Carbon Credits (Carbon Farming Initiative) (Audit Thresholds) Instrument 2025

The instrument operates through a small number of interlocking concepts, each defined or invoked in the text.

Audit threshold and threshold bands (clause 6)

• Annual average abatement amount is the metric used to classify projects into three bands: Threshold A (≤50 000 tCO2‑e), Threshold B (50 001-150 000 tCO2‑e) and Threshold C (>150 000 tCO2‑e). The instrument ties audit scheduling to these bands.

New project and transitioning project (clause 5; clause 7)

• “New project” is defined in clause 5 as an eligible offsets project, other than a transitioning project which is not required to have an initial audit. The schedule for required subsequent audits in clause 7 differentiates between new projects and transitioning projects not required to have an initial audit, indicating different compliance burdens based on project lifecycle status.

Subsequent audits and initial audits (clauses 5 and 7)

• The instrument sets the number of subsequent audits required once a project meets a threshold (clause 7). It relies on the CFI Rule’s existing definitions of initial audit and subsequent audit (clause 5 note) but does not alter those definitions. For new projects: Threshold A = 2 subsequent audits; Threshold B = 3; Threshold C = 5. For transitioning projects not required to have an initial audit: Threshold A = 3; Threshold B = 4; Threshold C = 6.

Trigger audit threshold (clause 8)

• The instrument sets a numerical trigger at 100 000 tCO2‑e. The instrument labels this as the “trigger audit threshold” (clause 8). The instrument does not elaborate within its text what procedural steps follow on surpassing or meeting that trigger; it merely sets the numeric threshold.

Alternative assurance projects (clause 9)

• Clause 9 implements subsection 73(7) of the CFI Rule by declaring eligibility conditions for alternative assurance projects. The mechanism specifies: the class of project (column 1), the prescribed methodology determination that applies (column 2), project criteria (column 3), operational/monitoring/reporting conditions for the proponent (column 4), and the number of scheduled audits and whether the first is an initial audit (column 5). The specified classes are limited to low‑risk plantings and plantation forestry projects, each with area caps and geospatial monitoring requirements.

Geospatial tool monitoring and project proponent criteria (clause 9)

• Several listed alternative assurance items require the project to be subject to Clean Energy Regulator geospatial tool monitoring. Some require the project proponent or nominee of multiple proponents to hold particular land interests (freehold, leaseholder, native title holder or registered native title body corporate); others require projects to be modelled in a specific way in FullCAM. The items also impose a maximum aggregate carbon estimation area of 200 hectares.

Administrative repeal (Schedule 1)

• Schedule 1 repeals the 2015 Audit Thresholds instrument in full, removing the prior instrument from the legal framework and replacing it with the current thresholds and alternative assurance designations.

Authority and commencement (clauses 2-4)

• The instrument begins the day after registration (clause 2) and is made under s75(4) of the CFI Rule (clause 3). Clause 4 confirms that instruments listed in Schedule 1 are repealed as set out.

Terminology linkage to parent laws (clause 5 note)

• The instrument explicitly depends on definitions and procedural rules contained in the Carbon Credits (Carbon Farming Initiative) Act 2011 and the CFI Rule 2015 for key terms such as “eligible offsets project”, “initial audit” and “subsequent audit”.

Together these concepts create a rule set that maps project scale and design to audit frequency, while carving out specific low‑risk project classes for lighter audit regimes provided they meet defined technical and monitoring conditions.

The instrument affects stakeholders associated with eligible offsets projects under the Carbon Farming Initiative framework, in particular:

Project proponents and nominees

• Any proponent of an eligible offsets project must classify the project by annual average abatement amount to determine the applicable audit threshold (clause 6). Proponents of projects that are “new projects” will face a different number of subsequent audits than proponents of transitioning projects not required to have an initial audit (clause 7). For specified low‑risk project classes, only proponents who meet the land tenure and reporting/monitoring conditions in clause 9 will qualify for alternative assurance treatment.

Owners and holders of land interests

• Clause 9(3) Item 1 and Item 3 require that the project proponent, or the nominee of multiple project proponents, be a freehold title holder, leaseholder, native title holder or registered native title body corporate for all project areas. That requirement makes eligibility for certain reduced‑audit classes contingent on land interest position.

Verification, auditing and assurance service providers

• The instrument changes the audit volume and scheduling that audit and assurance providers can expect for projects of different sizes. For projects falling into larger threshold bands (Threshold C), the required number of subsequent audits is higher (clause 7). Conversely, specific alternative assurance projects may have zero scheduled audits (clause 9(3) Item 1 and Item 3) or a single initial audit (Item 2), shifting demand patterns for auditors.

Clean Energy Regulator

• The instrument was made by the Regulator (clause 3) and expressly enables the Regulator to use geospatial tool monitoring for qualifying projects (clause 9). The Regulator also retains the ability to amend a project’s audit schedule if a project ceases to meet qualifying criteria (clause 9 note, referencing paragraph 73(5)(ab) of the CFI Rule). The Regulator will therefore make decisions about classification, monitoring and audit scheduling in practice.

Project designers and methodology users

• The instrument expressly predicates certain alternative assurance eligibility on using specified methodology determinations, for example the 2014 and 2024 FullCAM Reforestation by Environmental or Mallee Plantings determinations, and the 2022 Plantation Forestry methodology determination (clause 9(3) table, column 2). Project designers must ensure the applicable methodology determination applies to the project if they seek alternative assurance treatment.

Transitioning projects

• Projects that are transitioning under the broader CFI regulatory regime but are not required to have an initial audit are explicitly subject to a higher number of required subsequent audits than new projects when they meet an audit threshold (clause 7). That differentiation affects those project proponents in terms of audit scheduling burden.

Other market participants

• While the instrument does not set market mechanisms such as credit issuance, the changed audit schedule and the availability of alternative assurance for certain small, geospatially monitored projects will affect the cost and timing profile for generating and verifying credits, which in turn can influence market participants who purchase or finance projects.

What the instrument does not do in respect of who it affects

• The instrument does not specify who bears the financial costs of audits, nor does it state penalties or enforcement procedures; it therefore affects stakeholders primarily through procedural obligations rather than by specifying monetary liabilities within its text. It also does not define the measurement method for the “annual average abatement amount” within the instrument itself; that metric is used as the classification basis but its detailed calculation is found in the Act and CFI Rule (clause 5 note).

In summary, the instrument reallocates audit effort and monitoring expectations across project sizes and specified low‑risk classes, affecting project proponents, landholders, auditors, the Regulator and project designers, while leaving several operational details (cost allocation, calculation specifics, enforcement steps) to the parent legislative framework.

The instrument primarily imposes regulatory obligations in the form of audit schedules and eligibility criteria and also identifies administrative rights of the Regulator to amend schedules. It does not enumerate penalties or specify detailed compliance processes; those remain in the parent Act and Rule, which the instrument references.

Key duties imposed directly by the instrument

• Classification duty: Project proponents must determine the project’s annual average abatement amount in order to identify the audit threshold applicable to the project (clause 6). The duty is to classify under Threshold A, B or C, using the amounts set out in clause 6.
• Audit exposure duty: Once a project meets an audit threshold, the project is subject to a specified number of subsequent audits depending on whether it is a new project or a transitioning project that is not required to have an initial audit (clause 7). For new projects the subsequent audit counts are 2 (A), 3 (B) and 5 (C); for the relevant transitioning projects the counts are 3, 4 and 6. Proponents therefore have a duty to be audit‑ready for the number of scheduled audits specified.
• Alternative assurance eligibility compliance: To obtain the alternative assurance status under clause 9, proponents must meet the prescribed methodology, project‑level criteria (for example maximum carbon estimation area of 200 hectares and modelling requirements), and any operational/monitoring or reporting conditions in column 4 of the relevant item (clause 9(1) and 9(3) table). Where column 4 requires geospatial tool monitoring, the project must be subject to that monitoring.
• Ongoing eligibility duty: Where a project initially qualifies as an alternative assurance project, the proponent must continue to satisfy the listed criteria and conditions. The note after the table records that if a project ceases to satisfy a criterion or condition, the Clean Energy Regulator may amend the audit schedule under paragraph 73(5)(ab) of the CFI Rule (clause 9 note). That creates a continuing duty for proponents to remain within the qualifying criteria to retain lighter audit treatment.

Powers and administrative rights held by the Clean Energy Regulator

• The instrument is made under the Regulator’s delegated authority (clause 3). Clause 9 explicitly contemplates Regulator action to amend a project’s audit schedule if criteria cease to be met (clause 9 note). The Regulator therefore has a decision‑making role over both initial classification for alternative assurance and any subsequent schedule amendments.

Rights implicit in the instrument

• Eligibility right to alternative assurance: Projects that meet the specific criteria in clause 9(3) are eligible to be treated as alternative assurance projects (clause 9(1)). That is a right to a modified audit schedule, including in some cases zero scheduled audits or a single initial audit (clause 9(3) column 5).
• Continuity right subject to conditions: A project that continues to meet the listed criteria retains its audit schedule unless the Regulator amends it; the instrument does not provide automatic suspension of auditing while reassessment occurs.

Matters not specified in the instrument that affect duties and rights

• The instrument does not set out who pays for audits, the form of audits, the content of audit reports, the administrative process for scheduling audits, appeal or review rights or direct enforcement steps. Those procedural and enforcement aspects are governed by the CFI Act and the CFI Rule as referenced in clauses 3 and 5. Consequently, proponents will need to consult the parent instruments for duties such as appointing auditors, timeframes, or contesting audit decisions.

Operational implications for duties

• Proponents must align their project design and monitoring (for example, geospatial monitoring and FullCAM modelling) to the exact methodology determinations and project criteria set out in clause 9(3) to qualify for alternative assurance treatment. The instrument converts technical project design elements into audit obligations and opportunities.

In short, the instrument establishes duties to classify project size, to be prepared for a specified number of audits once thresholds are met, and to meet narrowly defined eligibility requirements to benefit from reduced audit schedules, while conferring administrative discretion on the Regulator to amend schedules where criteria lapse.

The instrument itself contains no specific penalty provisions, infringement schedules, fine amounts or criminal sanctions. It is procedural and prescribes audit thresholds and audit schedules; it does not directly specify enforcement mechanisms or penalties for non‑compliance within its text. The instrument explicitly relies on the broader Carbon Credits (Carbon Farming Initiative) Act 2011 and the Carbon Credits (Carbon Farming Initiative) Rule 2015 for the substantive legal framework, including definitions and likely enforcement provisions (clause 5 note and clause 3).

What the instrument does state about enforcement power

• Clause 9 and the accompanying note reference paragraph 73(5)(ab) of the CFI Rule as the mechanism by which the Clean Energy Regulator may amend an audit schedule if a project ceases to satisfy a criterion or condition in the alternative assurance table. That reference establishes a specific administrative consequence (amendment of audit schedule) for ceasing to meet eligibility criteria, but does not itself state penalties or enforcement steps beyond schedule change.

Absent penalties in the instrument

• Because the instrument does not enumerate penalty types, amounts or procedural enforcement pathways, it does not itself define fines, criminal offences, civil recoveries, credit suspension, or deregistration consequences. Those matters are left to the CFI Act and the CFI Rule. The instrument cannot be read alone as creating or limiting enforcement powers beyond the Regulator’s ability to adjust audit schedules under the referenced Rule paragraphs.

Practical enforcement implications for proponents

• Although the instrument lacks explicit penalties, non‑compliance with audit requirements (for example failing to be available for scheduled audits, or failing to satisfy the alternative assurance criteria yet claiming reduced audits) would, in practice, intersect with the Regulator’s enforcement powers in the parent legislation and Rule. The instrument’s direct enforcement effect is therefore administrative (the Regulator may alter audit schedules) while other enforcement actions would depend on the broader statutory regime.

Audit scheduling as an enforcement lever

• The instrument uses audit scheduling and the right to amend that schedule as the primary compliance lever within its scope. A change from zero or limited scheduled audits to a fuller audit schedule is the concrete administrative consequence the instrument contemplates when project criteria are not maintained (clause 9 note).

Advice for stakeholders given absence of penalties in this instrument

• Parties should consult the CFI Act 2011 and the CFI Rule 2015 for the complete enforcement regime, including available sanctions, audit enforcement powers, objection and review pathways, and the Regulator’s compliance tools. The instrument’s references (clauses 3 and 5) point to those sources as the substantive legal context for enforcement.

In summary, this instrument prescribes audit thresholds and schedules and reserves to the Regulator the power to amend audit schedules; it does not itself create explicit penalties or set out enforcement proceedings. The practical enforcement implications therefore require cross‑reference to the CFI Act and the CFI Rule.

This instrument is expressly positioned within and dependent on the existing CFI legislative framework. It does not stand alone; its legal effect is contingent on definitions, procedures and enforcement mechanisms in the Carbon Credits (Carbon Farming Initiative) Act 2011 and the Carbon Credits (Carbon Farming Initiative) Rule 2015.

Statutory basis and reliance on definitions (clauses 3 and 5)

• Clause 3 states the instrument is made under subsection 75(4) of the CFI Rule, establishing the delegated legislative authority for the instrument. Clause 5 includes a note that several expressions used in the instrument are defined in the CFI Act and the CFI Rule, explicitly naming “eligible offsets project”, “initial audit” and “subsequent audit” as examples. Therefore, the instrument imports and relies on those external definitions to operate.

Reference to specific Rule provisions (clause 9)

• Clause 9 implements or operates for the purposes of CFI Rule subsection 73(7) and paragraphs 75(4)(b) and 75(4)(bb). The alternative assurance table in clause 9 is therefore a delegated instrument that prescribes the classes, methodology determinations and conditions contemplated by those CFI Rule provisions. The instrument must be read alongside the CFI Rule provisions cited to understand the full procedural effect, such as how a project becomes an alternative assurance project and how the Regulator schedules audits under the Rule.

Amendment and schedule change powers (clause 9 note)

• The note following clause 9 points to paragraph 73(5)(ab) of the CFI Rule as authority for the Clean Energy Regulator to amend audit schedules if eligibility criteria are no longer satisfied. That cross‑reference clarifies that the Regulator’s power to change schedules is governed by the Rule, with the instrument supplying the criteria that trigger such administrative action.

Methodology determinations and the Act (clause 9 table)

• The instrument attaches eligibility to specific methodology determinations (for example the Carbon Credits (Carbon Farming Initiative) (Reforestation by Environmental or Mallee Plantings,FullCAM) Methodology Determination 2014 and 2024, and the Carbon Credits (Carbon Farming Initiative,Plantation Forestry) Methodology Determination 2022). Those methodology determinations are instruments made under the Act; the present instrument therefore links audit scheduling to the existing methodological architecture under the Act.

Repeal of prior instrument (Schedule 1)

• Schedule 1 repeals the Carbon Credits (Carbon Farming Initiative) (Audit Thresholds) Instrument 2015, removing the prior audit thresholds and replacing them with the structure set in this instrument. The repeal affects the corpus of delegated instruments under the Act and Rule.

Gaps left to parent instruments

• The instrument does not attempt to define procedural rights or obligations (for example, who pays audits, how to calculate annual average abatement, or the detailed steps for contesting a schedule amendment). It assumes those matters are addressed in the CFI Act and CFI Rule and therefore must be read together. Practically, an auditor or proponent needs to consult the parent legislation and methodology determinations for operational detail about audit timing, appointed auditors’ qualifications, forms, and appeal rights.

Interaction with land law and native title (clause 9)

• Clause 9 requires particular land interests (freehold, leaseholder or native title holder, or registered native title body corporate) for specified alternative assurance projects. That requirement creates a tie between carbon project eligibility for reduced audits and land tenure status, meaning that native title, lease and freehold arrangements under separate land law regimes will matter for audit treatment. The instrument does not modify land law; it conditions regulatory treatment on the existence of those land interests.

In sum, the instrument functions as a delegated regulatory adjustment to audit practice within the CFI framework. Its full legal effect and operational application require reading in conjunction with the Carbon Credits (Carbon Farming Initiative) Act 2011, the CFI Rule 2015, and the specified methodology determinations. The instrument supplies numerical thresholds and eligibility criteria, while the parent instruments supply the procedural, enforcement and substantive offsets rules that implement and give effect to those thresholds.

This instrument is narrow and self‑contained in its amendment operations. The text records two explicit historical or amending actions.

Immediate repeal of the 2015 instrument (Schedule 1)

• Schedule 1 repeals the earlier Carbon Credits (Carbon Farming Initiative) (Audit Thresholds) Instrument 2015 in full (Schedule 1 heading and item 1). The instrument therefore replaces the earlier 2015 audit thresholds and related provisions with the new thresholds, audit counts and alternative assurance formulations prescribed in the present instrument.

Commencement and date (clause 2 and instrument metadata)

• The instrument is dated 12 March 2025 in the signature block. Clause 2(1) states that the whole of the instrument commences the day after the instrument is registered. The “Commencement information” table repeats that the whole instrument commences the day after registration. The instrument includes a standard note that the table relates only to the instrument as originally made and will not be amended in that table to reflect later amendments.

Authority for amendment power (clause 3)

• The instrument declares that it is made under subsection 75(4) of the CFI Rule (clause 3). That citation indicates the legal power used to amend the audit thresholds and alternative assurance schedule is a specific delegated power in the Rule.

No changes to methodology determinations recorded

• The instrument references methodology determinations (columns in clause 9(3)) but does not itself amend any methodology determination. It prescribes which existing determinations are the applicable instruments for the alternative assurance classes. Any substantive change to those methodology determinations would require separate amendment instruments that are not contained in this text.

No transitional or savings clauses beyond repeal

• The instrument does not include transitional provisions specifying how projects transitioning under the old instrument are to be treated other than the differentiation in clause 7 between “new projects” and “transitioning projects that are not required to have an initial audit.” The instrument’s text does not expressly state transitional grandfathering rules for projects that were audited under the 2015 instrument; any transitional treatment must therefore be inferred from the parent Rule and the Regulator’s administrative guidance, or determined by the Regulator using its powers.

Administrative note about the commencement table (clause 2(2))

• Clause 2(2) contains the standard statutory drafting note that any information in column 3 of the commencement table is not part of the instrument and may be edited in published versions, but this is a drafting facility rather than a substantive amendment history.

Future amendments

• The instrument does not itself provide a mechanism for future amendments beyond normal repeal and amendment by the Regulator or by subsequent instruments under the CFI Rule. The Regulator may in future exercise delegated powers to update the audit thresholds or alternative assurance classes, as the instrument was made under a Rule power intended to permit such regulatory adjustments (clause 3).

In short, the immediate amendment history recorded in the instrument is confined to the repeal of the 2015 audit thresholds instrument and the record of commencement; the instrument does not include broader transitional or saving clauses, nor does it modify methodology determinations directly.

The instrument contains no litigation history, case citations, or references to judicial decisions. The text makes no mention of any challenges, appeals, or judicial review proceedings related to the instrument, the thresholds, or the alternative assurance classifications. The only legal references are to the Carbon Credits (Carbon Farming Initiative) Act 2011 and the Carbon Credits (Carbon Farming Initiative) Rule 2015, and to specific methodology determinations named in clause 9.

What the instrument records about review or amendment processes

• Clause 9 includes a note that if a project no longer satisfies a criterion or condition specified in the alternative assurance table, the Clean Energy Regulator may amend the audit schedule for the project in accordance with paragraph 73(5)(ab) of the CFI Rule. That note indicates an administrative pathway for schedule adjustment rather than a judicial mechanism. The text does not set out internal merits review rights, external merits review or judicial review processes; those processes, if any, would be established in the Act or Rule and are not recited in this instrument (clause 9 note; clause 3 and clause 5 note).

Implications of absence of litigation history in the instrument

• Because the instrument itself does not include litigation history or reference to prior tribunal or court determinations, stakeholders cannot rely on the instrument for precedential or interpretative guidance arising from litigation. Any interpretative disputes about thresholds, the meaning of “annual average abatement amount”, or the parameters for alternative assurance are to be resolved through the language of the instrument together with the parent Act, the CFI Rule and the relevant methodology determinations, and, if contested, potentially through judicial review or tribunal proceedings in the usual channels external to this instrument.

Recommended approach where litigation risk may arise

• Parties likely to anticipate legal disputes (for example, over eligibility for alternative assurance status, the Regulator’s amendment of an audit schedule, or the practical application of the trigger audit threshold) should examine the CFI Act and Rule for review rights, procedural fairness requirements and appeal mechanisms. The instrument’s absence of litigation history means it neither evidences nor limits litigation risk; it simply sets administrative parameters that could be the subject of future disputes and consequent litigation handled under the parent statutory and administrative law frameworks.

In sum, there is no litigation history recorded in the instrument; any past or future litigation relevant to its operation would be documented elsewhere and would rely on the wider statutory framework for procedural and review mechanisms.

The instrument appears compact, but several practical pitfalls and technical points arise directly from its text that stakeholders should treat as potential sources of error or unexpected outcomes.

Precise numerical boundaries and measurement

• The threshold bands in clause 6 are exact and contiguous: Threshold A is “50 000 tCO2‑e or less”, Threshold B is “50 001 to 150 000 tCO2‑e” and Threshold C is “More than 150 000 tCO2‑e”. There is no allowance for rounding or aggregation within the instrument itself. The instrument does not define how to calculate “annual average abatement amount”; that definition is supplied elsewhere (clause 5 note). Projects that miscalculate their average abatement could inadvertently fall into a different audit band and therefore face a different audit schedule.

“New project” definition and transitioning project distinctions

• The definition of “new project” in clause 5 excludes “a transitioning project which is not required to have an initial audit”. Therefore whether a project is classified as a “new project” for the purpose of clause 7 depends on the project’s transitional status under the broader regime. That label materially affects the number of subsequent audits (clause 7). Determining transition status requires reference to the Act and Rule.

Lopsided audit counts for large projects

• The number of subsequent audits increases substantially with size (clause 7). For Threshold C, new projects require five subsequent audits and transitioning projects not required to have an initial audit require six. Stakeholders should not assume these counts are flexible; they are statutory counts tied to the threshold bands.

Trigger audit threshold is set but consequences are not

• Clause 8 sets a “trigger audit threshold” at 100 000 tCO2‑e but the instrument does not within its text specify the procedural consequences of hitting that trigger. Practitioners must consult the CFI Rule/Act or Regulator guidance to know what administrative action or audit sequencing is initiated by crossing the trigger. Treat clause 8 as a numerical marker only, not a self‑executing process description.

Alternative assurance projects have strict criteria

• The alternative assurance items in clause 9(3) are narrow and conditional. For example, Items 1 and 3 require that the total size of all carbon estimation areas be no more than 200 hectares and that the project be subject to geospatial tool monitoring. Item 2 (Plantation Forestry) requires the project to fit the plantation definitions in the 2022 methodology determinations and subjects it to geospatial monitoring. Failure to meet any one listed criterion may cause the Regulator to amend the reduced audit schedule (clause 9 note). Project proponents should not rely on an initial qualification alone.

Zero scheduled audits possible but conditional

• Item 1 and Item 3 in clause 9(3) state “Zero” scheduled subsequent audits for qualifying projects. That reduction to zero audits is conditional on strict criteria (land tenure, area cap, modelling approach, and geospatial monitoring). A project that was initially classified as zero scheduled audits but later fails a criterion may be re‑scheduled for audits under the Regulator’s amendment power.

Geospatial monitoring is a gating condition

• The Clean Energy Regulator’s geospatial tool monitoring is repeatedly required in clause 9(3) column 3. That introduces technical dependency on the Regulator’s monitoring tools. If the Regulator changes its geospatial monitoring approach, withdraws tool access, or a project cannot be monitored due to technical constraints, eligibility for alternative assurance could be affected. The instrument does not specify contingencies in that event.

Land tenure requirements intersect other laws

• The requirement that the proponent or nominee be a particular kind of title or native title holder connects audit eligibility to land‑title circumstances. Complex land tenures, joint ventures, or disputes over native title could complicate eligibility. The instrument does not create or alter land rights; it simply ties administrative treatment to the existence of those rights.

No direct cost allocation rules

• The instrument does not say who pays for audits. Practitioners should treat the audit counts as obligations but must not assume who bears the cost on the basis of this instrument alone. Cost allocation, timing and audit procurement will be governed by the Act, the CFI Rule, contractual arrangements and Regulator practice.

Regulator discretion to amend schedules

• The instrument signals that the Regulator may amend audit schedules when a project ceases to satisfy criteria (clause 9 note). That power can alter the audit burden mid‑project. Proponents must maintain compliance with criteria and monitor any communications from the Regulator.

Repeal of 2015 instrument requires attention to legacy projects

• The instrument repeals the 2015 Audit Thresholds instrument (Schedule 1). Projects previously operating under the old instrument should verify how their audit schedule maps to the new thresholds and whether transitional arrangements apply; the instrument itself does not elaborate transitional steps.

Potential for unintended reclassification

• Projects near the numeric cutoffs (for example 50 000 or 100 000 tCO2‑e) should watch for small measurement changes that reclassify them into a more burdensome audit band or trigger audit status (clauses 6 and 8). The instrument’s strict numeric boundaries mean small calculation variances can have disproportionate administrative consequences.

In sum, the instrument is precise and conditional; stakeholders must avoid assumptions about rounding, cost allocation, or the permanence of alternative assurance status, and must check the parent Act/Rule for calculations, process, and enforcement detail.

Compliance under this instrument requires operational alignment with its numerical thresholds, eligibility criteria and monitoring requirements, together with cross‑reference to the Carbon Credits (Carbon Farming Initiative) Act 2011 and the CFI Rule 2015 for process, definitions and enforcement. The following steps translate the instrument’s text into actionable tasks.

1. Determine the project classification by annual average abatement amount (clause 6)

• Calculate the project’s annual average abatement amount in accordance with the definitions and procedures in the CFI Act/Rule (clause 5 note). Based on that calculation, assign the project to Threshold A (≤50 000 tCO2‑e), Threshold B (50 001-150 000 tCO2‑e) or Threshold C (>150 000 tCO2‑e). Treat the instrument’s numbers as exact boundaries.

2. Identify project status: new or transitioning (clauses 5 and 7)

• Confirm whether the project is a “new project” as defined in clause 5, or a transitioning project not required to have an initial audit. The audit schedule differs materially: new projects face fewer subsequent audits than the specified transitioning projects (clause 7). Consult the CFI Rule for the operational criteria that determine transitioning status.

3. Prepare for the prescribed number of subsequent audits (clause 7)

• Once a project meets an audit threshold, schedule and budget for the number of subsequent audits set by clause 7. For new projects: Threshold A = 2, Threshold B = 3, Threshold C = 5 subsequent audits. For transitioning projects not required to have an initial audit: Threshold A = 3, Threshold B = 4, Threshold C = 6. Confirm with the Regulator whether any of those audits are initial audits under the Rule’s definitions.

4. Check whether the project can qualify as an alternative assurance project (clause 9)

• Review the clause 9(3) table to determine whether the project falls within one of the listed classes (Low Risk Environmental Plantings 2014 and 2024, Low Risk Plantation Forestry 2022). Ensure the project uses the prescribed methodology determination specified in column 2 and meets all project‑level criteria in column 3 (for example maximum 200 hectares carbon estimation area, FullCAM modelling requirements, plantation coverage conditions) and any operation/monitoring/reporting conditions in column 4 (for example, geospatial tool monitoring).

5. Implement and maintain geospatial tool monitoring where required (clause 9(3) column 3 and column 4)

• For items that require geospatial tool monitoring by the Clean Energy Regulator, ensure the project is configured to be monitorable by those tools and that data and access meet the Regulator’s requirements. Maintain ongoing monitoring readiness because a loss of monitoring capability may trigger schedule amendment (clause 9 note). Liaise with the Regulator early to confirm geospatial monitoring arrangements.

6. Verify land‑tenure eligibility for alternative assurance classes (clause 9(3) columns 3 and 4)

• If seeking alternative assurance treatment under Items 1 or 3, ensure the project proponent or nominee has one of the required land interests (freehold, leaseholder, native title holder or registered native title body corporate) over all project areas. If land interests are complex or multiple proponents are involved, document the nominee arrangements carefully to demonstrate eligibility.

7. Document and evidence modelling and area limits (clause 9(3) columns 3)

• For FullCAM modelling requirements and mixed species block modelling, prepare and retain the FullCAM inputs and outputs that demonstrate compliance with the prescribed modelling approach. Keep consolidated evidence confirming that the anticipated and reported total carbon estimation area does not exceed 200 hectares where required.

8. Maintain ongoing compliance and monitor for criterion changes (clause 9 note)

• The Regulator may amend audit schedules where criteria cease to be met (clause 9 note). Establish compliance monitoring internal controls to alert project management if any criteria may lapse (for example changes in land tenure, area, species mix, or loss of geospatial monitoring capability). Promptly notify the Regulator if circumstances change that affect eligibility.

9. Budget and contract for audits but confirm cost allocation (instrument silence)

• The instrument does not specify who pays for audits. Therefore, contractually plan for audit costs in project budgets and confirm with the Regulator and any relevant contractual counterparties (investors or offtakers) how audit costs will be allocated. Ensure audit procurement complies with the Act and Rule regarding auditor qualification and appointment processes.

10. Liaise with the Clean Energy Regulator early on classification and schedules

• Where classification is borderline (close to 50 000 or 100 000 tCO2‑e markers) or project status is transitioning, engage with the Regulator to confirm classification, audit scheduling and any administrative procedures under the Rule. Request written confirmation where practical to reduce uncertainty.

11. Cross‑reference the CFI Act/Rule and methodology determinations for procedural detail

• Because the instrument relies on external definitions and Rule paragraphs (clauses 3, 5 and 9), read and apply the CFI Act, the CFI Rule and the named methodology determinations to understand initial audit definitions, timing, reporting obligations, audit scope and enforcement consequences.

12. Recordkeeping and audit readiness

• Maintain contemporaneous records, monitoring data (including geospatial data), FullCAM model files, land title documentation and any correspondence with the Regulator to support audit processes and to demonstrate continuing compliance with alternative assurance criteria where applicable.

13. Monitor for regulator communications and policy changes

• The instrument repeals the 2015 instrument and reflects the Regulator’s present policy settings; however, future instruments or Rule amendments could alter thresholds or eligibility. Track Regulator publications and legislative instruments that reference paragraph 75(4) of the CFI Rule.

Following these steps will align a project’s operational, monitoring and governance arrangements with the instrument’s requirements. Because several procedural and enforcement details are delegated to the CFI Act and the CFI Rule, compliance planning should incorporate those instruments and operational liaison with the Clean Energy Regulator.
