#### 42D Decision about application for approval of close associate 42D Decision about application for approval of close associate > > (1) The NICC must consider an application and decide to— > > > > > (a) grant the application and issue an approval (a close associate approval) to the person, with or without conditions or > > > > > (b) refuse the application. > > > (2) In deciding the application, the NICC must consider— > > > > > (a) whether the NICC is satisfied the person is a suitable person to be concerned in or associated with the management and operation of a casino, and > > > > > (b) any other matters the NICC considers relevant. > > > (3) For subsection (2)(a), the NICC must consider whether— > > > > > (a) the person is of good repute, having regard to character, honesty and integrity, and > > > > > (b) the person is of sound and stable financial background, and > > > > > (c) the person has any business association with a person, body or association that, in the NICC’s opinion— > > > > > > > (i) is not of good repute, having regard to character, honesty and integrity, or > > > > > > > (ii) has undesirable or unsatisfactory financial sources, and > > > > > (d) each director, partner, trustee, executive officer and secretary, and any other officer or person decided by the NICC to be associated or connected with the ownership, administration or management of the operations or business of the person, is a suitable person to act in that capacity. > > **s 42D:** Ins 2022 No 36, Sch 1\[42\].
