Part 2—Guiding principles and related matters 8—Requirement to give effect to this Part and Part 4 Division 3 (1) Each person or body engaged in the administration, operation or enforcement of this Act (including, to avoid doubt, the Court and a delegated decision maker) must perform their functions so as to give effect to and further the guiding principles and related matters set out in— (a) this Part; and (b) in the case of a function relating to an Aboriginal or Torres Strait Islander child or young person—Part 4 Division 3. See also section 45(2). (2) However, a failure to comply with subsection (1) does not, of itself, affect the validity of an act or omission under this Act.
