#### 98C Orders restricting secondary disclosure of information relating to ART reviews (1) This section applies if an order (the primary order) made under section 70 of the ART Act in relation to an ART review prohibits a person from disclosing information specified in the order, except to any of the following (an authorised recipient): (a) a specified person; (b) a member of a specified class. (2) The ART may, by order, give directions prohibiting or restricting an authorised recipient from disclosing the information specified in the primary order. (3) A person commits an offence if: (a) an order is made under subsection (2) in relation to the person; and (b) the person fails to comply with the order. Penalty: Imprisonment for 12 months or 60 penalty units, or both. (4) Subsection (3) does not apply in relation to information the person knew before it was disclosed to the person in accordance with the primary order. > Note: A defendant bears an evidential burden in relation to the matter in subsection (4) (see subsection 13.3(3) of the Criminal Code).
