Casino Control Regulation 2006

Prescribed functions - Section 5 lists seventeen specific functions that a casino employee must be licensed to perform. These are not merely suggestive; they define the outer limits of what an unlicensed employee cannot do. Functions include the conduct of gaming, management of commission based schemes and marketing schemes, handling of cash and chips (except in food/beverage contexts), movement and storage of gaming equipment, security and surveillance, computer systems maintenance, unsupervised repair of gaming and security equipment, and unsupervised access to administrative and financial information (excluding external auditors and company directors). Importantly, the list includes supervisory roles over any of these functions and management roles where discretions can substantially affect casino operations. The breadth of the list means that almost every operational role inside a casino, from floor dealer to IT support to security guard, is caught. The Regulation does not prescribe which documents or qualifications an employee must hold; it merely defines the functions that the Act treats as requiring a licence.

Core trading hours - Section 7 defines core trading hours as between midnight and 2 a.m., and between 5 p.m. and midnight, on any day. That means there are no gambling hours from 2 a.m. to 5 p.m. - a twelve hour gap that includes most of the day. The effect is that the casino can operate only in two narrow windows: early evening (5 p.m. to midnight) and a two hour window after midnight. The Regulation does not prohibit the casino from being open and serving food or drinks outside those hours, but gambling activity must cease. This restricts the casino’s ability to generate revenue outside peak times, and may shift demand to nearby venues or online gambling.

Document of identification - Section 7A prescribes an Australia Post Keypass ID as a document of identification for purposes of the Act. The Keypass ID must include the person’s name, photo and date of birth. It may be in electronic or physical form. This is the only additional identification document prescribed by the Regulation; the Act itself lists other types such as a driver licence or passport. The practical effect is that a Keypass ID is sufficient for a casino to verify a patron’s age and identity, which is relevant for age verification and for cheque transactions. The amendment was part of a broader red tape reduction package, arguably to encourage the use of a widely available digital identity product and reduce the need for patrons to carry a passport or driver licence if they have a Keypass.

Cheque acceptance - Sections 8 and 9 govern which cheques a casino may accept and how. A cheque must be drawn in favour of the licensee or the presenter, must not be postdated, and a redeeming cheque must not be dated earlier than the most recent cheque it replaces. The licensee must be satisfied about the identity of the presenter, keep records of proof of identity and any inquiries made, and comply with control procedures as defined by the Act. The effect is to impose a systematic identity check and record keeping requirement, which carries compliance costs for the casino and potential inconvenience for patrons, but also reduces the risk of fraud and limits the casino’s exposure to dishonoured cheques.

Commission based player scheme - Section 10 prescribes $1,500 as the amount under paragraph (b) of the Act’s definition of “commission based player scheme”. The Act prohibits any scheme that pays a player a commission based on their gaming, unless the amount paid or credited is below the prescribed amount. The Regulation sets that threshold at $1,500. This is a relatively low figure; a player who gambles heavily and receives commissions of $1,500 or more would be participating in an unlawful scheme. The effect is to restrict the casino’s ability to offer loyalty programs or cashback arrangements that exceed that amount, potentially reducing player incentives to gamble large sums.

Designation of casino - Sections 6 and Schedule 1 define the physical area of the casino by reference to floor plans. The areas outlined in bold on the plans (first floor, ground floor and basement) are designated as the casino. Gambling is only lawful within those boundaries. The designation is tied to a specific building and cannot be moved or extended without amending the Regulation.

The Regulation primarily affects the casino licensee (the entity holding the casino licence under the Act) and its employees. The licensee must ensure that only employees licensed to perform prescribed functions actually do so, must operate only in the designated area, must keep to core trading hours, must accept only prescribed cheques and follow the identity verification and record keeping procedures, must not operate commission based player schemes that exceed $1,500, and must accept Australia Post Keypass ID as a valid identification document. The licensee’s compliance obligations are ongoing and require training, systems and physical controls.

Casino employees are affected because the Regulation defines which functions they are permitted to perform, but only indirectly - the licensing regime is in the Act. An employee who is not licensed cannot lawfully perform any of the prescribed functions. Employees in roles such as security, surveillance, IT, and management are caught; even the unsupervised repair of gaming equipment is a prescribed function, so a technician doing that work would need a casino employee licence.

Patrons are affected in several ways. They can present an Australia Post Keypass ID to verify their identity and age, which may be more convenient than carrying a driver licence or passport. They may write cheques to the casino, but only of the prescribed kind and subject to the identity verification process. Patrons participating in commission based player schemes cannot receive total commissions of $1,500 or more; if a scheme offers such amounts, it is unlawful. The core trading hours restrict when patrons can gamble, potentially pushing them to other hours where gambling is not permitted in the casino (they may instead gamble online or in other jurisdictions with longer hours).

Australia Post is also affected as the issuer of the Keypass ID product. The Regulation gives its product a specific legal status. This may benefit Australia Post commercially, as it encourages casinos to accept the Keypass and patrons to acquire one. However, the Regulation does not impose any duty on Australia Post.

Other stakeholders include the ACT Gambling and Racing Commission (which enforces the Act), external auditors and company directors of the licensee (who are explicitly excluded from the restriction on unsupervised access to financial information), and any businesses adjacent to the casino that might benefit from spill over demand during the non trading hours.

The Regulation imposes several duties on the casino licensee. First, the licensee must ensure that any person who performs a prescribed function holds the appropriate casino employee licence under the Act. This is not a duty created by the Regulation itself, but the Regulation defines the scope of those functions. If an unlicensed employee performs a prescribed function, the licensee may face penalties under the Act. The Regulation therefore places a compliance burden on the licensee to map every role to the prescribed functions and to verify licensing status.

Second, the licensee must ensure that gaming only occurs in the area designated by Schedule 1. The licensee cannot expand the gambling floor without amending the Regulation, nor can it move to a different building. This duty is absolute: even a minor expansion beyond the outlined area would breach the Act.

Third, the licensee must adhere to core trading hours. Gambling activity must stop at 2 a.m. and cannot resume until 5 p.m. again at midnight. This duty applies to all gaming; it does not appear to distinguish between table games, machines or other forms. The licensee must have systems in place to ensure compliance, such as locking machines or closing tables.

Fourth, in relation to cheques, the licensee must only accept those that meet the prescribed requirements (drawn in favour of the licensee or presenter, not postdated, and for redeeming cheques not dated earlier than the most recent cheque). Additionally, the licensee must be satisfied about the presenter’s identity, keep records of proof of identity and any inquiries made, and comply with any control procedures (as defined in the Act). The duty to keep records is ongoing and may involve storing copies of identification documents and notes of verification steps. The duty to comply with control procedures means the licensee must have documented procedures for cheque acceptance and follow them.

Fifth, the licensee must not operate a commission based player scheme where the amount paid or credited is $1,500 or more. This is a prohibition that restricts marketing and loyalty programs. The licensee has a duty to track total commissions paid to each player and to ensure the threshold is not exceeded. The Regulation does not specify a time period for the threshold; it is presumably per scheme or per player, but the wording could create ambiguity.

Sixth, the licensee must accept the Australia Post Keypass ID as a valid document of identification for purposes of the Act. This is a duty: the licensee cannot refuse to accept a Keypass ID if a patron presents it. This may limit the licensee’s discretion to demand other forms of ID or to require additional verification.

The rights of patrons are less explicit. Patrons have the right to present a Keypass ID and have it accepted. Patrons also have the right to present a cheque that meets the prescribed requirements and to have it accepted (subject to the identity verification process). However, the licensee is not obliged to accept any cheque; the Regulation only prescribes which cheques may be accepted, not that they must be. Patrons may also participate in commission based player schemes of less than $1,500, but such schemes are at the casino’s discretion.

Employees have rights under the Act (not the Regulation) to be licensed to perform these functions, but the Regulation does not grant any rights itself.

The Regulation itself does not create penalty provisions; all penalties are found in the Casino Control Act 2006. However, a breach of the Regulation may cause a breach of the Act. For example, if a casino operates outside the designated area or outside core trading hours, that would be a breach of Act ss 62(1) or 68(4) respectively, which carry penalties under the Act. Similarly, accepting a non prescribed cheque or failing to comply with identity verification procedures could breach Act s 112. The penalty unit value at republication date is $150 for an individual and $750 for a corporation, per s 133 of the Legislation Act 2001. Offences under the Act may impose multiple penalty units, so the financial risk can be significant.

Enforcement is by the ACT Gambling and Racing Commission, which has inspection and investigation powers under the Act. The actual enforcement risk is low unless the Commission audits the casino’s ID acceptance practices.

The $1,500 threshold for commission schemes is low and may be easily exceeded, making strict liability more likely. Casinos that offer any form of commission based incentive must track cumulative amounts. If a casino inadvertently pays $1,500 or more, it faces a penalty under the Act. The Regulation does not define a time frame (e.g., per day, per month), so the limit effectively applies per scheme. This creates uncertainty and compliance cost.

The Regulation is made under the Casino Control Act 2006 and must be read together with it. The Act provides the licensing regime for the licensee and casino employees, the definition of gaming, the general prohibitions, and the penalty framework. The Regulation fills in details left by the Act: prescribed functions, the casino area, core trading hours, additional identification documents, cheque requirements, and the commission scheme threshold.

The Regulation also interacts with the Legislation Act 2001, which governs the making of subordinate laws, defines penalty units (s 133), and provides rules about dictionaries and notes (ss 155, 156). The Regulation’s dictionary incorporates terms from the Act, such as “commission based player scheme” and “prescribed function”.

The Australia Post Keypass ID is a product issued by Australia Post under the Australian Postal Corporation Act 1989 (Cth). The Regulation gives that federal instrument legal effect in ACT casino regulation. This creates an interaction with Commonwealth law: if the Keypass ID product ceases to be issued or its security features change, the Regulation would need amendment.

The cheque provisions interact with the Bills of Exchange Act 1909 (Cth) and the Cheques Act 1986 (Cth), which govern the legal nature of cheques. The Regulation does not override those laws but adds specific casino related requirements. For example, a cheque that is otherwise valid under federal law may be unacceptable to a casino if it is postdated.

The Regulation also interacts with privacy laws: the requirement to keep records of proof of identity and inquiries involves collection and retention of personal information. The Casino Control Regulation 2006 was originally notified on 21 March 2006 and came into effect on 1 May 2006. The original version had 10 sections (s 2 was later omitted) and Schedules. It remained unamended for over twelve years.

The only amendment occurred via the Red Tape Reduction Legislation Amendment Act 2018 (A2018-33), part 5, notified on 25 September 2018 and commencing on 2 October 2018. That Act inserted a new section 7A, which prescribes the Australia Post Keypass ID as a document of identification. The amendment was part of a broader legislative package aimed at reducing regulatory burdens across various ACT laws. The insertion of a single new section is a modest change, but it had a practical effect by allowing a new form of digital identification in casinos.

The amendment history shows that s 2 (commencement) was omitted by the Legislation Act 2001 (s 89(4)) at some point, and no other sections have been added, removed or altered. The Regulation has been republished twice: R1 on 1 May 2006 (original unamended) and R2 on 2 October 2018 (incorporating the 2018 amendment). No further amendments are shown.

The absence of substantial amendment over twelve years suggests the industry and regulator have found the Regulation largely workable, or that changes are instead being made to the Act itself. The lone 2018 amendment is a red tape reduction measure, which from a free market perspective reduces the compliance burden by accepting an additional identification document. However, it also imposes a duty on casinos to accept that document, limiting their discretion.

The Regulation itself has not been the subject of reported litigation in the ACT courts. There are no noted cases in the endnotes or amendment history. This is not surprising given the Regulation’s detailed but limited scope; it is a subordinate law that implements mechanical rules rather than creating independent causes of action. Most disputes about casino operations would challenge the Act itself or involve licensing decisions, not the Regulation’s specifics.

Potential areas for litigation include: (1) a dispute over whether the designated casino area accurately reflects the floor plans (though the plans are part of the Regulation, they are not reproduced as text, so interpretation may be difficult); (2) a challenge to the validity of a cheque acceptance procedure or the adequacy of identity records; (3) a prosecution for operating outside core trading hours; (4) a dispute about the $1,500 threshold for commission schemes, if the casino argues that the amount is per player or per scheme in a different way; (5) a challenge to the acceptance of Keypass ID as a valid identity document if a patron was refused entry or service due to ID issues.

The absence of litigation may indicate that the Regulation is clear and compliance is straightforward, or that the gambling industry in the ACT is small and disputes are resolved without judicial involvement. The free market perspective might suggest that the Regulation’s prescriptive nature reduces uncertainty but also invites disputes over interpretation (e.g., the definition of “control procedures”). The low threshold of $1,500 for commission schemes could be a trap for unwary operators, but no cases have tested it.

Several provisions contain traps for the unwary. The first is the absolute nature of the designated casino area. The Regulation designates specific floor areas on specific floors; any expansion even by a few square metres would be unlawful. The floor plans in Schedule 1 are not fully described in text, so a change in layout (e.g., moving tables or walls) could inadvertently create an unlicensed gambling area. The licensee must physically measure the area against the plans, which may be imprecise.

Second, core trading hours are narrow: only 5 p.m. to midnight and midnight to 2 a.m. on any day. That means no gambling from 2 a.m. to 5 p.m. - 15 hours of closure. The Regulation does not define “gaming” (that is in the Act), but any form of gambling, including electronic gaming machines, must cease during those hours. The casino cannot, for example, offer free play or practice games if they involve chance and prize.

Third, the cheque provisions require the licensee to be “satisfied about the identity” of the person presenting the cheque, and to keep records of “any proof of identity that the person shows”. This is an open ended duty: what satisfies identity may be subjective. The Regulation does not prescribe a minimum standard (e.g., not just a library card). The licensee also must keep records of “any inquiry the licensee makes to verify the person’s identity” - that means if the licensee makes no inquiry beyond looking at the ID, there is nothing to record? The wording is ambiguous. A strict reading might require the licensee to make some verification inquiry, such as calling the bank.

Fourth, the $1,500 threshold for commission based player schemes is low. A casino that offers a loyalty program paying $1,500 in free play or cashback to a high roller would breach if the commission is based on the player’s gaming. The Regulation does not specify a time period (per session, per day, per month). That creates uncertainty: if a player gambles over several visits and accumulates $1,500 in commission, is that still within the scheme? The literal wording says “the prescribed amount is $1,500” in the definition of “commission based player scheme” in the Act, which refers to “the amount prescribed by regulation”. The Act defines such a scheme as one where “the amount paid or credited to a player by the licensee under the scheme is more than the prescribed amount”. It is not clear whether the amount is cumulative or per transaction. This ambiguity is a trap.

Fifth, the document of identification amendment (s 7A) requires the casino to accept an Australia Post Keypass ID. However, the Keypass product is issued by a Commonwealth entity; if Australia Post changes the design or security features, or if the product is discontinued, the Regulation would need updating. Currently, a casino cannot refuse a Keypass even if it has security concerns. This limits the casino’s ability to refuse apparently fraudulent documents.

Sixth, the prescribed functions list (s 5) includes “the unsupervised maintenance and repair of gaming equipment” (s 5(m)). That means any repair work on gaming machines, even routine, must be done by a licensed employee. An external repairer who is not licensed would breach if unsupervised. The casino must supervise any unlicensed repairer, which may be impractical.

A casino licensee subject to the Casino Control Regulation 2006 should take the following steps to comply.

First, map every employee’s duties against the seventeen prescribed functions in s 5. Ensure that any employee who performs those duties holds a current casino employee licence under the Act. This includes not only gaming staff but also IT support, security, surveillance, storage room workers, and managers. For unsupervised repair roles, consider whether to hire licensed staff or to always supervise unlicensed contractors.

Second, physically demarcate the gambling area according to Schedule 1. The floor plans should be kept at the casino and regularly checked to ensure no expansion or encroachment. If the casino’s layout changes, the Regulation must be amended by legislative action; the licensee cannot unilaterally alter the area. Consider keeping the area slightly smaller than the maximum to avoid accidental boundary violations.

Third, ensure that gaming only occurs during core trading hours: between midnight and 2 a.m., and between 5 p.m. and midnight, on any day. This means no gambling from 2 a.m. to 5 p.m. The casino may remain open for other services (food, drinks, entertainment) but must shut down all gaming operations during those periods. Use signage and system locks to enforce.

Fourth, for cheque acceptance, train staff to identify only cheques that meet the three prescribed requirements in s 8: drawn in favour of the licensee or presenter, not postdated, and for redeeming cheques not dated earlier than the most recent cheque. Implement a check sheet. Before accepting a cheque, staff must be satisfied of the presenter’s identity. Acceptable forms include but are not limited to: a driver licence, passport, or Australia Post Keypass ID (per s 7A). Record the proof of identity (e.g., photocopy or scan, note the type and number). Also record any verification inquiries made (e.g., “called bank to confirm funds” or “checked ID against database”). Keep these records for a reasonable period (check with ACT privacy laws). Also comply with any control procedures published by the ACT Gambling and Racing Commission. If no control procedures exist, the licensee may need to develop and document its own.

Fifth, monitor all commission based player schemes. Ensure that the total amount paid or credited to any player does not reach $1,500. This may require tracking cumulative payments across multiple gambling sessions. If a player’s earned commission hits $1,499, the casino must stop paying further commission. Tie the threshold to the scheme definition; if the scheme is ongoing, do not let it exceed. Consider offering other non commission incentives (e.g., complimentary rooms or meals) that are not based on gaming to avoid the restriction.

Sixth, accept Australia Post Keypass ID as a valid document of identification. Update the casino’s ID acceptance policy to include it. Do not refuse it because it is electronic or because it is not a driver licence. If the Keypass appears tampered with, the casino should follow its standard procedure for suspected fraudulent documents (e.g., refuse the transaction).

Seventh, keep records of compliance activities: training logs, cheques accepted lists, identity verification records, commission tracking records, and area boundary monitoring. These may be needed for investigation or audit by the Commission.
