Child Wellbeing and Safety Regulations 2017

The Regulations operate by prescribing defined terms, dates and bodies referenced in the Child Wellbeing and Safety Act 2005. The principal regulatory mechanisms and concepts presented in the text are as follows.

• Prescribed date for employee status. The Regulations fix a statutory cut-off date for the definition of "employee" in the Act. Regulation 6 prescribes 1 July 2017 as the relevant date for paragraph (d) of the definition of employee in s 3(1) of the Act, affecting which persons are treated as employees for the reportable conduct scheme.
• Prescribed entities to which the reportable conduct scheme applies. Regulation 7 ties entities listed in Schedule 2 to the reportable conduct scheme under the Act and specifies the dates from which the scheme applies to each listed entity (Reg 7; Schedule 2). Schedule 2 further defines "youth organisation" and gives examples. Items in Schedule 2 take effect on the prescribed dates in Column 2.
• Sector and integrated-sector regulators. The Regulations specify which public entities are "prescribed sector regulators" for the purposes of particular parts of the Act. Regulation 7A identifies the Secretary to the Department of Health as prescribed sector regulator for certain Schedule 1 items and Wage Inspectorate Victoria for item 41. Regulation 7B prescribes the Social Services Regulator as the integrated sector regulator for specified items and identifies the Department of Families, Fairness and Housing as included; reg 7B(2) refers to the functions and powers in s 14 of the Social Services Regulation Act 2021.
• Additional regulators for early childhood sector. The Regulations (Regs 7C and 7D) designate the Victorian Early Childhood Regulatory Authority (per the Victorian Early Childhood Regulatory Authority Act 2025) as a regulator for approved providers and employees of approved early childhood services under the Education and Care Services National Law (Victoria) and the Children's Services Act 1996.
• Exemption from Child Safe Standards. Reg 8 expressly exempts Victoria Police from the requirement to comply with the Child Safe Standards under s 19(1) of the Act. This is a categorical, named exemption tied to the statutory definition of Victoria Police in the Victoria Police Act 2013.
• Disclosure pathways. The Regulations operationalise s 16ZC(2)(f) and s 16ZC(2)(g) of the Act by prescribing the persons and bodies to whom information may be disclosed, specifying the matters or classes of matter in Schedules 3 and 4. Schedule 3 covers Victorian recipients such as the chief psychiatrist and disability-safeguarding bodies (with some items commencing on 1 July 2020), and Schedule 4 lists interstate and Commonwealth recipients including the NDIS Quality and Safeguards Commissioner and named state guardians/ombudsmen.
• Early birth-notification form. Regulation 10 prescribes the form required under s 43(2) of the Act for early notification of births. Schedule 1 sets out the fields to be provided and who may sign as the "responsible person".
• Prescribed applicable entities with public functions. Regulation 11 prescribes a list of cultural, arts and conservation bodies to be treated as applicable entities with public functions for the purposes of item 5 of Schedule 5 to the Act.
• Infringement offences and penalties. Regulation 12 prescribes that specified offences under the Act may attract infringement notices and sets the penalty units for each infringement offence in Schedule 5. The explanatory details explain that penalty amounts are calculated by multiplying penalty units by the monetary unit under the Monetary Units Act 2004, and note the penalty unit value for the 2025-26 financial year.

Structurally the Regulations are a schedule-based subordinate instrument, cross-referencing the principal Act for definitions and operative sections (for example s 3(1) definitions, s 16ZC, s 19(1), s 36B and s 43(2)), while naming regulators and recipients to create discrete legal effects: who is within the reportable conduct regime, who may receive information, which public bodies are exempt from standards, the form of statutory notification and what contraventions attract infringement notices and the corresponding unit-based amounts.

The instrument changes legal status, obligations and information flows for several classes of persons and entities. The text identifies who is added, regulated, authorised to receive information, or exempt, together with the timing for these effects.

• Individuals who become "employees" for the reportable conduct scheme. By prescribing 1 July 2017 as the date relevant to paragraph (d) of the Act’s definition of employee (Reg 6), the Regulations affect foster carers and persons engaging in certain child-related work who meet that definition from that date. Those persons will be treated as employees for the reportable conduct scheme in the Act.
• Entities to which the reportable conduct scheme applies. Entities listed in Schedule 2 are prescribed as entities to which the reportable conduct scheme applies, with commencement dates set in Column 2 of Schedule 2 (Reg 7; Schedule 2). Examples in Schedule 2 include public health services listed in Schedule 5 to the Health Services Act 1988 (subject to 1 January 2018 commencement) and youth organisations whose primary activity includes overnight camps (from 1 May 2020). Entities added to the scheme will have to operate under the reportable conduct processes in the Act from their prescribed dates.
• Sector and integrated-sector regulators, and the early childhood regulator. The Regulations name specific public regulators that will exercise sectoral oversight or receive notifications under the Act: the Secretary to the Department of Health for certain entities (Reg 7A(a)), Wage Inspectorate Victoria for item 41 (Reg 7A(b)), the Social Services Regulator as the integrated sector regulator for identified entities and the Department of Families, Fairness and Housing (Reg 7B), and the Victorian Early Childhood Regulatory Authority for approved early childhood providers and their employees (Regs 7C and 7D). These bodies will therefore have responsibilities and powers in relation to the reportable conduct scheme or the Child Safe Standards as set out in the principal Act and the Social Services Regulation Act 2021 (Reg 7B(2) cites s 14 of that Act).
• Victoria Police. The Regulations explicitly exempt Victoria Police from the requirement to comply with the Child Safe Standards under s 19(1) of the Act (Reg 8). That alters obligations that would otherwise attach under the Act to a statutory entity.
• Named recipients of information. Schedule 3 prescribes Victorian persons and bodies who may receive disclosures under s 16ZC(2)(f) of the Act, such as the chief psychiatrist and specific disability safeguarding bodies. Some items in Schedule 3 are only prescribed from 1 July 2020 (Reg 9(2)). Schedule 4 prescribes interstate and Commonwealth recipients for disclosures under s 16ZC(2)(g), for example the Commissioner of the NDIS Quality and Safeguards Commission and the NSW Children’s Guardian (Reg 9A; Schedule 4). Those recipients gain authorised access to certain categories of information specified in Column 2 of those Schedules.
• Cultural and public heritage bodies listed in Reg 11. Entities such as the Australian Centre for the Moving Image, the National Gallery Council of Trustees and the Royal Botanic Gardens Board are prescribed as applicable entities with public functions for item 5 of Schedule 5 to the Act (Reg 11). Those entities will be treated within that item’s regime for the Act.
• Persons and entities subject to infringement notices. Schedule 5 sets prescribed infringement offences (Reg 12; Schedule 5). Individuals and corporations who commit the listed offences (s 29H(1), s 29K(1), s 34D of the Act) may be issued infringement notices with penalty units prescribed in Schedule 5. The explanatory details give the monetary unit value for 2025-26 and the calculation method, which produces concrete dollar amounts for these penalties.

Who pays. Where infringement notices are issued for the listed offences, the payer will be the individual or corporation found to have committed that infringement; Schedule 5 specifies different unit amounts for individuals and corporate bodies (Schedule 5 table). Who decides. The Regulations authorise particular regulators and public bodies to exercise functions and to receive information; they also delegate to specified regulators powers and functions referenced in the Act (for instance, the Social Services Regulator’s functions in reg 7B(2) as per s 14 of the Social Services Regulation Act 2021). Behaviour changes. Entities newly prescribed into the reportable conduct scheme, regulators given functions, and agencies authorised to receive disclosure will need to adapt policies and information flows from the commencement dates identified in this instrument. The early-notification form prescribes what data must be supplied when notifying births under s 43(2), which alters the content and responsibility for completing such notifications.

The Regulations operate mainly by prescribing who carries duties under the Act, who has rights to receive information, and what procedural form certain obligations take. The instrument delegates many substantive duties back to the principal Act but creates duties and rights by naming persons, dates and forms.

Duties created or clarified by prescription

• Duty to treat persons as employees for the reportable conduct scheme. Regulation 6 prescribes 1 July 2017 as the date relevant to the definition of "employee" in s 3(1). That means organisations and regulators must treat persons who fall within paragraph (d) of the Act’s employee definition as employees from that date for the purpose of the reportable conduct scheme. The duty to make and manage reportable conduct notifications under the Act follows from that status.
• Duty to comply with the reportable conduct scheme for prescribed entities. Regulation 7 prescribes entities in Schedule 2 as entities to which the reportable conduct scheme applies and gives the date from which it applies. Those entities acquire the duties under the Act to report, investigate, and keep records in accordance with the reportable conduct scheme once the prescribed date is reached.
• Duty to use the prescribed birth-notification form. Regulation 10 prescribes the form in Schedule 1 for the notice of birth under s 43(2) of the Act. The prescribed form lists specific fields to be supplied and identifies who may sign as the responsible person, creating an operational duty about the form and contents of information to be provided to municipal CEOs or the Secretary to the Department of Education and Training.
• Duty to make or accept disclosures to prescribed recipients. Regulation 9 and Regulation 9A prescribe recipients and the matters for which information may be disclosed under s 16ZC(2)(f) and s 16ZC(2)(g). The Act’s general disclosure power is therefore constrained or directed by the named recipients and topics in Schedules 3 and 4, which places duties on entities under the Act to disclose to those recipients where the statutory conditions are met, and confers a right on those recipients to receive the disclosed information.
• Duty to observe sectoral regulator relationships and consult or notify those prescribed regulators. Regulations 7A, 7B, 7C and 7D name particular regulators for specific entities or employees for the purposes of defined parts of the Act, which will impose duties on regulated entities to interface with those regulators and duties on regulators to exercise specified powers or functions under the Act and related instruments.

Rights and entitlements created or clarified

• Right of prescribed regulators to receive notifications and exercise functions. By prescribing the Secretary to the Department of Health, Wage Inspectorate Victoria, the Social Services Regulator and the Victorian Early Childhood Regulatory Authority as regulators for specified items, the Regulations grant those bodies the statutory entitlement to carry out their functions under the Act or the cross-referred Social Services Regulation Act 2021 (Reg 7B(2) refers to s 14 of that Act).
• Right of specified Victorian and interstate bodies to receive information. Schedule 3 confers the right to receive disclosures about the specified classes of matters for the chief psychiatrist and disability workforce safeguards bodies; Schedule 4 gives a similar right to interstate recipients such as the NDIS Commission and the NSW Children’s Guardian (Regs 9 and 9A).
• Right to issue and receive infringement notices. Regulation 12 prescribes certain offences as infringement offences for the purposes of s 36B(1) of the Act, and Schedule 5 sets the penalty units for those infringement offences. The Act’s infringement process therefore becomes available in the prescribed cases.

Operational form and limits

• Temporal limits. Several prescriptions are subject to staged commencement dates. For example, items in Schedule 3 at Items 2, 3 and 4 are only prescribed from 1 July 2020 (Reg 9(2)). Schedule 2 entries have their own prescribed dates. The staged approach creates temporal duties for compliance.
• Exemption. The Regulation 8 exemption for Victoria Police from the Child Safe Standards removes, for that named body, the duty that section 19(1) would otherwise impose. The right to be exempt is not general but specific to the named agency.
• Penalties and monetary calculation. Regulation 12 together with Schedule 5 prescribes infringement offences and the number of penalty units. The explanatory details set out the mechanism for calculating the dollar value of a penalty unit, and give the value applicable for the 2025-26 financial year ($203.51). This link means duties are backed by quantified monetary consequences where an infringement notice is issued.

In short, the Regulations define who must do what, when, and to whom an entity must disclose information, by naming parties, prescribing dates and setting form and penalty parameters. The precise duties under the Act remain the source; the Regulations determine which persons and bodies fall within those regimes and the administrative mechanics that follow.

The Regulations authorise the use of infringement notices for specified offences under the Child Wellbeing and Safety Act 2005 and fix the number of penalty units for those infringement offences. Enforcement is therefore both civil-administrative (via infringement notices) and remains law-enforcement or regulatory as set out in the principal Act for other contraventions.

Which offences are prescribed as infringement offences

• Regulation 12(1) declares that the offences listed in Column 1 of the Schedule 5 table are "prescribed offences" for the purposes of section 36B(1) of the Act. Schedule 5 lists three items: s 29H(1), s 29K(1) and s 34D of the Act (Schedule 5 table; Reg 12).

Penalty unit amounts in Schedule 5

• Schedule 5 sets different penalty-unit amounts for individuals and corporate bodies:
  • Item 1 (s 29H(1)) , individual: 6 penalty units; body corporate: 24 penalty units.
  • Item 2 (s 29K(1)) , individual: 6 penalty units; body corporate: 24 penalty units.
  • Item 3 (s 34D) , individual: 12 penalty units; body corporate: 24 penalty units.

Monetary calculation mechanism

• The explanatory details at the end of the instrument explain that penalty amounts are calculated by multiplying the number of penalty units by the value of a penalty unit under the Monetary Units Act 2004 (Endnotes: Penalty Units section). The value of a penalty unit for the financial year commencing 1 July 2025 is stated in the explanatory details as $203.51. The notes instruct that the amount of the penalty may be rounded to the nearest dollar and that future values are fixed by the Treasurer (Endnotes).

Concrete dollar equivalents for 2025-26 (as set out in the instrument)

• Using the penalty unit value provided in the explanatory details ($203.51):
  • Item 1 and Item 2: individual 6 units = 6 × $203.51 = $1,221.06 (approx); body corporate 24 units = 24 × $203.51 = $4,884.24 (approx).
  • Item 3: individual 12 units = 12 × $203.51 = $2,442.12 (approx); body corporate 24 units = $4,884.24 (approx).

Enforcement mechanism and limits

• The Regulations do not create new criminal offences; they designate which existing offences under the Act may be dealt with via infringement notices (Reg 12(1)). The Act’s s 36B(1) is the operative provision that allows infringement notices where an offence is prescribed. The Regulations therefore widen the Act’s infringement-toolbox by specifying particular Act provisions as suitable for infringement notices and setting unit amounts.
• The Regulations also specify that the infringement penalty prescribed for an infringement offence for the purposes of s 36B(3) of the Act is the amount specified in Column 2 of Schedule 5 (Reg 12(2)). That binds the monetary limit on infringement notices to the schedule.

Who enforces and who pays

• The instrument delegates enforcement mechanics to the processes set out in the principal Act (for example, section 36B). The immediate payer of an infringement penalty will be the individual or corporate body subject to an infringement notice; Schedule 5 assigns differing unit counts by offender type. The Regulations do not themselves specify which enforcement agency issues the infringement; that process follows the Act’s provisions and the enforcement arrangements within the Act and applicable regulator functions.

Temporal and administrative considerations

• The explanatory details emphasise that penalty units are adjusted annually and the value for future years is to be fixed and published by the Treasurer. This creates an administrative condition for enforcement authorities in converting units to dollars at the time of any infringement action.
• The Regulations also show staged commencements for other measures (for example, some disclosure recipients in Schedule 3 only prescribed from 1 July 2020). These staged starts can affect when enforcement risk arises for particular entities or conduct.

In sum, the Regulations provide specific, unit-based civil penalties for three identified Act provisions, instruct how to calculate the monetary amount, and leave implementation of infringement processes to the Act’s enforcement machinery.

The Regulations are intentionally cross-referential and specify interaction points with numerous other statutory instruments. The text embeds the Regulations within a broader regulatory network by prescribing regulators, naming institutions, and by making the operation of provisions conditional on other statutory definitions.

Interaction with the Child Wellbeing and Safety Act 2005

• The Regulations are made under s 47 of the Child Wellbeing and Safety Act 2005 (Reg 2). Multiple provisions in the Regulations directly implement and interpret defined terms and operative provisions of the Act, for example:
  • Reg 6 prescribes the date for paragraph (d) of the definition of "employee" in s 3(1) of the Act.
  • Reg 7 prescribes entities to which the reportable conduct scheme applies under the definition in s 3(1).
  • Reg 9 and Reg 9A implement the disclosure powers and limitations under s 16ZC(2)(f) and s 16ZC(2)(g).
  • Reg 8 interacts with s 19(1) by setting an exemption under that provision.
  • Reg 10 prescribes the form required by s 43(2).
  • Reg 12 interacts with s 36B concerning infringement notices.

Interaction with other Victorian Acts and bodies

• The Regulations expressly reference a number of other Acts when prescribing bodies, regulators or definitions:
  • Victoria Police is referenced by its definition in the Victoria Police Act 2013 for the purposes of the exemption in Reg 8.
  • The Secretary to the Department of Health is named as the sector regulator for items in Schedule 1 to the Act (Reg 7A(a)), which links the operation of the Act to the Department of Health via departmental authority.
  • Reg 7A(b) names Wage Inspectorate Victoria as prescribed sector regulator for item 41.
  • Reg 7B(2) links the Social Services Regulator’s prescribed functions and powers to section 14 of the Social Services Regulation Act 2021, cross-referencing that Act to import its functions and powers into the operation of the Child Wellbeing and Safety Act.
  • Regs 7C and 7D link to the Victorian Early Childhood Regulatory Authority Act 2025 and to the Education and Care Services National Law (Victoria) and the Children's Services Act 1996 in prescribing the early childhood regulator for approved providers and employees.

Interaction with interstate and Commonwealth laws

• Schedule 4 prescribes interstate and Commonwealth bodies as recipients for disclosure under s 16ZC(2)(g). This includes:
  • The Commissioner of the NDIS Quality and Safeguards Commission within the meaning of the National Disability Insurance Scheme Act 2013 (Commonwealth).
  • The NSW Children’s Guardian under the Children’s Guardian Act 2019 (NSW).
  • The ACT ombudsman under the Ombudsman Act 1989 (ACT).
• These prescriptions create a statutory basis for cross-jurisdictional disclosure consistent with the Act’s disclosure provisions.

Interaction with the Monetary Units Act and Sentencing Act

• The explanatory details require penalty amounts to be calculated using penalty units under the Sentencing Act 1991 and the Monetary Units Act 2004. Specifically, penalty amounts in Schedule 5 are expressed in penalty units, the value of which is set under the Monetary Units Act and noted in the explanatory details (value for 2025-26 is $203.51). Thus, penalties connect to the monetary unit-setting regime of other statutes.

Consequences of these interactions

• The Regulations function as an integrating instrument that tells regulated parties which other statutory regimes and agencies they must interact with: health, disability, early childhood, wage inspection, social services regulation, municipal councils for birth notifications, and interstate oversight bodies. That integration creates administrative interdependencies: compliance with the Child Wellbeing and Safety Act as supplemented by these Regulations will often require compliance with other statutory schemes or interaction with other agencies whose functions are set out elsewhere.

Limits and specifics of interaction

• These Regulations do not amend the principal Act’s substantive offences, definitions or investigative powers. Instead they identify particular bodies, dates and forms that trigger, channel or limit the Act’s application. They also create temporal staging which means interaction with other Acts and agencies begins on the dates specified in the Schedules and Regulations. The instrument therefore operates as a tailored interface between the Act and a range of public authorities and cross-jurisdictional counterparts.

The Regulations have been amended multiple times since enactment and the instrument’s endnotes provide a table of the statutory rules that changed its content and commencement dates. The endnotes also record future administrative details such as sunsetting. The amendment history in the instrument is the authoritative chronology.

Revocations

• The Regulations expressly revoke earlier subordinate instruments: the Child Wellbeing and Safety Regulations 2007 and the Child Wellbeing and Safety Amendment (Child Safe Standards) Regulations 2015 (Reg 4). This shows the 2017 instrument replaced and consolidated prior subordinate instruments.

Explanatory notes and administrative details

• The endnotes record interpretation notes on headings, examples and punctuation as matters of legislative drafting (ILA references), and provide an explicit cross-reference for penalty unit calculation, including the specified penalty unit value for 2025-26 ($203.51). The endnotes also specify that these Regulations will sunset 10 years after the day of making on 27 June 2027, pursuant to the Subordinate Legislation Act 1994.

Practical effect of amendment timing

• The amendment history shows multiple insertions and substitutions, including changes to which entities are prescribed, the addition of integrated sector regulator provisions, the naming of early childhood regulators, and the insertion of infringement provisions and penalty schedules. Several prescriptions have staged commencement dates; for example, some sector regulator prescriptions and disclosure recipients are effective from 1 January 2023 or 1 July 2024, or as noted in the respective Statutory Rules. The instrument retains notes on when specific items become effective (see Reg 9(2) noting some Schedule 3 items are only prescribed from 1 July 2020).

Taken together, the amendment history recorded in the instrument demonstrates an incremental approach to expanding and clarifying which entities and regulators fall within the Act’s regimes and to introducing infringement mechanics. The endnotes provide the statutory cross-references and the administrative detail necessary for calculating monetary penalties.

The Regulations and their endnotes do not record any litigation history. The instrument contains no judicial decisions, references to cases, or summaries of litigation arising under either the Child Wellbeing and Safety Act 2005 or these Regulations. The text therefore provides no precedent-based guidance or reported case-law to interpret or test the Regulations’ provisions.

What the absence of litigation reporting in the instrument means for practitioners

• No cases cited in the instrument. Because the Regulations do not name or summarise any judicial decisions, readers cannot rely on this instrument for case law interpreting its prescriptions, such as the prescribed date for employee status, the scope of the reportable conduct scheme as applied to entities in Schedule 2, or the operation of the disclosure provisions in Schedules 3 and 4. Any litigation-based interpretation would need to be sought elsewhere, outside this instrument.
• Implementation and potential areas of dispute. The Regulations create several potential factual and legal questions that could give rise to litigation or review, even though none is recorded here. Examples include disputes over whether an entity or person falls within the prescribed definitions (such as the meaning of a "youth organisation" or whether a given activity is a primary activity), the proper interpretation of staged commencement dates, whether particular information disclosures fall within the prescribed matters in Schedules 3 and 4, or whether an infringement notice was validly issued for a prescribed infringement offence. The instrument itself does not adjudicate these questions.
• Administrative review routes. Enforcement and decision-making powers that flow from the Act and the Regulations will be subject to the general administrative law framework; however, the Regulations do not set out appeal or review mechanisms. Challenges to administrative action will therefore be governed by the Act, other applicable procedural statutes and general judicial review principles, none of which are addressed in this instrument.

For practitioners advising clients on risk or likely litigation pathways, the absence of litigation in the instrument means analysis must be grounded in the text of the Regulations and the Act, and in any relevant case law found separately. This instrument provides the statutory architecture, but not adjudicative examples or interpretive guidance derived from judicial decisions.

The Regulations contain discrete technical points and staged commencements that can produce traps for the unwary. The following are concrete pitfalls and implementation frictions strictly supported by the text.

Staged commencement dates and temporal complexity

• Multiple prescribed dates. The Regulations prescribe different commencement dates for different entities and prescriptions. For example, Reg 3 sets the instrument’s commencement as 1 July 2017 while Schedule 2 prescribes specific dates for the reportable conduct scheme to apply to listed entities (Schedule 2 Column 2). Some recipients in Schedule 3 are only prescribed from 1 July 2020 (Reg 9(2)). Practitioners must treat each Schedule entry as having its own effective date; assuming a single uniform commencement date is an error.
• Amendment insertions with later dates. Various Statutory Rules amended the Regulations with staggered commencement dates (see Table of Amendments in endnotes). For instance, Reg 7B was inserted by S.R. No. 16/2024 and commenced 1 July 2024. Practitioners should check the particular Statutory Rule notes rather than relying on the instrument’s original date.

Definition precision

• Employee date is fixed and retrospective. Regulation 6 prescribes 1 July 2017 for the employee definition in s 3(1). Where parties seek to determine whether someone is an "employee" for the reportable conduct scheme, the practitioner must use the date and the Act’s definition as at that date. Misdating could wrongly exclude or include persons.
• "Youth organisation" explained by example. Schedule 2 defines "youth organisation" in general terms and gives examples (Girl Guides, Boy Scouts). But the Schedule also prescribes only those youth organisations that provide overnight camps as a primary activity from 1 May 2020. Determining whether an organisation’s activities make overnight camps a "primary activity" could be factually contested yet the Regulations do not clarify the test.

Exemptions and their scope

• Victoria Police exemption narrow but categorical. Reg 8 prescribes Victoria Police as exempt from the Child Safe Standards under s 19(1)(b). The text does not create a partial or conditional exemption; it is a named exemption. Users must not assume other law enforcement or related agencies are exempt; only the named body is exempt by the Regulation.

Disclosure timing and recipient limitations

• Some disclosure recipients only effective from 1 July 2020. Under Reg 9(2), items 2, 3 and 4 of Schedule 3 are only prescribed from 1 July 2020. Disclosing entities must ensure that, before that date, those recipients were not authorised recipients under the Act via these Regulations.
• Prescribed matters are specific. Schedule 3 and Schedule 4 identify not only recipients but the matters or classes of matter that may be disclosed to them. Disclosure must be matched to the specified matter; broad-brush disclosures to listed entities without checking Column 2 may be non-compliant.

Infringement nuances

• Different unit amounts for individuals and corporates. Schedule 5 assigns different penalty unit counts. For example, s 29H(1) attracts 6 units for an individual but 24 units for a corporation (Schedule 5). Practitioners must ensure fines are calculated against the correct offender type.
• Penalty unit value updated annually. The explanatory notes provide the penalty unit value for 2025-26 ($203.51) and instruct that the value for future years is fixed by the Treasurer. Users must compute current-dollar amounts at the time of any enforcement action rather than relying on historical figures.

Prescribed regulators and revocations

• Changes and revocations of earlier insertions. The instrument records that certain inserted provisions have been amended or revoked (Reg 7A(c) was inserted by S.R. No. 118/2022 reg 4(2) and revoked by S.R. No. 16/2024 reg 4(b) as noted in the marginal notes). This history signals that the list of prescribed regulators may have changed over time; practitioners must rely on the current consolidated version and the endnotes rather than earlier text fragments.

Form requirements and signature chain

• Prescribed birth-notification form has specific signature rules. Schedule 1 prescribes who qualifies as the "responsible person" for signing the notice (chief executive officer of the hospital, or professional attendant, or other person in attendance). The form also allows deletion instructions for fields. Using a non-prescribed form or an incorrect signatory will not meet the Regulation’s prescription for s 43(2).

Sunsetting

• Instrument sunset date. The endnotes state these Regulations will sunset 10 years after the day of making on 27 June 2027. Practitioners should note that prescriptions may lapse or require re-enactment unless otherwise preserved; relying on these Regulations without checking sunset status after mid-2027 is hazardous.

In practice, these specific timing, definitional and recipient limitations create areas where compliance can fail on technical grounds. The instrument’s text must be followed precisely with attention to commencement dates, recipient/matter pairings, and the precise identity of prescribed regulators and exempt bodies.

Compliance under these Regulations entails checking whether one is a prescribed person or entity, aligning administrative processes with prescribed forms and disclosure pathways, and managing the enforcement risk for the listed infringement offences. The steps below follow directly from the Regulations’ prescriptions.

1. Determine whether the organisation or person is captured by the reportable conduct scheme

   • Check the Act’s definitions in s 3(1) together with the Regulations’ prescriptions. Use Regulation 6 for the date relevant to the definition of "employee" (1 July 2017) and Regulation 7 and Schedule 2 to see whether the entity is prescribed and, if so, from what date. For organisations that are youth organisations, confirm whether their activities (for example overnight camps) make them subject to Schedule 2’s Item 2 from 1 May 2020 (Schedule 2).
   • For public health services, check whether they appear in Schedule 5 to the Health Services Act 1988; if so, note Schedule 2 prescribes their inclusion from 1 January 2018.

2. Map regulator relationships and notification pathways

   • Identify the prescribed sector regulator for your entity using Reg 7A and the prescribed integrated sector regulator (Reg 7B) where relevant. For early childhood providers and employees, verify whether the Victorian Early Childhood Regulatory Authority is the regulator for the relevant matters (Regs 7C and 7D).
   • Where your entity has obligations under Part 5A of the Act or other cross-referred parts, confirm whether the Social Services Regulator or the Secretary to the Department of Health has oversight functions by virtue of these Regulations (Reg 7A and Reg 7B(2)).

3. Update policies, record-keeping and reporting templates

   • If your entity is newly prescribed, update internal policies to comply with the Act’s reportable conduct scheme. Ensure the employee classification and screening processes reflect that certain foster carers or child-related workers are employees for the scheme from 1 July 2017 (Reg 6).
   • If your organisation must provide early notification of births under s 43(2), use the prescribed form in Schedule 1 (Reg 10). Ensure that the correct recipient is identified: the municipal CEO where the mother usually resides, or the municipal CEO of the district where the birth occurred if the mother’s residence cannot be determined, or the Secretary to the Department of Education and Training if the mother resides outside Victoria (Schedule 1). Confirm who qualifies as the "responsible person" to sign the form.

4. Implement information-disclosure procedures

   • For disclosures under s 16ZC, map which recipients in Schedule 3 (Victoria) or Schedule 4 (other jurisdictions) you are authorised to disclose to, and for which classes of matters (Reg 9 and Reg 9A; Schedules 3 and 4). Note that some Schedule 3 items are only prescribed from 1 July 2020 (Reg 9(2)), so disclosures to those bodies before that date were not authorised by these Regulations.
   • Record the legal basis for any disclosure by noting the specific Schedule item and the corresponding Column 2 matter, to avoid overbroad or unlawful sharing of information.

5. Prepare for infringement risk and penalty calculations

   • Identify the Act provisions listed in Schedule 5 (s 29H(1), s 29K(1), s 34D) and ensure internal compliance systems focus on the behaviours that those provisions prohibit. Avoid treating these as the exclusive enforcement risks; the Regulations only prescribe which offences may incur infringement notices, not all sanctions under the Act.
   • When calculating infringement amounts, convert penalty units to dollars using the methodology in the explanatory details and the current penalty unit value published by the Treasurer. For the 2025-26 financial year the instrument gives $203.51 per penalty unit; use that figure where applicable but verify the value for the specific enforcement year.

6. Coordinate with prescribed regulators and external bodies

   • Where the Regulations name a prescribed sector regulator, integrated regulator, or external recipient, establish contact points, agreed protocols and data-sharing agreements if required. For example, where the Social Services Regulator is prescribed, identify how its functions under s 14 of the Social Services Regulation Act 2021 will be exercised in respect of your entity (Reg 7B(2)).

7. Update governance for exemptions and special cases

   • If your organisation works closely with Victoria Police, note the explicit exemption in Reg 8: Victoria Police is exempt from the Child Safe Standards. Do not assume this exemption applies to non-police partners or contractors; it is limited to the named body.

8. Track amendments and sunsetting

   • Monitor Statutory Rules and the Government Gazette for changes to the Regulations and the penalty unit value. The endnotes record a sequence of amendments and the instrument’s sunset date (27 June 2027). Plan for regulatory continuity or transitional measures if the Regulations lapse or are re-enacted.

9. Documentation and training

   • Train staff involved in reporting, disclosure and compliance on the prescribed forms (Schedule 1), disclosure recipients and matters (Schedules 3 and 4), and the dates from which obligations apply to the organisation (Schedules and Regs 6, 7 and 7A-7D).
   • Keep records of decision-making that links a disclosure or reporting action to the exact Schedule item and Regulation clause relied on, to support defensible administrative decisions if challenged.

10. Legal check before acting on borderline questions

• For borderline issues (for example whether a given entity’s activity qualifies as a "primary activity" making overnight camps a prescribed trigger, or whether a particular employee falls within paragraph (d) of the Act’s employee definition as of 1 July 2017), secure a legal opinion referencing both the Act and the specific Regulation/Schedule entries. The instrument’s staged and prescriptive nature means factual classification errors have compliance consequences.

Following these steps will align a regulated entity’s administrative processes with the exact prescriptions in the Regulations: identification of capture, regulator mapping, use of the prescribed birth-notification form, compliant disclosure to prescribed recipients, calculation of infringement penalties by reference to penalty units, and keeping abreast of amendment and commencement details.
