What it does
This instrument is a ministerial listing made under subsection 15(1) of the Charter of the United Nations Act 1945. It formally lists two named entities as subject to measures taken to give effect to paragraph 1(c) of United Nations Security Council Resolution 1373 (2001). The Listing is titled "Charter of the United Nations Act 1945 Listing (No. 2) 2020" (s 1), it commences on gazettal (s 2), and it is issued by the Minister for Foreign Affairs (front matter and signature block, dated 15 January 2021). The operative certification in the instrument is at section 4: the Minister states she is "satisfied on reasonable grounds" that the entities in Schedule 1 are entities mentioned in paragraph 1(c) of UNSCR 1373 (2001).
Mechanically, the instrument does the following, as expressed in its own text:
- Names and records the listed entities (Schedule 1), including aliases and addresses for each entity.
- Declares the Minister's satisfaction basis under the Act (s 3-4).
- Points to related procedural and administrative mechanisms available to listed persons or other interested parties, set out in Schedule 2: requests for an unclassified statement of reasons, applications to the Minister for revocation of the listing, and applications for sanctions permits to use or deal with frozen assets (Schedule 2). Schedule 2 specifies where and how those written requests and applications may be lodged (postal address and email to the Australian Sanctions Office, Department of Foreign Affairs and Trade).
The Listing also records statutory cross-references and administrative notes. It cites regulation 20 of the Charter of the United Nations (Dealing with Assets) Regulations 2008 as governing the Minister’s satisfaction required to make the listing (Note 1), and regulation 40 of those Regulations as requiring DFAT to maintain an online consolidated list of all persons, entities, assets and classes of assets listed under section 15 of the Act (Note 2). For applications for permits to deal with frozen assets, Schedule 2 requires that applications specify whether they relate to a "basic expense dealing, a contractual dealing or an extraordinary expense dealing" as those terms are defined in section 30 of the Regulations (Schedule 2).
