635E Internal review (1) If an application is made for internal review, the decision-maker must arrange for someone else (the internal reviewer) to review the decision. (2) The internal reviewer must, within 40 days after the internal reviewer receives the application— (a) confirm the decision; or (b) vary the decision; or (c) set aside the decision and substitute their own decision. (3) If the internal reviewer does not take action under subsection (2) within the 40-day period, the internal reviewer is taken to have confirmed the decision.
