70H Holders may prohibit works with no works notices

(1) The holder of an interment right may, by written notice to the cemetery operator, prohibit works referred to in section 70D in relation to the interment site.

(2) A cemetery operator must, as soon as reasonably practicable after receiving the notice, make a record of the notice on the cemetery operator’s register.

Maximum civil penalty— $2,200.
