Charitable Collections Act 1946

The Act’s central organising concepts are licence control, defined charitable scope, evidentiary burden shifting in enforcement, financial accountability, and Executive power to reallocate funds where necessary.

Definition and scope of charitable purpose. Section 5 provides the operative definition of "charitable purpose". It lists relief to the sick, poor and dependants; relief of distress occasioned by war; support for His Majesty’s forces and their dependants; support for hospitals, infant health centres and kindergartens; and a general residual category of "any other benevolent, philanthropic or patriotic purpose". That definition both delimits who may benefit and sets a broad catalogue that includes welfare and patriotic objects. The Act applies to collections for those enumerated categories.

The licensing prohibition and authorised actors. Section 6(1) makes it an offence to collect, attempt to collect, sell devices for charity, conduct chargeable entertainments held out as providing proceeds to charity, or advertise such events, unless done by a licence holder, a committee member authorised by a licensee, or an individual authorised by a licensee (s 6(1)(e)-(g)). The prohibition applies to collections that are wholly or partly for charitable purposes (s 6(4)). The maximum penalty specified in the Act for this subsection is a fine of $20 000. The Act shifts an evidentiary burden: the prosecution need not negative the existence of authority but the accused must prove any licence or authority relied on (s 6(3)).

Licensing process and discretionary refusal. Applications are made to the Commissioner and must be referred to the advisory committee for report (s 11(1)). The advisory committee must consider whether the applicant’s objects would be more effectively or economically carried out by another licensee or applicant (s 11(2)). The Commissioner has an express discretion to grant or refuse a licence and is insulated from proceedings for refusal (s 11(3)). Licences may be issued for specified periods or until revoked, may be subject to conditions and may be revoked administratively by the Commissioner (s 12(1)-(3)).

Financial control and contract approval. The Commissioner may impose licence conditions requiring that proposed contracts or arrangements dealing with charitable moneys be submitted for prior approval. Contracts made in breach of such a requirement may be void and money received under them recoverable at the suit of the Commissioner (s 12(4)(a)-(b)). Money recovered is to be appropriated to the charitable purpose, with recovery costs deductible first (s 12(5)).

Recordkeeping, audit and investigatory powers. Section 15 creates statutory obligations to keep "collection records" , accounts and statements of how money and goods were collected and dealt with , and to retain them for seven years (s 15(1)-(2)). The Commissioner may require a collector to provide copies or access to records or to have them audited by an auditor approved by the Commissioner (s 15(3)). Failure to keep records or to comply with a Commissioner’s requirement attracts penalties (s 15(2); s 15(3A)). Section 20 empowers the Auditor General to inspect, audit and investigate accounts relating to charitable moneys and to report to the Minister (s 20(1)-(3)). Section 20A imports s 61 and Part 6 (other than s 88E) of the Fair Trading Act 2010 for investigatory powers; that effectively makes the Fair Trading Act’s Part 6 investigatory toolkit available for purposes of enforcing this Act.

Concentration of executive powers over funds. Sections 16 and 17 authorise the Governor to make proclamations to declare that charitable moneys not required for their intended purpose be applied to other charitable purposes or vested in the Minister. Vesting can also be triggered where a supermajority of trustees consents or where maladministration is found (s 17(1)). Proclamations have the force of law and transfers are to be effected accordingly (ss 16(2), 17(3)). The Governor may vary trusts through proclamation (s 17(2A)). Proclamations under s 16 require approval of both Houses of Parliament before being made (s 16(3)).

Administrative structures. The Act establishes an advisory committee of five members appointed by the Governor on the Minister’s recommendation (s 10). The Minister holds delegation power subject to s 17A; the Minister may delegate functions under the Act other than the delegation power itself and performance by a delegate is treated as performance by the Minister (s 17A).

Penalty and prosecutorial control. The Act sets specific monetary penalties for key offences and requires Commissioner approval in writing before a prosecution for an offence under the Act may be commenced (s 19(1)). Documents purporting to be Commissioner approvals are prima facie evidence of that approval in court (s 19(2)).

Interplay with other statutes. Section 4 makes the Street Collections (Regulation) Act 1940 paramount in case of inconsistency. Section 5 ties the Commissioner definition to the Fair Trading Act 2010 (s 6 of that Act). Section 20(4) imports auditing powers under the Auditor General Act 2006. Section 20A directly imports investigatory provisions from the Fair Trading Act 2010. The Act also contains transitional provisions relating to the Consumer Protection Legislation Amendment Act 2019 at s 22.

These concepts create incentives and constraints. Licence control centralises authority with the Commissioner and the advisory committee. Recordkeeping and audit requirements impose compliance costs on collectors and create potential exposure for officers. Executive powers to vest, transfer and vary trusts provide a mechanism to reallocate funds where trustees are inactive or funds are mismanaged, but those powers are subject to parliamentary and administrative checks as specified.

The statutory regime touches several distinct groups. The Act defines each group in operational terms and allocates duties, rights and potential liability.

Collectors and licence‑holders. Any person, society, body or association that collects or receives money or goods for a charitable purpose is a collector under the Act (s 15(1) definition). Collectors who conduct the specified activities in s 6(1) must hold a licence or be authorised by a licence holder; otherwise they face a specified fine (s 6(1), s 6 penalty). Licence holders are the primary regulated subjects: they apply for licences to the Commissioner, are the persons who may authorise others to collect on their behalf (s 8), and are liable to licence conditions and possible revocation (s 12, s 13).

Members of governing bodies and authorised agents. Members of a committee or governing body of a licence‑holding society may collect if authorised by the licensee (s 6(1)(f)). Individuals authorised by licence holders may also lawfully collect (s 6(1)(g)). Where authority is granted and later revoked, the authorised person must, if the authority was in writing, return the authority and any funds, books, vouchers or other things controlled by virtue of it within seven days after notice (s 9(1)). Failure to do so is an offence punishable by a fine (s 9(2)).

Officers of bodies corporate. Section 15A applies s 39 of the Criminal Code to offences under s 15(2) and s 15(3A) (recordkeeping and compliance with Commissioner requests). That brings into play the Criminal Code mechanism whereby corporate officers may be held criminally liable for offences committed by the corporate body, subject to the defences and tests in s 39. In effect, corporate officers of collector organisations must be alert that recordkeeping and compliance failures can attract officer liability (s 15A).

The Commissioner and advisory committee. The Commissioner, as defined in the Fair Trading Act 2010, is the decision maker for licence grant, conditions, administrative revocation and the addressee of statutory reporting and disclosure powers (ss 11, 12, 15(3)). The advisory committee is a statutory body of five members appointed by the Governor on the Minister’s recommendation; it provides reports and inquiries on licence applications and revocation questions (ss 10-11, 13).

The Minister and the Governor. Executive authorities have substantive powers over funds. The Governor may make proclamations to transfer or vest funds where money is not required for the original charitable purpose or where maladministration exists (ss 16-17). The Minister receives audit reports from the Auditor General (s 20(2)) and may direct publication of those reports (s 20(3)). The Minister may delegate functions under the Act other than the delegation power itself (s 17A).

Auditor General and auditors. The Auditor General may inspect, examine, audit and investigate accounts relating to charitable moneys (s 20(1)). The Commissioner may also require collectors to have collection records audited by an auditor approved by the Commissioner (s 15(3)). The Auditor General’s powers are exercised subject to the Auditor General Act 2006 (s 20(4)).

Donors and the public. Donors are indirect stakeholders because the Act regulates how fundraising is permitted and how proceeds may be applied or recovered (s 12(4)(b)). The Act’s vesting and transfer powers mean donors’ intended application of donations could in practice be altered when funds are declared not required or where maladministration is found (ss 16-17).

Third party contractors and service providers. Parties entering contracts with licensed collectors may be affected because licence conditions may require prior Commissioner approval for contracts dealing with charitable moneys (s 12(4)). Contracts entered without required prior approval can be void and monies received under them recoverable by the Commissioner (s 12(4)(a)-(b)). That creates operational and transactional risk for suppliers, fundraising consultants, event organisers and venues.

Parliament. Section 16(3) requires a resolution of both Houses of Parliament before a proclamation under s 16 can be made. Parliament therefore participates indirectly in the process when the Executive proposes reallocation of charitable funds under s 16.

Local authorities and street‑collection regulators. Section 4 makes the Street Collections (Regulation) Act 1940 paramount where it conflicts with this Act. Entities regulated under that Act, including local authorities that licence or regulate street collections, will interact with this Act when collections are street based. Practitioners must therefore coordinate compliance with both statutes where applicable.

In practical effect, the Act imposes obligations and potential sanctions on organisers and their officers, empowers the Commissioner and advisory committee to control entry and conditions of fundraisers, and places funds at risk of transfer or vesting when administrative or trust problems are identified. The Act’s combination of criminal penalties, administrative censorship of contracting, recordkeeping and investigatory regimes, and transfer powers means that organisations engaging in fundraising must operate within a regulated perimeter or rely on being authorised by a licensed entity.

The Act establishes a set of legal duties on collectors and corresponding rights vested in administrative actors.

Key duties imposed on collectors and licensees

• Licence requirement. A person must not carry out the fundraising activities described in s 6(1) unless they are the holder of a licence under the Act, a committee member authorised by a licence holder, or authorised by a person or body which holds a licence (s 6(1)(e)-(g)). The prohibition applies to collections, sales of devices, entertainments where proceeds are represented to be for charity, and advertising for such activities (s 6(1)(a)-(d)). Contravention attracts a fine (s 6 penalty).
• Recordkeeping and retention. A collector must keep "collection records" , accounts of money and goods collected and statements of how they have been dealt with , and retain them for seven years after the end of the relevant financial year (s 15(1)-(2)). The penalty for breach of the retention duty is $5 000 (s 15(2)).
• Compliance with Commissioner requests. The Commissioner may require in writing that a collector give copies of or access to collection records, or have them audited by an auditor approved by the Commissioner; the collector must comply with such a requirement (s 15(3)-(3A)). Failure to comply attracts a $5 000 fine (s 15(3A)).
• Return of revoked authorities. When a licence holder revokes a written authority it gave, the person to whom the authority was given must within seven days after written notice produce and deliver the authority together with any moneys, books, vouchers or other things held by virtue of the authority (s 9(1)). Failure to comply is an offence with a $5 000 penalty (s 9(2)).
• Pre‑approval of contracts where imposed as a licence condition. If a licence condition requires proposed contracts dealing with charitable moneys to be submitted to the Commissioner for approval, then contracts made without such submission and approval are void and monies received under them recoverable by the Commissioner or a person authorised to sue (s 12(4)(a)-(b)).
• Cooperation with audits and investigations. The Auditor General may inspect, examine, audit and investigate accounts relating to charitable moneys and report to the Minister (s 20). Section 20A imports s 61 and Part 6 (except s 88E) of the Fair Trading Act 2010, bringing that Act’s investigative powers into play.

Key administrative rights and powers

• Discretion to licence and to impose conditions. The Commissioner has the right to grant or refuse licences after considering advisory committee reports, and may impose conditions on licences or revoke licences as an administrative act (ss 11(3), 12(2)-(3)). The advisory committee must consider whether an applicant’s objects could be more effectively or economically carried out by another licensee (s 11(2)).
• No fee for licensing. Section 14 provides that no fee shall be charged for any licence under the Act. This is a statutory right for applicants, though not a waiver of compliance costs otherwise incurred.
• Authority to approve means of authorisation. Licence holders may give authority to collect in means approved by the Commissioner, and Commissioner approvals can be revoked (s 8).
• Ministerial and Governor powers. The Governor may make proclamations to transfer moneys to other charitable purposes or to vest moneys in the Minister where moneys are not required for their original purpose (s 16). The Governor may vest funds in the Minister where a three‑quarters majority of trustees consent or where maladministration is found (s 17(1)). The Minister may delegate functions under the Act to other persons (s 17A).
• Capacity to audit and publish. The Auditor General must report the results of inspections and audits to the Minister and, at the Minister’s direction, those reports may be published (s 20(2)-(3)).
• Prosecutorial gatekeeping. No prosecution for an offence under the Act may be commenced without the written approval of the Commissioner (s 19(1)). A document purporting to be a Commissioner’s approval is admissible as proof (s 19(2)).

Other ancillary rights and duties

• Advisory committee’s role. The advisory committee may be asked by the Commissioner to inquire into whether a licence should be revoked and may recommend revocation for specified reasons such as mismanagement, inadequate charitable application relative to receipts, excessive remuneration or cessation of charitable activity (s 13(1)-(2)).
• Recovery and appropriation of void contract monies. Where contracts are void for lack of required Commissioner approval, monies recovered are to be appropriated to the charitable purpose, and the cost of recovery may be deducted (s 12(5)).
• Delegation and legal effect. Section 17A provides that performance by a delegate is treated as performance by the Minister and that a person purporting to act under delegation is taken to have acted in accordance with it unless the contrary is shown (s 17A(2)-(3)).

Several statutory mechanisms create compliance pressures. The evidentiary rule in s 6(3) shifts the burden onto the accused to establish a licence or authority when charged under s 6. Licence conditions can extend control beyond the simple grant of a licence into pre‑approval of contracts that materially affect how funds are spent (s 12(4)). Audit and investigatory powers in s 20 and s 20A enable both financial scrutiny and enforcement. Officers of corporate collectors face additional overlay of potential personal criminal liability via s 15A.

The Act sets out specific monetary penalties for statutory offences, prescribes administrative enforcement levers, and imports additional investigatory powers from the Fair Trading Act 2010 and auditing powers from the Auditor General Act 2006. It also controls prosecutorial initiation.

Monetary penalties

• Unlicensed collection and related contraventions. Section 6(1) attracts a penalty of a fine of $20 000 for anyone who collects or attempts to collect money or goods for a charitable purpose, sells devices purportedly for charity, conducts entertainments with proceeds held out as for charity, or advertises such activities without a licence or proper authorisation (s 6 penalty).
• Failure to return revoked authority and property. Section 9(2) prescribes a fine of $5 000 where a person to whom a written authority was given fails to produce and deliver the authority or any moneys, books or vouchers held by virtue of that authority after revocation (s 9(2)).
• Recordkeeping and compliance penalties. Section 15(2) provides for a $5 000 fine for failure to keep collection records and retain them for seven years. Section 15(3A) provides a $5 000 fine for failure to comply with a Commissioner’s written requirement to provide collection records or to have them audited.
• Criminal liability of officers. Section 15A applies s 39 of the Criminal Code to offences under s 15(2) and s 15(3A). That draws in provisions for officers’ criminal liability for corporate offences, subject to the defences and tests contained in the Criminal Code.

Administrative enforcement levers

• Licence revocation and conditions. The Commissioner may impose licence conditions, revoke licences administratively at any time, and require prior approval of contracts as a licence condition; breaches of such conditions can render contracts void and expose parties to recovery actions (s 12(2)-(4)).
• Advisory committee inquiries and recommendations. The advisory committee may be requested by the Commissioner to inquire into whether a licence should be revoked and may recommend revocation for causes such as mismanagement, inadequate application of funds, excessive remuneration, and cessation of charitable activity (s 13(1)-(2)). These recommendations can be the factual basis for administrative action.
• Contract voidness and recovery. Where licence conditions require prior submission and approval of contracts and those requirements are ignored, such contracts can be void (s 12(4)(a)) and monies received recoverable at the suit of the Commissioner (s 12(4)(b)). Recovered money is to be appropriated to the charitable purpose, after deduction of unrecovered costs of recovery (s 12(5)).
• Vesting and transfer of funds. Sections 16 and 17 permit the Governor, by proclamation, to direct that moneys or securities or goods collected for charitable purposes be applied to other charitable purposes or be vested in the Minister. Vesting may be based on trustee consent or maladministration (s 17(1)). Proclamations have the force of law (ss 16(2), 17(3)), and s 17(4) immunises prior trustees as to funds paid and transferred to the Minister.
• Auditor General powers. The Auditor General has express power to inspect, examine and audit accounts relating to charitable moneys and to investigate related documents and vouchers; the Auditor General must report to the Minister and may publish on the Minister’s direction (s 20(1)-(3)). Section 20(4) imports powers available under the Auditor General Act 2006. Those auditing activities can form the evidentiary and administrative basis for further enforcement measures.
• Investigatory powers via Fair Trading Act. Section 20A imports s 61 and Part 6 (except s 88E) of the Fair Trading Act 2010 for the purposes of the Charitable Collections Act. Practitioners must therefore consult those provisions to understand the full scope of investigatory powers (searches, notices, compulsory information, enforceable undertakings where relevant) that may be available in practice.

Prosecutorial gatekeeping

• Commissioner approval required. No prosecution for an offence under this Act is to be commenced without the approval in writing of the Commissioner (s 19(1)). A document purporting to be such approval is prima facie evidence of approval in court without further proof of signature (s 19(2)). This creates a centralised gatekeeper for criminal enforcement and prevents private prosecutions in the absence of Commissioner sign‑off.

Protections and limits

• Parliamentary check on proclamations under s 16. Proclamations under s 16 cannot be made until a resolution has been passed by both Houses of Parliament approving the proclamation (s 16(3)). That introduces a parliamentary check on certain executive reallocations of charitable funds.
• Delegation and legal effect. The Minister may delegate functions under the Act (s 17A), and acts of delegates are treated as acts of the Minister (s 17A(2)). A purported acting delegate is presumed valid unless the contrary is shown (s 17A(3)). This both distributes administrative workload and creates procedural presumptions about delegated acts.

Practical enforcement consequences

• Substantial fines and officer liability create incentives for strict compliance with licensing, recordkeeping and Commissioner requests.
• Commissioner control over prosecutions effectively centralises the decision whether to criminally pursue alleged offences and may shape enforcement priorities.
• Administrative tools such as licence conditions, contract pre‑approval and the power to vest funds provide the Executive with instruments to prevent or remedy misapplication of charitable donations without immediate recourse to criminal penalties.
• Audit and investigatory powers create both detection capacity and a reporting pipeline to the Minister where problems are uncovered.

Practitioners should combine an understanding of the Act’s monetary penalties with the investigatory, administrative and prosecutorial controls that the Act places in the hands of executive actors when advising collectors or structuring fundraising activities.

The Charitable Collections Act 1946 expressly interacts with a small set of other statutes and leaves room for additional regulatory overlay by regulation or local laws. The Act imports definitions and powers from other statutes and establishes primacy relationships where conflicts may arise.

Street Collections (Regulation) Act 1940 paramount. Section 4 provides an explicit supremacy rule: where the Street Collections (Regulation) Act 1940 or regulations or by‑laws made under it are repugnant or inconsistent with any provision of the Charitable Collections Act or regulations under it, the Street Collections Act provisions prevail. Practically this means that street collection activity potentially regulated by local street collection by‑laws or the Street Collections Act may be governed by that Act even if the Charitable Collections Act has different requirements. Practitioners must review the Street Collections Act and local rules in parallel when advising on public street fundraising.

Fair Trading Act 2010. Section 5 of this Act defines "Commissioner" by reference to s 6 of the Fair Trading Act 2010. Section 20A incorporates s 61 and Part 6 of the Fair Trading Act 2010 (other than s 88E) for the purposes of the Charitable Collections Act. That import is material: Part 6 of the Fair Trading Act contains investigatory powers, notice and compliance tools, and enforcement mechanisms for the Commissioner which, once imported, apply when investigating compliance with the Charitable Collections Act. Practitioners must therefore read the Fair Trading Act to understand the scope of powers the Commissioner may exercise in relation to collectors (for example, compulsory information notices or entry and inspection powers that Part 6 may provide; the text of Part 6 must be consulted).

Auditor General Act 2006. Section 20(4) makes available to the Auditor General "all or any of the powers conferred upon him with reference to the auditing of public accounts by the Auditor General Act 2006" for the purposes of auditing charitable moneys. The Auditor General’s statutory audit powers and investigatory capacities under that Act apply when exercising the audit function under s 20 of the Charitable Collections Act.

Criminal Code. Section 15A applies s 39 of the Criminal Code to offences under s 15(2) and s 15(3A). That brings the Criminal Code’s rules concerning officer liability for corporate offences into the enforcement landscape for recordkeeping offences under this Act.

Parliamentary procedure for proclamations. Section 16(3) conditions proclamations under s 16 on a prior resolution of both Houses of Parliament approving the making of the proclamation. That procedural check involves parliamentary law and practice and means that reallocation of funds under s 16 is not solely an executive administrative act; it requires parliamentary endorsement.

Regulations and subordinate law. Section 21 gives the Governor power to make regulations "not inconsistent with this Act" for carrying out the Act and "in particular" prescribes a non‑exhaustive list of matters such as the manner and times for returns, investment of moneys, banking methods, forms, and regulation of advisory committee proceedings (s 21(a)-(f)). The regulatory power allows detailed procedural rules, and regulation can therefore introduce additional obligations or clarifications that will affect compliance costs and operational choices.

Transitional and amendment links. Section 22 contains a transitional provision for the Consumer Protection Legislation Amendment Act 2019, treating existing Ministerial approvals of means of giving an authority (as defined) under s 8 as taken to be approvals by the Commissioner from the commencement day, thereby changing the approving entity from Minister to Commissioner in specified circumstances (s 22(2)). The compilation table shows that the Act has been amended multiple times and that later amendments such as those in 2019 and 2023 inserted or modified provisions that tie the Act more closely to contemporary consumer protection and directors’ liability reforms.

Local government and other regulatory regimes. While the Act itself does not directly reference local government ordinances beyond the Street Collections Act linkage, real‑world street fundraising often involves local permits, public place approvals and noise/event regulations. Section 4’s primacy clause highlights the potential for multi‑layered compliance , a fundraiser must satisfy both the Charitable Collections Act and any applicable street collection statutes or local by‑laws.

Interaction by effect rather than express mention. The Act’s operation , especially s 12(4) which can void contracts made without prior Commissioner approval when required by a licence condition , can affect commercial contracts with third parties, procurement agreements, paid fundraisers and service providers. Those contract law effects sit alongside the Act even though core contract law remains governed by general common law and statute; the Charitable Collections Act can create statutory grounds for voidness and recovery.

In short, this Act is not a free‑standing, isolated regulatory instrument. It is designed to be read and applied in conjunction with the Street Collections Act 1940, the Fair Trading Act 2010, the Auditor General Act 2006, the Criminal Code (as to officer liability), and any regulations made under s 21. Practitioners must therefore consult those instruments together and account for the procedural and investigatory powers they import when advising collectors or handling enforcement matters.

The text contains an embedded compilation table and bracketed amendment notes identifying the principal legislative changes since assent in 1947 through the present compilation. The Act has been amended repeatedly, with the most consequential recent changes importing investigatory and officers’ liability linkages. The compilation table summarises enactments, assent dates and commencement dates. Below are the material amendments and their mechanical effects as recorded in the source.

Early amendments and reprints

• Charitable Collections Act Amendment Act 1947 (No. 55 of 1947), assented 10 January 1948. This early amendment added provisions such as the audit powers now reflected in s 20 (see s 20 amended: No. 55 of 1947 s. 5-7).
• Charitable Collections Act Amendment Act 1949 (No. 2 of 1949), assented 24 August 1949. This amendment introduced s 12(4)-(5) regarding voidness of contracts made without Commissioner approval and recovery of monies (noted in s 12 amended: No. 2 of 1949 s. 3).

Mid 20th century and technical amendments

• Decimal Currency Act 1965 (No. 113 of 1965) effected technical amendments for currency conversion (s 6 amended: No. 113 of 1965 s. 8).
• Acts Amendment (Financial Administration and Audit) Act 1985 (No. 98 of 1985) amended auditing references enabling the Auditor General’s role under s 20 (s 20 amended: No. 98 of 1985 s. 3).

21st century amendments and statutory modernisation

• Statutes (Repeals and Minor Amendments) Act 2003 (No. 74 of 2003) introduced s 17A (delegation) as recorded in the text (s 17A inserted: No. 74 of 2003 s. 33).
• Courts Legislation Amendment and Repeal Act 2004 and Criminal Procedure and Appeals (Consequential and Other Provisions) Act 2004 effected timing and technical changes, reflected in compilation reprints.
• Financial Legislation Amendment and Repeal Act 2006 (No. 77 of 2006) modified the auditing references in s 20 by reference to the Auditor General Act 2006 (s 20 amended: No. 77 of 2006 Sch. 1 cl. 23).

Recent legislative changes

• Statutes (Repeals and Miscellaneous Amendments) Act 2009 (No. 8 of 2009) included various textual updates across the Act (e.g., s 6 amended: No. 8 of 2009 s. 28(2)-(3); s 13 amended: No. 8 of 2009 s. 28(4)).
• Standardisation of Formatting Act 2010 (No. 19 of 2010) made formatting and standardisation adjustments across statutes, incorporated in compilation table entries.
• Consumer Protection Legislation Amendment Act 2019 (No. 25 of 2019) included multiple substantive and technical amendments. The Act inserted s 20A to apply s 61 and Part 6 of the Fair Trading Act 2010 for investigatory purposes, amended definitions such as the Commissioner reference, altered approval mechanics for existing Ministerial approvals of authority (s 22), and amended s 15 to include collection records definitions and the Commissioner’s written powers to require records and audits (s 15 amended: No. 25 of 2019 s. 16; s 22 inserted: No. 25 of 2019 s. 20; s 5 amended: No. 25 of 2019 s. 9; s 8 amended: No. 25 of 2019 s. 11; s 9 amended: No. 25 of 2019 s. 12; s 11 amended: No. 25 of 2019 s. 13; s 12 amended: No. 25 of 2019 s. 14; s 13 amended: No. 25 of 2019 s. 15; s 19 amended: No. 25 of 2019 s. 18).
• Directors’ Liability Reform Act 2023 (No. 9 of 2023) inserted s 15A to apply Criminal Code s 39 to recordkeeping and compliance offences, thereby exposing officers of corporate collectors to liability for s 15(2) and s 15(3A) offences (s 15A inserted: No. 9 of 2023 s. 41). This came into operation on 5 April 2023.

Reprints and ongoing compilation notes

• The Act has multiple reprints (1959, 1971, 2004, 2009) consolidating amendments at those dates.
• The compilation concludes with an "Uncommenced provisions table" listing a Charitable Collections Amendment Act 2025 (No. 18 of 2025) section 3-20 that is to be proclaimed; the compilation entry notes assent on 4 December 2025 and commencement to be proclaimed (compilation table, uncommenced provisions). This indicates further amendments enacted but unproclaimed at the time of the compilation.

Mechanics of amendment as reflected in the text

• Many substantive powers and procedural duties were added progressively: auditing powers in the late 1940s and 1980s; delegation powers in 2003; investigatory powers and clearer recordkeeping duties in 2019; and officer liability in 2023. Each change shifts the compliance perimeter, moving from a licensing and prohibition model to a modern regulatory model that integrates investigatory capacity and officer accountability.
• The amendment notes bracketed in the statutory text identify which sections were amended by which Acts. Those bracketed notes are the authoritative internal history for the provision as compiled.

For practitioners, the amendment history shows recent policy emphasis on investigatory integration with consumer protection machinery and on personal accountability for corporate officers. It also highlights the need to consult the enabling and imported statutes (Fair Trading Act 2010 and Auditor General Act 2006) to see the operational scope of investigatory and audit powers now embedded into the Charitable Collections regime.

The statutory text compiled here does not cite any judicial decisions. There are no cases or reported judicial interpretations included in the Act itself. The compilation table and notes do not record litigation history. Accordingly, the source provides no authoritative case law to summarise.

That absence, however, does not mean litigation will not arise under the Act. The Act contains multiple provisions that typically give rise to litigation and judicial review in the issues that commonly attend statutory regulatory schemes. Based on the statutory text, likely categories of contest that could generate litigation include the following, each with specific statutory hooks:

• Judicial review of administrative decisions. The Commissioner has unqualified discretion to grant or refuse licences and to impose conditions and to revoke licences administratively (ss 11(3), 12(2)-(3)). That discretion , particularly in relation to refusal, the imposition of conditions such as pre‑contractual approval under s 12(4), and revocation , can be the subject of judicial review on public law grounds (procedural fairness, Wednesbury unreasonableness, jurisdictional error). The Act itself does not specify internal review mechanisms; practitioners should be alert to standard administrative law remedies.
• Enforcement and evidentiary burden challenges. Section 6(3) places the onus on the accused to prove matters of licence or authority. This evidentiary shifting could be challenged on procedural or charter grounds in appropriate jurisdictions, or become a central contested issue in prosecutions under s 6.
• Civil recovery of monies and contract validity. Section 12(4) allows contracts entered without required prior approval to be void and monies recoverable by the Commissioner. Disputes over whether a contract was subject to a licence condition, whether the condition applied to a specific contract, or whether the Commissioner’s approval was effectively given may give rise to civil litigation. Contractors and suppliers who provided services under an allegedly void contract could litigate their entitlements and the Commissioner could litigate or recover funds. Section 12(5) provides for appropriation of recovered funds and deduction of recovery costs, which may itself be litigated.
• Challenge to proclamations and vesting. Sections 16 and 17 permit the Governor, by proclamation, to transfer or vest charitable funds. Section 16(3) requires approval by resolution of both Houses before a proclamation under s 16 may be made. Litigation could arise around the validity of proclamations, the sufficiency of parliamentary approval, the existence of maladministration justifying vesting under s 17(1)(b), or alleged breaches of trust arising from executive action. Section 17(4) immunises trustees from liability after transfer to the Minister, but questions of valid transfer, trust variation, and rights of beneficiaries could lead to controversies.
• Audit and investigatory powers. Section 20 confers audit powers on the Auditor General and s 20A imports investigatory powers from the Fair Trading Act 2010. Disputes may arise over the scope of investigatory powers, procedural protections, or the admissibility of material obtained by those powers.
• Officer liability under the Criminal Code. Section 15A applies Criminal Code s 39 to recordkeeping and compliance offences. Cases testing the threshold for officer liability, the availability of defences, and the application of s 39’s tests would be expected in practice.

Because the Act delegates investigatory powers and prosecutorial control (s 19 requires Commissioner approval before prosecution), litigation arising from enforcement will often implicate the Fair Trading Act 2010, the Criminal Code, administrative law principles, and the Auditor General Act 2006. Practitioners interpreting the Act in a dispute should therefore build litigation strategy around both the Act’s text and the body of law governing administrative decision-making, evidence and criminal officer liability.

The statutory text itself does not provide case citations or litigation summaries; the follow‑up task for any practitioner is to search reported decisions and tribunal determinations post‑enactment to identify how courts and tribunals have actually interpreted the Act’s provisions on licence discretion, burden of proof, voidness of contracts, vesting of funds, and officer liability.

The Act contains a number of specific provisions and structural features that can produce inadvertent non‑compliance, contractual risk, or exposure for officers and third parties. The following are concrete "gotchas" drawn from the statutory text.

Burden of proof shifted to accused on licence/authority (s 6(3)). The prosecution need not negative licence or authority; it is for the accused to prove any licence or authorisation relied upon. Practically, individuals who rely on an oral or informal authority from a licence holder may find it difficult to discharge this evidentiary burden in court. Written authorisations, structured recordkeeping and readily retrievable proof of licence status are essential.

High penalty for unlicensed activity (s 6 penalty). The maximum fine for contraventions of s 6(1) is $20 000, a significant sanction for individuals and small volunteer groups. The breadth of s 6 , covering attempts to collect, sale of devices, conduct of entertainments where proceeds are held out as for charity, and advertising , means many routine fundraising activities can trigger statutory liability if unlicensed or unauthorised.

Licence condition can void contracts (s 12(4)). A licence may include a condition requiring that proposed contracts or arrangements be submitted to and approved by the Commissioner; contracts made without submission and approval are void and money received under them recoverable by the Commissioner (s 12(4)(a)-(b)). Third parties contracting with collectors must verify whether such a licence condition exists before entering agreements that involve charitable monies (for example, agreements with professional fundraisers, event managers, printers or suppliers). Failure to confirm can expose suppliers to non‑payment disputes and expose collectors to recovery actions.

Strict recordkeeping and compliance obligations with criminal officer liability overlay (s 15; s 15A). Collectors must keep collection records and retain them for seven years (s 15(2)). The Commissioner can require audited records and access (s 15(3)-(3A)). The penalty for failing to keep records or comply is $5 000. Section 15A applies Criminal Code s 39 to offences under s 15(2) and s 15(3A), thereby creating potential criminal liability for officers of corporate collectors. Corporate officers must therefore ensure compliance systems, delegations, and oversight to avoid personal exposure.

Commissioner approval required before prosecution (s 19). No prosecution can proceed without written approval of the Commissioner. While this centralises prosecutorial control, it also means complainants cannot themselves initiate prosecutions without the Commissioner’s sign‑off. In practice, this can slow or deter enforcement in some cases and can concentrate discretion in the Commissioner’s office.

Vesting and transfer powers can alter donor intent (ss 16-17). The Governor may proclaim that moneys not required for their original charitable purpose be applied to other charitable purposes or vested in the Minister; vesting can occur where a three‑quarters majority of trustees consents or where maladministration is found (ss 16(1), 17(1)). Practitioners should note that donor designations can be displaced by proclamation under the Act when statutory triggers are met. Section 16 requires parliamentary approval for proclamations under that section (s 16(3)), but the political and administrative reality of such actions can produce outcomes that depart from donors’ expectations.

Auditor General and Fair Trading investigatory powers (s 20; s 20A). Section 20 grants broad audit powers to the Auditor General and section 20A imports Fair Trading Act investigatory capacity. Those powers can lead to compelled disclosure, inspections and other regulatory intrusions; collectors should prepare for compliance with formal notices and audits and avoid ad hoc or informal record systems.

Return of revoked authorities strictly framed (s 9). Where a licence holder revokes a written authority, the former authorised person must within seven days deliver the written authority and any moneys, books or vouchers held under it (s 9(1)). Failure carries a $5 000 fine (s 9(2)). Volunteers and casual fundraisers must be advised of this requirement and given processes for prompt handover to avoid criminal exposure.

No licence fee but compliance costs remain (s 14). The Act disallows licence fees (s 14) but licensing can nonetheless impose administrative costs, audit expenses and potential contractual limitations such as pre‑approval requirements. Organisations should not assume the absence of an application fee means negligible regulatory cost.

Potential conflict with street collection rules (s 4). Because the Street Collections (Regulation) Act 1940 is paramount in case of inconsistency (s 4), some activities regulated under local street collection regimes may be governed by that Act rather than by this one. Practitioners must coordinate compliance with both Acts where public street fundraising is contemplated.

Prosecution documentation admissibility presumption (s 19(2)). A document purporting to state Commissioner approval for prosecution is, unless contradicted, sufficient proof in court without further authentication (s 19(2)). This evidentiary presumption simplifies the Crown’s presentation of approval, and defence strategies should plan accordingly.

Transitional confusion over approvals (s 22). Section 22 converts pre‑commencement Minister approvals of means of giving an authority to Commissioner approvals on commencement day of the Consumer Protection Legislation Amendment Act 2019. Practitioners should verify whether historical Ministerial approvals remain effective and whether administrative records have been updated to reflect the Commissioner as the approving officer.

Uncommenced amendments. The compilation table records a Charitable Collections Amendment Act 2025 sections 3-20 uncommenced at the time of compilation. Organisations should monitor proclamation status of any uncommenced changes to evaluate new compliance obligations.

These concrete statutory features create multiple operational risk points. Practical mitigation requires written authorisations, robust record systems, due diligence on licence conditions, pre‑contracting checks, officer training on personal liability risks, and prompt responsiveness to Commissioner and Auditor General requests.

Compliance under the Charitable Collections Act requires addressing licensing, recordkeeping, contractual processes, auditing readiness, delegation and officer accountability. Below is a structured operational checklist aligned to statutory obligations and practical steps grounded in the text.

Pre‑activity: determine whether activity falls within the Act. Confirm that the planned activity (collecting money or goods, selling discs/badges/tokens/flowers, conducting chargeable entertainments where proceeds are represented as charitable, or advertising such fundraising) falls within s 6(1). Remember s 6(4) captures activities that are partly charitable as well as wholly charitable. If the activity is a street collection, check the Street Collections (Regulation) Act 1940 because that Act is paramount in case of inconsistency (s 4).

Licence application and authorisation. If the activity triggers s 6, obtain a licence from the Commissioner. Submit an application to the Commissioner and be prepared for referral to the advisory committee for consideration and report (s 11(1)). The advisory committee will consider whether the applicant’s objects might be more effectively or economically carried out by another licence holder or applicant (s 11(2)); prepare documentation demonstrating the organisation’s efficiency and effectiveness. Maintain written records of any authorisations granted by a licence holder to individuals and ensure written authorities are retrievable (s 8, s 9(1)).

Understand and manage licence conditions. Expect the Commissioner to impose licence conditions under s 12(2). If a licence condition requires prior submission and approval of contracts dealing with charitable moneys, procure Commissioner approval before entering such contracts. Contracts made without required prior approval can be void and monies recoverable by the Commissioner (s 12(4)(a)-(b)). Implement a pre‑contract approval checklist and a clearance process to avoid inadvertent voidness.

Recordkeeping and retention. Maintain comprehensive collection records as defined in s 15(1): accounts showing money and goods collected and statements showing how those funds and goods were dealt with. Retain those records for seven years after the end of the relevant financial year (s 15(2)). Put in place secure storage, version control, and a records management policy to ensure timely retrieval.

Responding to Commissioner requests and audits. The Commissioner may require in writing that a collector provide copies of or access to collection records, or have the records audited by an auditor approved by the Commissioner (s 15(3)). A collector must comply with such written requirements (s 15(3A)) and non‑compliance attracts a $5 000 fine. Establish a process for rapid response to written demands from the Commissioner, maintain a list of auditors acceptable to the Commissioner where possible, and keep audit‑ready financial statements and supporting documents.

Prepare for Auditor General inspection. The Auditor General may inspect, examine and audit accounts relating to charitable moneys and report to the Minister (s 20(1)-(2)). Maintain file systems to support such inspections, including vouchers, receipts and banking records. Expect that audit reports may be sent to the Minister and, if the Minister so directs, published (s 20(3)).

Governance and officer practices. Given s 15A applies the Criminal Code’s officer liability rules to recordkeeping offences, ensure corporate officers and governing body members receive compliance training, have clear delegations of authority, and receive regular financial reports. Implement internal controls on funds handling, segregation of duties, authorisation protocols for disbursements, and periodic independent reviews.

Returning revoked authorities. If operating under an authority given by a licence holder, ensure that any written authority contains clear terms about revocation and return procedures. When a licence holder revokes written authority, donors and authorised collectors must return the authority documents and any controlled moneys or records within seven days of written notice (s 9(1)). Implement immediate handover protocols for such events.

Contracts with third parties. Vendors, fundraisers and other service providers should include contractual warranties and representations about the licenced status of the client collector. Require the collector to confirm in writing that no licence condition requiring prior Commissioner approval applies, or obtain evidence of Commissioner approval before commencing work that would be paid from charitable funds. Where payments are to be taken from collections, ensure that escrow or trust accounts and clear accounting lines are used to separate charitable moneys from other funds.

Communications and advertising. When advertising an event as contributing proceeds to charity, verify licence status and authority. The prohibition in s 6 extends to advertising and representation that proceeds will be applied to a charitable purpose. Ensure marketing materials accurately reflect the proportion of proceeds intended for charity and that any disclaimers are consistent with licence conditions.

Dealing with vesting and transfer risks. Be aware that where the Executive is satisfied moneys are not required for their original purpose, the Governor can direct application to other charitable purposes or vestment in the Minister (s 16). Where trustees consent or maladministration is found, the Governor may vest funds in the Minister (s 17). Maintain trustee oversight and respond promptly to any Auditor General audit findings to avoid maladministration findings.

Interacting with other regulatory regimes. For street collections, obtain any required permits or approvals under the Street Collections (Regulation) Act 1940, noting its primacy where inconsistent with this Act (s 4). For investigatory procedures, be prepared for Fair Trading Act investigatory powers to be applied via s 20A; consult s 61 and Part 6 of the Fair Trading Act 2010 to understand notice and compliance obligations.

Prosecution and complaints handling. Because prosecutions cannot be commenced without the Commissioner’s written approval (s 19(1)), develop a complaints handling protocol for donors and the public that can be escalated to the Commissioner when required. Keep records of complaints, resolutions and remedial measures to demonstrate good regulatory citizenship.

Documentation checklist (operational)

• Licence application and current licence copies.
• Written authorities granted to collectors; template and signed copies.
• Full set of collection records: daily tallies, receipt books, bank deposits, reconciliation statements, disbursement vouchers.
• Policies: funds handling, delegation of authority, conflict of interest, remuneration/salaries, procurement and contracting.
• Records retention policy aligned to seven year statutory requirement.
• Auditor contacts and audit readiness pack.
• Revocation and handover procedure for authorised collectors.
• Pre‑contract approval checklist to detect licence conditions requiring Commissioner approval.
• Training materials and signed officer acknowledgement re recordkeeping and compliance obligations.

Periodic compliance actions

• Quarterly reconciliation and reporting to the governing body.
• Annual checklist confirming accounts available for audit and retention of prior seven years of records.
• Annual review of licence conditions and confirmation of whether any licence condition requires prior Commissioner approval.
• Periodic legal review of contracts to ensure no inadvertent voidness risk.

By aligning operational controls, recordkeeping, governance systems and contract practices with the specific statutes cited above (notably ss 6, 9, 11-12, 15, 20, 20A), organisations and their officers can materially reduce the risk of statutory non‑compliance, seizure or recovery of funds, and personal liability.
