3A What is intoxication? For the purposes of this Act, a person is in a state of intoxication if the person's speech, balance, co‑ordination or behaviour is noticeably affected and there are reasonable grounds for believing that this is the result of the consumption of liquor. The Victorian Liquor Commission issues guidelines containing information about how to determine whether a person is in a state of intoxication.
