Plain English Summary

1/10 complexity

This instrument draws a line in the sand for landfill gas projects under the Carbon Farming Initiative (CFI). It sets 1 July 2012 as the landfill legacy date.

What this means:

Landfill legacy emissions are methane (a potent greenhouse gas) released from rubbish that was already buried before the CFI began rewarding capture activities
Waste deposited in landfills before 1 July 2012 is classified as "legacy" waste
Landfill operators can earn carbon credits by capturing and destroying methane from this old waste, provided they meet other requirements in the Act

Essentially, this date determines which rotting rubbish piles qualify for credits under the "legacy" category versus new waste streams.
