CASA 30/22 — Air Displays (Temora Historic Flight Club) Ongoing Approval Instrument 2022

The instrument rests on a small set of defined concepts that determine scope and obligations. The definitions are in section 3 and the instrument also relies on meanings drawn from the Civil Aviation Act 1988 and the Civil Aviation Safety Regulations 1998 for terms such as air display, crew member and passenger (section 3 note).

• THFC. THFC means Temora Historic Flight Club Incorporated, ARN 780559 (section 3). The instrument applies to THFC as the body corporate responsible for organising the display(s) (section 4). The instrument authorises THFC to conduct the THFC air display, subject to the condition in section 6 (section 5(1), 5(5)).

• THFC air display and display area. “THFC air display” is defined to include any air display conducted in the display area at Temora aerodrome that is organised by the organiser, and the instrument expressly lists the September 2022 Aircraft Showcase and Warbirds Downunder Airshow 2022 as examples (section 3). “Display area” is the area at Temora aerodrome described as the display area in the Temora Historic Flight Club Air Display Manual, as the manual exists from time to time (section 3). The instrument therefore ties the physical limits of approved operations to the location and diagram in the Manual (section 3 note).

• Organiser and program of events. “Organiser” is the person nominated by THFC to be the air display organiser and named as organiser in the program of events (section 3). “Program of events” is a written program prepared by the organiser that must, at minimum, include names of participants, names of any crew members and passengers accompanying a participant, types of aircraft, the kind of display flights to be conducted by each participant and related requirements, and the name of the organiser (section 3). The program is therefore the operational control document that defines who is approved to fly, which aircraft will be used, which passengers (if any) will be carried and what manoeuvres will be performed.

• Participant. “Participant” means the pilot in command of an aircraft being operated in the THFC air display (section 3). The approvals in section 5 operate only for participants named in the program of events (section 5(2)) and for aerobatic approvals where participants are identified as conducting aerobatics (sections 5(3)-(4)).

• Relevant documents. The instrument incorporates a suite of operational and safety documents by reference in the definition of “relevant document”: the Temora Historic Flight Club Air Display Manual, THFC Standard Operating Procedures, THFC Safety Management System, and Warbirds Downunder Safety Management & Operational Plan (section 3). Each is included “as the document exists from time to time” and the instrument records the versions current at commencement (section 3 notes). That makes obligations contingent on the current content of those documents rather than frozen to a single version.

• Conditions and directions. Approvals are made conditional on compliance with the relevant documents (sections 5(5)-(6), 6, 7, 8). Section 6 imposes an explicit condition on THFC to comply with any requirement in a relevant document that applies to THFC and relates to the THFC air display; section 7 imposes specific duties on participants and conditions on passenger carriage; section 8 contains directions for the organiser including the requirement to provide a CASA Post Display Report within 14 days (section 8(3)).

These concepts together form a governance chain: CASA grants statutory approvals to THFC and named participants, and makes continued lawful operation contingent on compliance with the program of events and the operational documents that THFC and the organiser control and update, subject to the Safety Management System’s management of change obligations (section 6 note). The program of events is the operative document that connects approvals to named pilots, aircraft, flight types and passengers.

This instrument directly affects three categories of actors and indirectly affects anyone relying on the safety perimeter set by those actors. The affected parties are named in sections 4, 3 and 5.

• THFC (the club). The instrument applies to THFC (section 4). THFC is the primary legal entity authorised to conduct the display (section 5(1)) and is placed under a direct statutory condition to comply with any requirement in the relevant documents that applies to it and relates to the THFC air display (section 6). THFC must also operate within the “display area” as defined in the Air Display Manual (section 3). THFC therefore bears the organisational compliance burden: maintaining the relevant documents, running the management of change process set out in the Safety Management System (section 6 note), ensuring briefings happen, and coordinating the organiser and participants.

• The organiser. “Organiser” is the person nominated by THFC and named in the program of events (section 3). The organiser has specific directions in section 8: to comply with requirements in relevant documents that apply to the organiser and relate to the THFC air display (section 8(1)); to be satisfied that any carriage of a passenger is required for safe operation before naming that passenger in the program (section 8(2)); and to provide CASA with a completed CASA Post Display Report form within 14 days of the completion of the THFC air display (section 8(3)). The organiser controls the program of events and thereby controls the activation of the statutory approvals for participants (section 3 program of events; section 5(2)).

• Participants (pilots in command). A “participant” is the pilot in command of an aircraft in the display (section 3). Only participants named in the program of events are approved under the instrument (section 5(2)). Participants who are named as conducting aerobatic manoeuvres are approved to conduct aerobatics, including aerobatics over a populous area if so specified (sections 5(3)-(4)). Participants must not carry passengers unless the passenger is named in the program of events (section 7(1)), and must comply with the program of events and the Air Display Manual (section 7(2)). The instrument thereby delegates to the organiser and the program of events the power to determine who may lawfully fly in the display and what they may do.

• Passengers and crew. Passengers and crew are affected indirectly through constraints on carriage and the requirement that passenger names be included in the program of events (section 3 program of events; section 7(1)). A passenger who is not named in the program may not be carried on any aircraft piloted by a participant during the THFC air display (section 7(1)). The organiser must satisfy itself as to the safety necessity before naming a passenger (section 8(2)).

• CASA. The instrument establishes obligations that impose reporting and approval‑control points for CASA. The instrument was made by a CASA delegate and refers to CASA forms and the CASA website for the Post Display Report (instrument header and section 8(3) and its notes). The Safety Management System note in section 6 indicates CASA approval is required for “significant change” under the THFC management of change process (section 6 note). That creates a continuing supervisory role for CASA over material changes to THFC’s systems, processes or procedures that relate to the air displays.

• Wider public and regulators. While not named in the statutory definitions, members of the public in the vicinity of Temora and other regulatory stakeholders are indirectly affected by the instrument’s scope, the defined display area and the safety documentation that the instrument incorporates by reference (section 3). The instrument’s effect is to channel authorised aerial activity into the defined display area and onto the documents and processes THFC maintains.

Who pays. The instrument does not expressly charge fees. It creates compliance tasks that will impose costs: preparation and maintenance of the relevant documents, program of events creation and updates, participant briefings, pre‑display checks, record keeping, and completion of the CASA Post Display Report within 14 days (section 8(3)). That administrative and operational burden will fall primarily on THFC and the organiser, and on participants insofar as they must brief and certify compliance with the program and manual. The instrument does not allocate explicit monetary payments to CASA, nor does it set fees, fines or compensation. Any enforcement or further administrative costs would flow from CASA’s general regulatory machinery rather than from the instrument itself.

The instrument establishes a small set of discrete statutory rights (approvals) and a web of duties and directions attaching to THFC, the organiser and participants. The rights are time limited and conditional; the duties specify operational constraints and reporting obligations.

Statutory rights and approvals

• Approval to operate. THFC is approved to conduct the THFC air display pursuant to subregulation 91.180(1) of CASR (section 5(1)). That is the central authorisation for THFC’s air display activities.
• Participant approvals. Each participant named in the program of events is approved under regulation 91.180 (section 5(2)). The instrument therefore limits statutory participant approvals to those pilots named in the program.
• Aerobatic approvals. For subparagraphs 91.185(2)(b)(i) and (ii) of CASR, participants named as conducting aerobatic manoeuvres are approved to conduct such manoeuvres, including over populous areas where specified in the program (sections 5(3)-(4)).

Statutory duties and conditions

• Dynamic incorporation of operational documents. THFC must comply with any requirement in a “relevant document” that applies to THFC and relates to the THFC air display (section 6). “Relevant documents” are listed and include the Air Display Manual, Standard Operating Procedures, Safety Management System, and Warbirds Downunder operational plan, and they are incorporated as they exist “from time to time” (section 3 definitions and notes).
• Management of change. The instrument highlights that the Safety Management System requires THFC to follow a management of change process for changes to systems, processes or procedures relating to THFC air displays; significant changes must be approved by CASA (section 6 note). That imposes a process duty on THFC to seek CASA approval for material changes under its own SMS.
• Passenger carriage restriction. A participant must not carry a passenger in any aircraft piloted by the participant in the THFC air display unless the passenger is named in the program of events for the THFC air display as a passenger of the aircraft for the flight (section 7(1)). This converts passenger carriage into a managed, pre‑authorised list item in the program.
• Participant compliance with program and manual. Participants must comply with the requirements of the program of events and the Temora Historic Flight Club Air Display Manual, as the manual exists from time to time (section 7(2)). The instrument’s note records that the manual requires participants to be briefed before any air display, including changes to the program (section 7 note).
• Organiser duties. The organiser must comply with relevant document requirements that apply to the organiser and relate to the THFC air display (section 8(1)). Before naming a passenger in the program, the organiser must be satisfied that the carriage of the passenger is required for the safe operation of the aircraft (section 8(2)). The organiser must provide CASA with a completed CASA Post Display Report within 14 days of the completion of the air display (section 8(3)).

Temporal limits and conditionality

• Duration. The instrument commences the day after registration and is repealed at the end of 8 October 2027 (section 2). However, the approvals in section 5 cease at the end of 24 September 2027 (section 5(7)). That introduces different expiry points for the instrument as a whole and for the grants of approval.
• Conditional approvals. The approvals in section 5 are explicitly subject to the conditions in sections 6 and 7 (sections 5(5)-(6)). Non‑compliance with those conditions is therefore incompatible with the approvals, although the instrument itself does not set out the remedial process or sanctions within its text.

Rights and discretion

• Right to conduct aerobatics. Participants named for aerobatics have the right to conduct those manoeuvres under the specified CASR provisions as applied by the instrument (sections 5(3)-(4)). Those rights are exercised only in the defined display area and only when the participant is named in the program.
• Organiser discretion over participants and passengers. Because the program of events both nominates participants and lists passengers and types of flights (section 3), the organiser holds practical gatekeeping discretion over who obtains the statutory approvals and over who may be carried as a passenger during the display (section 3 and section 8(2)). That discretion is bounded by the instrument’s duties to comply with relevant documents and by the SMS management of change requirements referenced in section 6 note.

Operational implication: the instrument delegates substantial operational control to the THFC documents and to the organiser’s program of events, while CASA retains oversight through conditional approvals, the need for CASA approval for significant changes (SMS note) and the Post Display Report requirement (section 8(3)).

The instrument itself does not prescribe particular fines, sanctions or a step‑by‑step enforcement regime. It creates approvals that are expressly conditional and imposes duties and directions that create obligations enforceable under the broader regulatory framework, but the text does not include new penalty provisions or specify sanctions for non‑compliance.

What the instrument does provide

• Conditional authorisations. Approvals under section 5 are granted subject to the conditions in sections 6 and 7 (sections 5(5)-(6)). That conditionality is a legal lever: continuation of authorised activity depends on compliance with those conditions. The instrument does not state the mechanism by which approvals are suspended, varied or revoked; any such action would be taken under CASA’s regulatory powers established by the Civil Aviation Act 1988 and the Civil Aviation Safety Regulations 1998, which are cited as the statutory basis for the instrument (instrument header).
• Reporting requirement as compliance control. The organiser must provide CASA with a completed CASA Post Display Report form within 14 days of the completion of the THFC air display (section 8(3)). The post display report is a compliance monitoring instrument. The form is available from the CASA website (section 8 note 1). The instrument thereby establishes an information flow to CASA for post‑event oversight.

What the instrument does not do

• No express penalties. The instrument does not itself create penalties, infringement notices or criminal offences, nor does it state the consequences of failing to submit the Post Display Report or of failing to comply with conditions. It also does not set out procedures for revocation or amendment of the approvals beyond the stated expiry dates (sections 2 and 5(7)).
• No enforcement procedures included. The instrument does not specify enforcement powers or the process CASA would follow if THFC, the organiser or a participant fails to comply with a condition. Any enforcement would thus depend on CASA’s existing powers under the Civil Aviation Act and CASR, and on any procedural provisions in those instruments which are not reproduced here.

Enforcement levers that the instrument implies

• Withdrawal or non‑renewal at expiry. Because the authorisations are time limited (sections 2 and 5(7)), CASA’s non‑renewal or its refusal to reissue a subsequent instrument would be an administrative lever to deny future rights.
• Information‑based oversight. The mandatory Post Display Report (section 8(3)) and the dynamic incorporation of operational documents create reporting and documentary oversight channels which CASA can use to identify compliance failures.
• Approval conditioned on SMS change control. The SMS requirement that significant changes be approved by CASA (section 6 note) creates a pre‑approval control point where CASA can assess and block material modifications to THFC’s arrangements.

Practical compliance enforcement point. Practitioners should note that while the instrument places no express sanctioning text, the approvals it grants are contingent on compliance, and the documents and processes it incorporates by reference include management and approval pathways that bring CASA into the loop for significant changes (section 6 note). Any regulatory action would rely on the existing statutory machinery referenced at the head of the instrument rather than on penalties set in the instrument itself.

This instrument is explicitly made under specified provisions of the Civil Aviation Safety Regulations 1998 and interacts with the CASR by granting approvals required by particular CASR provisions. It also incorporates external operational documents by reference, linking statutory approvals to non‑statutory operational materials.

Legal basis and direct cross‑references

• Instrument authority. The instrument records that it is made under regulations 11.056, 11.245 and 91.045 of the Civil Aviation Safety Regulations 1998 (instrument heading). That identifies the CASR provisions relied upon for power to make the instrument, but the instrument does not reproduce the content of those CASR provisions.
• CASR approvals referenced. Section 5 expressly ties the instrument’s approvals to particular CASR provisions:
  • The approval to conduct the THFC air display is given for subregulation 91.180(1) of CASR (section 5(1)).
  • Participant approvals are given for regulation 91.180 (section 5(2)).
  • Aerobatic approvals reference subparagraph 91.185(2)(b)(i) and subparagraph 91.185(2)(b)(ii) of CASR (sections 5(3)-(4)).
  • The instrument notes that the participant approvals are required for paragraphs 91.265(2)(b) (see 91.265(4)(e)) and 91.267(2)(b) (see 91.267(3)(g)) of CASR (section 5 note). Those notes identify which CASR provisions necessitate the statutory approvals that the instrument supplies.

Incorporation by reference of operational documents

• Relevant documents. The instrument incorporates the Temora Historic Flight Club Air Display Manual, Standard Operating Procedures, Safety Management System, and Warbirds Downunder Safety Management & Operational Plan as “relevant documents” (section 3). Each is incorporated “as the document exists from time to time” (section 3). That makes the instrument operationally dependent on material contained in non‑statutory documents which are routinely developed and updated by THFC and Warbirds Downunder.
• Versions at commencement. The instrument records particular versions current at commencement (section 3 notes). Because the documents are incorporated dynamically, their future amendments will change the operative obligations created by the instrument unless those changes trigger the SMS management of change process which, for significant changes, requires CASA approval (section 6 note).

Reporting to CASA and CASA forms

• Post display reporting. Section 8(3) requires the organiser to provide CASA with a completed CASA Post Display Report form within 14 days. The instrument’s note points to the CASA website for the form (section 8 note 1). That creates an intersection between the instrument’s obligations and CASA’s administrative forms and systems.

Temporal interaction with CASR provisions

• Expiry and notes referencing CASR. Section 5(7) states that section 5 ceases at the end of 24 September 2027. Section 8 contains a note that, for regulation 11.250 of CASR, the directions in section 8 cease to be in force at the end of 8 October 2027 (section 8 note 2). Those statements show that the instrument has specific temporal interaction points with CASR provisions, signalling when its approvals and directions are no longer in force.

Practical legal interaction

• The instrument does not displace CASR; rather it supplies specific approvals required by CASR for the named participants and for aerobatics in the specified display area, while linking the continuity of those approvals to internal operational documents and to CASA oversight via the SMS change control and reporting obligations.
• Because the instrument dynamically incorporates non‑statutory operational documents, practitioners must treat compliance as a function of both the instrument and the current content of those documents; any legal analysis of compliance must therefore consider both the instrument and the then‑current versions of the Air Display Manual, SOPs, SMS and Warbirds plan.

Limits of the instrument’s interaction with other laws

• The instrument does not restate or amend CASR provisions; it grants approvals and imposes conditions and directions that operate within the CASR framework. It also does not invoke or modify other federal or state legislation in its text. Any enforcement or sanctioning action arising from non‑compliance would be taken under the general authorities of CASA and the CASR/Act framework rather than under new penalty provisions contained in the instrument.

The instrument itself records its making, commencement mechanics and expiry dates, and it records the versions of documents current at commencement. The text supplies the history limited to those facts; it does not record subsequent amendments within the instrument text provided.

Recorded provenance and dates

• Signing and maker. The instrument was made by KAREN PATRICIA BLAIR, National Manager Regulatory Services, Regulatory Oversight Division, a delegate of CASA, and is signed in the instrument (instrument header).
• Date of signature. The instrument bears the date 20 September 2022 in the signature block.
• Commencement and repeal. Section 2 provides that the instrument commences the day after it is registered and is repealed at the end of 8 October 2027 (section 2(a)-(b)).
• Special cessation for approvals. Section 5(7) states that section 5 ceases to be in force at the end of 24 September 2027. That creates an earlier end date for the statutory approvals granted under section 5 than the instrument’s overall repeal date.

Document versions recorded at commencement

• The instrument records particular versions of the documents that it incorporates at commencement as a matter of record:
  • Temora Historic Flight Club Air Display Manual: Version 1.9, dated September 2022 was the latest version at commencement (section 3 note).
  • Temora Historic Flight Club Standard Operating Procedures: Version 9, dated July 2022 (section 3 note).
  • Temora Historic Flight Club Safety Management System: Version 5.5, dated July 2022 (section 3 note).
  • Warbirds Downunder Safety Management & Operational Plan: Version 4, dated July 2022 (section 3 note).

No recorded amendments in the instrument text

• The instrument as supplied does not include any entries or schedules recording amendments or prior versions of CASA 30/22. It does not record that it was amended between its making and any later date. Any amendments to the instrument after the signature date are not documented in the supplied text.

Implication for practitioners

• Because the instrument binds parties to documents “as the document exists from time to time” (section 3), the operational content of the instrument can change as the incorporated documents change even though the instrument itself may remain formally unamended. Practitioners should therefore maintain and archive the versions of the relevant documents current at each display and track any subsequent changes that could alter the obligations under sections 6, 7 and 8.
• The two different expiry dates (section 5(7) for section 5, and section 2 for overall repeal) are recorded here and must be observed in any planning for displays in late 2027.

The instrument text supplied contains no record of litigation, judicial review, or any court proceedings relating to CASA 30/22. It contains no references to cases, legal challenges, or dispute resolution outcomes. The instrument does not include any appeals or review information.

What the instrument does show

• Delegation. The instrument was made by a named CASA delegate, which is a factual point about who exercised the making power (instrument header). The instrument does not state whether that delegation or the instrument’s content has been objected to or litigated.
• Reporting and oversight. The Post Display Report requirement (section 8(3)) creates an administrative record that CASA may use in its regulatory oversight activities that could be material in any future enforcement or litigation context, but the instrument itself contains no litigation history.

Practical note for legal researchers

• If litigation or judicial review exists concerning this instrument, that material will not appear in the instrument text provided here. Researchers seeking any litigation history must search administrative tribunal and court records, CASA decisions and public registers outside the instrument text. The instrument does not provide those materials or references.

The instrument is concise but contains several features likely to catch practitioners, organisers, pilots and compliance officers if not watched carefully. These “gotchas” derive from the instrument’s conditionality, dynamic incorporation of non‑statutory documents, temporal quirks and the delegation of operational control to the program of events and the organiser.

1. Split expiry dates. The instrument as a whole is repealed at the end of 8 October 2027 (section 2(b)). However, the approvals granted in section 5 cease at the end of 24 September 2027 (section 5(7)). Practitioners planning late‑2027 displays must note that the statutory approvals for participants and aerobatics expire earlier than the instrument’s repeal date. Failure to observe section 5(7) could result in operating without the approvals the instrument supplies.

2. Dynamic incorporation of documents. “Relevant documents” are taken to be the listed manuals and plans “as the document exists from time to time” (section 3). That means the operative obligations change as those documents are updated. The instrument records the versions current at commencement (section 3 notes), but it does not freeze obligations to those versions. THFC’s own document updates can therefore expand, narrow or alter obligations without a formal amendment to the instrument. The Safety Management System’s management of change process and CASA approval requirement for significant changes provides a control mechanism, but routine or minor updates can alter participant and organiser duties (section 6 and its note).

3. Organiser’s gatekeeping power. The organiser names participants and passengers in the program of events and thereby determines who is covered by the statutory approvals (section 3 program of events and section 5(2)). That concentrates practical authority in the organiser. The organiser’s decision to include a participant or passenger is therefore dispositive of whether that pilot or passenger may lawfully fly under the instrument. Section 8(2) requires the organiser to be satisfied that passenger carriage is required for safe operation before naming them; however that is a subjective evidential point and depends on the organiser’s procedures and records.

4. Passenger carriage limitation. Participants may not carry passengers unless the passengers are named in the program (section 7(1)). A last‑minute request by a passenger to board a participating aircraft will therefore be incompatible with the instrument unless the program is amended and the organiser inspects the safety need and any SMS change control requirements are satisfied. Routine passenger carriage cannot be improvised during the display window without breaching the instrument.

5. Participant approvals are program‑specific. The instrument approves “each participant mentioned in the program of events” (section 5(2)). A pilot who is not included in the program has no approval under this instrument even if otherwise qualified. Administrative errors in drafting or circulating the program will therefore have legal consequence.

6. Display area tied to manual. The “display area” is defined by the Air Display Manual (section 3). If the manual’s diagram or description changes, the geographic scope of the approval can change. Operators should ensure they have the current manual version and that the program and flight profiles conform to the display area diagram.

7. Significant change requires CASA approval under THFC SMS. The note under section 6 states that the THFC Safety Management System requires THFC to follow a management of change process and that significant change must be approved by CASA (section 6 note). That creates a potential procedural bottleneck: material operational changes risk being delayed pending CASA review.

8. Reporting deadline. The organiser must submit a completed CASA Post Display Report within 14 days of completion of the air display (section 8(3)). Failure to comply may undermine CASA’s oversight. The instrument does not specify consequences for late or non‑submission, but the requirement is clear and time bounded.

9. No express enforcement steps or sanctions in the instrument. Because the instrument does not set out specific sanctions, organisations must understand that any enforcement action would rely on CASA’s statutory powers external to the instrument. That may create uncertainty as to remedies available to CASA or to affected third parties should breaches occur.

10. Narrow scope of application. The instrument “applies in relation to THFC, the organiser and participants, in relation to any THFC air display” (section 4). Persons or entities not falling within those categories (for example, a visiting performer not named as a participant) are not covered by the approvals granted here. Activities outside the display area or not authorised in the program of events are not authorised by this instrument.

11. Reliance on external forms and the CASA website. The instrument requires a CASA Post Display Report form “as the form exists from time to time” (section 8(3) and note). If CASA changes the form or its online location, organisers must track that change to ensure timely and proper submission.

12. Administrative recordkeeping requirement. Because obligations hinge on program content and document versions “from time to time”, THFC, the organiser and participants should archive contemporaneous program versions, manual pages and change approvals to demonstrate compliance in any post‑event review.

These are not legal judgments but operationally significant features embedded in the instrument text. Each can create compliance risk or administrative cost if not actively managed.

This section outlines a practical, source‑grounded compliance checklist for THFC, the organiser and participants based on the instrument’s express text. It focuses on actions and documentary controls that align with the statutory conditions and directions.

For THFC (the club)

• Maintain and publish the relevant documents. Ensure the Temora Historic Flight Club Air Display Manual, Standard Operating Procedures, Safety Management System and Warbirds Downunder Safety Management & Operational Plan are current, accessible to organisers and participants, and archived by version (section 3 relevant document).
• Observe the management of change process in the SMS. For any proposed changes to systems, processes or procedures that relate to THFC air displays, follow the SMS management of change steps set out in the Safety Management System and seek CASA approval for “significant changes” as required by that process (section 6 and its note).
• Ensure the display area is correctly defined in the Air Display Manual. Confirm the diagram in section 4.1.2 (Air Display Manual note) is current and used operationally when planning flight tracks (section 3 display area).

For the organiser

• Prepare a compliant program of events. The program must include at least: names of participants, names of any crew members and passengers accompanying a participant, types of aircraft, the kind of display flights for each participant and related requirements, and the organiser’s name (section 3 program of events). Draft the program early, circulate it to participants and to THFC for records.
• Use the program to activate approvals. Remember that the statutory participant approvals in section 5 apply only to pilots named in the program of events (section 5(2)). Ensure any pilot intended to fly is named and that their aircraft and flight type are specified.
• Passenger carriage pre‑approval. Before naming any passenger in the program, be satisfied that carriage is required for the safe operation of the aircraft and document the reason for that determination (section 8(2)). Do not rely on ad hoc passenger additions during the display; they are prohibited unless the program is amended to include them (section 7(1)).
• Ensure participant briefings. The Air Display Manual requires that THFC ensure participants are briefed before any air display, including regarding the program and any changes (section 7 note). Document attendance and briefing content.
• Submit the Post Display Report on time. Complete and submit the CASA Post Display Report form within 14 days after the event (section 8(3)). Keep a copy of the submitted form and any supporting documents. Track CASA’s website for the current form (section 8 note 1).

For participants (pilots in command)

• Verify nomination in the program. Do not operate as a participant under this instrument unless your name appears in the program of events (section 5(2)). Confirm aircraft type and planned display flights are correctly recorded.
• Do not carry passengers unless named. Do not carry any passenger during the THFC air display unless that passenger is named in the program for the specific flight (section 7(1)). If a passenger is named, retain proof of that inclusion in the program.
• Comply with the program and manual. Operate in strict accordance with the program of events and the Temora Historic Flight Club Air Display Manual as they exist at the time of the display (section 7(2)). Attend and record the pre‑display briefing required by the manual (section 7 note).
• Aerobatics only as authorised. Only conduct aerobatic manoeuvres that are specified in the program and authorised by the instrument (sections 5(3)-(4)). If authorised to operate over a populous area, confirm the program records that permission and the aircraft and manoeuvres intended.

Administrative and documentary controls

• Version control and archive. Store copies of the program of events, the exact versions of all “relevant documents” in force at the time of the display, briefings, change controls and any CASA approvals of significant changes. The instrument’s dynamic incorporation of documents means that contemporaneous proof of the version in force is critical (section 3).
• Change control and CASA notifications. If THFC or the organiser contemplates material changes to operations, run the SMS change control process and obtain CASA approval for significant changes as required (section 6 note). Keep records of CASA communications and approvals.
• Audit trail for passenger necessity. When naming a passenger, record the factual basis for the organiser’s satisfaction that carriage is required for safe operation (section 8(2)). Keep that document with the program and the post display reporting package.
• Compliance calendar. Track the instrument’s dates: confirm that the proposed display date falls within the instrument’s operational window and that the approvals under section 5 have not ceased for the intended date (section 2 and section 5(7)). If operating in late 2027, check the differing expiry dates carefully.
• Post‑event reporting. Complete the CASA Post Display Report and submit within 14 days. Maintain copies and an internal checklist of items required by the report to ensure completeness.

Recordkeeping and evidence

• Maintain an audit pack for each display that includes: the program of events as published, evidence participants were briefed, the exact versions of any relevant documents used, any change control records and CASA approvals, and the Post Display Report and supporting material. The instrument’s obligations and its dynamic document incorporation make an auditable compliance pack a practical necessity.

Practical risk mitigation

• Build a conservative approach to passenger carriage and last‑minute participant substitutions. Because approvals are program‑based and passenger carriage is restricted, treat any last‑minute changes as requiring formal amendment and, where relevant, SMS change control and CASA approval.
• Engage early with CASA for any changes that might be “significant” under the SMS. Advance engagement reduces the risk of an unapproved material change being treated as a compliance breach.

These steps track the instrument’s express text: they rely on the approvals and conditions in section 5, the condition on THFC in section 6 and the participant and organiser duties in sections 7 and 8, together with the instrument’s definitions and notes in section 3.
