sec.32B Dealing with things forfeited or transferred to State
A thing becomes the property of the State if— the thing is forfeited to the State under section 32A (2) ; or the owner of the thing and the State agree, in writing, to the transfer of the ownership of the thing to the State. The chief executive may deal with the thing as the chief executive considers appropriate (for example, by destroying the thing or giving it away). However, the chief executive must not deal with the thing in a way that could prejudice the outcome of an appeal against the seizure of the thing. If the chief executive sells the thing, the chief executive may, after deducting the costs of the sale, return the proceeds of the sale to the owner of the thing. s 32B ins 2024 No. 17 s 121 (sec.32B-ssec.1) A thing becomes the property of the State if— the thing is forfeited to the State under section 32A (2) ; or the owner of the thing and the State agree, in writing, to the transfer of the ownership of the thing to the State.
