Carers Recognition Act 2005

The Act defines several key concepts that set the scope of its operation. A “carer” (section 5) is a natural person who provides ongoing care or assistance to a person who has a disability within the meaning of the Disability Inclusion Act 2018, a chronic illness including a mental illness under the Mental Health Act 1993, a person who because of frailty requires assistance with everyday tasks, or a person of a class prescribed by regulation. Critically, a person is not a carer if the care is provided under a contract for services or a contract of service (i.e., paid workers) or in the course of community work organised by a community organisation within the meaning of the Volunteers Protection Act 2001 (section 5(2)). Furthermore, a person is not a carer “only because” they are a spouse, domestic partner, parent, or guardian of the care recipient, or provide care to a child placed in their care under children’s protection legislation (section 5(3)). The word “only” leaves room for the possibility that such a person may be a carer if they provide care beyond that inherent in the relationship or placement, but the Act does not elaborate, creating interpretive ambiguity. An “applicable organisation” (section 4) comprises three categories: a reporting organisation; a person or body providing relevant services under a contract with a reporting organisation (other than a contract of employment); and any other person or body declared by regulation to be an applicable organisation. This means a private or non‑government service provider can be caught indirectly if it contracts with a public sector entity. A “reporting organisation” is an administrative unit of the Public Service (as defined in the Public Sector Act 2009) that provides relevant services, or any person or body declared by regulation to be a reporting organisation. “Relevant services” means services relevant to carers and the persons they care for , a circular definition with little precision. The “Carers Charter” is the set of seven principles set out in Schedule 1. These principles are broad statements of expectation: carers should have choices, be supported, enjoy well‑being, be recognised, have service providers work in partnership, and have access to resources. Ethnically and culturally specific considerations for Aboriginal and Torres Strait Islander carers and for children and young people who are carers are also included. The Charter itself is not legally binding; it is the standard against which the section 6 duty is measured.

The Act directly affects three groups. The first group is carers themselves, as defined in section 5. The Act purports to recognise and support them, but gives them no directly enforceable rights or entitlements. Carers may benefit indirectly if applicable organisations change their behaviour to reflect the Charter principles. The second group is applicable organisations. These include all public sector agencies (administrative units of the Public Service) that provide relevant services, and any private or non‑governmental bodies that provide such services under contract with a reporting organisation. For example, a non‑profit disability support provider that receives government funding to deliver services would likely be an applicable organisation if it contracts with a state administrative unit. The third group is reporting organisations, which are a subset of applicable organisations. They bear the additional obligation of preparing and publishing a compliance report each year. The Act also indirectly affects the employees, officers, and agents of applicable organisations, because section 6 requires that those individuals have awareness and understanding of the Charter. It may affect the terms of contracts between reporting organisations and service providers, because the reporting organisation must report on the contractor’s compliance with section 6. This creates an incentive for reporting organisations to include clauses in contracts that require the contractor to take the prescribed measures. Care recipients are also affected indirectly, because the Charter principles include consideration of their views and best interests (Charter principle 4(5)). However, the Act does not create any right for care recipients to demand compliance. The broader community may be affected through the annual reports that disclose how public sector agencies are performing against the Charter. There is no direct effect on the general public as taxpayers, although the compliance costs of the Act (staff training, consultation processes, reporting) are ultimately borne by the public purse and therefore by South Australian taxpayers. The Act also potentially affects private sector entities if they are declared by regulation to be reporting organisations or applicable organisations. No such regulations are included in the source text, but the power exists. Over time, the scope of who is affected can be expanded through regulation without further amendment of the Act.

The central duty in the Act is imposed by section 6(1): every applicable organisation must take all practicable measures to ensure that it and its officers, employees, or agents have an awareness and understanding of the Carers Charter and take action to reflect the principles of the Charter in the provision of the organisation’s relevant services. This is a duty of conduct, not of result. The phrase “all practicable measures” is not defined, leaving a wide margin of discretion. An organisation might argue that a measure is not practicable if it would impose disproportionate cost or disrupt service delivery. The duty applies to both the organisation and its contracted service providers, through the definition of applicable organisation. For public sector agencies only, section 6(2) imposes an additional duty to consult carers, or persons or bodies representing carers, in policy or program development and in strategic or operational planning relevant to carers and the persons they care for. This consultation duty does not apply to non‑government applicable organisations. Section 7 imposes a duty on reporting organisations to prepare a report on compliance with section 6, covering both the organisation itself and any contractor providing relevant services. The report must include information prescribed by regulation and be incorporated with the annual report. This duty is mandatory; there is no discretion to omit the report. Reporting organisations can only discharge this duty if they have mechanisms to monitor their own compliance and the compliance of their contractors. The Act creates no individual rights for carers. The Charter uses aspirational language (“should”) throughout, not binding language. There is no right for a carer to bring a legal action against an organisation that fails to comply with section 6. There is no right to a particular service, no right to be consulted (except through the duty on public sector agencies, which is owed to the public sector itself, not to individuals), and no right to compensation. The only accountability mechanism is the annual report and the review by the Minister after five years. The Act does not provide a right to inspect reports or to complain to an ombudsman. The duties are duties owed to the state, not to carers; the ultimate sanction is political, not legal.

The Act contains no penalties of any kind. There is no offence provision for contravening section 6 or section 7. There is no civil penalty, no infringement notice, and no power for a court or tribunal to order compliance. There is no provision for a carer or any other person to seek an injunction, damages, or a declaration. The Act does not establish a regulator, inspector, commissioner, or complaints body to enforce compliance. Enforcement is therefore entirely dependent on the self‑reporting system under section 7 and the ministerial review under section 9. The theory of the Act appears to be that transparency will drive compliance: reporting organisations must publicly disclose whether they have complied, and that disclosure may attract scrutiny from the media, advocacy groups, or Parliament. However, the report is prepared by the organisation itself, and there is no independent audit of the accuracy of the reported information. The Minister’s review was required to occur after the fifth anniversary of commencement (2010) but the Act does not mandate any subsequent review. Once the five‑year review is done, there is no further statutory obligation to revisit the Act’s effectiveness. The absence of penalties means that an organisation that takes no action at all to comply with section 6 faces no legal adverse consequences. It can simply report that it has not complied, and the Act provides no mechanism to compel it to change. This creates a risk that the Act becomes a purely symbolic statement, imposing a reporting burden without any real leverage for behavioural change. In economic terms, the Act creates a classic soft‑law regime: it signals a policy preference but does not alter the marginal cost of non‑compliance. Rational organisations will comply to the extent that they believe the reputational cost of reporting non‑compliance exceeds the cost of taking measures. For organisations that are not subject to public scrutiny (for example, a small contracted provider that does not have its own annual report), the incentive to comply is minimal.

The Act explicitly cross‑references several other South Australian statutes. The definition of “carer” in section 5(1)(a) relies on the definition of “disability” in the Disability Inclusion Act 2018. Section 5(1)(b) refers to chronic illness including a mental illness within the meaning of the Mental Health Act 1993. Section 5(2)(b) excludes care provided in the course of community work organised by a community organisation under the Volunteers Protection Act 2001. Section 5(3)(a) excludes a person from being a carer purely because of a spousal or family relationship, and the terms “spouse” and “domestic partner” are defined by reference to the Family Relationships Act 1975. Section 4 defines “public sector agency” by reference to the Public Sector Act 2009. Section 5(3)(b) originally referred to the Children’s Protection Act 1993, but that was amended by the Children’s Protection Law Reform (Transitional Arrangements and Related Amendments) Act 2017 to also refer to the Children and Young People (Safety) Act 2017. The legislative history shows that an uncommenced amendment by the Children and Young People (Safety and Support) Act 2025 will update this further. The Act does not contain a provision stating that it prevails over other legislation in the event of conflict. It is therefore likely to be read as supplementary to other laws governing service provision and disability, health, mental health, and child protection. It imposes obligations on applicable organisations that are additional to any obligations they have under other statutes. For example, a public hospital that is a reporting organisation must comply with both the Health Care Act 2008 and the Carers Recognition Act 2005, with compliance under the latter requiring consultation with carers and annual reporting. The Act may also interact with contract law, because a reporting organisation must report on a contractor’s compliance. A contract that does not require the contractor to take measures to reflect the Charter may expose the reporting organisation to a compliance gap that it must report. The Act does not create any tort law liability (e.g., for negligence in failing to consult carers). It does not affect the operation of the Freedom of Information Act 1991 or privacy laws. The Carers Charter itself is not enshrined in any other Act, so its principles do not have automatic legal effect outside this Act.

The Carers Recognition Act 2005 (SA) received royal assent on 3 November 2005 and commenced on 1 December 2005. It has been amended seven times, according to the legislative history provided. The amendments are as follows:

1. Statutes Amendment (Domestic Partners) Act 2006 (No 43 of 2006), Part 11 (sections 36 and 37), commenced 1 June 2007. This inserted definitions of “domestic partner” and “spouse” into section 4 and amended section 5(3) to include domestic partners in the exclusion from carer status based solely on relationship.
2. Statutes Amendment (Public Sector Consequential Amendments) Act 2009 (No 84 of 2009), Part 24 (section 46), commenced 1 February 2010. This amended the definitions of “public sector agency” and “reporting organisation” in section 4 to reflect the new Public Sector Act 2009.
6. Carers Recognition (Miscellaneous) Amendment Act 2025 (No 73 of 2025), Part 2 (sections 3 to 9). This amendment is scheduled to commence on 1 July 2026 (Gazette notice 19 February 2026). The source does not provide the text of these sections, so the precise changes are unknown from the source; only the provision numbers are listed. The legislative history table indicates that these sections amend provisions of the Act, but the source does not specify which ones. The Act’s principal provisions (sections 1, 3‑9, Schedule 1) have otherwise remained structurally unchanged since 2005, with only definitional updates and cross‑reference changes.

The source text does not cite any litigation involving the Carers Recognition Act 2005. The Act creates no private right of action and no penalty, which makes it unlikely to be the subject of court proceedings. Enforcement is purely through internal reporting and ministerial oversight. No case is mentioned in the legislative history, the principal Act, or any associated materials included in the source. It is plausible that disputes about compliance could arise under public law, such as a judicial review application arguing that a public sector agency failed to consult carers as required by section 6(2). However, such a claim would face the hurdle that the duty is to consult “carers, or persons or bodies that represent carers” in policy or program development or planning. If a public sector agency could show that it consulted some representative body, an applicant would have to prove that the consultation was inadequate or that the agency acted unreasonably in failing to consult a particular group. The absence of any definition of “consult” and the broad discretion given by “all practicable measures” would make such a claim difficult. A claim for breach of statutory duty is not available because the Act does not confer a private right of action. The Act may have been mentioned in tribunal decisions about service provision or in parliamentary committee reports, but no such references are in the source. The lack of litigation history is consistent with the Act’s nature as a soft‑law, awareness‑raising instrument without coercive enforcement. It also means there is no judicial interpretation of key terms such as “all practicable measures” or “support” in the Charter, leaving those concepts legally untested.

Several interpretive traps and hidden consequences lie in the Act’s detail. First, the definition of carer excludes those who provide care under a contract for services or contract of service, or in the course of community work organised by a community organisation. This means that a paid support worker or a volunteer for a charity is not a carer for the Act’s purposes, even if they provide identical care to a family member. Consequently, the protections and recognition of the Charter do not extend to these workers, and organisations are not required to take measures to reflect the Charter in relation to them as carers. Second, section 5(3) states that a person is not a carer “only because” they are a spouse, domestic partner, parent, or guardian. This wording implies that such a person can be a carer if the care provided goes beyond what is inherent in the relationship. But the Act gives no guidance on where that line is drawn. A mother caring for a disabled adult child might argue she is a carer; but a public agency might argue the care is merely parental. This ambiguity creates uncertainty for both carers and applicable organisations, potentially leading to inconsistent application. Third, the Act imposes no duty to actually comply with the Charter, only to take “all practicable measures” to reflect its principles. An organisation could argue that it has taken all practicable measures simply by distributing a pamphlet about the Charter and offering a one‑hour staff training session, even if its service delivery remains unchanged. The duty is one of process, not outcome. Fourth, the reporting obligation under section 7 applies only to reporting organisations, which are primarily public sector administrative units. Contractors that are applicable organisations but not themselves reporting organisations do not have to prepare their own report. Their compliance is reported by the contracting reporting organisation. If the reporting organisation’s report is inaccurate or incomplete, the contractor faces no direct consequence. Fifth, the Act contains no sunset clause, no requirement for periodic review beyond the initial five‑year review, and no mechanism for stakeholder input into the review. The ministerial review required after five years (by 2010) could have been done once; the Act does not require any further review. Sixth, the Act does not create any obligation to provide resources or funding. The Charter principle 7 says resources should be available, but the Act itself does not mandate budget allocations. An organisation could be in full compliance with section 6 while still failing to provide the “timely, appropriate and adequate assistance” that the Charter contemplates. Seventh, the Act’s commencement table shows that some amendments by the Children and Young People (Safety and Support) Act 2025 are uncommenced. Anyone relying on the Act must check whether those amendments have come into force, as they will alter references in section 5(3). Finally, the Carers Charter uses the word “should” throughout, not “must”. Courts generally treat “should” as aspirational rather than mandatory. Even if an organisation fails to follow a Charter principle, it is not automatically in breach of section 6 unless it also failed to take all practicable measures to reflect that principle. These gotchas mean the Act is easily circumvented by an organisation that wishes to meet the letter of the duty without changing its culture.

Compliance with the Carers Recognition Act 2005 requires a systematic approach by applicable organisations, particularly reporting organisations. The following steps are not prescribed in the Act but are consistent with its duties. First, an organisation must identify whether it is an applicable organisation. If it is an administrative unit of the Public Service and provides relevant services (broadly, services to carers or care recipients), it is a reporting organisation. If it is a non‑government body providing relevant services under a contract with a reporting organisation, it is an applicable organisation. If it is neither, it may be declared by regulation. Second, the organisation must ensure that its officers, employees, and agents (including contracted workers who are agents) have an awareness and understanding of the Carers Charter. This typically involves training sessions, distribution of the Charter text, and integration of the Charter into induction materials. The duty extends to agents, so volunteers or subcontractors should be included. Third, the organisation must take action to reflect the principles of the Charter in the provision of its relevant services. This requires a gap analysis between current service delivery and the Charter’s seven principles. For example, principle 4 (service providers work in partnership with carers) requires that organisations include carers in the assessment, planning, delivery and review of services. An organisation might need to revise its intake procedures, consent forms, and care plans to formally involve carers. Principle 5 requires specific consideration of Aboriginal and Torres Strait Islander carers, which may mean developing culturally appropriate engagement strategies and referring to Aboriginal community‑controlled services. Principle 6 requires identification and support of children and young people who are carers, and minimising their caring responsibilities. This could involve collaborating with schools or youth services. Fourth, for public sector agencies, section 6(2) mandates consultation with carers or their representatives in policy development and planning. This means establishing or joining existing carer advisory groups, conducting surveys, or holding public forums. The consultation must be genuine and not merely nominal. Fifth, reporting organisations must prepare an annual report on compliance, covering both their own compliance and that of any contractor providing relevant services. The report must include information prescribed by regulation (the source does not list any such regulation). At a minimum, an organisation should document the measures taken to meet the duty, the outcomes of those measures, and any areas of non‑compliance. The report must be incorporated with the annual report. Sixth, the organisation should keep records of all training, consultation, policy changes, and service delivery adjustments to substantiate its compliance report. Seventh, the organisation should monitor for regulatory changes, as the Governor may declare additional persons or bodies to be reporting organisations or applicable organisations, and may prescribe additional information to be included in reports. Eighth, organisations should review their contractual arrangements with service providers to ensure that contractors are aware of their obligations under section 6. A clause requiring the contractor to take all practicable measures to reflect the Charter and to provide information to the reporting organisation for the compliance report would help mitigate risk. Finally, given the absence of penalties, the primary risk is reputational. Organisations should treat the Act as a minimum standard and proactively seek to improve carer recognition beyond the bare legal duty, as this may improve service outcomes and reduce long‑term costs associated with carer burnout and service breakdown.
