserted divisions; older matters might be governed by prior rates.

These "gotchas" are procedural and financial traps that flow directly from the text. They affect litigant access, budgeting for litigation, registrar workload, and potential exposure to penalty. Practitioners should incorporate checks (document verification, pre‑filing eligibility applications, client cost estimates for transcript and enforcement fees) into client intake and case planning.

Complying with the Children’s Court (Fees) Regulations 2005 requires both procedural steps and substantive verification measures. The following practical checklist and guidance, grounded in the regulations, sets out concrete actions for litigants, lawyers, and court officers.

1. Confirm which fees apply to the matter (reg 4(1), Schedule 1): Before filing or requesting services, identify the correct Schedule 1 item for the action (e.g., prosecution notice, application under Criminal Procedure Act s 71, transcript, copy of application). Use the Schedule’s divisions to locate the correct item: Division 1 (General), Division 2 (Civil jurisdiction), Division 3 (Criminal jurisdiction).

2. Determine eligible status early (regs 8, 9A-9B): If the client holds a Centrelink or DVA concession card listed in reg 8(2)(a)-(b), or is a legal aid recipient (reg 8(2)(e)), gather and prepare to produce the card or legal aid documentation. If the client claims financial hardship or interests of justice (reg 9B(1)), lodge an application under reg 9A in the approved form before the matter proceeds; reg 9A(3) states no fee is payable for that application. Anticipate a request from the registrar or Court for further information under reg 9B(2) and be ready with documentary evidence.

3. Pay required fees before filing in civil matters (reg 7(2)): For civil jurisdiction filings, ensure the relevant fee is fully paid before attempting to file or issue documents. If unsure whether a waiver or eligible rate applies, consider making the eligible‑status application under reg 9A first, or seek the Court’s direction under reg 9B to avoid rejected filings or having to re‑file.

4. Use waiver and exemption rules where applicable (regs 5, 6AA, 6A, 9): Identify if the matter falls within the exemptions in reg 5 (FVRO/VRO, prohibited behaviour orders, civil proceedings under the Criminal Law (Mental Impairment) Act 2023, persons under 18). If the matter involves FVROs/VROs and a copy of the application or transcript is required in the specific circumstances in reg 6AA(2)-(5), request the registrar to waive the applicable Schedule 1 fees per reg 6AA(3) and (5). For a failure to appear believed to be caused by a court clerical error, ask the registrar to exercise discretion to waive the s 71 application fee under reg 6A.

5. Prepare clients for transcript and enforcement costs (Schedule 1 items 3, 7, 2): If the client is likely to require transcripts quickly, explain the increased per‑page rates for faster turnaround (Schedule 1 Division 1, item 7) and budget accordingly. If enforcement activity is likely (service, execution), explain that service fees cover up to three attempts at a single address and that travel charges apply per kilometre (Schedule 1 Division 1, items 2 and 3) and may vary whether metropolitan or non‑metropolitan.

6. Maintain documentary accuracy to avoid reg 9C exposure: Ensure that any representations in an application for eligible status or requests for waiver are accurate and supported by documents. Regulation 9C criminalises material false or misleading statements and permits revocation and reimbursement orders. Have clients sign and verify statements and provide copies of concession cards, benefit letters, legal aid certificates, or hardship evidence where relevant.

7. Use dispute and review procedure where errors occur (reg 10): If a fee is charged incorrectly or disputed, make an application in the approved form for a determination by the registrar under reg 10(1)-(2). If dissatisfied, seek summary review by the Court under reg 10(3). Note that these determinations/reviews are fee‑free (reg 10(4)).

8. Track and reclaim refunds where required (reg 9D): If a fee was overpaid, seek a refund from the registrar in writing and, if presiding judicial officer action is needed, a judge or magistrate may order a refund of any difference under reg 9D(1) and registrars may refund fees paid in error under reg 9D(2).

9. For public prosecutions and State‑instituted matters, check if reg 6 applies: If proceedings are brought by police, a department officer, or the State Solicitor’s Office acts for a board, fees may be chargeable only on conviction/making of an order and recovery from the convicted person/respondent (reg 6(3)). In such matters the State may initially meet administrative costs; advise clients accordingly.

10. Keep abreast of amendment and commencement dates: The Schedule and regulatory provisions have been amended repeatedly (compilation table). Before relying on any fee quantum or exemption, check the relevant amending instrument and its commencement date to ensure the right regime applies to the client’s matter.

11. Administrative practice for registrars and court staff: Set up checklists to verify concession cards and legal aid certificates automatically at intake (reg 8), maintain approved forms for reg 9A applications, and prepare templates for waiver and refund decisions (regs 6AA, 9, 9D). Keep record of any further information requested under reg 9B(2) and the applicant’s responses, since reg 9C contemplates sanctions for false information.

12. Budget and client advice on recoverability: Where the State seeks to recover fees after conviction or order (reg 6(3)), advise clients on likely recovery processes and the possibility that the State may not be able to recoup all costs. For private litigants or respondents ordered to pay fees, the Court may enforce under reg 9C(3)(b) or pursue debt recovery under reg 11.

To summarise, compliance requires early eligibility checks, precise documentation, pre‑filing fee payment in civil matters, careful use of waiver routes and an organised approach to disputing fees or seeking refunds. Practitioners should build these steps into standard operating procedures for Children’s Court matters to avoid rejections, penalties or unexpected client liabilities.
