82 Attendance at hearings (1) If the applicant does not attend a hearing fixed under section 81 or a further hearing under section 76, the court: (a) if it is satisfied the applicant was notified of the hearing – must dismiss the application; or (b) otherwise – must adjourn the hearing. (2) If the applicant attends a hearing fixed under section 81 or a further hearing under section 76 but the respondent does not attend, the court: (a) if it is satisfied that the respondent was served with a summons requiring the respondent to attend the hearing – must hear the matter in the absence of the respondent; or (b) otherwise – must adjourn the hearing. (3) The registrar of a court that adjourns a hearing must notify any party permitted to attend the hearing who was not present when the hearing was adjourned.
