What it does
These regulations set the fees payable under the Child Care Act 2001 by prescribing a schedule of fee units for licence applications, renewals, late lodgements and licence amendment requests for different classes of child care registration. Regulation 3 expressly makes the numbers in Schedule 1 the fees “payable under the Child Care Act 2001, in respect of the matters to which they relate” for two time periods: Part 1 of Schedule 1 applies for 5 June 2023 to 30 June 2024 (reg 3(1)); Part 2 is prescribed as payable “on and from 1 July 2024” (reg 3(2)). The regulations commence on 5 June 2023 (reg 2) and were notified in the Gazette on 30 May 2023. Administration is assigned to the Department for Education, Children and Young People (final line of instrument).
Mechanically, the instrument does three things:
- It prescribes fee unit amounts for an “approved registration body licence” (application, renewal, late renewal, amendment) and for a set of licence classes under the Child Care Act: centre‑based child care licences (distinguishing centres providing vacation care only), and home‑based child care licences (Schedule 1, Parts 1 and 2).
- It fixes temporally distinct fee schedules: one applying from commencement through 30 June 2024 (Schedule 1, Part 1), and a second schedule meant to apply thereafter (Schedule 1, Part 2), with the text of reg 3(2) identifying 1 July 2024 as the start date for Part 2.
- It allocates fees by licence type and by capacity bands (for example “licensed for up to 15 children”, “16 to 40 children”, etc.), and by transaction (application, renewal, late lodgement, request for amendment) (Schedule 1).
By operation, paying the prescribed amount will be necessary when making the listed applications, renewals or amendment requests under the Child Care Act 2001. The schedule uses “Fee units” as the stated measure for each item; the regulations themselves do not define within their text the monetary conversion of a fee unit. The Department for Education, Children and Young People is named as the administrative agency for these regulations, which indicates where applications and payments will be processed.
