Child Safety (Prohibited Persons) Regulations 2019

The regulations hinge on a small set of operational legal concepts, each of which channels administrative discretion and determines the pathways for exclusion, notification, and review.

• Protected information (reg 3; reg 4). The Registrar may classify information as protected if disclosure would prejudice criminal investigations, child‑safety investigations under other Acts, identify an abused child or related persons, identify reporters, or endanger life or safety (reg 3 definition; reg 4(1)). If a prohibition relies on protected information, the central assessment unit need only state the public‑interest basis for prohibition; fuller reasons need not be provided (reg 4(2)). Courts must maintain confidentiality and may hear such evidence in private; the court may accept affidavit evidence about classified information (reg 4(3)). This concept allocates decision‑making authority to the Registrar and shifts the balance between transparency and confidentiality where investigative or safety concerns arise.

• Assessable information (reg 8). The regulations list specific categories of information the central assessment unit may treat as assessable: material supplied under statutory sections of the Act, police information supplied under s 39, restraining orders, intervention orders and other material the Registrar determines in accordance with guidelines (reg 8(a)-(f)). The list ties the working-with-children check to existing court, police and child‑protection information flows.

• Child‑related work (reg 7). A deliberately broad, itemised definition covers education, health and allied health services, child protection, residential, foster and overnight care, coaching and tuition, transport services (as a prescribed passenger transport service), religious organisation activities with expected child contact, club activities (sports, cultural, recreational), commercial services directly to children (examples include play gyms, face painting, costumed characters and photography), and specified emergency service contact (reg 7(1)-(4), (7)). The definition also clarifies what “contact with a child” means, physical contact, close proximity or communication (reg 7(6)). This expansive operational definition determines the universe of persons and roles to which checks potentially attach.

• Prescribed positions and offences (reg 6; reg 5; reg 15A). The regulations identify particular public positions whose holders are prescribed (administrative units assisting Ministers in Act administration, certain education registrars, employees or assignees in witness assistance roles) (reg 6). They also carve out specific offences from the prescribed‑offence definition in the Act in narrowly defined situations, and separately declare an extensive list of “presumptive disqualification offences” drawn from South Australian statutes, Commonwealth Criminal Code provisions and corresponding laws (reg 5; reg 15A). The regulation therefore establishes which historical criminal findings automatically signal disqualification and which do not.

• Records management system and interrogation (reg 3; reg 11; reg 19-21). The records management system is the statutory repository; employers verify a recent check and non‑prohibition by accessing and interrogating that system per Registrar instructions and must obtain a certificate of interrogation (reg 11). The Registrar can limit access to parts of the system (reg 20). The central assessment unit may retain records indefinitely (reg 21(1)), with disposal permitted under guidelines (reg 21(2)). These provisions allocate both practical compliance burden to employers and data retention/risk decisions to the central authority.

• Procedural fairness boundaries (reg 10). The central assessment unit must take reasonable steps to notify persons about assessable information and permit submissions (reg 10(1)(a), (b)); where the unit determines to prohibit a person, reasons must be provided in accordance with guidelines (reg 10(1)(c)). Exceptions exclude cases where immediate and serious risk is posed, where the assessable information is a charge not yet determined, where the person is already a prohibited person, and other matters as the Registrar determines (reg 10(2)). These clauses specify where and how natural justice applies and where it may be curtailed.

• Exemptions and temporary exemptions (reg 26; reg 27). Certain carers or placement circumstances are exempt from Part 4 (reg 26). A temporary exemption regime applies to persons who have an application underway and had a check in the previous five years, subject to conditions and a range of limits, including that the regulation does not apply to anyone who is or has been a prohibited person (reg 27). The temporary exemption also suspends certain employer obligations for that person until the check is completed, and the central assessment unit is similarly exempted from specified notice obligations in relation to that person (reg 27(5)-(7)).

Other administrative concepts include the Ministerially constituted advisory panel (reg 17), prescribed functions for the Registrar (reg 13), the requirement for independent five‑year reviews of the central assessment unit (reg 14), and the obligation for courts and police to supply particular data points to the central assessment unit in Registrar‑determined form (reg 22-23). Overall, the regulations translate statutory powers into discrete, operational categories and rules that guide information handling, employer verification, and exclusion decisions.

These regulations affect a defined set of actors through information obligations, verification duties, and exposure to prohibition decisions.

• Individuals seeking, applying for, or holding child‑related roles. The definition of child‑related work in reg 7 captures people in education (preschool through secondary), allied health and health services to children, residential care (licensed and otherwise), foster and approved carers, coaching and tuition, entertainment directed at children (face‑painters, mascots), photographers of children, and those providing transport services where children are passengers (reg 7(1)-(4)). Persons who fall into those categories must be prepared to undergo working‑with‑children checks, be subject to assessable information, and may be prohibited from working with children where the central assessment unit determines so.

• Employers. Employers who engage persons to perform child‑related work have active verification obligations: to verify that a working-with-children check has been conducted within 5 years and that the person is not a prohibited person by accessing and interrogating the records management system according to Registrar instructions and obtaining a certificate of interrogation (reg 11). Employers must also provide notices to the central assessment unit under s 19 of the Act containing prescribed content (reg 12). Temporary exemptions (reg 27) may relieve employers from certain obligations for a defined period, but only while the exemption applies.

• The Registrar and the central assessment unit. The Registrar has functions including classifying protected information (reg 4(1)), determining assessable information under regulation (reg 13(b)), limiting access to the records system (reg 20), specifying content and forms for notices and certificates (reg 12; reg 19), and appointing conditions for temporary exemptions (reg 27(4)). The central assessment unit conducts working-with-children checks, issues prohibition notices (reg 18), actively seeks assessable information (reg 15(a)), may keep records indefinitely (reg 21), and must notify employers of prohibition outcomes (reg 25). The unit’s operations are subject to periodic independent review (reg 14).

• Courts, police and specified third parties. Courts must notify the central assessment unit of prescribed particulars in relation to findings of guilt (reg 22), and the Commissioner of Police must provide prescribed information when persons are charged (reg 23). Certain persons required to notify under s 40 must provide prescribed information (reg 24). These statutory notification duties channel information into the central assessment unit’s assessable information pool (reg 8).

• Ministers and the advisory panel. The Minister appoints an advisory panel to assist the central assessment unit (reg 17). The Minister appoints the independent reviewer for the central assessment unit’s evaluation (reg 14(1)(a)) and specifies matters for the reviewer to consider (reg 14(1)(d)). These provisions create ministerial control points over advisory and evaluative inputs to the scheme.

• Persons with criminal records. The regulations specify which offences are presumptive disqualification offences (reg 15A) and which convictions are excluded from the prescribed‑offence definition (reg 5). Spent convictions under the Spent Convictions Act 2009 are excluded from the prescribed-offence definition but may remain assessable (reg 5(b)). This affects how certain historical offences are treated in vetting decisions.

• Parents, interstate workers and children under fourteen. The excluded persons provision lists categories that do not fall under the Act’s prohibitions: children under 14 (reg 9(1)(a)); interstate or interstate‑accredited workers engaged for organised events not exceeding 10 consecutive days (reg 9(1)(b)); and parents/guardians volunteering for activities that include their own child, subject to limits on close personal contact and overnight care (reg 9(1)(c)). These carve‑outs place limits on the Act’s reach and specify circumstances where working-with-children checks are not required.

Who pays and who decides: employers bear verification and notice costs and administrative burden (reg 11; reg 12). The Registrar and central assessment unit decide classification of information, access limits, and whether a person is prohibited (reg 4; reg 20; reg 15). The Minister appoints review and advisory roles and determines certain parameters for review (reg 14; reg 17).

The regulations allocate duties, notification obligations, and rights to receive or withhold information, and they define where procedural fairness must be offered and where it may be limited.

Duties

• Employers must verify that a working-with-children check was conducted within the preceding five years, and that a person is not a prohibited person, by accessing and interrogating the records management system per Registrar instructions and obtaining evidence in the form of a certificate of interrogation (reg 11(1)-(3); reg 19). Notices to the central assessment unit under s 19 must contain prescribed personal identifiers, circumstances giving rise to the notice, employer details and employer contact information (reg 12).

• Courts that find a person guilty of a prescribed offence must send prescribed particulars , full name, address, date of birth, particulars of the offences, date and court , to the central assessment unit in a Registrar‑determined form (reg 22(1)-(2)). The Commissioner of Police must provide full name, address, date of birth (if known) of a charged person, and details of the charge and alleged conduct to the central assessment unit (reg 23). Certain other persons required to notify the central assessment unit must provide prescribed information including personal identifiers and employer details (reg 24).

• The Registrar and central assessment unit must actively seek assessable information for working‑with‑children checks as far as is reasonably practicable (reg 15(a)). The central assessment unit must issue prohibition notices promptly after a determination to prohibit, serve them according to s 51, and comply with relevant guidelines (reg 18(1)(a)-(c)).

• The central assessment unit may retain information, documents or records indefinitely received in performing its functions, and may dispose of material according to guidelines (reg 21(1)-(2)).

Rights and procedural protections

• Procedural fairness: The central assessment unit must, for checks conducted on application or where the person is not the applicant, take reasonable steps to notify the person of any assessable information, specify a period for submissions regarding that information, and have regard to submissions made within that period (reg 10(1)(a)-(b)). If the central assessment unit determines a person is prohibited, it must provide reasons in accordance with guidelines, subject to the Act (reg 10(1)(c)).

• Exceptions to procedural fairness: The regulations specify matters where procedural fairness need not be provided , where the Registrar deems the person an immediate and serious risk, where assessable information comprises an undetermined charge, where the person is already prohibited, and other matters the Registrar determines (reg 10(2)). Where protected information forms the basis for a prohibition, the central assessment unit need only state that allowing the person to work with children would be contrary to the public interest (reg 4(2)).

• Confidentiality in court proceedings: On application of the Registrar, the court must take steps to maintain confidentiality of protected information and may hear evidence privately, and may take affidavit evidence on classified material (reg 4(3)). This provides a mechanism to exclude public and party access to sensitive material.

• Access limitations: The Registrar may limit access by persons or classes of persons to specified parts or specified information of the records management system if disclosure would disclose criminal intelligence, protected information, or otherwise would not be appropriate (reg 20).

• Exemptions: Specific persons are exempt from Part 4 of the Act (reg 26) and temporary exemptions apply to persons caught by the transitional regime in reg 27, relieving employers and the central assessment unit of certain obligations while a pending application is processed (reg 27(3)-(7)).

Forms, timing and formality duties

• Certificates of interrogation must be issued to any person who interrogates the records management system, contain prescribed data points (name of interrogator; full name and unique identifier of subject; time and date), be in a ministerially approved form and may be issued electronically (reg 19(1)-(3)). Receipts for applications are prescribed forms approved by the Minister (reg 16(4)). Prohibition notices must set out reasons and review avenues (subject to protected information constraints) (reg 18(2)).

Who decides and the thresholds

• The Registrar and central assessment unit exercise significant discretionary powers: classifying protected information (reg 4(1)), determining assessable information under reg 8(f) (reg 13(b)), determining which matters fall within the procedural fairness exception (reg 10(2)(d) as prescribed by reg 13(c)), and limiting access to records (reg 20). The Minister selects the independent reviewer and advisory panel members (reg 14; reg 17), and the Registrar determines forms and procedural guidelines referenced throughout the regulations.

Collectively, the duties impose operational verification and reporting burdens on employers and data‑supply burdens on courts and police, while the rights and exemptions give the central authorities and courts tools to limit disclosure and to prioritise safety and confidentiality in high‑risk cases.

The regulations themselves do not create new criminal penalties; they operate within the enforcement architecture of the Child Safety (Prohibited Persons) Act 2016 and related Acts. Several aspects of the regulations create enforceable obligations and administrative sanction pathways that affect individual and organisational behaviour.

Enforcement mechanisms and administrative sanctions

• Prohibition notices (reg 18). The central assessment unit issues prohibition notices under the Act when it determines a person should be prohibited from working with children (reg 18(1)). Prohibition notices are the primary instrument for removing an individual’s lawful ability to engage in child‑related work. The notice must be served in accordance with s 51 of the Act (reg 18(1)(b)), set out reasons for prohibition and explain review options to the South Australian Civil and Administrative Tribunal (reg 18(2)). The effect of a prohibition notice is regulatory exclusion enforced through criminal offence provisions in the parent Act for working with children whilst prohibited (see the Act for specific offence provisions).

• Records and verification (reg 11; reg 19). Employers who fail to comply with verification and notice requirements under the Act risk contravention of duties in the Act; the regulations prescribe how verification is to be conducted and documented (accessing records management system, interrogating it in accordance with Registrar instructions and obtaining a certificate of interrogation; reg 11). Failure to obtain, keep, or produce prescribed certificates or to follow required processes may expose employers to compliance action under the Act or other administrative penalties, those specific penalties are located in the Act.

• Notification obligations of courts, police and certain persons (reg 22-24). These regulations impose mandatory notification duties on courts (where a person is found guilty of a prescribed offence), the Commissioner of Police (where a person is charged), and other specified notifiers, with prescribed information to be supplied in Registrar‑determined forms (reg 22-24). Failure to comply with statutory notification obligations in the Act and regulations may constitute an offence or administrative breach under the Act and impair the central assessment unit’s ability to detect assessable information. The Act governs penalties for non‑compliance by those statutory actors.

• Access limitations and confidentiality controls (reg 4(3); reg 20). The Registrar may limit access to records and classify material as protected; courts must maintain confidentiality where the Registrar requests it (reg 4(3); reg 20). Those provisions are enforcement tools to protect investigative processes and personal safety, enforced through court procedure and administrative access control.

Discretionary and oversight enforcement

• Registrar and CAU discretion (reg 4, reg 13, reg 20). Enforcement relies on registrarial and central assessment unit decisions to classify information, to determine assessable information beyond specific lists, and to limit access to parts of the records management system. Those discretionary acts are reviewable under administrative law and subject to judicial review or merits review avenues available under the Act (for example, review of prohibition notices to SACAT as flagged in reg 18(2)(b)). The Act contains the offence and penalty framework that gives effect to these administrative exclusion decisions. The regulations do not themselves specify fines or criminal sanctions; they prescribe the steps that trigger the Act’s enforcement mechanisms.

• Procedural fairness exceptions and immediate risk (reg 10(2)). The regulations allow the Registrar to bypass certain procedural fairness steps in immediate and serious risk circumstances, or where charges are not yet determined, or where a person is already prohibited (reg 10(2)). The availability of those exceptions creates potential for quick administrative exclusion; the legal review mechanisms under the Act and SACAT provide a pathway for affected persons to challenge both the facts and the process.

Record retention and evidential effect

• Indefinite retention (reg 21(1)). The central assessment unit may keep records indefinitely. Indefinite retention increases the evidential base available for enforcement action and for re‑examination of past decisions. It also raises the potential for old information to re‑emerge in future checks. Disposal is permitted under guidelines (reg 21(2)), but non‑mandatory retention can maintain evidence for future enforcement action.

Interaction with crime and child protection enforcement

• Information flows from courts and police (reg 22-23) ensure the central assessment unit receives information that can lead to prohibition notices and to activation of enforcement through the Act’s offence provisions. The regulations prescribe the content and form of notifications, which streamlines the enforcement pipeline.

In summary, these regulations underpin enforcement by structuring information flows (court and police notifications), defining how verification occurs (records interrogation and certificates), creating the mechanism for exclusion (prohibition notices), and providing confidentiality exceptions for safety. The Act contains the specific penalty provisions; the regulations set out the procedural mechanics that trigger those penalties and the administrative enforcement architecture in practice.

The regulations are expressly designed to operate with a number of existing South Australian and Commonwealth laws. They do not operate in isolation; several provisions incorporate or reference other statutes and regimes by definition or by operational linkage.

Statutory cross‑references and information sharing

• Children and Young People (Safety) Act 2017 and Children’s Protection Act 1993. The definition of protected information includes material that could prejudice investigations under these Acts (reg 3 protected information(b)). Child‑related work and child protection services definitions reference the Children and Young People (Safety) Act 2017, and the regulations treat licensing terms from that Act as relevant to what counts as residential or foster care (reg 7(1)(a)-(d), (2), (5), (8)). This ties working-with-children checks to child protection casework and statutory interventions.

• Criminal Law Consolidation Act 1935 and other criminal statutes. The regulations call out specific provisions of the Criminal Law Consolidation Act 1935 in the lists of excluded offences (reg 5) and presumptive disqualification offences (reg 15A). They also incorporate offences and provisions from the Summary Offences Act 1953, Animal Welfare Act 1985, Controlled Substances Act 1984, and the Commonwealth Criminal Code (reg 15A). By doing so, the working‑with‑children scheme uses convictions under these laws as triggers for presumptive disqualification and as assessable information.

• Spent Convictions Act 2009. Regulation 5(b) excludes convictions that are spent under the Spent Convictions Act 2009 from the prescribed‑offence definition, while explicitly noting that this does not prevent the central assessment unit from treating such convictions as assessable information (reg 5(b)). Thus the scheme recognises the operation of spent conviction rules while reserving the unit’s discretion to treat the underlying information as relevant to a working‑with‑children check.

• Records management and administrative law. The records management system referred to in the regulations is the system established by the Registrar under s 34 of the Act (reg 3). The Registrar’s power to restrict access to parts of the system (reg 20) and to classify protected information likely intersects with police and prosecution confidentiality regimes, as well as with administrative law principles on procedural fairness and reviewability. Courts must maintain confidentiality on application of the Registrar (reg 4(3)), which may interact with rules of evidence and open justice.

• Intervention Orders (Prevention of Abuse) Act 2009 and Criminal Procedure Act 1921. Assessable information explicitly includes intervention orders and restraining orders issued under these Acts (reg 8(d)-(e)), meaning civil and family intervention orders feed directly into the CAU’s risk assessments.

Transitional and interstate arrangements

• Working-with-children schemes of other States and Territories. Regulation 9 recognises working‑with‑children schemes in other jurisdictions, allowing residents of other States or Territories who hold current accreditation or authorisation under those schemes to be excluded from South Australia’s prohibition obligations for organised events of up to 10 consecutive days (reg 9(1)(b)). This provision creates an interstate reciprocity and short‑term cross‑border activity pathway, limiting duplication where another jurisdiction has performed vetting.

• Commonwealth offences and overseas equivalents. The presumptive disqualification list includes offences under the Commonwealth Criminal Code and corresponding laws of other States/Territories or foreign jurisdictions (reg 15A(j), (k), (n)). The regulations therefore capture conduct dealt with at different levels of law and overseas, contingent on equivalence.

Operational couplings and evidence flows

• Court and police notification duties (reg 22-23) create an operational pipeline where findings of guilt and charges in other statutes automatically generate information flow to the central assessment unit. Those flows enable the CAU to exercise functions under the Act, and they can trigger immediate administrative action where the CAU identifies risk.

• Guidelines and Registrar instruments. Many of the procedural details are delegated to guidelines and Registrar instruments: classification requirements for protected information (reg 4(1)), the form of receipts and certificates (reg 16(4); reg 19(3)), Registrar instructions for interrogation of the records management system (reg 11), and determinations of which matters are excluded from procedural fairness (reg 10(2)(d); reg 13(c)). Those instrumentary mechanisms link the regulations to subordinate administrative instruments and policy choices.

Conflict and overlap management

• Spent convictions remain potentially assessable (reg 5(b)), so the scheme preserves state discretion to treat historically spent convictions as relevant despite their statutory spent status. That intersection requires CAU guidance and may produce tensions with rehabilitation protections in other statutes.

• The regulations’ protected information regime (reg 4) creates a legal mechanism that may limit disclosure and the availability of reasons. That mechanism interacts with principles of natural justice and the Act’s appeal and review routes; where reasons are withheld, courts are directed to maintain confidentiality and may receive evidence in closed proceedings (reg 4(3)).

In short, the regulations weave the working‑with‑children scheme into South Australia’s criminal, family/protection, and administrative law fabric, prescribing specific data flows and equivalences and leaving certain implementation choices to guidelines and Registrar instruments. Practitioners will need to consult the cited external Acts when handling assessable information, contested prohibition notices, and notification duties.

The regulations include an explicit legislative history section listing principal instruments and variations. Key amendment points and their mechanical effects are identifiable from the history table and notes.

Commencement and principal instruments

• The regulations were originally made in 2019 (No 5) with commencement on 1 July 2019, as the principal instrument establishing the regulatory detail for the Act (Legislative history table: 2019, No 5; commencement 1.7.2019: r 2).

Subsequent variations

• Multiple variations followed shortly after commencement: 2019 No 182 (Gazette 27.6.2019) varied r 6 (prescribed positions) (see Legislative history and Provisions varied: r 6 varied by 182/2019 r 4, commencement 1.7.2019). That indicates an early refinement of which positions are prescribed for the purposes of the Act.

• A notable insertion was regulation 15A (Presumptive disqualification offences), inserted by 182/2019 r 5, commencing 1 July 2019, which provided a detailed schedule of offences treated as presumptive disqualifiers (Legislative history: r 15A inserted by 182/2019 r 5). The insertion early in the instrument’s life suggests the government clarified which offences should trigger presumptive disqualification after initial drafting.

• In 2020 there were at least two amendment instruments (No 36 and No 73), with commencement dates 2 April 2020 and 21 May 2020 respectively. Part of r 27 was initially inserted by 36/2020 r 4 and later had a sub‑clause expire under the Legislation Revision and Publication Act 2002, reflecting temporary or transitional arrangements being modified over time (Legislative history notes on r 27 and expiry on 30.9.2020 for earlier insertion).

• In 2022, instruments No 8 and No 77 further amended the regulations (Gazette 3.2.2022; Gazette 1.9.2022). Regulation 18(1) was amended by 8/2022 r 3 (commencement 3.2.2022); Reg 27 was substituted by 77/2022 r 3 (commencement 1.9.2022). Those substitutions indicate the temporary exemptions regime was revisited and replaced.

• A later amendment was enacted in 2023 by reg instrument No 120 (Gazette 14.12.2023 p4136), with an apparent commencement for certain provisions on 30 June 2024 (Legislative history table: 2023 No 120, commencement 30.6.2024: r 2). The 2023 instrument deleted r 13(a) (see Provisions varied: r 13(a) deleted by 120/2023 r 3, 30.6.2024), and substituted r 27 (r 27 substituted by 120/2023 r 4, 30.6.2024). These edits further refined delegated powers and the temporary exemption structure.

Technical and revision notes

• The short title r 2 was omitted under the Legislation Revision and Publication Act 2002 as of 1.9.2022 (Provisions varied table: r 2 omitted 1.9.2022). This is a technical housekeeping change related to legislative drafting practice.

• Some earlier versions of reg 27 were temporary and included provisions which expired, were reinserted, substituted, or otherwise amended across the 2020-2024 period. The history records multiple entries for reg 27, showing iterative policy changes, likely reflecting transitional arrangements for persons with prior checks and operational refinements.

Implications for practitioners

• The legislative history demonstrates a pattern of iterative amendments in the early years of the scheme, particularly around the temporary exemption regime and the list of prescribed positions and offences. Practitioners should consult current consolidated text and the instrument history to identify which version applied at any particular time, especially where a working-with-children check, conviction notification, or exemption was processed during the amendment windows.

• Deletions and substitutions (for example, r 13(a) deleted by 120/2023) may alter the scope of delegated functions. Because the regulations rely on guidelines and Registrar instruments in several places, changes to what the Registrar is empowered to determine (via reg 13) can have amplifying effects on processes and access.

• The effect of amendments that took place on or after 30 June 2024 (Gazette 14.12.2023 instrument with that commencement date) must be checked against the date of any event or application. Transitional provisions and temporary exemptions have been a recurring focus of amendment, so fact‑sensitive legal advice will require mapping the operative regulation version to the facts.

In sum, the regulations have been amended multiple times since 2019, particularly to refine Temporary Exemptions and to specify lists of offences and powers. A careful chronological check is necessary to determine which regulatory regime governed a given period or application.

The text supplied contains no case law and names no judicial determinations under the Child Safety (Prohibited Persons) Regulations 2019. The regulations direct that certain decisions are reviewable to the South Australian Civil and Administrative Tribunal (reg 18(2)(b) requires prohibition notices to explain how to seek review in SACAT). The regulations also create mechanisms for courts to protect confidentiality (reg 4(3)). Beyond those features, the instrument does not reference any litigation, precedent, or judicial interpretation. Therefore:

• There is no litigation history recorded in the provided material. The regulations include procedural mechanisms anticipating litigation and review (SACAT review, potential judicial handling of protected information in closed hearings), but they do not cite or summarise any cases that have adjudicated their operation.

• Practitioners seeking precedent or contested interpretation of key discretionary points in the regulations, such as the Registrar’s classification of protected information, the boundaries of procedural fairness when reg 10(2) exceptions are invoked, or the interplay with spent convictions, will need to search case law databases for decisions under the parent Act or for SACAT and judicial review proceedings that have arisen since the regulations commenced. The regulations themselves instruct courts on confidentiality procedures (reg 4(3)) but do not provide examples or case citations.

• Because the regulations confer review rights to SACAT (reg 18(2)(b)), the initial body for merits review of prohibition notices will typically be SACAT. Administrative law challenges in the Supreme Court (judicial review) may also arise in circumstances where applicants seek to challenge the lawfulness of Registrar discretion, the records management system access limitations or the sufficiency of reasons provided where protected information has been invoked. Those avenues are implicit rather than elaborated in the regulations.

In short, the instrument anticipates and structures litigation pathways but does not contain or summarise any litigation history. Users must consult external legal databases and tribunal records for concrete litigation outcomes and interpretive lines.

The regulations contain several technical features and discretionary mechanisms that create practical traps for employers, applicants and agencies. These are concrete points to watch; they derive directly from the text.

• Protected information can substantially limit reasons and disclosure. Where a prohibition is based on Registrar‑classified protected information, the central assessment unit need only say that it would be contrary to the public interest to allow the person to work with children (reg 4(2)). This reduces the granularity of reasons available to an affected person and changes the evidence environment by enabling courts to receive classified material in private and by affidavit (reg 4(3)). Practitioners should anticipate difficulty in fully testing some decisions in public proceedings where protected information is invoked.

• Registrar discretion is wide and often delegated to guidelines or instruments. The Registrar decides what is assessable under reg 8(f), can determine matters excluded from procedural fairness under reg 10(2)(d) via reg 13(c), and may limit access to parts of the records management system (reg 20). Many operational processes therefore hinge on Registrar instructions and guidelines rather than the fixed wording of the regulations. Access and fairness outcomes can vary depending on the content of those guidelines.

• Employers must interrogate the records management system in specific ways and obtain certificates of interrogation. The verification duty is not simply “check a database” , employers must follow Registrar instructions on how to access and interrogate the records management system, and must obtain a ministerially approved certificate that records the interrogator’s name, subject identity and timestamp (reg 11; reg 19). Failure to obtain or retain that certificate may leave an employer exposed to contravention allegations or unable to prove compliance.

• Spent convictions are excluded from the prescribed‑offence definition but may still be assessable. Regulation 5(b) excludes convictions that are spent under the Spent Convictions Act 2009 from the prescribed‑offence definition, but the regulation expressly notes that a spent conviction may still be assessable or otherwise taken into account for a working-with-children check. Practitioners should not assume spent status provides insulation from administrative vetting.

• Temporary exemption regime is complex and time‑sensitive. Reg 27 creates transitional temporary exemptions for applicants who had a prior check within five years and whose application straddles the five‑year anniversary. The exemption suspends certain employer and CAU duties for the person until the check is completed, but it can cease upon a range of events (completion of the check, specified dates, contravention of conditions, becoming a prohibited person) (reg 27(2)-(6)). Employers relying on temporary exemptions must carefully track expiry triggers and conditions.

• Broad definitions of child‑related work produce wide scope. Regulation 7 contains an expansive set of examples including commercial entertainment services, costumed characters, photography of children, coaching, transport and emergency services with “regular contact” (reg 7(1)-(4), (7)). Activities that may feel peripheral, such as short‑term entertainers at children’s events, competition organisers with child categories, or transport providers for hire, can fall within the scheme. Organisations should review their activities against the explicit examples and the “contact” definition (reg 7(6)).

• Records retention is not mandatory but is permitted indefinitely. The central assessment unit may keep records indefinitely (reg 21(1)). While retention is discretionary, the absence of a mandatory deletion timetable increases the chance that historical information will be available for future checks. This has data protection and reputational implications for applicants.

• Notification format and formality matters. Courts and police must provide prescribed information "in a manner and form determined by the Registrar" (reg 22(2); reg 23(2)). If these forms and processes change, notification pipelines can be disrupted. Agencies must be aligned with Registrar determinations to avoid missed notifications.

• Procedural fairness exceptions are broad. Reg 10(2) excludes multiple categories from the procedural fairness requirements, including where the Registrar thinks there is an immediate and serious risk. The undefined threshold of “immediate and serious risk” is a discretionary determination that can be invoked to expedite protective measures but may limit an affected person’s opportunity to respond.

• Interstate short‑term workers and event volunteers have limited immunity but with precise conditions. Exclusions for interstate workers apply only where the worker is a resident of another State/Territory, not prohibited elsewhere, holds current accreditation where that scheme exists, and the child‑related work occurs in an organised event and does not exceed 10 consecutive days (reg 9(1)(b)). Failure to meet any of those criteria removes the exclusion.

• Employer notification content must be complete. Notices to the CAU must include personal identifiers and unique identifiers if known (reg 12). Incomplete notices or failure to include unique identifiers may impede CAU processing and increase compliance risk for employers who are required by the Act to notify.

These operational “gotchas” arise directly from the text; practitioners and compliance officers should map them to internal procedures, update job descriptions and vetting flowcharts accordingly, and monitor Registrar guidelines and forms which materially affect how several of these rules operate in practice.

Compliance requires translating the statutory mechanics into operational policies and workflows that satisfy the prescriptions in the regulations. Below are concrete steps, mapped to the regulations, for employers, registrars, the central assessment unit, courts and police.

For employers and organisations engaging child‑related workers

1. Determine whether a role is child‑related. Use the itemised definition at reg 7: education (preschool to secondary), care and residential services, foster and approved carer roles, coaching and tuition, health and allied health services to children, transport services where children are passengers, commercial entertainments and activities involving contact with children (reg 7(1)-(4), (6)). Where contact is physical, proximate or communicative, treat it as “contact” (reg 7(6)).

2. Verify working‑with‑children checks and prohibition status by interrogating the records management system in accordance with Registrar instructions and retain evidence. Follow reg 11(1)-(3): access the records management system per Registrar instructions, determine whether a check has been conducted in the past five years and whether the person is recorded as prohibited, and obtain the certificate of interrogation required by reg 19. The certificate must record the interrogator’s name, the subject’s full name and unique identifier, and the time and date (reg 19(1)). Ensure the certificate is in the ministerially approved form and stored in personnel files (reg 19(3)).

3. Provide prompt and complete notices to the central assessment unit where required. When a notice under s 19 is triggered, include the prescribed information: name and address of the person, unique identifier if known, circumstances giving rise to the obligation to notify, employer name and address, and employer contact details (reg 12). Use the Registrar‑determined form if one exists. Accurate unique identifiers reduce risk of mistaken identity in CAU processing.

4. Track temporary exemptions and their expiry. If a worker’s status is potentially covered by the temporary exemption in reg 27, maintain records on receipt date, prior working‑with‑children check date, and ensure applications are completed promptly to avoid gaps. Understand which employer obligations remain suspended under reg 27(5) and when the exemption ceases (reg 27(2)-(6)).

5. Maintain internal policies for managing protected information and prohibition notices. If the CAU issues a prohibition notice, it must set out reasons and review routes unless limited by protected information (reg 18(2)). Organisations should have procedures for immediate compliance, removal from child‑related duties, and decision on whether to contest the prohibition in SACAT. Train HR to deal with notices served under s 51 of the Act (reg 18(1)(b)).

For the Registrar and central assessment unit

1. Publish clear guidelines and Registrar instructions. The regulations repeatedly refer to requirements in "the guidelines" or "instructions of the Registrar" (reg 4(1); reg 10(1); reg 11). Because many operational duties depend on those materials, the Registrar should issue detailed, regularly updated guidelines on: classification criteria for protected information, access rights and limitations to the records management system, forms and electronic procedures for certificates and notices, and the processes for notifying and inviting submissions under reg 10.

2. Document the basis for classifying information as protected. Reg 4(1) permits classification; to withstand review the Registrar should record the statutory test applied (reg 3 protected information definition) and contemporaneous reasons for the classification to support closed‑court processes and any judicial review.

3. Ensure records management system integrity, audit trails and role‑based access. The Registrar may limit access to parts of the system (reg 20). Implement role‑based permissions, logging of interrogations, and mechanisms for issuing ministerially approved certificates of interrogation (reg 19). Preserve audit logs to demonstrate compliance with reg 11 and to support later reviews or appeals.

4. Actively seek assessable information. Reg 15(a) obliges the CAU to “as far as is reasonably practicable, actively seek to obtain assessable information”. Operationally, set up automated feeds from courts and police (reg 22-23), liaison arrangements with child‑protection agencies and clear procedures to evaluate intervention and restraining orders (reg 8(d)-(e)).

5. Plan records retention and data disposal policies. Reg 21 allows indefinite retention but does not require it. Publish a data retention policy consistent with guidelines, privacy law and data minimisation principles, and define the circumstances under which disposal will occur (reg 21(2)). Implement secure storage and data protection controls given sensitivity of material, notably when dealing with protected information or criminal intelligence (reg 3; reg 20).

For courts, police and other notifying persons

1. Comply with prescribed notification content and form. Courts must provide full name, address, DOB, particulars of the prescribed offence, date of finding, and the court to the CAU in a Registrar‑determined form (reg 22). Police must provide full name, address, DOB (if known), details of the charge and alleged conduct (reg 23). Use the Registrar’s form for consistency and to reduce processing delays.

2. Coordinate with the Registrar on timing and form. Because notifications must be in forms determined by the Registrar, liaison between registries and the CAU will reduce administrative friction. Maintain internal protocols to transmit notifications promptly and securely.

For persons subject to checks and their advisers

1. Monitor procedural fairness timelines. When a working‑with‑children check is conducted, the CAU must take reasonable steps to notify the person of assessable information and specify a period for submissions (reg 10(1)(a)-(b)). Keep contact details up to date and respond within the specified period to ensure submissions are considered.

2. Prepare for limited disclosure in protected information cases. If the Registrar classifies information as protected and the CAU relies on it, the person may receive limited reasons and the hearings or evidence may occur privately (reg 4). Advisers should seek procedural directions, consider applying for appropriate disclosure or in camera inspection where permitted, and be ready to litigate via SACAT or judicial review channels to test legality.

Cross‑cutting recommendations

1. Map legal obligations to HR processes. Incorporate the verification sequence (check within 5 years, interrogate records management system, obtain certificate) into recruitment onboarding, contractor induction and vendor agreements (reg 11; reg 19).

2. Keep a schedule of regulatory updates and Registrar instruments. So many operational details are delegated to Registrar instructions and Ministerially approved forms that organisations must monitor changes in guidelines and forms (reg 11; reg 16(4); reg 19(3)).

3. Ensure data privacy and secure transmission. Notifications between courts, police and the CAU will carry sensitive personal and child‑safety information (reg 22-23). Use secure transmission channels, encryption and least‑privilege access consistent with reg 20’s ability to limit access where disclosure would disclose criminal intelligence or protected information.

4. Train front‑line staff on exclusions and short‑term interstate rules. Prevent misclassification of short‑term interstate workers and volunteer parents under reg 9: confirm residency, accreditation in the home jurisdiction, organised event status, the ten‑day limit and parental volunteer boundaries on close personal contact and overnight care.

5. Document decisions and maintain audit trails. Given the possibility of review to SACAT and judicial review, preserve documentary records of notification, interrogation certificates, CAU decisions, reasons provided and any submissions made by applicants (reg 10; reg 18; reg 19).

Following these concrete procedural steps, documented in internal policy and linked to technical systems that generate and store the required certificates and notifications, will place employers and agencies in a defensible compliance position under the regulatory framework.
