The Child Welfare (Commonwealth Agreement Ratification) Act 1962 is a short but potent New South Wales statute whose mechanical effect is to approve, ratify and confirm a supplemental agreement executed on 26 July 1962 between the State of New South Wales and the Commonwealth of Australia, and to validate any acts done before its commencement that would have been lawful had the Act then been in force. The Act itself is ratificatory: it does not create substantive welfare obligations; rather, it gives the force of law to the 1962 agreement (set out in the Schedule) and overrides any other Act that might otherwise obstruct the agreement’s operation. Section 2(1) specifically states that the agreement may be carried into effect “notwithstanding the provisions of any other Act”, a sweeping provision that subordinates both earlier and later inconsistent State legislation to the agreement’s terms. Section 2(2) further sanctions and authorises all acts, matters and things agreed, directed or permitted to be done by the Governor, the Minister, the Director or any other officer under the agreement or the 1941 principal agreement as varied. Section 3 validates any act done before the Act’s commencement that would have been lawful if the Act had been in force at that time, thereby retroactively immunising past administrative conduct from legal challenge. The Act thereby eliminates any doubt about the legality of past transfers of children from the Australian Capital Territory to New South Wales institutions and establishes a secure statutory basis for future transfers. The 1962 agreement itself amends the 1941 principal agreement, extending its scope beyond children committed by ACT courts to include children “admitted to government control” under the ACT’s Child Welfare Ordinance 1957. The supplemental agreement also defines new terms, expands the categories of institutions (adding “depots” and “homes” alongside existing State Institutions), introduces a formula-based costing mechanism for maintenance payments, and substitutes a new clause governing maintenance and conveyance costs. The Act thus operates as a delegated legislative instrument that constitutionalises a bilateral administrative arrangement, removing any impediments in NSW general law to the reception and treatment of ACT children as if they were NSW wards.

The central organising concept is the “principal agreement”, being the 1941 agreement between NSW and the Commonwealth set out in the Schedule to the Child Welfare (Commonwealth Agreement Ratification) Act 1941 of NSW and the Child Welfare Agreement Ordinance 1941 of the ACT. The 1962 Act ratifies the “supplemental agreement” which varies the principal agreement. The principal agreement established the framework for the reception, detention and maintenance in NSW institutions of children committed by ACT courts. The 1962 agreement extends that framework to children “admitted to government control” under the ACT’s Child Welfare Ordinance 1957, which is a broader category than court-committed children, potentially including children placed under state care through administrative action. The 1962 agreement defines a “child” in relation to persons from the Territory as a person to or in respect of whom the Ordinance or the State Act (the NSW Child Welfare Act 1939) applies because the person is or has been a “child or young person” as defined in the relevant law. This creates a cross-jurisdictional definition: a person can be a “child” for the purposes of the agreement even if aged differently under each system, so long as one of the two acts applies. Key institutional concepts include “depot” (temporary accommodation under s 21 of the NSW Child Welfare Act 1939) and “home” (reception and maintenance under the same section). These are distinguished from “State Institution” under the principal agreement. The agreement also defines “the Ordinance” as the ACT’s Child Welfare Ordinance 1957, as amended or substituted. “The Territory” means the Australian Capital Territory as defined in the principal agreement. The concept of “government control” under the Ordinance is pivotal: it is the gateway for a child to become subject to the transfer mechanism. Upon transfer and reception into care in a NSW depot or home, the child “shall become and remain subject to the terms and provisions of the State Act” and be treated “in all respects as if the child were a ward admitted to state control under the State Act”. This is a legal fiction: an ACT child becomes a deemed NSW ward for the duration of their stay. The cost recovery mechanism uses the concept of “average cost per week” determined by the Director, with a formula (A/7 × B = C) where A is days maintained, B is average weekly cost, and C is total cost. The Director’s certificate of that average cost is conclusive evidence between the parties. The agreement also introduces delegation: references to the State Minister or Commonwealth Minister include their delegates or authorised persons under the relevant laws. This expands administrative discretion without requiring ministerial personal involvement.

The Act directly affects two government parties: the State of New South Wales and the Commonwealth of Australia. Within NSW, the key affected officials are the Minister for Child Welfare, the Director (presumably the Director of Child Welfare), and other officers responsible for depots, homes and State Institutions. These officers gain statutory authority to receive transferred children and exercise powers under the NSW Child Welfare Act 1939 over those children as if they were NSW wards. The Act also validates (and thus protects from liability) any past acts by the Governor, Minister, Director or other officers that would have been lawful had the Act been in force. The Commonwealth is affected through its Minister administering the ACT’s Child Welfare Ordinance 1957, who may direct transfers of children. Commonwealth officers are authorised to take children to depots or homes, or hand them to NSW officers. The Commonwealth must pay the costs of conveying children from the ACT to NSW institutions (clause 3(7)) and ongoing maintenance, expenses for apprenticeship, boarding out, placement, or adoption, plus conveyance costs while in NSW care (clause 4). The primary human subjects are children from the Australian Capital Territory who are admitted to government control under the Ordinance. These children are the objects of the agreement, not parties to it. They have no consent rights, no choice of destination institution, and no mechanism to contest their transfer or the conditions of their reception. Once handed over, they become subject to NSW welfare law, including any powers of apprenticeship, boarding out or placement. Their families may also be affected, as the child may be removed to NSW, potentially far from family contact. The taxpayers of both jurisdictions are indirectly affected: NSW taxpayers bear some risk if the Commonwealth fails to pay (though the agreement makes Commonwealth payment obligatory), and Commonwealth taxpayers fund the costs. The Act also affects the ACT administration, as the Ordinance and its officers are integrated into a cross-border arrangement. Persons or entities who might have claims against NSW or Commonwealth officials for unlawful detention or removal are affected too, because the validation clause (s 3) retrospectively legitimises pre-commencement acts that would otherwise be wrongful. Finally, the Act affects the legal system by overriding inconsistent NSW legislation, thereby limiting the rights of third parties (such as family members) who might rely on other Acts to challenge a child’s placement.

The 1962 agreement creates specific duties for both governments, but confers very few, if any, rights on the children who are its subject. For the Commonwealth, the primary duty is payment: the Commonwealth must pay the cost of conveying a child from the ACT to a NSW depot or home (clause 3(7)), the cost to NSW of maintaining the child in a State Institution, depot or home (clause 4(2)(a)), expenses incurred by NSW when the child is apprenticed, boarded out, placed out or placed as an adopted boarder (clause 4(2)(b)), and the costs and expenses reasonably incurred by NSW in or in connection with conveyance of the child from one place to another (clause 4(2)(c)). The Commonwealth also has the right to direct that a child be transferred to a depot or home (clause 3(2)). That directive power is exercisable by the Commonwealth Minister or a person authorised by that Minister. The duty of the Commonwealth Minister is not described as mandatory; it is a power to direct. For the State of NSW, the duty is to accept the child into the care of the person in charge of the depot or home, and then to treat the child as if the child were a ward admitted to state control (clause 3(5)). That means NSW officials must provide accommodation, maintenance, and exercise the powers under the NSW Child Welfare Act 1939. NSW also has the right to determine the average cost per week and to issue certificates that are conclusive evidence of that cost (clause 4(3) and (4)). NSW may also recover expenses for boarding out, maintenance payments, clothing, travelling, pocket money, medical and dental attention, and education (clause 4(5)), with a certificate from the Director being prima facie evidence of the amount due (clause 4(6)). The officers involved have duties regarding documentation: when a child is transferred, the Territory officer must hand over a copy of the direction and copies of the documents giving effect to the admission to government control, and if required, evidence of identity and authority (clause 3(4)). The rights of the child are notably absent: there is no provision for the child to be heard, to consent to transfer, to request a particular placement, to have contact with family, or to challenge the decision. The child becomes a passive object of administrative direction. The only “right” arguably created is the child’s right to have the NSW Act applied to them, but that is a legal status rather than a substantive right to welfare. The principal agreement (clauses 10, 13, 14) which is confirmed except where varied (clause 5) may contain additional provisions, but the source does not reproduce those clauses. The agreement states it does not affect Norfolk Island (clause 6). Overall, the duties flow upward to governments; the child is the beneficiary of care but not the holder of enforceable rights.

The Act and the supplemental agreement contain no express penalty provisions for non-compliance, either criminal or civil. There are no fines, imprisonment terms, or infringement notices. Enforcement is left to the contractual and intergovernmental mechanisms. The agreement includes reference to clauses 10, 13 and 14 of the principal agreement, which are confirmed and applied to the 1962 agreement as if incorporated (clause 5). Although those clauses are not reproduced in the source, they likely deal with arbitration, variation and termination. Clause 10 of the principal agreement (as referenced in earlier source materials) typically provided for determination of disputes. The enforcement of the Commonwealth’s payment obligations rests on the State’s ability to rely on the Director’s certificates: a certificate of average weekly cost is “conclusive evidence” as between the parties (clause 4(4)), and a certificate of expenses under clause 4(2)(b) or (c) is “prima facie evidence” of the amount due and payable (clause 4(6)). This creates a streamlined mechanism: NSW can issue a certificate and the Commonwealth must pay on that basis unless the Commonwealth can rebut the certificate where it is only prima facie evidence. For the average cost certificate, the conclusive evidence clause means the Commonwealth cannot challenge the amount in any dispute between the parties; the certificate binds both governments. This is a strong enforcement tool for NSW. For non-compliance with the duty to accept a child, the Act itself does not specify a remedy. However, the ratification and override of other Acts (s 2(1)) means NSW cannot plead inconsistency with its own laws to refuse a transfer. If NSW failed to accept, the Commonwealth could possibly refer to the dispute resolution clauses of the principal agreement. The validation clause (s 3) effectively grants immunity from certain penalties: any pre-commencement act that was unlawful is now validated, meaning no penalty or damages can be sought for that act. This retroactive protection extends to both Commonwealth and NSW officers. For failures by officers to follow the documentation requirements (clause 3(4)), there is no expressed penalty, but such failures could affect the validity of the transfer or the child’s status. The child’s remedy, if any, would have to be found under the general law or the NSW Child Welfare Act 1939, which is incorporated. In practical terms, the Act sets up a cooperative federal arrangement where enforcement relies on the continuing agreement of both governments, backed by the binding effect of certificates and the override of other legislation. The lack of penalties for either government suggests that the intended enforcement is political and financial rather than legal.

Section 2(1) contains a paramountcy provision: the agreement “may be carried into effect notwithstanding the provisions of any other Act”. This subordinates all other NSW Acts, both those in force at the time and any future inconsistent Acts (until they are specifically amended to exclude this Act). The 1962 Act thus operates as a form of legislative override: if any other NSW Act would prevent the reception, detention or maintenance of an ACT child, or would impose conditions inconsistent with the agreement, that other Act is displaced. This is not a repeal; it is a suspended operation while the agreement is being carried into effect. The Act specifically interacts with the NSW Child Welfare Act 1939, which is referred to as “the State Act”. The agreement makes the State Act applicable to transferred children as if they were wards admitted to state control (clause 3(5)). This means that all provisions of the 1939 Act regarding the powers of the Minister, Director, officers, the regime for apprenticeships, boarding out, placement, adoption, and discipline apply to ACT children. The State Act is incorporated by reference, and any amendments to it will automatically apply to these children, unless inconsistent with the agreement. The ACT’s Child Welfare Ordinance 1957 (“the Ordinance”) is also central. The agreement defines “child” by reference to both the Ordinance and the State Act. The Ordinance’s definitions of “child” or “young person” determine the initial cohort of children who can be transferred. The 1962 agreement varies the principal agreement to extend its operation to children admitted to government control under the Ordinance, which is a broader category than those committed by courts. The interaction with the principal agreement (1941) is detailed: the 1962 agreement varies specific clauses (3, 4, 7, 8, 9, 11, 12, 15 and sub-clause 6(1)) and confirms others (clauses 10, 13, 14 apply to the 1962 agreement as if incorporated). The principal agreement itself was ratified by the Child Welfare (Commonwealth Agreement Ratification) Act 1941 (NSW) and the Child Welfare Agreement Ordinance 1941 (ACT). The 1962 agreement does not affect Norfolk Island (clause 6). The validation clause (s 3) of the 1962 Act retroactively confirms any act done before commencement that would have been lawful if the Act had been in force. This could interact with the general law of tort (e.g. false imprisonment, trespass) or criminal law by providing a statutory defence. The Act also interacts with appropriation and finance legislation: the Commonwealth’s obligation to pay costs would ordinarily require an appropriation, but the agreement itself creates a contractual obligation. The Director’s certificates (conclusive and prima facie) provide a streamlined evidence regime that overrides ordinary rules of evidence in any legal proceedings between the parties. Finally, the Act interacts with the Commonwealth Constitution to the extent that it requires cooperative federalism for child welfare; however, the source does not mention any constitutional challenge.

The Child Welfare (Commonwealth Agreement Ratification) Act 1962 is Act No 28 of 1962 of the New South Wales Parliament. Based on the source provided (a historical document marked as in force but presumably a historical snapshot), there is no indication of any subsequent amending legislation. The Act appears to have been enacted as a self-contained ratification statute and not amended later. The Act itself is very short (three sections plus a schedule). Its purpose was to ratify the 1962 supplemental agreement, and once that agreement was in force, the Act’s operative provisions (ratification, override, validation) had continuing effect. The principal agreement of 1941 was ratified by an earlier Act (1941 No 28? The Schedule reference is to the Child Welfare (Commonwealth Agreement Ratification) Act 1941). The 1962 Act does not repeal or amend that earlier Act; it adds a supplemental agreement. Any subsequent changes to the intergovernmental child welfare arrangement would likely be by further agreement and further ratification Acts. However, the source does not mention any such later Acts. The agreement itself provides that it “shall have no force or effect until it is approved by the Parliament of the State and by a law of the Territory” (clause 1). The 1962 Act provided that approval. The Act commences on a day appointed by the Governor by proclamation (s 1(2)). No commencement date is given in the source, but it is flagged as in force. The Act’s ongoing relevance depends on whether the 1941 principal agreement and the 1962 supplemental agreement remain operative. The source does not indicate any termination or sunset clause. Clause 6 of the agreement preserves the principal agreement’s operation regarding Norfolk Island, implying the 1962 agreement is confined to ACT children. The absence of amendment history suggests the Act has not been revisited, perhaps because the arrangement became routine or was later superseded by broader child welfare legislation (e.g., the Community Services legislation or the eventual establishment of ACT own child welfare systems). However, without source evidence, that is speculation. The Act remains on the statute books as a historical document.

The source material contains no references to any litigation arising from the Act or the supplemental agreement. This is unsurprising for a ratificatory Act that validates intergovernmental arrangements. The Act and agreement are designed to minimise litigation: the conclusive evidence clause for average cost certificates (clause 4(4)) precludes any dispute between NSW and the Commonwealth over the per-child cost formula, and the prima facie evidence clause for other expenses (clause 4(6)) makes a court challenge difficult. The validation clause (s 3) eliminates causes of action for pre-commencement conduct. The overriding provision (s 2(1)) prevents reliance on other NSW Acts to challenge the agreement’s implementation. The child who is the subject of the transfer has no express right to sue under the agreement, and any claim would have to be based on the NSW Child Welfare Act 1939 or the general law, but the Act’s paramountcy and validation might shield defendants. The principal agreement’s clauses 10, 13 and 14, which are incorporated into the 1962 agreement (clause 5), likely provide for arbitration or other non-judicial dispute resolution between the parties, further channelling disputes away from courts. There is also the possibility of constitutional litigation if the arrangement was challenged as exceeding Commonwealth power or infringing state rights, but the source does not record any such case. The absence of litigation history may indicate that the arrangement worked without major controversy, or that disputes were resolved administratively. It could also reflect the low visibility of the children involved. Without case citations, we cannot state that any case exists. The source does not provide any. Therefore, the litigation history under this Act is nil. However, the structure of the Act itself - with its conclusive certificates, validation, and override of other Acts - strongly suggests an intent to avoid judicial scrutiny of the transfers and costs. The drafter clearly intended to create a closed administrative system with minimal opportunity for external legal challenge. The lack of litigation may be a measure of that design’s success.

The Act and agreement contain several traps for the unwary practitioner or affected party. The most significant is the validation clause (s 3): it retroactively validates any act, matter or thing done before commencement that would have been lawful if the Act had been in force. This means that any prior transfers of children, any detention, any use of funds, any direction given by an officer that lacked statutory authority at the time is now deemed lawful. A person who was wrongly removed or detained before the Act’s commencement has no remedy for that period. Similarly, legal proceedings commenced after commencement but based on pre-commencement conduct may be defeated by this validation. The override provision (s 2(1)) is another gotcha: the agreement can be carried into effect regardless of any other Act. This could surprise parties who assume that the NSW Child Welfare Act 1939 or other welfare legislation applies in its entirety. Where that Act conflicts with the agreement, the agreement prevails. For example, if the State Act required a court order for a child to be placed out, but the agreement authorises it upon the Commonwealth Minister’s direction, the direction suffices. The definition of “child” is also a potential trap: it is not a simple age-based definition. It ties to the concept of “child or young person” under either the Ordinance or the State Act. Because those definitions may differ, a person who is a child under one may not be under the other, but the agreement picks up either. So a person aged 17 who is a young person under the Ordinance but an adult under the State Act could still be transferred and treated as a child. The delegation clause (clause 2(3)) expands the class of persons who can act as Ministers: references to the State or Commonwealth Minister include their delegates or authorised persons under the relevant laws. This means a relatively junior officer could exercise the power to direct a transfer, not just the minister. The conclusive evidence certificate for average cost is a trap for the Commonwealth: once the Director certifies the amount, that is conclusive between the parties, meaning the Commonwealth cannot challenge it even if the cost is unreasonably high or based on faulty data. The agreement does not require the Director to use a particular methodology; it only requires the amount to be the “average cost per week” determined by the Director. The Director’s discretion is essentially unreviewable as between the parties. The certificate for other expenses is only prima facie evidence, so the Commonwealth can rebut it, but the burden shifts to the Commonwealth. Another trap is that the child, once transferred, becomes “subject to the terms and provisions of the State Act” and is treated “in all respects as if the child were a ward admitted to state control”. This means the NSW Child Welfare Act 1939’s provisions regarding discipline, placement, apprenticeship, and even adoption apply. A child could be placed out or apprenticed without the specific consent required under ACT law. The child’s parent or guardian has no standing under this agreement to prevent the transfer or placement. There is also no provision for the child’s return to the ACT once the need for care ends; the arrangement appears indefinite. Finally, the agreement’s clause 5 confirms clauses 10, 13 and 14 of the principal agreement as incorporated. Those clauses are not reproduced, so anyone relying on the agreement must locate the 1941 principal agreement to understand the full framework. Not doing so could lead to missing important provisions on termination, variation or dispute resolution.

Compliance depends on which entity is acting. For the NSW Department (the State, its Minister, Director and officers), the obligations are to accept transferred children, treat them as NSW wards, bill the Commonwealth, and issue certificates. Upon receiving a direction from the Commonwealth Minister (or delegate) and a child being handed over, the person in charge of the depot or home must accept the child into care (clause 3(5)). The receiving officer should verify that the handing-over officer provides a copy of the direction, copies of the documents giving effect to the admission to government control, and if requested, evidence of identity and that the child is the one referred to (clause 3(4)). The NSW officer should retain these documents for record-keeping and to evidence the lawful basis for the child’s reception. Once the child is received, NSW must apply the State Child Welfare Act 1939 to the child as if the child were a ward. This means the child must be placed, maintained, and have access to education, medical care, and the other entitlements under that Act. NSW must also calculate the cost of maintenance using the formula in clause 4(3): multiply the number of days (A) divided by 7, times the average weekly cost per child (B) determined by the Director. The Director should maintain a methodology for determining average weekly cost, and issue certificates for each period. For expenses under clause 4(2)(b) and (c) (e.g., boarding out payments, clothing, travelling, medical, education), NSW should keep detailed records of all expenses incurred, and the Director should issue a certificate stating the amount due. That certificate is prima facie evidence, so it should be accurate and prepared in good faith. The Commonwealth must pay within a reasonable time; the agreement does not specify payment terms but the parties can rely on the principal agreement’s dispute clauses if needed. For the Commonwealth, compliance means ensuring that any direction to transfer is made by a person with delegated authority. The direction should be in writing and handed to the Territory officer. The Territory officer must obtain copies of the admission documents and ensure the child is correctly identified. The Commonwealth must also arrange and pay for the child’s conveyance to the NSW depot or home (clause 3(7)). The Commonwealth should maintain a system to receive invoices from NSW based on the Director’s certificates and pay them promptly to avoid being in breach. For both governments, ongoing compliance requires periodic review of the average cost calculation and the continued alignment of definitions with the State Act and the Ordinance as they are amended. Since the 1962 Act overrides other Acts, NSW must not apply other legislation to frustrate the agreement. Officers should be trained to recognise that these children are legal wards of NSW by operation of the agreement, not through any court order. Records should distinguish ACT-sourced children from NSW-origin wards for accounting purposes, as the Commonwealth is liable for the costs of the former. Finally, if either party wishes to change the arrangement, they must follow the variation or termination clauses of the principal agreement (incorporated by clause 5). The lack of a sunset date means compliance obligations continue indefinitely unless the agreement is formally terminated.
