12Circumstances in which an individual is taken to be experiencing temporary financial hardship

#### 12 Circumstances in which an individual is taken to be experiencing temporary financial hardship (1) For subsection 85CG(2) of the Family Assistance Act, an individual is taken to be experiencing temporary financial hardship if: (a) the individual has had a substantial reduction in her or his ability to pay child care fees as a result of any of the circumstances described in subsection (2) of this section; and (b) the circumstance described in subsection (2) occurred in relation to the individual on a day that is no earlier than 6 months before the day the application for ACCS (temporary financial hardship) was made. (2) For subsection (1), the circumstances are as follows: (a) the death of a partner or child of the individual; (b) a loss of employment of the individual, or a partner of the individual, other than due to resignation or retirement; (c) a loss of income or business failure of the individual, or a partner of the individual, due to circumstances outside of the control of the individual or of the partner (such as serious illness); (d) a loss of income of the individual, due to the death of a former partner, where the former partner was providing ongoing financial assistance in relation to the child under child support arrangements; (e) the individual, or a partner of the individual, being adversely affected by a major disaster event; (f) the destruction of, or severe damage to, the home of the individual, or of a partner of the individual; (g) the individual having to leave home, and not being able to return because of an extreme circumstance (such as domestic violence); (h) the individual still living at home after being subjected to domestic violence by a family member who has left or has been removed from the home.
