What it does
This instrument, CASA EX87/25 , Obtaining Experience (Grant of RePL for Medium RPA and RePL Upgrade to Different Category of Small or Medium RPA) Exemption 2025, creates time‑limited exemptions to parts of Part 101 of the Civil Aviation Safety Regulations 1998 (CASR) for specified practical flying activities by holders of remote pilot licences, and an associated limited exemption from the requirement to hold a remotely piloted aircraft operator certificate, ReOC. The instrument is made under regulations 11.160 and 11.205 of CASR, is signed by a CASA delegate (Danny O’Hagan), commences 1 October 2025 and automatically repeals at the end of 30 September 2028 (see sections 1 and 2).
Mechanically, the instrument does three things. First, it exempts (subject to conditions) a RePL holder for a category of small remotely piloted aircraft, who operates the same category of medium RPA, from compliance with subregulation 101.252(2) to the extent the holder would otherwise commit an offence because the medium RPA is not an excluded RPA (Exemption 1, s 4). Second, it exempts (subject to conditions) a RePL holder for a category of small or medium RPA who operates a different category of small or medium RPA from compliance with subregulation 101.252(2), where the holder would otherwise commit an offence because they do not hold a RePL for the different category or because a medium RPA is not an excluded RPA, as applicable (Exemption 2, s 6). Third, it exempts persons from compliance with regulation 101.270 to the extent they would otherwise commit an offence under subregulation 101.270(2) because they do not hold a ReOC authorising an operation that complies with the instrument’s operative exemptions (Exemption 3, s 8).
Each exemption is conditional. Operations benefiting from the instrument must be conducted under the standard RPA operating conditions in regulation 101.238, and must be for narrowly defined purposes: meeting the experience requirement in paragraph 101.295(2)(c) for obtaining a RePL or RePL upgrade, getting practical experience and competency for the grant of the relevant RePL or upgrade, or preparing to undertake a CASA flight test under subparagraph 101.295(2)(b)(iii) (see ss 5, 7 and 9). For category upgrades, the different category must be of the same type of RPA already included in the holder’s RePL (s 7(a) and the explanatory Note in s 7). The instrument does not itself amend Part 101; it operates by exempting certain conduct from specified offences in the regulations, for a defined period.
