Carers Recognition Act 2004

The statute rests on several core legal and administrative concepts set out in text and schedules.

Carer: The substantive beneficiary is defined in s 5. A “carer” is generally an individual providing ongoing care or assistance to persons with disability (per the Disability Services Act 1993 s 3), persons with chronic illness (including mental illness per the Mental Health Act 2014 s 4), people who require assistance due to frailty, or persons of a prescribed class (s 5(1)). The Act expressly excludes persons who provide care under a contract for services or employment contract (except certain Disability Services Act agreements), and those performing community work as defined in the Volunteers and Food and Other Donors (Protection from Liability) Act 2002 (s 5(2)). The Act also clarifies that being a spouse, de facto partner, parent or guardian, or caring for a child under certain Child Welfare arrangements, is not, by itself, sufficient to qualify the person as a carer “only because” of that relationship (s 5(3)).

Carers Charter: The Charter is normative and declaratory in Schedule 1. It sets four principles: respect and dignity (item 1); inclusion of carers in assessment, planning, delivery and review of services that impact them (item 2); taking carers’ views and needs into account alongside the care recipient’s best interests (item 3); and giving due attention to carers’ complaints about services (item 4). The Charter is not framed as a statutory rule with standards of remedy attached; rather statutory obligations require organisations to take practicable measures to comply with it (s 6(1)).

Applicable organisations and reporting organisations: “Applicable organisation” is defined by reference to Schedule 2 and by regulation (s 4). Schedule 2 divides organisations into “reporting organisations” (Division 1) and “other organisations” (Division 2). Reporting organisations include specified health and disability providers (Schedule 2 items 1-4, 3A) and any person or body prescribed by regulation (Schedule 2). Other organisations include contractors providing services under contract with a reporting organisation and any prescribed persons or bodies (Schedule 2 Div 2).

Obligation standard: The Act uses the phrase “take all practicable measures” (s 6(1)). That is a statutory standard that requires effort consistent with practicability; the Act does not supply a statutory test or enumerated compliance steps. For public sector bodies, the Act sets a distinct duty to involve carers or their representatives in policy or program development and in strategic or operational planning that might affect carers (s 6(2)).

Oversight and reporting: Reporting organisations must submit annual reports to the Council by 30 September on performance and compliance with the Act and the Charter, including compliance by contracted providers (s 7(1)(a)-(d)). Reports must include specified details for public sector bodies (s 7(2)(a)) and be made publicly available in the prescribed manner (s 7(4)). The Council must report annually (and on ministerial direction) to the Minister on reporting organisations’ performance and compliance; the Minister must lay those reports before each House of Parliament (s 10(1)-(3)).

Council architecture and ministerial control: The Council is a ministerially appointed body of up to 10 members with knowledge and experience relevant to carers (s 8). The Minister must consult the Ministers responsible for the Disability Services Act and Health Services Act before appointments (s 8(3)). The Council’s functions include promoting compliance and making recommendations to the Minister (s 9). The Minister can give written directions to the Council, and the Council must give effect to such directions (s 12). The Minister is entitled to Council information and may request documents and copies (s 13).

Regulation and review: The Governor may make regulations for matters required or permitted (s 21). The Minister must carry out a statutory review of the operation and effectiveness of the Act within three years of commencement and lay a report before Parliament within 12 months after the three‑year period (s 22).

Primary beneficiaries and rights‑holders:

• Carers, as defined by s 5, are the central beneficiaries of the Charter’s principles and the focus of the Act’s reporting and advisory mechanisms. The definition captures unpaid or informal carers providing ongoing assistance to people with disability, chronic illness (including mental illness), or frailty, and any class prescribed by regulation (s 5(1)). The statutory text excludes paid contract workers and volunteers as carers for the purposes of the Act (s 5(2)). The Act also clarifies that certain familial relationships alone do not automatically make a person a carer for the Act’s purposes (s 5(3)).

Obligated organisations:

• Reporting organisations listed in Schedule 2 Division 1 must prepare and deliver annual reports to the Council on their compliance with the Act and the Carers Charter (s 7(1)). Schedule 2 lists: providers as defined under the Health and Disability Services (Complaints) Act 1995 (item 1); the Disability Services Commission (item 2); health service providers per the Health Services Act 2016 (item 3); the chief executive officer of the department principally assisting under the Health Services Act 2016 in relation to health services provided by that CEO (item 3A); and any other prescribed person or body (Schedule 2).
• “Applicable organisations” more broadly (Schedule 2 plus any prescribed organisations) are required to take all practicable measures to ensure their officers, employees or agents comply with the Charter in providing services (s 6(1)). This means organisations beyond reporting organisations may have duties if included in Schedule 2 or by regulation (s 4; Schedule 2; s 21).

Public sector bodies:

• Public sector bodies are a subset of applicable organisations with an additional statutory duty to involve carers, or their representatives, in policy or program development or strategic/operational planning that might affect carers (s 6(2)). The Act cross‑references the Public Sector Management Act 1994 for the meaning of public sector body (s 4).

Contracted service providers:

• Persons or bodies providing services under contract with a reporting organisation are included as “other organisations” in Schedule 2 Division 2 (item 5). Annual reports by reporting organisations must include compliance or non‑compliance by these contracted providers with the Carers Charter (s 7(1)(d)).

Government actors:

• The Minister (with power to appoint and remove Council members, give directions, and access Council information) and the department principally assisting the Minister have responsibilities for administering the Act and for transparency obligations (ss 8, 12, 13; s 12(6) requires directions to be included in the department’s annual report under the Financial Management Act 2006 Part 5).

Other affected actors:

• Members of the Carers Advisory Council (up to 10 appointees) who have statutory duties, attendance obligations, terms of office up to two years (s 14), and removal grounds including illness, misbehaviour, insolvency or repeated absence (s 15). The Minister must consult specified ministers before appointment (s 8(3)) and choose members to reflect carers’ interests (s 8(2)).

Unspecified expansion:

• The Act’s coverage can be extended by regulation (s 21) to add prescribed organisations into Schedule 2, and to prescribe specific reporting content (s 7(2)(b), s 10(2)(b)). Thus, entities not presently captured may be brought within the Act’s reporting or “applicable organisation” obligations by regulation.

Who is not covered or only partially covered:

• Paid carers engaged under contract for services or employment contracts are excluded (s 5(2)(a)), subject to a specific exception for agreements under Disability Services Act s 25. Volunteers carrying out community work as defined in the Volunteers and Food and Other Donors (Protection from Liability) Act 2002 are excluded (s 5(2)(b)). The Act does not purport to create private legal remedies for carers; obligations are on organisations, with compliance monitored administratively.

Duties on organisations:

• All “applicable organisations” must “take all practicable measures” to ensure the organisation and its officers, employees or agents comply with the Carers Charter in providing services (s 6(1)). This is the central operational duty. The text does not prescribe a checklist; it sets a practicability standard that will be applied to organisational conduct.
• Public sector bodies face a discrete statutory duty to involve carers or bodies representing carers in policy/program development and in strategic or operational planning that might affect carers and their role (s 6(2)). The duty applies “without limiting” the general s 6(1) obligation.

Reporting duties:

• Reporting organisations must prepare and deliver to the Council, as soon as practicable after each 1 July and not later than 30 September, an annual report on:
  • performance of the organisation’s obligations under the Act;
  • compliance or non‑compliance with the Act;
  • compliance or non‑compliance with the Carers Charter; and
  • compliance or non‑compliance with the Carers Charter by any person or body providing a service under contract with the organisation (s 7(1)(a)-(d)).
• Reports must include specified details for public sector bodies on compliance with the s 6(2) duty (s 7(2)(a)) and any other specific information prescribed by regulation (s 7(2)(b)). Reporting organisations must make the report publicly available in the prescribed manner (s 7(4)).

Council and Minister duties and powers:

• The Council’s functions include advancing carers’ interests, promoting organisational compliance with the Charter, making recommendations to the Minister on fostering compliance, providing general advice to the Minister, carrying out functions directed by the Minister, and requesting information from reporting organisations (s 9(1)-(2)). Reporting organisations must, “as far as practicable”, comply with requests for information unless prohibited by another law (s 9(3)).
• The Council must prepare and deliver to the Minister an annual report on reporting organisations’ performance and compliance and any other prescribed information; the Minister must cause that report to be laid before each House of Parliament within 14 sitting days of receipt (s 10(1)-(3)).
• The Minister may give written directions to the Council about the performance of its functions and the Council must give effect to any such direction (s 12(1)). The Minister must cause the text of any direction to be laid before each House, or transmit it to the Clerk if the House is not sitting, and include the direction in the department’s annual report under the Financial Management Act 2006 Part 5 (s 12(2)-(6)). The Minister is also entitled to any information in the possession of the Council and may request documents or copies; the Council must comply (s 13).

Rights of carers in the Charter:

• The Charter sets principles that carers must be treated with respect and dignity; be included in assessment, planning, delivery and review of services that impact them; have their views and needs taken into account alongside the care recipient’s best interests; and have complaints given due attention (Schedule 1). These are declaratory rights in the Charter; the statute ties organisational duties to complying with the Charter rather than providing express enforceable remedies in the Act.

Procedural rights and internal governance:

• Council members have specified terms of office (maximum two years per appointment, s 14), may resign (s 15(1)), and are subject to removal on specified grounds (s 15(2)). The Minister appoints a chair from among the members (s 16(1)), the Council elects a deputy (s 16(2)), and the deputy acts when the chair is unavailable (s 16(3)). Members are entitled to remuneration and allowances determined by the Minister on the Public Sector Commissioner’s recommendation (s 17).

Limits and constraints:

• The obligation to take “all practicable measures” is qualified by the opening phrase of s 6(1): “Subject to any other written law”. This means other statutory legal obligations or prohibitions can limit the operation of the Charter obligations in practice (s 6(1)). Additionally, reporting organisations are required to comply “as far as practicable” with Council requests for information unless expressly prohibited by another law (s 9(3)).

Statutory enforcement architecture:

• The Act does not set out express civil or criminal penalties, pecuniary fines, or private causes of action for non‑compliance with the Carers Charter or for failure to take practicable measures (the statute contains no penalty clauses). Enforcement is administrative, relying on reporting, Council oversight, ministerial direction and parliamentary scrutiny (ss 6-13).
• Reporting obligations create an administrative transparency mechanism: reporting organisations must provide annual reports to the Council by prescribed dates (s 7(1)) and make those reports publicly available (s 7(4)). The Council must report to the Minister, and the Minister must lay Council reports before Parliament (s 10(1)-(3)). Ministerial directions to the Council must also be laid before Parliament and included in the department’s annual report (s 12(2), (6)). These steps create a public record and parliamentary oversight rather than prescriptive sanctions.

Information powers and compliance:

• The Council may in writing request information relevant to its functions from reporting organisations (s 9(2)). Reporting organisations must comply “as far as practicable” with such requests unless expressly prohibited by another written law (s 9(3)). The Council is granted “all the powers it needs to perform its functions” (s 11). The Minister may require the Council to furnish information and documents, and the Council must comply (s 13(2)-(4)). These provisions enable administrative follow‑up and evidence gathering but do not themselves prescribe enforcement mechanisms such as injunctions or fines.

Ministerial controls:

• The Minister may give written directions to the Council about the performance of its functions and the Council must give effect to such directions (s 12(1)). Directions are subject to parliamentary notice requirements (s 12(2)-(6)). Ministerial removal powers for Council members are set out at s 15(2), with broad grounds including misbehaviour, neglect, incompetence, insolvency or absence without leave. These administrative levers affect the Council’s composition and activity and thereby indirectly shape compliance oversight.

Regulatory tools:

• The Governor may make regulations necessary to give effect to the Act (s 21). Regulations could in theory prescribe further compliance mechanisms, reporting details, or other procedural matters, but none are specified in the Act text itself. The Act expressly contemplates prescribed information to be included in reports (s 7(2)(b); s 10(2)(b)).

Consequences in practice:

• Non‑compliance consequences in the Act are principally reputational and procedural: public reporting, Council findings and recommendations, ministerial directions, and parliamentary scrutiny (ss 7, 9-12). The statute frames compliance as an organisational obligation to be documented and monitored rather than an offence that attracts statutory fines or criminal penalties within the Act itself.

Direct statutory cross‑references:

• The Act relies on definitions and constructs from several other statutes. The “carer” definition references the Disability Services Act 1993 s 3 for persons with disability and the Mental Health Act 2014 s 4 for mental illness (s 5(1)(a)-(b)). The definition of “public sector body” is by reference to the Public Sector Management Act 1994 s 3(1) (s 4). Reporting organisations are defined with reference to the Health and Disability Services (Complaints) Act 1995 and the Health Services Act 2016 (Schedule 2 items 1, 3, 3A, 2). The exclusions for volunteers link to the Volunteers and Food and Other Donors (Protection from Liability) Act 2002 s 3(1) (s 5(2)(b)).

Priority and limitation:

• The duty in s 6(1) is expressly made “subject to any other written law”. That language signals that if other statutes create conflicting duties or prohibitions, those laws will limit how organisations implement the Carers Charter obligations. The Act therefore contemplates coexistence and potential precedence issues with other regulatory regimes (s 6(1)).

Administrative reporting and financial management:

• Ministerial directions to the Council must be included in the annual report of the department under the Financial Management Act 2006 Part 5 (s 12(6)). The Act therefore links its transparency obligations into the Financial Management Act reporting cycle for departmental accountability.

Contractual and procurement interfaces:

• The Act requires reporting organisations to report on compliance or non‑compliance with the Carers Charter by contracted service providers (s 7(1)(d)). This creates an interface between the Act’s compliance and reporting obligations and procurement and contract management practices of reporting organisations. Contractual terms and monitoring arrangements will bear on how reporting organisations discharge their s 7 obligations.

Regulation-making power:

• The Governor in Council may make regulations for matters required or permitted by the Act, or necessary or convenient to give effect to its purposes (s 21). The Act anticipates that regulations may prescribe additional persons or bodies for Schedule 2 and may prescribe content for reports (s 7(2)(b); Schedule 2).

Indirect interactions:

• Because the “carer” definition references other Acts’ definitions (Disability Services Act, Mental Health Act), any amendments or judicial interpretation of those external definitions will affect who is captured by this Act. Similarly, changes to public sector definitions in the Public Sector Management Act could alter the subset of organisations subject to s 6(2).

Repeals and historical notes:

• The Act references the Child Welfare Act 1947 in s 5(3)(b); the notes indicate that that Act was repealed by the Children and Community Services Act 2004 s 250(1)(a). The compilation table records subsequent amending Acts and their commencement dates, which is relevant for historical interpretation and for tracking which external statutory references were in force at different times.

Compilation summary:

• The Act was originally assented on 28 October 2004 and commenced other than ss 1-2 on 1 January 2005 (Compilation table). The compilation table in the Act text lists subsequent amendments and their commencements. Notable amendments recorded in the compilation table and reflected in the body of the Act include:

Key amending instruments recorded in the compilation table:

• Financial Administration Legislation Amendment Act 2005 (No. 5 of 2005), assented 27 June 2005, commenced 1 January 2006. The Act text notes an amendment at s 12(6) referring to inclusion in the department’s annual report under the Financial Management Act 2006 Part 5 (amendment recorded as No. 5 of 2005 s 36).
• Volunteers (Protection from Liability) Amendment Act 2006 (No. 53 of 2006), assented 26 October 2006, commenced 2 December 2006. This amendment appears in s 5 with a footnote citation for the volunteer exclusion (s 5 amended: No. 53 of 2006 s 12(1)).
• Financial Legislation Amendment and Repeal Act 2006 (No. 77 of 2006), assented 21 December 2006, commenced 1 February 2007. This instrument is cited in s 12 amendments (No. 77 of 2006 Sch. 1 cl. 18).
• Health and Disability Services Legislation Amendment Act 2010 (No. 33 of 2010), assented 30 August 2010, commenced 30 November 2010. The long title was amended and Schedule 2 and other parts were modified (see compilation table; s 33(3) noted as Part 5 deleted).
• Public Sector Reform Act 2010 (No. 39 of 2010), assented 1 October 2010, commenced 1 December 2010. This Act amended s 17 on remuneration and allowances (No. 39 of 2010 s 89).
• Mental Health Legislation Amendment Act 2014 (No. 25 of 2014), assented 3 November 2014, commenced 30 November 2015. The carer definition refers to the Mental Health Act 2014 s 4 (s 5 amended No. 25 of 2014 s 37).
• Health Services Act 2016 (No. 11 of 2016), assented 26 May 2016, commenced 1 July 2016. Schedule 2 was amended to add or clarify reporting organisations tied to the Health Services Act (s 8 and Schedule 2 amendments referenced No. 11 of 2016 s 286).

Reprint:

• Reprint 1 of the Carers Recognition Act 2004 as at 4 March 2011 is recorded in the compilation table and includes the amendments listed up to that date.

Textual amendments visible in the Act:

• Section 5 carries amendment citations reflecting changes in 2006 and 2014. Section 8 was amended by the Health Services Act 2016 (No. 11 of 2016 s 286(2)), affecting consultation obligations for appointments. Section 17 was amended by the Public Sector Reform Act 2010. Section 12 carries amendment citations from earlier financial acts. Schedule 2 was amended in 2010 and 2016 to update the list of reporting organisations and the ability to prescribe others.

Implication of amendments:

• The amendment history demonstrates that the Act’s administrative structures and reporting designations have been updated to reflect broader health and public sector legislative reform over time. The compilation table records those amending instruments and commencement dates, which are material for practitioners tracking when particular duties or reporting obligations came into force.

No textual account of regulations:

• The Act provides a regulation‑making power (s 21) and references “prescribed” classes and persons (Schedule 2; s 5(1)(d); s 7(2)(b); s 10(2)(b)). The compilation table does not list specific regulations made under the Act; the Act text itself records only the principal amending Acts.

No cases recorded in the statute text:

• The Act’s text and compilation notes do not list any judicial decisions or specify litigation history. The schedule of amendments in the compilation table records only parliamentary amendments and commencement details; there are no references to reported cases, judicial interpretations or litigation outcomes in the Act as compiled.

Implication for practitioners:

• Because the Act establishes duties that are administrative, reporting and advisory, any litigation arising from it would likely engage issues of statutory interpretation (for example the meaning of “all practicable measures” or the scope of compliance obligations) or challenge of administrative decisions connected with the Council or Ministerial directions. The Act itself does not create express enforcement penalties or private rights of action in the text; absent external causes of action, litigation would likely be atypical and would depend on interaction with other statutes, common law remedies (such as judicial review) or contractual claims arising from procurement and contract terms. The Act does not provide guidance on standing to challenge omissions under the Act.

Search note:

• The absence of cases in the Act text means that users seeking litigation precedents should search case law databases and parliamentary records external to the Act to determine whether courts have interpreted the Act’s duties or the Charter since commencement.

Definition nuances and eligibility traps:

• The Act’s treatment of who is a “carer” contains layered qualifications. A person can meet the s 5(1) substantive description, yet be excluded under s 5(2) if they provide care under a contract for services or a contract of service (paid carers), or while doing community work as defined by the Volunteers Act (s 5(2)). Practitioners should note the parenthetical exception: an agreement entered into under the Disability Services Act 1993 s 25 is not treated as excluding a person from the carer definition (s 5(2)(a)). The s 5(3) wording that a person is not a carer “only because” they are a spouse, de facto partner, parent or guardian means that familial relationship alone does not automatically satisfy the Act’s definition, but it does not exclude such persons if they otherwise meet s 5(1). That “only because” formulation can create ambiguity in edge cases where relationship and caring duties overlap.

“All practicable measures” standard:

• The central duty in s 6(1) is to “take all practicable measures”. This is a non‑specific standard. The Act does not prescribe what measures are “practicable” in a given context, nor does it set minimum procedures or timelines. Organisations must therefore translate the standard into policy and record keeping. The lack of prescriptive steps is a compliance risk: regulators or the Council may judge adequacy on a case‑by‑case basis, but there is no statutory safe harbour.

Public sector involvement duty scope:

• The s 6(2) obligation requires public sector bodies to “involve carers, or persons or bodies that represent carers” in policy/program development or strategic/operational planning that might affect carers. The phrase “might affect carers and the role of carers” is broad and potentially expansive; organisations will need to take a conservative approach to identifying initiatives that trigger the duty. Failure to involve carers where the Council or Parliament later deems involvement appropriate may result in adverse findings in Council reports.

Reporting mechanics and deadlines:

• Reporting organisations must prepare and deliver annual reports “as soon as practicable after each 1 July and not later than 30 September” for the preceding financial year ended 30 June (s 7(1)). The specific window imposes a hard deadline; reports must also be made publicly available “in the prescribed manner” (s 7(4)). Practitioners should ensure internal timelines for evidence collection, contractual compliance checks (including for providers under contract), and sign‑off align with the statutory deadline. The Act permits the regulations to prescribe further reporting details (s 7(2)(b)), which can expand or complicate report content.

Contractual liability and oversight:

• Reporting organisations are required to report on compliance by contracted service providers with the Carers Charter (s 7(1)(d)). This creates an operational need to include Charter compliance clauses, monitoring, audit, and remedies in contracts. Contract managers must factor the Act’s reporting obligations into procurement and contract performance management to avoid gaps in annual reporting.

Ministerial control and Council independence:

• The Minister has power to give directions to the Council and the Council must give effect to them (s 12(1)). The Minister may also terminate appointments on broad grounds (s 15(2)). The Minister is entitled to Council information and may request documents and copies (s 13). Practically, this means the Council’s agenda, priorities and access to information are subject to ministerial control; organisations interacting with the Council should expect ministerial oversight to shape Council activity.

No statutory penalties:

• The Act contains no penalty provisions. Practitioners should note that non‑compliance’s immediate statutory consequence is reputational and administrative rather than punitive. However, reporting failures could attract parliamentary scrutiny, public criticism, or constraints in related funding or procurement contexts, none of which the Act itself makes explicit.

Regulation power and future expansion:

• The Act’s reliance on “prescribed” classes and the regulation‑making power (s 21 and Schedule 2 references) means that organisations not presently captured could be designated by regulation. Entities that presently consider themselves outside the Act should monitor regulations and legislative amendments.

Interplay with other written laws:

• The opening “subject to any other written law” qualifier in s 6(1) can limit Charter obligations where other statutory duties conflict. Organisations operating under multiple regulatory regimes should conduct a legal cross‑check to determine priority obligations and whether compliance with one statutory duty might preclude or limit compliance with the Charter.

Public disclosure format:

• The Act requires the report to be made available to the public “in the prescribed manner” (s 7(4)). The regulations may therefore set precise publication formats or platforms; failure to follow those prescription requirements could technically render an organisation non‑compliant even if substantive reporting is complete.

Practical compliance checklist for applicable organisations and reporting organisations:

1. Identify coverage

   • Map your organisation against Schedule 2 (reporting organisations and other organisations) and confirm whether you are a reporting organisation, an applicable organisation, or neither. Check whether any regulations have added prescribed entities (s 4; Schedule 2; s 21).

2. Clarify carer‑relevant activity

   • Identify services provided that “impact on carers and the role of carers” and any policy, program or strategic planning activity that “might affect carers” for public sector bodies (s 3; s 6(2)). Maintain a register of initiatives and decision points where involvement or Charter compliance must be considered.

3. Embed the Carers Charter into organisational policy

   • Translate Schedule 1 principles into operational policies: respect and dignity in service delivery; mechanisms for including carers in assessment, planning, delivery and review; procedures for recording and weighing carers’ views alongside care recipients’; and complaints handling that gives due attention to carers’ complaints (Schedule 1). Document how policies meet the “all practicable measures” standard (s 6(1)).

4. For public sector bodies: formalise carer involvement

   • Design and document processes to involve carers or representative bodies in policy/program development and strategic/operational planning that might affect carers (s 6(2)). Keep records of invitations, consultations, minutes and how carers’ input influenced outcomes. That evidentiary trail addresses the “as far as practicable” and “all practicable measures” standards.

5. Contract management and procurement

   • For reporting organisations, include contractual provisions requiring contracted providers to comply with the Carers Charter, to provide evidence of compliance, and to permit audits or reporting to the organisation (Schedule 2 Div 2 item 5; s 7(1)(d)). Maintain contract schedules linking contract performance indicators to Charter compliance.

6. Reporting cycle and content

   • Prepare an annual compliance report covering the items specified in s 7(1)(a)-(d). For public sector bodies, include details of compliance with s 6(2) (s 7(2)(a)). Identify any additional matters prescribed by regulation and ensure the report meets those requirements (s 7(2)(b)). Time the preparation so the report can be delivered to the Council “as soon as practicable after 1 July and not later than 30 September” and published in the prescribed manner (s 7(1); s 7(4)).

7. Information requests from the Council

   • Maintain systems for responding to Council written information requests promptly and “as far as practicable” (s 9(2)-(3)). Keep an up‑to‑date record of evidence supporting compliance claims, and flag any legal prohibitions that might prevent disclosure under another written law.

8. Internal governance and training

   • Train staff on the Charter’s principles and the practical expectations for interactions with carers. Ensure senior management and governance bodies are aware of reporting obligations, publication requirements, and the deadlines under s 7.

9. Ministerial and parliamentary transparency

   • Be prepared for findings and recommendations from the Council to be reported to the Minister and laid before Parliament (s 10(1)-(3)). Reporting organisations should consider reputational risk and prepare communications strategies in advance of public disclosure.

10. Monitor regulatory and legislative developments

    • Monitor regulations made under s 21 that may expand Schedule 2, prescribe report content, or change publication requirements. Track amendments to statutes referenced in the carer definition (Disability Services Act, Mental Health Act, Health Services Act, Public Sector Management Act) for any definitional spillover.

11. Risk management and documentation

    • Because the Act frames compliance as “all practicable measures” without specific sanctions, document the decision‑making processes, resource constraints, and reasons why particular measures were or were not practicable. That documentation provides a contemporaneous record should the Council or the Minister request information or comment.

12. Liaise with the Council

    • Consider proactive engagement with the Carers Advisory Council for guidance on what constitutes adequate compliance and to align organisational practices with the Council’s understanding of the Charter (s 9(1)). Be aware the Council must give effect to ministerial directions (s 12(1)), which may influence the Council’s advice.

13. Use the statutory review

    • The Minister must review the Act’s operation and effectiveness within three years of commencement and lay a report before Parliament (s 22). Organisations can use that review cycle to feed evidence about implementation challenges or to seek clarity about practical expectations.

Document templates and recordkeeping suggestions:

• Maintain a standard reporting template aligned with s 7(1) headings to streamline annual reporting.
• Maintain a register of consultations with carers (who was consulted, when, issues raised, how input influenced outcomes).
• Keep copies of all written requests from the Council and responses, and a record of any legal constraints to disclosure.
• Maintain contract clauses and compliance evidence for contracted providers.

In short, compliance is primarily administrative and documentation‑driven: identify coverage, translate Charter principles into concrete policy and contractual obligations, record consultation and decision‑making processes, and meet the statutory reporting and publication timelines (ss 6-7, Schedule 1, Schedule 2).
