3 Schedules

Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1—Consequential amendments

Competition and Consumer Act 2010

1 Subsection 4(1)

Insert:

cash distribution framework means:

(a) the Cash Distribution Framework Act 2026; or

(b) record‑keeping rules within the meaning of that Act; or

(c) rules or any other instrument made under that Act; or

(d) the Regulatory Powers Act to the extent that it applies in relation to a provision of that Act.

2 Subsection 19(1)

After “a gas market instrument”, insert “, the cash distribution framework”.

3 Subsection 19(7)

After “a gas market instrument”, insert “, the cash distribution framework”.

4 Subsection 87B(1)

After “a gas market instrument”, insert “, the cash distribution framework”.

5 At the end of paragraph 155(2)(a)

Add:

(vi) the Cash Distribution Framework Act 2026 (other than Part 6 or 7, or Division 3 or 4 of Part 8, of that Act); or

6 After subparagraph 155(2)(b)(iaa)

Insert:

(iab) a designated cash distribution framework matter (as defined by subsection (9AAB) of this section); or

7 After subsection 155(9AAA)

Insert:

(9AAB) A reference in this section to a designated cash distribution framework matter is a reference to the performance of a function, or the exercise of a power, conferred on the Commission by or under the cash distribution framework.

8 Subsection 155AAA(21) (after paragraph (g) of the definition of protected information)

Insert:

; or (h) information that:

(i) was given in confidence to the Commission; and

(ii) relates to a matter arising under the cash distribution framework; or

(i) information that was:

(i) obtained by the Commission under the cash distribution framework; or

(ii) obtained by the Commission under section 155 of this Act and relates to a designated cash distribution framework matter within the meaning of that section.
