59 Agreement property to be clean and suitable for habitation (1) It is a term of each caravan park agreement that the operator must ensure that, during an occupancy, the agreement property: (a) continues to be habitable; and (b) continues to meet all health and safety requirements under an Act that apply to the agreement property. Example for subsection (1)(b) See regulations under the Fire and Emergency Act 1996 that specifically refer to caravans. (2) It is not a breach of the term specified in subsection (1) if the failure to comply with the term is caused by: (a) an act or omission of the resident, including a contravention of a law in force in the Territory; or (b) the resident's failure to notify the operator of repairs required to the agreement property.
