What it does
This instrument, CASA EX44/24 , Maintenance on Limited Category and Experimental Aircraft Exemption 2024, creates a time‑limited statutory exemption from specified provisions of the Civil Aviation Regulations 1988 (CAR) for maintenance on certain aircraft. It commences on 1 August 2024 and is expressly temporary, expiring on the earlier of the commencement of Parts 1 and 2 of Schedule 1 to the Civil Aviation Legislation Amendment (Part 43,Maintenance of Aircraft) Regulations 2024 or the end of 31 July 2027 (s 2). The instrument is made by a delegate of CASA under regulations 11.160 and 11.205 of the Civil Aviation Safety Regulations 1998 (preamble).
Mechanically, the instrument does the following. It defines the scope of the exemption by reference to two classes of aircraft: limited category aircraft and aircraft subject to an experimental certificate, together termed “exempted aircraft” (s 3, definition). It defines “exempted aircraft maintenance” by listing what is excluded from the exemption (s 3). It applies to the registered operator of an exempted aircraft and to each person carrying out exempted aircraft maintenance (s 4). It then exempts both the registered operator and the person carrying out that maintenance from compliance with CAR regulation 42U and with paragraphs 42W(2)(b) and 42W(4)(a) and (c) in respect of exempted aircraft maintenance (s 5(1)). For the registered operator, those exemptions are subject to a condition concerning major design changes (s 5(2); s 6).
Where the maintenance involves a “major design change”, defined to include significant effects on weight and balance, structural strength, performance, operational characteristics or other characteristics that may affect the validity of the relevant special or experimental certificate, the registered operator must not operate or allow the aircraft to be flown until specified written information is provided and the recipient informs the registered operator in writing that the major design change is acceptable (s 3 definition of major design change; s 6(1)-(2)). The instrument specifies who the recipient may be: CASA’s Airworthiness and Engineering Branch, certain authorised persons holding decision power under Subpart 21.M of CASR, a person authorised to issue a certificate of airworthiness in the relevant category, or an approved design organisation (s 6(1)(a)(i)-(iv)). The information to be provided is itemised and includes a description of the maintenance, photographs if carried out, reasons for the change, analysis of effects against the listed design factors, and an explanation of why safety is not adversely affected (s 6(2)(a)-(e)).
