Carers Recognition Act 2012

The Act defines “care” as “the provision of ongoing support, assistance or personal care to another person” (section 3). A “care relationship” exists when one person provides or receives care because the other person has a disability, is older, has a mental illness, or has an ongoing medical condition (including a terminal or chronic illness or dementia) - section 4(1). Care relationships also include certain statutory placements under the Children, Youth and Families Act 2005: permanent care orders, child care agreements, and protection orders (section 4(2)). However, the Act expressly excludes relationships that are solely based on being a spouse, domestic partner, parent, child, other relative, or co‑resident (section 4(3)). It also excludes care provided under a contract of service or for services, an employment contract, voluntary work for a community organisation, or as part of an education course or training (section 4(4)). This means paid carers, professional medical staff, and volunteers for charities are not in a “care relationship” for the purposes of the Act. A “carer” is defined as a person (including a minor) who provides care to another with whom he or she is in a care relationship (section 3). The Act does not define “person being cared for” but section 8 refers to that individual. “Care support organisation” is defined by reference to the entities to which the Act applies (section 5). The key categories are “public service care agency” and “funded care agency”. A public service care agency means a public service body under the Public Administration Act 2004, a council under the Local Government Act 2020, or an entity established by or under an Act for a public purpose - in each case, responsible for policies, programs or services affecting carers and those they care for (section 3). A funded care agency means a person or body funded by a public service care agency and responsible for programs or services that directly impact carers and care recipients. The principles themselves are set out in Part 2: section 7 (carers), section 8 (persons being cared for), and section 9 (care relationships). They use hortatory language (“should”) and cover respect, recognition, support, taking views into account, consideration of health, wellbeing, employment, and education effects. Notably, the principles for carers include that they should be recognised for “the social and economic contribution to the whole community” - a statement of value rather than a duty.

The Act directly binds care support organisations. Those organisations fall into four categories under section 5(1): (a) public service care agencies, (b) funded care agencies, (c) any person or body that has entered into a contract or funding arrangement with a funded care agency to undertake part of that agency’s responsibilities regarding programs or services that directly impact carers and care recipients, and (d) any person or class prescribed by regulations. The regulations power under section 13 allows the Governor in Council to add further entities. The Act specifically excludes from its application a list of children’s service providers: family day care services, children’s services, education and care services, and preschool programs as defined in the Education and Care Services National Law Act 2010, and government and non‑government schools under the Education and Training Reform Act 2006 (section 5(2)). This exclusion means that the principles do not apply to early childhood educators or school staff in their professional capacity, though the care relationship exclusions in section 4(4) would have already excluded paid work. The practical effect is that the Act imposes obligations on state government departments and agencies that develop or deliver carer‑related policies (e.g., Department of Health, Department of Families, Fairness and Housing), local councils, and the non‑government organisations they fund to provide carer support services, respite, or disability services. Contractors of those funded agencies are also caught but only in relation to the funded activities. The Act does not impose any direct duties on carers themselves or on private individuals who provide care. However, it may indirectly affect them because care support organisations are supposed to inform them of the principles and take their views into account when assessing, planning, delivering, managing and reviewing services (section 9(b)). For the community, the Act is largely invisible - compliance is internal and reported only in annual reports, which are public but rarely scrutinised for this purpose. The costs of compliance fall on the organisations: ensuring employees and agents are trained, developing materials to inform service recipients, and adjusting procedures to reflect the principles. No funding is provided for these activities.

The central duty is in section 11(1): a care support organisation must take “all practicable measures” to ensure three things: (a) its employees and agents have awareness and understanding of the care relationship principles, (b) persons in care relationships who receive services from the organisation have that awareness and understanding, and (c) the organisation and its employees and agents reflect the principles in developing, providing or evaluating support and assistance for persons in care relationships. The phrase “all practicable measures” sets a standard of reasonableness; it does not require absolute compliance. What is practicable will depend on the organisation’s resources, size, and the nature of its services. The duty is qualified by section 11(2): nothing in section 11 creates an obligation to provide funding or services. So the duty is purely process‑oriented: it requires awareness, understanding, and reflection, not specific outcomes or increased service levels. The reporting duty in section 12 requires a compliance report in the organisation’s annual report. That report must relate to the period of the annual report and include any additional information prescribed by regulations (section 12(2)). No regulations have been made prescribing additional information (the source shows no such regulations). The Act confers no rights on carers or care recipients. Section 10 explicitly negates any enforceable right or entitlement arising from the principles. This is reinforced by section 6, which provides that in any inconsistency between the Act (except section 12) and another Act, the other Act prevails. Thus, if another Act imposes a duty that conflicts with the principles, the other Act overrides. The only provision that survives inconsistency is section 12, which means the reporting obligation cannot be displaced by another Act. In practice, this means a carer cannot sue for breach of the principles, cannot seek an injunction to compel compliance, and cannot claim damages. The only potential lever is to complain to the Ombudsman, Auditor‑General, or via a parliamentary process about non‑compliance, but those avenues are not created by this Act. The Act does not create a right to be heard in decision‑making; it says carers’ views “if appropriate” should be taken into account - a very weak formulation.

The Act contains no penalty provisions. It creates no offences. There are no infringement notices, fines, or civil penalties for failure to comply with section 11 or section 12. The only enforcement mechanism is reputational and political: if a care support organisation fails to include the required compliance report in its annual report, or if its report reveals inadequate compliance, the organisation may face scrutiny from the responsible Minister, parliament, or the public. But there is no consequence specified in the Act for non‑reporting. The reporting obligation in section 12 is stated to apply “despite anything to the contrary in any other Act”, so it cannot be avoided by relying on another Act that might prohibit disclosure or otherwise excuse reporting. But even if a report is omitted, there is no enforcement machinery. This design choice reflects the Act’s character as a recognition statute rather than a regulatory one. The absence of penalties means that compliance costs can be minimal - an organisation could in theory do nothing and face no legal sanction. In practice, organisations subject to audit and public accountability (especially public service bodies and funded agencies) would likely include the report to avoid criticism. However, the “all practicable measures” standard is vague and could be satisfied by a brief statement that training has been provided and principles have been considered. Without regulations specifying minimum content, the report itself could be very thin. There is no provision for the Minister to order compliance, no power to issue directions, no enforcement agency. The only oversight is indirect: the annual report is tabled in parliament (for government agencies) or lodged with a regulator (for funded agencies). The Act effectively trusts the organisations to self‑regulate. For a free‑market analyst, this is a low‑cost, low‑impact statute: it imposes a symbolic duty but does not divert resources from service delivery to compliance burdens. However, it also creates no incentive for real behavioural change beyond what was already happening.

Section 6 provides that if there is any inconsistency between this Act (other than section 12) and any other Act, the other Act prevails. This makes the Carers Recognition Act a subordinate statute. It does not override the Disability Act 2006, the Mental Health Act 2014, the Health Services Act 1988, or any other legislation. The saving for section 12 means the reporting obligation cannot be nullified by another Act, but the substantive duties in section 11 can be. The Act also incorporates definitions from other Acts: “disability” has the same meaning as in the Disability Act 2006; “personal care” has the same meaning as “special or personal care” in the Health Services Act 1988; “public service care agency” references the Public Administration Act 2004 and the Local Government Act 2020. The exclusions in section 5(2) for various children’s services and schools are defined by reference to their respective Acts. This means that changes to those Acts can affect the scope of this Act. For example, when the Local Government Act 2020 replaced the Local Government Act 1989, the definition of “public service care agency” was amended to update the reference (by No. 9/2020). Inconsistency could arise, for instance, if another Act obliges an agency to prioritise a particular service criterion that conflicts with taking a carer’s views into account. In such a case, the other Act would prevail. In practice, this is unlikely to cause problems because the principles are hortatory and the duty is only to reflect them, not to follow them absolutely. The Act also interacts with the annual reporting requirements of other Acts. Many public entities are already required to produce annual reports under their own enabling Acts or the Financial Management Act 1994; this Act merely adds a specific content requirement to that existing report. It does not create a standalone reporting mechanism. The Act is silent on interaction with Commonwealth laws. Given that many carer payments and supports are funded by the Commonwealth, there could be overlapping obligations, but the Act does not purport to override Commonwealth law. Inconsistency with a Commonwealth law would be resolved under Commonwealth constitutional supremacy (section 109 of the Australian Constitution). The Act does not address that, so compliance with Commonwealth law would prevail.

The Carers Recognition Act 2012 (No. 10 of 2012) received assent on 20 March 2012 and commenced on 1 July 2012 by virtue of section 2(2). As originally enacted, it contained a Part 5 with sections 14 and 15. Section 15 provided for the repeal of Part 5 on 1 July 2013, one year after commencement. The content of those sections is not provided in the source, but the table of provisions shows they were repealed. The only other amendment is by the Local Government Act 2020 (No. 9 of 2020), which amended the definition of “public service care agency” in section 3. Prior to that amendment, the definition referenced “a council within the meaning of the Local Government Act 1989”. The amendment substituted “Local Government Act 2020” for the earlier reference. This amendment commenced on 6 April 2020. No other amendments are shown in the Table of Amendments. The version at hand (Version No. 003) incorporates that amendment. There are no amendments not yet in operation listed in the endnotes. The regulations power under section 13 has not been exercised to prescribe additional persons, bodies, or additional information for reports, as the source includes no reference to any regulations. The Act is therefore largely unchanged since its commencement, with only a minor technical update to reflect local government legislation consolidation. This stability suggests that the Act is not a high‑priority instrument for legislative reform. It also means that any judicial interpretation or administrative practice has likely settled.

The source does not record any litigated cases under the Carers Recognition Act 2012. This is consistent with its structure: section 10 expressly denies any enforceable rights, and section 6 makes other laws prevail. There is no private right of action. The only potential avenue for a legal challenge would be if a care support organisation failed to include the compliance report in its annual report, and someone sought a mandatory injunction or declaration. Even then, the Act does not specify a remedy. No such case appears in the source or is commonly reported. The Act has not been the subject of any judicial interpretation reported in the Victorian law reports or noted in the endnotes. The absence of litigation reflects the Act’s weak legal force. It is essentially a policy statement dressed as legislation rather than a source of justiciable obligations. For a practising lawyer advising a carer, this means that any grievance about treatment by a care support organisation cannot be pursued under this Act. Other avenues would need to be explored: disability discrimination complaints under the Equal Opportunity Act 2010, health complaints under the Health Complaints Act 2016, or administrative law remedies for unreasonable decision‑making. The Carers Recognition Act might be cited as a relevant policy consideration in those contexts, but it cannot ground a cause of action. For the reader, this means the Act’s practical significance is limited to internal compliance and public relations, not to creating legal risk. Compliance officers and auditors should note the reporting requirement, but they need not fear adverse legal outcomes.

Several aspects of the Act are easy to misread or underestimate. First, the principles use “should” not “must”, but section 11(1) imposes a duty to take “all practicable measures” to ensure awareness and reflection. That duty is legally binding, albeit weakly enforced. An organisation that wholly ignores the principles could be found in breach, even if no penalty attaches. Second, the Act applies to contractors of funded care agencies (section 5(1)(c)), not just the direct fund recipients. A small business that wins a subcontract to provide respite services may become a care support organisation without realising it. The obligation to ensure employees and agents understand the principles then applies. Third, the exclusions in section 4(4) for employment and voluntary work are narrow: they exclude the service provider from being in a care relationship, but they do not exclude the organisation from being a care support organisation if it is funded. So a funded respite service that employs paid carers is still bound, even though its employees are not themselves in a “care relationship” with the care recipients for the purposes of the Act. Fourth, the “all practicable measures” standard is undefined. An organisation that does nothing could be in breach, but there is no guidance on what is sufficient. This creates uncertainty. Fifth, the reporting obligation applies “despite anything to the contrary in any other Act” (section 12(1)). This is a strong provision that overrides privacy or confidentiality provisions that might otherwise prevent the organisation from reporting on compliance. However, the content of the report is minimal unless regulations prescribe additional information; none have been made. So a bare statement of “we took measures” might suffice. Sixth, the Act does not require consultation with carers, only that their views be taken into account “if appropriate” (section 7(d)). This gives the organisation wide discretion. A carer who feels ignored has no legal recourse under this Act. Seventh, the Act’s application to children under a permanent care order or protection order (section 4(2)) means that foster carers and kinship carers are in a care relationship for the Act’s purposes, even though other family relationships are excluded. This could catch child protection agencies and foster care support organisations. Eighth, the Act does not define “funded care agency” except by reference to being funded by a public service care agency. That funding could be partial or indirect, creating ambiguity about which entities are caught. Finally, the Act has no sunset or review clause; it continues indefinitely without any mandated evaluation. This means that even if the principles are ineffective or outdated, there is no legislative requirement to reconsider them.

Compliance with the Carers Recognition Act 2012 requires a systematic but low‑cost approach. The core obligation is section 11(1): take all practicable measures to ensure that employees and agents have awareness and understanding of the care relationship principles, that service recipients have that awareness, and that the organisation reflects the principles in its activities. Step one is to identify whether the entity is a care support organisation. If it is a Victorian public service body, a local council, an entity established for a public purpose, or a recipient of government funding to provide programs that directly impact carers and care recipients, then the Act applies. Contractors of funded agencies should also assess their exposure. Step two is to develop a written policy or procedure that incorporates the principles. This could be a standalone carers recognition policy or an addition to existing service delivery guidelines. Step three is to provide training to all employees and agents (including volunteers and subcontractors) on the principles. Training could be part of induction and refresher sessions. The Act does not mandate a specific format, but records of training should be kept. Step four is to inform persons in care relationships of the principles. This could be through brochures, posters, website content, or verbal explanation at intake. The requirement is “all practicable measures”, so reasonable efforts tailored to the audience will suffice. Step five is to review service development, provision, and evaluation processes to ensure they reflect the principles. This might involve checking assessment forms, decision‑making protocols, and feedback mechanisms to see if carers’ views are solicited and considered. Step six is to prepare the annual compliance report. The report must be included in the organisation’s annual report and relate to the period of that report. The content should describe the measures taken to comply with section 11. Without regulations prescribing additional information, a succinct statement is acceptable. For example: “During the year, the organisation provided training on the care relationship principles to all frontline staff, distributed information leaflets to service users, and revised its assessment framework to include a carer’s views section.” Step seven is to ensure the report is actually included; failure to do so is a breach of section 12. There is no penalty, but the omission could be noted by auditors or parliament. Organisations should also consider that the Act does not require them to fund services or to provide particular outcomes. They cannot be compelled to do more than take reasonable steps. Compliance costs are mainly staff time for training and document preparation. There is no requirement to allocate budget to carer services. For a free‑market analysis, this is a light‑touch regulation that imposes a modest compliance burden without distorting resource allocation. However, the risk of over‑compliance - creating bureaucratic processes that exceed legal necessity - should be avoided. The Act does not require committees, working groups, or detailed data collection. Keep it simple.
