sec.102 Giving official false or misleading information

A person must not give an official information that the person knows is false or misleading in a material particular. Maximum penalty—100 penalty units. Subsection (1) applies to information whether or not the information was given in response to the exercise of a specific power under this Act. Subsection (1) does not apply to a person if the person, when giving the information in a document— tells the official, to the best of the person’s ability, how the document is false or misleading; and if the person has, or can reasonably obtain, the correct information—gives the correct information. In this section— official means— a staff member of the commission; or the principal commissioner or a commissioner; or an authorised officer.
