What it does
CASA EX92/23 , DAMP Implementation (Information) Exemption 2023 grants a time-limited exemption to qualifying DAMP organisations from the obligation to comply with subregulations 99.100(1) and (2) of the Civil Aviation Safety Regulations 1998. Section 4(1) states that a DAMP organisation which has implemented a DAMP is exempt from those subregulations. The exemption does not operate in isolation. Section 4(2) provides that it is subject to the conditions stated in section 5. The instrument was made by Daniel Bernard O’Hagan, Manager, Legislative Drafting, acting as a delegate of the Civil Aviation Safety Authority under regulations 11.160 and 11.205 of the Civil Aviation Safety Regulations 1998. Section 1 names the instrument. Section 2 sets the duration: it commences on 1 October 2023 and is repealed at the end of 30 September 2026. This creates a three-year operational window during which organisations that meet the conditions can avoid the reporting requirements in subregulations 99.100(1) and (2) while maintaining internal records of the information mentioned in paragraphs 99.100(1)(a) to (l) of CASR. The conditions in section 5 require the creation of anonymised records, secure retention for five years after the relevant DAMP reporting period or part of that period, and timely destruction of specified parts of those records. The instrument therefore substitutes external reporting with a structured internal record-keeping regime for the defined period.
The text of the instrument makes clear that the exemption applies only where a DAMP has been implemented. Organisations that have not implemented a DAMP receive no relief from subregulations 99.100(1) and (2). The conditions further limit the exemption by requiring that records created under section 5(1)(a) or (b) must not include any information that might identify an SSAA employee. This anonymity requirement applies to both the standard records of information mentioned in paragraphs 99.100(1)(a) to (l) and any additional records created following a written request from CASA under section 5(1)(b). Each record must state the date it was created. Retention must occur in a secure location for the full five-year period after the last day of the DAMP reporting period or part of that period. Within six months after the end of that five-year period, the parts of the records that relate to the results of drug or alcohol testing of an SSAA employee must be destroyed or deleted. These requirements are mandatory for the exemption to remain effective.
