#### 23 Actively setting up a business
(1) For the purposes of paragraph 12(2)(d) of Schedule 2 to the Family Assistance Act, an individual engages in a recognised participation type during a CCS fortnight if, during the fortnight, the individual engages in actively setting up a business that has not yet started to operate, including engaging in one or more of the following participation types in relation to the proposed business:
(a) obtaining finance, advice and support;
(b) attending and organising events, including meetings, networks and seminars;
(c) developing business, marketing or other plans.
(2) However, an individual only engages in a recognised participation type under subsection (1) in relation to a CCS fortnight if, during the period of 12 months immediately before the CCS fortnight, determinations have been made under subsection 67CD(2) of the Family Assistance Administration Act that the individual is entitled to a payment of CCS worked out on the basis of the application of subsection (1) of this section in relation to fewer than 13 CCS fortnights:
(a) whether or not occurring consecutively; and
(b) whenever occurring during that period; and
(c) in relation to that proposed business, or any other.
