Cat (Uniform Local Provisions) Regulations 2013

The regulations define a small set of terms and concepts that determine rights, duties and defences. These are concentrated in regulation 4 (definitions), regulation 5 (counting rule), regulation 6 (offence and defences), regulation 7 (enhanced allowance for organisation members), and regulations 8-11 (application, grant, conditions, duration and review of approvals). Key legal concepts and how the regulations treat them are:

• Prescribed premises: premises subject to a local law limiting the number of cats. The definition in regulation 4(1) ties the concept to whatever local law applies to the premises. Regulation 4(2) explicitly incorporates local laws made under the Local Government Act 1995 that are saved by the transitional provision in regulation 12(2) and treats them as though made under the Cat Act for these regulations.

• Standard number of cats: the baseline cap against which compliance is measured. The definition in regulation 4(1) is conditional:

  • If no member of a cat organisation is ordinarily resident at the premises, the standard number equals the number permitted under the local law that applies to the premises (regulation 4(1)(a)).
  • If a member of a cat organisation is ordinarily resident, the standard number is the number referred to in regulation 7 (regulation 4(1)(b)).
  • Regulation 7 then specifies that, where a member of a cat organisation is ordinarily resident, the permitted number is three times the number that could be kept under the local law.

• Counting rule for age: cats under six months of age are excluded when calculating the number of cats “ordinarily kept” at prescribed premises (regulation 5). The statutory headcount therefore omits juveniles below six months from enforcement calculations.

• Offence and punishments: a person ordinarily resident at prescribed premises must ensure the number of cats ordinarily kept is not more than the standard number (regulation 6(1)). The maximum penalty listed in the regulation text is a fine of $5,000. The regulation creates a statutory defence where an approval authorising an additional number is in effect and the total does not exceed the sum of the standard number and the approved additional number (regulation 6(2)). Premises operated by specified organisations (referenced to the Cat Regulations 2012 regulation 9) are excluded from the application of regulation 6(1) (regulation 6(3)).

• Administrative approvals for additional cats: an applicant ordinarily resident at prescribed premises may apply to the local government for approval to keep an additional number (regulation 8(1)). Forms and manner are set by the local government chief executive officer (regulation 8(2)). The local government may require supporting documents or verification by statutory declaration within a 21‑day window (regulation 8(3)), and may refuse to consider late or incomplete applications (regulation 8(4)). On receiving an application the local government must either grant, refuse, or grant fewer additional cats than sought (regulation 9(1)). The decision to grant is conditioned on the local government being satisfied the premises are suitable for the additional number (regulation 9(2)), and any approval may be subject to conditions specified in the approval that the local government reasonably considers necessary (regulation 9(3)). Approval duration is as specified in the approval (regulation 10). Applicants have a statutory right to apply for review by the State Administrative Tribunal of specified adverse decisions (regulation 11).

• Infringement pathway and prescribed forms: regulation 13(1) makes the offence under regulation 6(1) a “prescribed offence” for the purposes of section 62(1) of the Act and sets the modified (infringement) penalty at $200. The regulation cross‑references the Cat Regulations 2012 Schedule 1 Forms 6 and 7 for infringement notices and their withdrawal, and regulation 14 cross‑references Form 8 for objections.

These concepts create an enforcement triangle: defined counting and caps; an offence with a civil infringement pathway; and an administrative approval process with procedural safeguards (documentary requirements, review rights). The cross‑references to the Cat Regulations 2012 and to pre‑existing local laws are central; the regulations do not themselves define the membership criteria for a “member of a cat organisation” nor the excluded organisations under Cat Regulations 2012 regulation 9, so the substantive consequences of those labels rest on the separate instrument.

Primary persons and bodies affected by the regulations are:

• Persons ordinarily resident at prescribed premises. The duty not to exceed the standard number of cats is imposed on “a person who is ordinarily resident at prescribed premises” (regulation 6(1)). That phrasing focuses legal responsibility on residents rather than, for example, owners who do not live at the premises.

• Local governments and their chief executive officers. Local governments must receive, determine and decide applications for approvals to keep additional cats (regulations 8-9). The chief executive officer of a local government sets the manner and form of applications (regulation 8(2)). Local governments also issue infringement notices for the prescribed offence under section 62(1) (as made a prescribed offence by regulation 13(1)), and they have discretion to require supporting documents and statutory declarations (regulation 8(3)).

• Applicants who seek to keep more cats than the standard number. These persons must comply with procedural requirements (form and manner determined by the CEO, document production within 21 days, possible statutory declaration) and may be subject to conditions on any approval granted (regulations 8-10). Applicants also have a right to seek review by the State Administrative Tribunal against specified decisions (regulation 11).

• Members of “cat organisations”. The regulations distinguish households where a “member of a cat organisation” is ordinarily resident (regulation 4(1)(b)). Where that is so, regulation 7 increases the number of cats that may be kept to three times the number permitted under the applicable local law. The regulations therefore affect people who qualify as members of such organisations by changing the numerical cap that applies at their premises. The regulations do not define the content of membership; they cross‑refer to the Cat Regulations 2012 (regulation 4(1)).

• Operators of premises run by certain organisations referenced in the Cat Regulations 2012 regulation 9. Premises operated by those organisations are explicitly excluded from application of the offence in regulation 6(1) (regulation 6(3)), so operators of those organisations’ premises are affected by that exclusion.

• Owners who take up residence. The transitional provisions treat circumstances where premises become prescribed premises or where an owner of cats takes up residence as “triggering events” and provide a statutory defence in narrow circumstances for cats already present at the premises (regulation 12(3)-(4)). Thus owners who move into premises that become prescribed premises are directly affected by those transitional rules.

Secondary bodies and sectors indirectly affected include veterinary practices, boarding kennels/catteries, animal welfare and rescue organisations, and local cat organisations. The regulations alter the number of cats that may lawfully be kept at a premises and so bear on demand for veterinary and pet services, boarding and rehoming services, and on rules for organisations that certify or represent “members of cat organisations” (though the regulations do not set any fees or veterinary requirements themselves).

Who bears costs and who makes decisions

• Residents/owners: bear compliance costs (application preparation, gathering documents, potential conditions on premises), risk the $5,000 court fine or $200 infringement, and can pursue a review in the State Administrative Tribunal (regulations 6, 8-11, 13).
• Local government: must administer applications, apply suitability standards, set forms and procedures via the CEO, issue infringements, and supervise compliance (regulations 8-9, 13).
• State Administrative Tribunal: adjudicates reviews brought by applicants under regulation 11.

The regulations therefore distribute administrative work to local governments, leave enforcement options available to those governments, and confer specific procedural rights on applicants.

Duties

• Duty not to exceed the standard number of cats. A person ordinarily resident at prescribed premises must ensure the number of cats ordinarily kept at the premises does not exceed the “standard number of cats” for the premises (regulation 6(1)). The standard number is determined by the local law that applies to the premises or, where applicable, by regulation 7 (regulation 4(1)).

• Duty to comply with local government application requirements. An applicant must submit an application in the manner and form determined by the local government chief executive officer (regulation 8(2)), and must provide any documents or information the local government requires within a specified time not exceeding 21 days, including verification by statutory declaration if required (regulation 8(3)). Failure to comply permits the local government to refuse to consider the application (regulation 8(4)).

• Duty on local governments to decide applications. On receiving an application the local government must either grant or refuse approval, or grant approval for fewer additional cats than applied for (regulation 9(1)). A local government may not grant approval unless it is satisfied that the premises are suitable for the additional cats (regulation 9(2)). Any approval may contain specified conditions reasonably considered necessary to ensure suitability (regulation 9(3)).

• Duty to specify duration. Approvals must specify their duration; the approval has effect for that specified period (regulation 10).

Rights

• Right to apply for approval to keep additional cats. Persons ordinarily resident at prescribed premises may apply to their local government for approval for an additional number of cats (regulation 8(1)).

• Right to be informed of application process. The manner and form for applications is to be determined by the chief executive officer of the local government, creating an administrative duty to provide a process (regulation 8(2)).

• Right to have an application considered unless compliance failure. Local government may refuse to consider applications that do not satisfy documentary requirements within the specified time (regulation 8(4)); otherwise an applicant is entitled to a decision (regulation 9(1)).

• Right to conditions only if reasonably necessary and specified. Approval conditions must be those the local government reasonably considers necessary to ensure suitability and must be specified in the approval (regulation 9(3)).

• Right to review by the State Administrative Tribunal. Applicants may apply to the State Administrative Tribunal for review of local government decisions to refuse approval, to grant approval for fewer cats than applied for, or to grant approval subject to conditions (regulation 11). That is a statutory right of merits review for applicants.

• Statutory defences to the offence. There are two separate defences:

  • Where an approval authorising the additional number is in effect and the total number is less than or equal to the standard number plus approved additional number (regulation 6(2)).
  • Transitional defence for premises affected by triggering events: for each cat present at the time of the offence, either the cat was kept at the premises immediately before the triggering event, or the cat’s owner at the time of the offence was the owner immediately before the triggering event (regulation 12(4)). The regulation defines triggering events (regulation 12(3)).

Enforcement pathway and penalties

• Criminal penalty for contravention. The maximum penalty on conviction for contravening regulation 6(1) is a fine of $5,000 as stated in the regulation text (regulation 6(1)). The regulations also create an infringement pathway: the offence is a “prescribed offence” under section 62(1) of the Act and carries a modified penalty of $200 if dealt with by infringement notice (regulation 13(1)). The prescribed forms for the notice, withdrawal and objections are provided in the Cat Regulations 2012 Schedule 1 (regulations 13-14).

Other procedural rights and limitations

• Local government may impose documentary and verification requirements, including statutory declarations (regulation 8(3)); failure to meet those requirements within the specified time allows local government to refuse to consider the application (regulation 8(4)).

• The regulations do not provide a right of review for third parties or neighbours to challenge a local government grant of approval; review rights explicitly attach to the applicant (regulation 11).

• Premises operated by certain organisations referenced to the Cat Regulations 2012 regulation 9 are excluded from the operation of the offence (regulation 6(3)), which alters rights and duties for those operators.

These duties and rights create a process-based compliance regime: count animals using the age rule (regulation 5), consult the relevant local law for the baseline number, join or verify membership of a “cat organisation” only if necessary to invoke the higher standard (regulations 4 and 7), and if exceeding the standard, apply to local government under the specified administrative process (regulations 8-10) and retain approvals as statutory defences (regulation 6(2)).

The regulations provide two enforcement pathways and set the applicable sanctions and forms.

Offence and maximum penalty

• The substantive criminal offence is in regulation 6(1): a person ordinarily resident at prescribed premises must ensure the number of cats ordinarily kept at the premises is not more than the standard number of cats for the premises. The regulation sets a penalty on conviction of a fine of $5,000.

Infringement notice and modified penalty

• Regulation 13(1) makes the offence under regulation 6(1) a “prescribed offence” for the purposes of section 62(1) of the Cat Act 2011 and sets the modified penalty (the infringement amount) at $200. The regulation therefore creates an option to deal with breaches by way of infringement notice rather than court prosecution, subject to the procedures in the Act. The prescribed form for an infringement notice is Form 6 in the Cat Regulations 2012 Schedule 1, and the form of withdrawal is Form 7 (regulation 13(2)-(3)).

Procedural mechanisms available to alleged offenders

• Objection form. If an infringement notice is issued, the prescribed form of an objection is Form 8 in the Cat Regulations 2012 Schedule 1 (regulation 14). The regulations do not specify objection time frames; those will be governed by the infringement notice regime in the Act and the forms cross‑referenced.

Defences can be raised in court or relied upon administratively

• Approval defence. Regulation 6(2) is a statutory defence to a charge under regulation 6(1): the defendant must prove that an approval for an additional number of cats is in effect for the premises and that the total number of cats is less than or equal to the standard number plus the additional number specified in the approval. The defence therefore shifts evidentiary focus to the existence and terms of any approval.

• Transitional defence. Regulation 12(3)-(4) provides a limited transitional defence where a triggering event has occurred (premises becoming prescribed premises, or an owner of cats taking up residence) and the cats were present or the owner owned them immediately before the triggering event. If each cat satisfies that test, the defendant has a defence to a charge under regulation 6(1).

Decision‑maker and review

• Local governments. Local governments decide applications and manage enforcement actions (regulations 8-9, 13). The chief executive officer determines form and manner for applications (regulation 8(2)), and local governments can require documentary evidence and statutory declarations (regulation 8(3)).

• State Administrative Tribunal. Applicants who have a decision to refuse approval, grant fewer cats than applied for, or grant subject to conditions may apply to the State Administrative Tribunal for review (regulation 11). The regulations therefore protect applicants’ access to merits review for those specified decisions, but they do not create a general third‑party review route.

Enforcement discretion and forms

• Discretion to issue an infringement notice rests with enforcement officers acting under the Act and local government powers. The instrument standardises the modified penalty and the required forms, but it does not prescribe enforcement priorities or internal prosecution policies; those remain for local governments and enforcement agencies under the Act and local practice. The forms required for notices, withdrawals and objections are in the Cat Regulations 2012 Schedule 1 (regulations 13-14), so practical compliance with enforcement procedures requires accessing that separate instrument.

Interaction between infringement and court paths

• Because the offence is both a prescribed offence for infringement and a court offence with a higher penalty, local governments have the option to pursue the infringement route (a $200 fine) or, presumably under the Act’s enforcement framework, escalate to prosecution in circumstances where they consider it warranted. The regulations themselves do not set criteria for that prosecutorial discretion.

Information burden on enforcement

• The statutory defences place importance on documentary evidence: approvals must exist and be verifiable, and transitional defences require proof of presence/ownership before triggering events. Enforcement officers and local governments will therefore need to manage records, approvals and evidence when issuing infringement notices or initiating prosecutions.

In short, the regulations create a two-tiered enforcement architecture: an accessible administrative infringement pathway with a modest monetary penalty and a retained criminal penalty on conviction for more serious enforcement, with statutory defences hinging on administrative approvals and narrow transitional protections. The forms and procedural links to the Cat Regulations 2012 are integral to operating that enforcement architecture in practice.

These regulations are expressly designed to function alongside and as local laws under the Cat Act 2011 and to operate in tandem with pre‑existing local laws made under the Local Government Act 1995 and the Cat Regulations 2012. The instrument cross‑references and imports aspects of those instruments in multiple ways.

Relationship with the Cat Act 2011

• Operation as local laws. Regulation 3 expressly states that under section 77 of the Act these regulations apply as if they were local laws made by each local government. This ties the regulations into the enforcement and local government powers framework established by the Act and creates legal effect equivalent to a local law for each local government.

• Prescribed offence and infringement mechanism. Regulation 13(1) refers to section 62(1) of the Act in making the offence under regulation 6(1) a prescribed offence and setting a modified penalty. The infringement notice regime and any time limits, objection processes and enforcement steps associated with infringement notices will be governed by the Act as amplified by the forms specified by these regulations and the Cat Regulations 2012.

Relationship with local laws (including those made under the Local Government Act 1995)

• Standard number set by local law. The “standard number of cats” is, in most cases, the number permitted by the applicable local law (regulation 4(1)(a)). The instrument therefore presupposes the existence of local laws fixing baseline caps and defers to them for that baseline figure.

• Transitional preservation of pre‑existing local laws. Regulation 12(2) preserves local laws made under the Local Government Act 1995 that limit cat numbers and are in effect immediately before commencement day, treating them for the purposes of these regulations as if made under the Cat Act. This avoids gap or conflict where local governments had previously regulated cat numbers under the Local Government Act 1995.

• Triggering events connected to local law effect. Regulation 12(5) specifies that if a local law limiting cat numbers applied to premises before commencement day, the premises become prescribed premises on commencement day. The transitional provisions therefore connect the scope of these regulations to the prior local law state.

Relationship with the Cat Regulations 2012

• Cross‑referenced definitions and mandatory forms. Several definitions and procedural forms are imported from the Cat Regulations 2012:
  • The meaning of “member of a cat organisation” is taken from the Cat Regulations 2012 regulation 23(c) (regulation 4(1)).
  • The exclusion in regulation 6(3) references an organisation referred to in the Cat Regulations 2012 regulation 9.
  • The forms for infringement notice, withdrawal and objection are specified as Forms 6, 7 and 8 in the Cat Regulations 2012 Schedule 1 (regulations 13-14). This means that the legal effect of “membership”, the identity of the excluded organisations, and the practical forms and timetables for objections and withdrawals are determined by the Cat Regulations 2012 and its Schedule 1 forms, not by the text of these regulations.

Administrative law overlay and review rights

• State Administrative Tribunal review. Regulation 11 grants applicants the right to apply to the State Administrative Tribunal for a review of certain local government decisions (refusal, grant of fewer cats, or grant subject to conditions). The Tribunal’s powers and the procedure for review are contained in the State Administrative Tribunal Act and related practice directions, which will determine the nature and scope of merits review.

Scope limits and gaps

• No self-contained membership rules. Because the effect of being a “member of a cat organisation” materially alters the standard number of cats (regulation 7), the cross‑reference to the Cat Regulations 2012 means that the full legal picture requires consulting that instrument to see how membership is established and proven.

• Enforcement and procedural detail outside the instrument. The infringement process, objection timelines, and other procedural points are governed by the Cat Act 2011 and the Cat Regulations 2012 forms, so operationalising these regulations requires reading them in combination.

In essence, these regulations do not create an entirely self‑contained regime; they integrate and depend on both the Cat Act 2011 and the Cat Regulations 2012, and they preserve and import aspects of local laws previously made under the Local Government Act 1995. Effective compliance or enforcement therefore requires cross‑referencing those instruments: to determine baseline cap numbers, to verify organisational membership and exclusions, and to use the prescribed forms and processes for infringement and objections.

The regulations as compiled contain their original enactment information and no subsequent amendments are recorded in the text provided. The compilation table at the end of the instrument records the making and commencement details:

• Citation and making: Cat (Uniform Local Provisions) Regulations 2013 were published in the Western Australian Government Gazette on 31 October 2013, pages 4879-4888 (compilation table).

• Commencement: Regulations 1 and 2 (the citation and commencement provisions) commenced on 31 October 2013 (the day of Gazettal) (regulation 2(a) and compilation table). The remainder of the regulations came into operation on the following day, 1 November 2013 (regulation 2(b) and compilation table).

• Transitional saving for local laws: regulation 12(2) preserves local laws made under the Local Government Act 1995 that limit cat numbers and were in effect immediately before commencement day by treating them as if they were local laws made under the Cat Act for the purposes of these regulations. That is a built‑in transitional arrangement rather than an amendment.

No subsequent changes, repeal provisions or amendment dates appear in the text provided. The “Notes” and “Compilation table” at the end record only the original Gazettal and commencement data. If a practitioner needs to confirm whether these regulations have been amended since their original Gazettal, the instrument as supplied does not show amendments; the practitioner should check the official Western Australian consolidated legislation database and subsequent Gazettes for any amendments post‑2013. The regulations’ substantive cross‑references to the Cat Regulations 2012 mean that later amendments to the Cat Regulations 2012 or to relevant local laws may alter how these regulations operate in practice, but such changes would appear in the respective instruments rather than in the text of these regulations as provided.

The regulations do not contain any annotated case law or litigation references. The instrument itself names no judicial decisions, and there is no litigation history recorded within the text of the regulations or the attached compilation notes provided here.

Consequently:

• No reported cases are cited in these regulations.
• No interpretive decisions or judicial expositions of these specific regulations are contained in the instrument.

Practitioners seeking litigation history must therefore search external sources:

• Court and tribunal databases for decisions interpreting regulation 6 (offence) or the defence provisions in regulation 6(2) and regulation 12(4).
• Decisions of the State Administrative Tribunal for appeals under regulation 11, since regulation 11 creates a right to apply to the SAT for review of certain local government decisions; SAT decisions may provide practical guidance about what it means for premises to be “suitable” for additional cats, what conditions are “reasonably considered necessary”, and how local governments should exercise documentary and suitability assessments under regulations 8-9.
• Local court and magistrates’ court records for prosecutions under regulation 6(1), if any, to see how courts have applied the “ordinary resident” concept or treated the counting rule excluding cats under six months (regulation 5).

Because the regulations themselves do not record litigation, a search of the published decisions databases (State Administrative Tribunal decisions, Magistrates Court and higher courts) and legal reporting services is required to assemble litigation history and to identify any precedents on interpretation or enforcement. The absence of recorded cases in the instrument should not be taken as evidence that none exist; it only means none are reported within the text here.

The regulations are compact but contain several technical features and cross‑references that can produce traps for the unwary. Practitioners and compliance officers should watch for these concrete points when advising clients or designing local government procedures.

1. “Ordinarily resident” vs “owner”. Liability under the main offence (regulation 6(1)) falls on a person who is “ordinarily resident at prescribed premises”, not necessarily the legal owner. That distinction matters when ownership and residence are split (for example, landlords, absentee owners or people who board cats at premises but do not live there). The regulations impose the primary compliance duty on residents; ownership per se is relevant for the transitional defence in regulation 12(4) but not the basic duty in regulation 6(1).

2. Kittens under six months excluded from the headcount. Regulation 5 instructs that cats under 6 months of age are not to be included when calculating the number of cats ordinarily kept. This creates a precise temporal exclusion: a kitten less than six months old does not count, but once it passes six months it must be included. Practically, this requires record‑keeping (dates of birth or documented estimates) and raises the possibility of temporary headcount increases that later become relevant; businesses or households that breed or foster litters need to monitor ages carefully.

3. Membership of a “cat organisation” drastically changes the cap. The definition of “standard number of cats” refers to whether a “member of a cat organisation” is ordinarily resident (regulation 4(1)(b)). If so, regulation 7 increases the permissible number to three times the number that could otherwise be kept under the local law. The instrument does not explain how membership is evidenced; the definition points to the Cat Regulations 2012 regulation 23(c). Therefore, the legal effect of membership depends on another regulation and requires verifying the Cat Regulations 2012 for the criteria. Practitioners must not assume membership is informal; it may require documentary proof under the Cat Regulations 2012.

4. Cross‑referenced exclusions and forms. Regulation 6(3) excludes premises operated by an organisation referred to in Cat Regulations 2012 regulation 9 from the offence. The identity and qualifying criteria for that organisation are in the other instrument. Similarly, regulation 13 and 14 rely on Forms 6-8 in the Cat Regulations 2012 Schedule 1. To follow enforcement procedures correctly one must consult the Cat Regulations 2012.

5. The local government CEO sets the form and manner for applications. Regulation 8(2) gives the chief executive officer discretion to determine the application form and manner. That means that although the regulations create a statutory right to apply for approval, the applicant’s failure to use the CEO’s prescribed form or manner can justify refusal to consider the application (regulation 8(4)). Practically, applicants must obtain the local government’s published application procedure and form.

6. Local government can require documentary proof and statutory declarations with tight timeframes. Regulation 8(3) allows a local government to require documents or information to be provided in a specified time not exceeding 21 days and to require verification by statutory declaration. Regulation 8(4) allows refusal to consider non‑compliant applications. This generates a strict evidence regime and a short compliance window that can be decisive.

7. Approval conditions must be “reasonably considered necessary” but are otherwise open‑ended. Regulation 9(3) authorises conditions that the local government reasonably considers necessary to ensure suitability and requires those conditions to be specified. The legal standard of “reasonableness” will be the test for challenge, but in practice this grants local governments wide scope to attach conditions addressing hygiene, enclosure standards, noise, waste management, or other premises suitability matters. Applicants should expect conditions and negotiate or review them, including via SAT review if appropriate (regulation 11).

8. The approval duration is set by the approval itself. Regulation 10 leaves it to the approval to specify its effective period. Approvals could be time‑limited (creating renewal requirements), which imposes ongoing administrative burdens on the holder.

9. Two enforcement pathways with very different financial effects. The maximum court sanction is $5,000 (regulation 6(1)) but the infringement notice offers a $200 modified penalty (regulation 13(1)). Local governments can choose which pathway to employ in particular cases, which affects the practical penalty exposure for residents and the strategic approach for enforcement. The instrument does not prescribe escalation criteria.

10. Transitional defence is narrow and fact‑specific. Regulation 12(3)-(4) provides a defence where a triggering event occurs and each cat meets a strict test: either the cat was kept at the premises immediately before the triggering event or the owner at the time of the offence was the owner immediately before the triggering event. This defence requires contemporaneous evidence of presence or ownership before the triggering event and will be fact‑sensitive in practice.

11. Review rights belong to applicants only. Regulation 11 grants a right to the person who applies for approval to seek a Tribunal review of refusals, grants of fewer cats, or grants with conditions. Neighbours or other third parties do not receive an express review right under these regulations and must look to other statutory avenues if they wish to challenge a decision.

12. Local laws under the Local Government Act 1995 are preserved. If a local government had previously limited cat numbers under the Local Government Act 1995, that local law has effect as if made under the Cat Act for these regulations (regulation 12(2)). Practitioners must check for such pre‑existing local laws when calculating the standard number.

Those “gotchas” show that compliance depends as much on local law content, membership proof under the Cat Regulations 2012, and local government administrative practice, as on the text of these regulations alone.

Compliance requires a combination of record‑keeping, checking local law caps, understanding membership status under the Cat Regulations 2012, following the local government’s application form and process, and, where relevant, obtaining and preserving approvals. The following practical checklist and steps are grounded in the regulations’ text.

Checklist before assessing whether an approval is required

1. Determine whether the premises are “prescribed premises”. Check whether a local law limiting the number of cats applies to the premises. If a local law under the Local Government Act 1995 limiting cats applied immediately before commencement day, regulation 12(2) treats it as a local law under the Act and the premises are prescribed from commencement day (regulation 12(2) and (5)).

2. Identify the “standard number of cats” for the premises. If no “member of a cat organisation” is ordinarily resident, the standard number equals the limit in the applicable local law (regulation 4(1)(a)). If a member of a cat organisation is ordinarily resident, the standard number is the number in regulation 7, i.e. three times the number permitted under the local law (regulations 4(1)(b) and 7). To verify membership status consult the Cat Regulations 2012 (regulation 4(1) cross‑reference).

3. Count cats excluding juveniles under six months. When calculating how many cats are “ordinarily kept” at the premises exclude any cat under six months of age (regulation 5). Maintain records of dates of birth or written estimates to show ages.

If the number exceeds the standard number 4. Apply for approval to keep an additional number of cats. Regulation 8(1) gives the right to apply. Obtain the application form and instructions from the local government chief executive officer (regulation 8(2)). Use the exact form/manner required; failure to do so may justify refusal to consider the application (regulation 8(4)).

5. Prepare documentary evidence and be ready to verify it. Local government may require supporting documents and may request verification by statutory declaration within a specified time not exceeding 21 days (regulation 8(3)). Anticipate and provide evidence regarding premises suitability (e.g. accommodation layout, hygiene measures, containment), ownership/residency, and any membership evidence if relevant.

6. Expect suitability assessment and conditions. Local government may only grant approval if satisfied the premises are suitable for the additional cats (regulation 9(2)). If an approval is granted, it may include any conditions the local government reasonably considers necessary to ensure suitability, and those conditions will be specified in the approval (regulation 9(3)). Be prepared to negotiate or comply with practical conditions (for example, enclosure size, environmental controls, waste management), and ensure the approval’s duration is noted (regulation 10).

7. Keep the approval document accessible and retain evidence. An in‑effect approval is a statutory defence under regulation 6(2) if a charge is laid. Maintain a copy of the approval and any correspondence with the local government.

If you receive an adverse decision 8. Consider State Administrative Tribunal review. If the local government refuses approval, grants fewer cats than applied for, or grants approval subject to conditions, the applicant has a right to apply to the State Administrative Tribunal for review (regulation 11). Time limits for lodging an SAT application are governed by the Tribunal’s procedures; seek legal advice early.

If enforcement action occurs 9. Respond to infringement notices and objections using prescribed forms. Infringement notices and their withdrawal are Forms 6 and 7 in the Cat Regulations 2012 Schedule 1; objections use Form 8 (regulations 13-14). Follow the objection procedure and timelines in the Act and on the prescribed form. Preserve documents proving the existence of any approval or transitional defence.

Transitional and movement scenarios 10. If moving into premises or if premises become prescribed after occupancy, check the transitional defence. Regulation 12(3)-(4) provides a defence if each cat at the time of the offence was kept at the premises immediately before the triggering event or was owned by the same owner immediately before the event. That requires contemporaneous evidence; gather bills, veterinary records, microchipping/registration evidence and dated photographs if needed.

Practical record‑keeping recommendations

• Maintain a dated register of all cats ordinarily kept, including species identifiers, dates of birth or estimates, microchip numbers, ownership information and any transfer or sale documentation.
• Keep copies of membership documents for cat organisations if relying on the enhanced allowance under regulation 7.
• Retain all approvals, application forms, correspondence and proof of delivery or receipt of documents to the local government, and any statutory declarations used as verification.

Consultation with local government and forms

• Before submitting an application, contact the local government to obtain the CEO‑determined form and to clarify documentary requirements and likely suitability criteria. That reduces the risk of an application being refused under regulation 8(4).

Enforcement risk management

• If approaching or exceeding the standard number, apply for approval promptly and do not rely on temporary non‑enforcement assumptions. The statutory defences are documentary; an in‑effect approval is the principal safe harbour (regulation 6(2)).

Finally, note procedural dependencies: the practical operation of the infringement and objection process depends on the Cat Regulations 2012 Schedule 1 forms and the Cat Act 2011 infringement rules (regulations 13-14). Practitioners should therefore read these regulations in combination with the Cat Regulations 2012 and the Cat Act 2011 when designing compliance programmes or advising clients.
