Carer Recognition Act 2010

Definitions establish the Act’s operative categories and the unit of measurement for compliance.

• Carer (s 5): An individual who provides personal care, support and assistance to another individual because that person has a disability, medical condition (including terminal or chronic illness), mental illness, or is frail and aged (s 5(1)). The Act excludes persons providing care under a contract of service or contract for services, those doing voluntary work for a charitable, welfare or community organisation, and persons doing care as part of education or training (s 5(2)). It also clarifies that a person is not a carer merely because they are a relative or guardian, or live with the person needing care (s 5(3)).
• Public service agency and public service care agency (s 4(1)): “Public service agency” is the term used in the Public Service Act 1999. A “public service care agency” is a public service agency responsible for development, implementation, provision or evaluation of “care supports” (s 4(1) definitions).
• Associated provider (s 4(2)-(3)): The Act treats an entity that a public service care agency funds or contracts to undertake development, implementation, provision or evaluation of care supports as an “associated provider” for those funded activities; subcontracted entities similarly become associated providers. The definition does not apply to a contract or funding arrangement with a State or Territory (s 4(3)). The general definition of “agent” includes contractors (s 4(1)).
• Statement for Australia’s Carers (s 6; Schedule 1): Ten principles about carers’ rights, wellbeing, participation, recognition, dignity and the nature of the relationship between carers and care recipients. The Statement is the substantive policy content the Act asks agencies to reflect in policy and practice; the Schedule sets out each principle in numbered paragraphs.

Operational standards in the Act are framed in soft, procedural language rather than mandatory legal duties. Key operational verbs are “take all practicable measures” (used in ss 7, 8(1), 9) and “have due regard to” (used in s 7(2) for HR policies). The obligation to consult carers appears only in relation to developing or evaluating care supports by public service care agencies (s 8(2)). Compliance reporting is required but limited to inclusion in the agency’s statutory annual report for each reporting period (s 8(3)-(4)); “annual report” is defined to mean a report required by the Public Service Act 1999 or another Act that establishes the agency (s 4(1)).

The Act’s legal force is expressly limited: it does not create enforceable legal rights and non‑compliance is not a ground for review (s 10(1)-(2)). It also clarifies it must not be taken to require acting inconsistently with other Commonwealth or State/Territory laws that impose particular considerations or requirements (s 10(3)). The Governor‑General may make regulations to prescribe matters necessary or convenient to carry out the Act (s 12).

The Act targets specific institutional and private actors:

• Commonwealth public service agencies (s 4(1)). Every public service agency must take measures for employee and agent awareness and develop HR policies with “due regard” to carers’ needs where HR policy may significantly affect an employee’s caring role (s 7(1)-(2)). The Act therefore applies across the Commonwealth public service as defined by the Public Service Act 1999; the Act ties compliance reporting to the agency’s existing statutory annual reporting obligations (s 4(1) definition of “annual report”; s 8(3)).
• Public service care agencies (s 4(1)): a subset of public service agencies that develop, implement, provide or evaluate care supports. These agencies have additional obligations: reflecting Statement principles in care supports, consulting carers or representative bodies when developing or evaluating care supports, and reporting on compliance each reporting period in their annual report (s 8(1)-(4)).
• Associated providers (s 4(2), s 9): entities that are funded or contracted by a public service care agency to undertake care support activities become associated providers for those funded activities, and must take all practicable measures to ensure awareness of the Statement among officers, employees and agents and to reflect the Statement in their activities (s 9). Subcontractors of a funded entity are similarly captured (s 4(2)(b)). Contracts or funding arrangements with a State or Territory are excluded from this definition (s 4(3)), so State/Territory funding lines fall outside the associated provider obligation.
• Employees and agents of public service agencies and associated providers: the Act requires agencies and providers to ensure employee and agent awareness and action reflecting the Statement (s 7(1), s 8(1), s 9). The Act defines “agent” to include contractors (s 4(1)), therefore contractors engaged by a public service agency can be treated as agents covered by the awareness and action obligations.
• Carers themselves: the Act defines which individuals are treated as carers for purposes of the Statement (s 5). The Act also requires public service care agencies to consult carers or bodies representing carers when developing or evaluating care supports (s 8(2)). The Statement’s principles in Schedule 1 set out the rights, needs and expectations that agencies are to reflect.

Who is not covered or is expressly excluded:

• Individuals providing care under employment contracts or service contracts, those volunteering for charitable/welfare/community organisations, and persons providing care as part of education or training are expressly excluded from the Act’s definition of carer (s 5(2)). Family relationship or co‑residence does not, by itself, create carer status (s 5(3)).
• Entities contracting with or funded by State or Territory governments for care supports are not treated as associated providers by the Act (s 4(3)).
• The Act does not bind State or Territory laws that establish carer charters; it is not intended to exclude such laws (s 11).

The locus of decision and cost is primarily at the Commonwealth agency and associated provider level: agencies decide their practicable measures and HR policy adjustments, funders decide contract terms for associated providers, and associated providers must adapt their practices where they undertake funded activities. Compliance costs therefore fall on Commonwealth agencies and their funded providers; carers themselves obtain consultative rights but not legally enforceable rights under the Act (see s 8(2) and s 10).

The Act establishes duties of conduct (administrative and procedural) rather than enforceable legal rights. The operative duties and entitlements are:

Duties on all public service agencies (s 7)

• Awareness and understanding: Each public service agency must “take all practicable measures” to ensure its employees and agents have an awareness and understanding of the Statement for Australia’s Carers (s 7(1)).
• Human resources policies: Each public service agency must develop internal HR policies “having due regard to the Statement” so far as those policies may significantly affect an employee’s caring role (s 7(2)). The duty is directional: “due regard” rather than a prescriptive standard.

Additional duties on public service care agencies (s 8)

• Reflection of principles in care supports: Public service care agencies must take “all practicable measures” to ensure the agency and its employees and agents “take action to reflect the principles of the Statement” when developing, implementing, providing or evaluating care supports (s 8(1)). This applies to both policy design and program delivery activities related to care supports.
• Consultation: Public service care agencies must consult carers, or bodies representing carers, when developing or evaluating care supports (s 8(2)). The Act does not prescribe consultation method, timing, or minimum engagement standards; it requires consultation as a discrete duty.
• Reporting: Public service care agencies must prepare an explanatory report on their compliance with s 7 and s 8 in each reporting period; this report must be included in the agency’s annual report (s 8(3)). The requirement applies from the first full reporting period after commencement and thereafter (s 8(4)). “Annual report” is defined by reference to the Public Service Act 1999 or the establishing Act for the agency (s 4(1)).

Duties on associated providers (s 9)

• Awareness: Associated providers must take all practicable measures to ensure officers, employees and agents have an awareness and understanding of the Statement (s 9(a)).
• Reflection of principles: Associated providers must take all practicable measures to ensure they and their officers, employees and agents “take action to reflect the principles of the Statement” in developing, implementing, providing or evaluating care supports (s 9(b)). Associated providers become subject to these duties by virtue of contracts or funding arrangements with public service care agencies (s 4(2)).

Rights (statutory)

• The Act does not create enforceable rights (s 10(1)). Carers’ rights and entitlements in Schedule 1 are aspirational principles the Act requires agencies and associated providers to consider and reflect in practice, but they are not judicially enforceable rights.
• Carers have a consultation entitlement when public service care agencies are developing or evaluating care supports (s 8(2)), but because s 10 precludes enforceability, the practical effect of that entitlement will be administrative rather than a basis for legal remedy.

Limitations on legal effect (s 10)

• No judicially enforceable rights or duties are created (s 10(1)).
• Failure to comply does not affect the validity of decisions nor act as a ground for review or challenge (s 10(2)).
• The Act is not to be read as requiring inconsistency with other Commonwealth or State/Territory laws that impose particular considerations (s 10(3)).

Mechanics of coverage and reach

• “Agent includes a contractor” (s 4(1)), meaning agencies are required to take measures that cover their contractors when ensuring awareness of the Statement.
• “Associated provider” extends beyond primary contractors to subcontractors when performing funded activities (s 4(2)(b)). The Act thus creates obligations that can follow funding chains at Commonwealth level, except where the contract is with a State or Territory (s 4(3)).

In short, the Act imposes administrative duties on Commonwealth agencies and funded providers to embed a Statement of principles across HR policy, program design and delivery, and to consult carers in program development or evaluation. It expressly withholds legal enforceability and review remedies for carers or third parties.

The Act contains no penal sanctions, civil remedies, or enforcement mechanisms within its text. Its enforcement architecture is administrative and reporting‑based rather than judicial. Key points from the statutory text:

• No legal enforceability (s 10(1)): The Act expressly states it does not create rights or duties that are legally enforceable in judicial or other proceedings. There is therefore no private right of action or statutory cause of action created by the Act itself.
• Non‑justiciability of non‑compliance (s 10(2)): A failure to comply with the Act is not a ground to review or challenge agency decisions, and does not affect the validity of any decision. This precludes judicial review or administrative challenge based solely on non‑compliance with the Act’s duties.
• Interaction with other legal obligations (s 10(3)): The Act cannot be read to require an agency or associated provider to act inconsistently with other Commonwealth law or State/Territory law requiring consideration of particular matters or compliance with particular requirements. That provision limits the possibility of interpreting the Act as altering statutory duties elsewhere.
• Reporting obligation (s 8(3)-(4)): The only express enforcement conduit is transparency via reporting. Public service care agencies must prepare a report on compliance with ss 7 and 8 each reporting period, and include it in the agency’s annual report. That embeds reputational and parliamentary oversight as the principal accountability mechanism.
• Regulations (s 12): The Governor‑General may make regulations “prescribing matters required or permitted by this Act to be prescribed” or matters necessary or convenient to carry out the Act. While the Act itself contains no penalties, the regulations power could, in principle, be used to create further administrative requirements or processes. The Act does not, however, specify any regulatory penalty powers; any such power would need to be created by regulation within the scope of s 12.

Practical enforcement therefore rests on internal compliance regimes within Commonwealth agencies, contractual conditions placed on associated providers, and oversight through annual reports and parliamentary or public scrutiny. The Act provides no statutory mechanisms for third parties to compel compliance, obtain injunctive relief, or recover damages based on contravention of the Statement or the Act’s duties.

Because the Act expressly denies enforceable rights and reviewable obligations (s 10), any enforcement action,if pursued, would be by administrative means: departmental audits, inclusion in annual reports, contractual remedial clauses applied by funding agencies to associated providers, or by political and public accountability channels. The Act also does not prescribe monitoring or auditing arrangements; those would arise from agency practice, contract terms, or potential regulations not contained in the text.

The Act incorporates and limits interaction with other Commonwealth and State/Territory laws in explicit terms.

Connections to other Commonwealth laws

• Public Service Act 1999: The Act relies on the Public Service Act for the definition of “public service agency” (s 4(1)) and for the meaning of “annual report” for reporting obligations (s 4(1) definition of “annual report” states it means an annual report required by a provision of the Public Service Act 1999, or by a provision of another Act that establishes the agency). The reporting obligation in s 8 requires insertion of the compliance report into the agency’s statutory annual report, which ties the Act’s transparency mechanism to existing statutory reporting regimes under other Commonwealth legislation.
• Non‑inconsistency with other statutory duties: Section 10(3) provides that nothing in the Act is to be taken to require an agency or associated provider to act inconsistently with a Commonwealth law or a State/Territory law that requires consideration of particular matters or compliance with particular requirements. That places a limiting construction on the Act and prioritises other statutory obligations where there is potential conflict.

Interaction with State and Territory laws

• Preservation of State/Territory carers charters: Section 11 expressly states the Act is not intended to exclude any State or Territory law that establishes a carers charter or otherwise provides for recognition of carers. The Commonwealth Act therefore operates alongside State and Territory carers’ laws rather than displacing them.
• Associated provider exclusion: Subsection 4(3) excludes contracts or funding arrangements between a public service care agency (or another person or body) and a State or Territory from the “associated provider” definition, so State/Territory funded entities are not captured as associated providers by the Commonwealth Act. That carve‑out can create differences in obligations depending on whether funding is Commonwealth or State/Territory sourced.

Contractual and procurement consequences

• Agent and associated provider concepts connect the Act to contracting practices. “Agent includes a contractor” (s 4(1)), and associated provider status arises where a public service care agency contracts or funds an entity to undertake care supports (s 4(2)). Agencies can therefore impose contract terms that reflect Act obligations and ensure associated providers adopt required measures. The Act itself does not prescribe contract terms, but its structure anticipates embedding the Statement via funding and procurement relationships.

Rights and remedies

• The Act’s explicit non‑enforceability clause (s 10(1)-(2)) means it does not create civil or administrative remedies. Consequently, compliance with the Act must be managed through administrative and contractual channels; litigation under the Act itself is precluded by the statute’s language.

Regulations

• The Governor‑General’s regulations power (s 12) permits prescription of matters necessary to give effect to the Act, though no regulations are contained in the text. Regulations could be used to specify implementation or reporting detail, within the Act’s stated limits.

Net effect

• The Act operates as a Commonwealth administrative overlay: it uses definitions from existing Commonwealth law to target agencies and ties its reporting and transparency mechanism to existing annual report duties. It acknowledges and preserves State/Territory carers’ laws and excludes State/Territory contracting from the associated provider concept. The Act does not displace other statutory duties and forbids judicial enforceability of its obligations, thereby making its interaction with other laws primarily one of coordination through administrative practice and contracting rather than of statutory primacy or direct legal effect.

The text provided does not include any amendment schedule, repeal provisions or historical amendments to the Carer Recognition Act 2010. The Act as presented contains a commencement provision and an assented date:

• Short title and commencement: The Act may be cited as the Carer Recognition Act 2010 (s 1). It commences on the day it receives Royal Assent (s 2). The copy supplied records the Act as assented to on 18 November 2010 in the heading.
• No textual amendments shown: The provided text contains the Act’s operative provisions but does not include subsequent amendment notes, expiry provisions, transitional arrangements or any legislative history beyond the Minister’s second reading speech dates noted at the end. There is no schedule of amendments, no section specifying repeal or sunset, and no marginal notes indicating later changes within the source provided.
• Reporting commencement timing: For agency reporting obligations, s 8(4) specifies that the obligation to prepare a report on compliance applies to the first full reporting period of the agency that starts on or after the commencement of the Act and to all subsequent reporting periods. That provides the statutory anchoring point for when reporting obligations formally began relative to the Act’s commencement date.
• Regulations power: Section 12 contemplates future regulations by the Governor‑General for matters required or permitted to be prescribed or necessary or convenient to give effect to the Act. The Act therefore leaves open the possibility of implementing or procedural changes by regulation, but the provided text contains no such regulations.

Implication for users: because the source does not supply amendments, readers should not infer any post‑2010 changes from this document. If practitioners require up‑to‑date status, they must consult the consolidated statute register or parliamentary records for any amendments or regulations made after the Act’s commencement. Within the scope of the supplied text, the Act’s substantive content and reporting cycle commencement are as enacted in 2010.

The provided Act text contains no cases, no reported litigation, and no judicial interpretations. There is also no statutory cause of action created by the Act. Key points relevant to litigation prospects based on the text:

• No enforceable rights (s 10(1)): The Act explicitly prevents the creation of rights or duties that are legally enforceable in judicial or other proceedings. That textual bar makes direct litigation under the statute for breach of its duties unavailable.
• Non‑reviewability (s 10(2)): The Act also provides that failure to comply does not affect the validity of decisions and is not a ground for review or challenge. This removes the possibility of judicial review based solely on non‑compliance with the Act’s consultation or awareness duties.
• Interaction with other laws (s 10(3)): The Act cannot be used to require inconsistency with other Commonwealth, State or Territory laws. If litigation arises, it is more likely to be about the operation of other statutes or contractual obligations rather than the Carer Recognition Act itself.
• Practical litigation vectors: Because the Act does not create private remedies, litigation that touches on issues the Act addresses is more likely to rely on:
  • Contract law: An associated provider or a public service agency’s contractual obligations (including contract terms requiring adherence to the Statement) could be enforced through normal contractual remedies if those terms are included in procurement documents.
  • Administrative law under other statutes: If a public service agency’s decisions are reviewable under other Commonwealth law (for example, statutes establishing the agency or other procedural statutes), affected persons might seek review under those statutes, not under the Carer Recognition Act itself.
  • Statutory causes of action created elsewhere: If State or Territory carers’ charters or other Commonwealth statutes create enforceable rights, litigation would proceed under those laws rather than this Act.
• Absence of judicial gloss: Because the Act excludes enforceability and the source includes no litigation references, there is no statutory interpretative guidance from courts within this text. Any judicial treatment of the Act’s language in practice would be outside the content of the supplied document.

In sum, the Act by its terms limits litigation directly under its provisions. The most likely litigation history, if any, would be indirect, through contractual disputes or judicial review under other statutory regimes, not through causes of action derived from the Carer Recognition Act itself. The supplied material does not record any such cases.

Practitioners and compliance officers should note a set of specific drafting features that produce discrete operational consequences:

• No legal enforceability: The Act explicitly disclaims judicial enforceability (s 10(1)) and makes non‑compliance non‑reviewable (s 10(2)). This means that stakeholders cannot rely on the Act as a legal lever to compel agencies to act, obtain remedies, or invalidate decisions. The Statement’s principles are aspirational unless implemented through contract or other statutory obligations.
• “All practicable measures” is an imprecise standard: Key duties use the phrase “take all practicable measures” (ss 7(1), 8(1), 9). The Act does not define what measures are “practicable” or set minimum standards for timing, form, or substance of awareness‑raising, HR policy adjustments, consulting processes, or how principles must be reflected. That creates compliance uncertainty and discretion for agencies about how much effort suffices.
• Reporting relies on pre‑existing annual report obligations: The compliance reporting duty in s 8(3) requires inclusion in an agency’s annual report, which is in turn defined by reference to the Public Service Act 1999 or another establishing Act (s 4(1)). If an organisation is a public service care agency but lacks a statutory annual report requirement under those Acts, the mechanics of the reporting duty may be unclear; in practice, the definition restricts the duty to agencies with an existing statutory obligation to produce annual reports.
• Contractual cascade and State/Territory carve‑out: The associated provider concept applies along funding chains, that is, subcontractors become associated providers under s 4(2)(b). However, s 4(3) excludes contracts or funding arrangements with a State or Territory. Where funding flows through States or Territories, the Commonwealth Act’s associated provider obligations will not automatically capture downstream providers. This creates potential compliance gaps depending on the funding pathway.
• Exclusions in definition of “carer”: The Act does not treat persons providing care under a contract of service, as volunteers for charitable organisations, or as part of education or training as “carers” (s 5(2)). Similarly, family relationship or co‑residence alone does not make a person a carer (s 5(3)). These exclusions matter when designing consultation processes or eligibility criteria for supports that are informed by the Statement.
• No prescribed consultation standard: s 8(2) requires public service care agencies to consult carers or bodies representing carers when developing or evaluating care supports, but the Act supplies no detail on timing, scope, who qualifies as a representative body, or required outcomes. Agencies will need to design and define consultation processes themselves, which can create inconsistency and potential disputes about whether adequate consultation occurred, though such disputes cannot be litigated under the Act itself because of s 10.
• Agents and contractors: The Act defines “agent” to include contractors (s 4(1)), and associated provider obligations extend to funded entities and subcontractors (s 4(2)). Agencies must therefore decide how to allocate contractual responsibility and monitor compliance across their procurement supply chain. Failure to impose contractual obligations on associated providers will not expose agencies to statutory penalties under this Act, but may undermine compliance in practice.
• No prescribed regulator or oversight body: The Act gives no role to a regulator, ombudsman or enforcement agency for monitoring compliance; oversight is via annual reports and, potentially, internal audit and parliamentary scrutiny. This places weight on agencies’ internal governance arrangements.
• Possible divergence from State/Territory regimes: Because the Act preserves State/Territory carers’ laws (s 11) and excludes State/Territory contracts from the associated provider definition (s 4(3)), there can be divergent obligations depending on whether a care support is funded or regulated by Commonwealth or State/Territory actors. Contracts spanning Commonwealth and State funding may therefore require careful drafting to avoid compliance gaps.

These features mean compliance is largely an administrative and contractual design question for agencies and associated providers. Absent contractual incorporation or another statutory obligation, the Statement’s principles are not a legal remedy or direct enforcement instrument.

The Act’s obligations are procedural and administrative. Compliance requires documented, proportionate measures that are defensible as “all practicable measures” and “due regard” under the circumstances. Below is a practitioner‑oriented checklist and recommended steps, each tied to the Act’s text.

1. Identify whether the agency is within scope

   • Confirm whether the entity is a “public service agency” as defined in the Public Service Act 1999 (s 4(1)). If the agency develops, implements, provides or evaluates care supports, classify it as a “public service care agency” to trigger the additional duties (s 4(1)). If unsure, document the functional basis for the classification.

2. Adopt and publish the Statement internally

   • Ensure the Statement for Australia’s Carers (Schedule 1) is available to staff and agents. The Act requires awareness and understanding among employees and agents (s 7(1); s 9(a)). Practical steps include intranet publication, staff briefings, and onboarding material for contractors.

3. Embed the Statement in HR policy where relevant

   • Review internal HR policies and update them “having due regard to the Statement” to the extent they significantly affect an employee’s caring role (s 7(2)). For example, flexible work arrangements, leave policies, and performance management guidance that significantly impinge on carers’ roles should be reviewed and documented with a rationale referencing the Statement.

4. Take “all practicable measures” to reflect Statement principles in care supports

   • For public service care agencies, ensure program design, service delivery, and evaluation documents record how the Statement’s principles were considered and reflected (s 8(1)). Use policy templates, checklists and decision records to show the measures taken, including risk assessments and resource implications where needed.

5. Design and document consultation processes with carers

   • Where developing or evaluating care supports, consult carers or carer representative bodies (s 8(2)). Set out in writing: who was consulted, how they were selected, consultation materials, dates, and how consultation feedback was incorporated into final decisions. Even though the Act does not provide legal remedies, documenting consultation supports internal accountability and parliamentary reporting.

6. Contractual allocation for associated providers

   • Where a public service care agency funds or contracts an entity to perform care supports, include provisions in contracts requiring associated providers to:
     • Ensure officers, employees and agents are aware of the Statement (s 9(a));
     • Take measures reflecting the Statement when delivering the funded activities (s 9(b));
     • Provide evidence of compliance on request, e.g., implementation plans or training records.
   • Ensure subcontracting chains are addressed, since subcontractors become associated providers under s 4(2)(b). For funding arrangements that involve States/Territories, note s 4(3) excludes those contracts from associated provider status; in such cases incorporate comparable contract terms if appropriate.

7. Prepare and include compliance reports in annual reports

   • Public service care agencies must prepare a report each reporting period on compliance with ss 7 and 8 and include it in the agency’s annual report (s 8(3)-(4)). Use the agency’s annual reporting timetable under the Public Service Act 1999 or the agency’s establishing Act to time the compliance reporting. The compliance report should set out measures taken, consultation records, outcomes, and plans for the next period.

8. Train staff and agents

   • Implement training modules, webinars, or briefing sessions targeted at employees and agents most likely to interact with carers or design care supports, to satisfy s 7(1) and s 9(a). Maintain attendance records and materials as evidence of “practicable measures.”

9. Audit and records retention

   • Maintain records of policies, training, consultations, and contractual clauses to demonstrate compliance in the annual report. Internal audits can validate whether the “practicable measures” standard has been met and identify gaps for remediation.

10. Monitor regulatory and legislative environment

• The Act allows regulations (s 12). Monitor for any regulations made under s 12 that prescribe implementation or reporting details. Also monitor State/Territory carers’ laws (s 11) for interactions and potential obligations that may affect Commonwealth programs.

11. Consider risk allocation and communication

• Because the Act precludes enforceable rights (s 10), manage expectations with carers and stakeholders about the legal status of the Statement. Use consultation to manage stakeholder expectations and communicate how feedback was or was not adopted.

12. Contract drafting for cross‑jurisdictional funding

• For arrangements involving both Commonwealth and State/Territory funding, ensure contracts explicitly allocate responsibilities with respect to adherence to carers’ principles, recognising s 4(3) excludes State/Territory contracts from associated provider status.

Practical templates and controls that agencies might incorporate

• A short Statement implementation plan template that records objectives, actions, responsible officers, timeline and evidence.
• A consultation log template listing consultees, materials provided, submissions received and how input influenced outcomes.
• Contract clauses for associated providers requiring awareness training, incorporation of the Statement principles into delivery, reporting obligations and rights to audit compliance.
• An annual compliance report template aligned to the agency’s annual report structure that collates evidence against ss 7 and 8.

Because the Act provides no penalty regime and disclaims legal enforceability, compliance is best pursued through clear governance, contractual levers, transparent reporting and documented consultation. Those administrative controls are the primary levers available under the Act’s scheme to operationalise the Statement and demonstrate that “all practicable measures” and “due regard” have been applied.
