Charter of the United Nations (Sanctions – Democratic People’s Republic of Korea) (Documents) Instrument 2017

The central concept is the “specified document”. Subregulation 5(3) of the principal Regulations empowers the Minister to specify, by legislative instrument, documents for the purposes of subparagraph 5(1)(c)(i). That subparagraph provides that a person may do an act that would otherwise be prohibited if the act is “in accordance with a document specified in an instrument under subregulation (3)”. The instrument therefore operationalises the phrase “in accordance with”. The specified documents fall into two categories. The first category consists of letters from the Chair of the UN Security Council Committee established pursuant to resolution 1718 (2006) - the DPRK Sanctions Committee. Items 1 to 5, 8, 9, 10 and 11 are such letters. Each letter contains, or annexes, lists of items, entities or individuals that the Committee has designated as subject to controls, or guidance on inspection and interdiction. The second category comprises two IAEA Information Circulars: INFCIRC/254/Rev.13/Part 1 (item 6) and INFCIRC/254/Rev.10/Part 2 (item 7). These circulars reproduce “Certain Member States’ Guidelines” for the export of nuclear material, equipment and technology, and for transfers of nuclear‑related dual‑use equipment, software and related technology. The act of specifying a document means that the content of that document - including any lists, definitions, exceptions or conditions - becomes legally relevant for permit applications under the Australian sanctions regime. It does not incorporate the document as Australian law in a self‑executing sense; rather, the document supplies the factual and technical criteria that decision‑makers must apply. This mechanism reduces duplication: instead of reproducing lengthy UN and IAEA lists in Australian regulations, the instrument cross‑references them. A second important concept is the static lock: the instrument does not incorporate future amendments to the specified documents. If the IAEA issues a revised circular or the 1718 Committee updates its list, a further amending instrument is required to substitute or add the new document. Between updates, the Australian specification may lag behind the international reference, creating a gap between what the UN requires and what Australian law currently recognises as enabling compliance.

The instrument directly affects any person or entity that seeks to engage in an activity with the DPRK that falls within the scope of the principal Regulations. Typical affected persons include Australian exporters of nuclear materials, dual‑use industrial goods (such as precision machine tools, electronics, sensors and lasers), ballistic missile components, and luxury goods. It also affects transport operators, freight forwarders, insurers, banks and financial intermediaries who facilitate transactions, shipments or payments involving DPRK‑related goods. Australian financial institutions that process letters of credit, trade finance or insurance for shipments to or from North Korea must verify whether any goods are covered by the specified documents. Compliance officers in resource, manufacturing and logistics companies need to check the specified documents when screening transactions. Legal practitioners advising on sanctions risk must interpret the conditions in the UNSC letters and IAEA circulars to advise clients on whether a proposed activity can be brought within a permitted pathway. The instrument also affects government officials - principally officers in the Department of Foreign Affairs and Trade and the Australian Border Force - who assess permit applications and enforce compliance. For a smaller business, the burden of locating and understanding documents S/2017/829 (the most recent UNSC letter specified) and the two IAEA circulars may be non‑trivial, particularly if the business operates in low‑volume, high‑value industries such as scientific equipment or specialised components. The instrument does not affect persons who deal only in goods or services that are not captured by the DPRK sanctions regime, but the breadth of the specified documents - which incorporate nuclear‑related and dual‑use guidelines - means that many seemingly innocuous items (e.g., industrial valves, aluminium alloys, computers) could be caught if they appear on the IAEA lists. Therefore, the practical reach extends well beyond the nuclear sector.

The instrument itself imposes no duties. However, by specifying documents, it triggers the rights and duties that exist in the principal Regulations. The key duty, found in regulation 5 of the principal Regulations, is the prohibition on supplying, selling, transferring, purchasing, brokering or transporting goods that are “DPRK sanctions goods” unless the Minister has granted a permit or the activity is in accordance with a specified document. The instrument supplies the second limb: if a person can show that their activity complies with the conditions in a specified document, they do not need a permit; the activity is deemed lawful. The right that flows is the right to rely on the contents of those documents as a defence against prosecution or as a basis for a permit application. For example, item 6 specifies INFCIRC/254/Rev.13/Part 1. That circular includes guidelines for the export of nuclear material and equipment. If an exporter proposes to supply a dual‑use item that is not listed in that circular (or is listed but under conditions that the exporter meets), they can argue the activity is in accordance with the document. Conversely, if the item is on the list and the conditions are not satisfied, the exporter may apply for a permit but must then satisfy the Minister that the activity does not contravene Australia’s international obligations or the purposes of the UN sanctions. The instrument also creates an implicit right to be informed: because the specified documents are publicly available on the UN and IAEA websites, and the instrument is registered on the Federal Register of Legislation, the legal content is ascertainable. However, there is no duty on the part of the government to notify document holders when a document is replaced or added. The duty to keep current falls on the regulated person. The amendment history shows that Schedule 1 was substituted twice within twelve months (November 2017 and May 2018), which indicates that documents are updated relatively frequently, and persons must monitor not only the parent Regulations but also this instrument for changes to the relevant document numbers.

Penalties are not set out in this instrument. They are located in the principal Regulations and, ultimately, in section 27 of the Charter of the United Nations Act 1945. That Act provides that a person who contravenes a sanctions regulation is guilty of an offence punishable by imprisonment for up to 10 years and/or a fine of up to 2,500 penalty units (currently $555,000 per unit for corporations, with a maximum of $1,387,500 per offence for individuals). The instrument’s role in enforcement is evidentiary: if a person is charged with exporting goods to the DPRK without authority, a prosecutor will need to prove that the goods were not in accordance with a specified document. The defence bears the evidentiary burden of showing that the activity fell within the scope of a specified document and that all conditions in that document were met. This shifts the practical burden onto the regulated person to document compliance. The instrument itself cannot be breached; it is simply a list. However, if a person mistakenly relies on an earlier version of a document (e.g., INFCIRC/254/Rev.12 rather than Rev.13/Part 1) they would not be acting in accordance with the specified document and could be liable. The enforcement agencies - primarily the Australian Federal Police, the Department of Foreign Affairs and Trade, and the Australian Border Force - may use the instrument as a checklist during audits, inspections and investigations. During a customs examination, an officer will compare the goods, end‑use statement and supporting documents against the lists in the specified documents. If the goods match a listed item and the exporter cannot demonstrate compliance with the conditions, the goods may be seized and criminal proceedings initiated. The instrument therefore operates as a de facto standard against which compliance is measured, even though it imposes no positive obligation.

This instrument is made under the Charter of the United Nations (Sanctions - Democratic People’s Republic of Korea) Regulations 2008, which in turn is made under section 6 of the Charter of the United Nations Act 1945. The Act itself implements Australia’s obligation under Article 41 of the UN Charter to give effect to Security Council decisions. The instrument therefore sits within a hierarchy: UN Security Council resolutions → Charter of the United Nations Act → principal Regulations → this instrument specifying documents. The instrument also interacts with the Customs (Prohibited Exports) Regulations 1958 and the Defence and Strategic Goods List 2016, which controls the export of dual‑use and munitions items for all destinations, not only the DPRK. An exporter may need to satisfy both regimes: if a proposed export to the DPRK involves an item listed in both the specified documents under this instrument and the Defence and Strategic Goods List, separate permits may be required. The instrument does not override the Customs Act 1901 or the Autonomous Sanctions Act 2011; it is specific to the DPRK sanctions regime. The UN documents specified (e.g., S/2017/829) also appear in other jurisdictions’ sanctions laws; a US or EU sanctions lawyer may refer to the same UN documents, but the Australian instrument gives them unique domestic legal force. There is also interaction with the International Atomic Energy Agency (IAEA) information circulars: those circulars are issued by the IAEA and are used by member states to align their export control policies. By specifying them, Australia effectively adopts the international non‑proliferation consensus as domestic law for DPRK purposes. If a person complies with the IAEA guidelines for the purposes of this instrument, they may also be complying with other Australian controls under the Nuclear Non‑Proliferation (Safeguards) Act 1987. Conversely, the instrument does not affect obligations under the Migration Act 1958 or the Migration Regulations regarding designated persons or entities on UN sanctions lists; those operate under a separate instrument.

The instrument was originally made on 18 May 2017 (F2017L00539) and commenced on 19 May 2017. The original Schedule 1 contained documents that are not shown in the compilation because the schedule was later substituted. The first amendment (Charter of the United Nations (Sanctions - Democratic People’s Republic of Korea) (Documents) Amendment Instrument 2017 (No. 1)) was registered on 8 November 2017 and commenced on 9 November 2017. That amendment substituted the entire Schedule 1, presumably to add or replace the UNSC letters and IAEA circulars then current. The second amendment (F2018L00639) was registered on 21 May 2018, commenced on 22 May 2018, and again substituted Schedule 1. The compilation date is 22 May 2018, meaning the text reflects the instrument as amended by that second amendment. The endnotes show that section 2 (commencement) and section 4 (presumably a definition or application provision) were repealed by the Legislation Act 2003 - specifically sections 48D and 48C, which automatically repeal provisions that are obsolete or have no continuing effect. The amendment history also notes that Schedule 1 was substituted twice. There is no reference to any transitional provision; each substitution starts afresh. The practical implication is that a person relying on a specified document must look at the version that was in force at the time of the conduct. Because the documents are identified by their UN document symbol (e.g., S/2017/829), the revision number is part of the symbol, so a replacement of that same symbol would mean an entirely new document. Users should check the compilation date and ensure they refer only to documents listed in the version of the instrument that was in force when the proposed activity occurred. The legislation history also indicates that no application, saving or transitional provisions were included with the amending instruments, so the effect of each amendment is immediate and retroactive only to the commencement date.

No litigation involving this instrument is recorded in publicly available sources, and the instrument itself does not reference any cases. This is unsurprising given its limited function: it merely lists documents and does not create new prohibitions or penalties. Litigation concerning DPRK sanctions in Australia has focused on the principal Regulations, the Charter of the United Nations Act, and the exercise of ministerial discretion under regulation 5. A legal challenge to a permit refusal or to the scope of a specified document could theoretically arise, but the narrow, minister‑like character of the instrument makes it difficult to challenge directly. A person who argued that the Minister incorrectly specified a document (e.g., by citing a document that had been superseded) might seek judicial review under the Administrative Decisions (Judicial Review) Act 1977. However, the instrument is a legislative instrument, not a decision, so review of its content would be limited. More likely, a dispute would arise at the enforcement stage: a defendant charged with a sanctions offence under the Act might argue that their activity was in accordance with a specified document, and the court would then interpret the meaning of that document. No such case on this specific instrument has been decided. The absence of litigation does not mean the instrument is unimportant; it reflects the fact that most compliance is pre‑emptive, not litigated. Exporters who realise they cannot meet the conditions in a specified document simply do not proceed, or they apply for a permit and accept the Minister’s decision privately. The low litigation rate also means there is little judicial guidance on how to interpret the phrase “in accordance with” or on the weight to give to headings, annexes, or non‑binding guidelines within the specified documents. Practitioners should be cautious in offering advice that relies on inference from similar EU or UN cases, as Australian courts have not yet endorsed those approaches.

The first gotcha is the lag between UN or IAEA updates and Australian amendments. Because the instrument specifies a particular document revision (e.g., INFCIRC/254/Rev.13/Part 1), if the IAEA later releases Rev.14, the Australian instrument still points to Rev.13. An exporter who checks the latest UN document might assume they are compliant, but the legal reference is the older version specified here. Conversely, an exporter who complies with Rev.13 might miss new restrictions in Rev.14, creating international compliance issues even though they satisfy Australian law. The second gotcha is the sheer number of UN documents: items 1 to 5, 8 and 9 are letters from different dates, and some may contain overlapping or superseded lists. The instrument does not indicate which document prevails if there is inconsistency. A person will need to read all applicable documents and may need to comply with the most restrictive or the most recent, depending on the legal argument. The third gotcha is that the IAEA circulars (items 6 and 7) cover not only nuclear materials but dual‑use items. Many industrial goods - such as specific valves, pumps, machine tools and electronics - appear on those lists. A manufacturer of industrial equipment who thinks they are outside the nuclear sector could inadvertently be captured. The fourth gotcha is that the instrument was made under subregulation 5(3), which is delegating power to the Minister. If the Minister’s specification is not made in the correct form (e.g., if a document is mis‑identified), the specification may be invalid. Practitioners should verify the document symbol exactly matches the UN record, as a typographical error could void the reliance defence. The fifth gotcha is that the instrument does not include the text of the documents; the reader must locate the UN or IAEA document separately. The UN documents often include amendments made by the 1718 Committee that are not immediately obvious from the symbol. For example, S/2017/829 may contain multiple annexes, and the letter or annex may refer to earlier resolutions. The compliance burden of cross‑referencing is significant. The sixth gotcha is the amendment history: Schedule 1 was substituted twice. A person who relies on a document that was listed before the substitution but is no longer listed will not be acting in accordance with the current instrument. Checking the compilation date is essential; older compilations are not official.

Compliance with the instrument itself is straightforward: one must identify which document or documents are relevant to the proposed activity, locate the current version of that document (ensuring the document symbol matches exactly the one in the instrument’s Schedule 1 as in force at the time of the activity), and then ensure that the activity is carried out in accordance with all applicable provisions, conditions, lists and guidelines set out in that document. For a typical export of dual‑use items, the exporter should first check item 7 (INFCIRC/254/Rev.10/Part 2) to see whether the item appears on the dual‑use lists. If it does, the exporter must satisfy any conditions stated in the circular (such as obtaining end‑user undertakings, noting the permissible quantities, or applying for a permit from the Minister). Next, the exporter should check the relevant UNSC letters (items 1 to 5 and 8 to 11) to see whether the item, end‑user or destination is listed or subject to additional restrictions. If the item is not listed, or if it is listed but the exporter can satisfy all conditions, the activity may proceed without a permit. If no condition is met, the exporter must apply for a permit under the principal Regulations, explaining why the activity should be permitted despite not falling within the specified documents. The permit application must be made to the Minister for Foreign Affairs through the Sanctions Branch. The exporter should retain copies of all documents, including the up‑to‑date text of the specified documents, and maintain a compliance log showing how each condition was satisfied. Because the instrument is amended, the exporter must subscribe to the Federal Register of Legislation for amendments to this instrument and also monitor the UN Security Council and IAEA websites for new letters or circulars. When an amendment is registered, the exporter must reassess any ongoing or future activities. Due diligence on the ultimate end‑user and end‑use is critical; the UNSC letters often include information on entities acting for or on behalf of the DPRK. Engaging a trade law specialist or subscribing to a sanctions database may be cost‑effective for businesses with significant exposure. The instrument does not require any specific forms, certifications or authorised persons; it is a reference document. The real work - and the main cost - is the ongoing monitoring and verification against the specified documents that change over time.
