Car Market Regulations 1981

The regulations are compact and procedural. The main concepts and their legal mechanics are:

• Prescribed forms and mapping to the Act: reg 4 and Schedule 1 operate as the hook tying particular sections of the Act to defined templates. Schedule 1 supplies a table mapping specified provisions of the Act (column 1) to the “matter or thing” for which the form is to be used (column 2) and the form number in Schedule 2 (column 3). This creates a legal instruction: where an Act provision is listed, the corresponding form in the regulations is “prescribed as the form to be used” (reg 4). The definition of “form” in reg 3 ties this to Schedules 2 and 3.
• Register formality: reg 5 prescribes the physical form and format of the car market operator’s register required by s 25(2a) of the Act. The register must be a bound book, each page in the form of Form 15, and pages must be consecutively numbered. Form 15 itself includes entries expected to be recorded (vendor, registered owner, vehicle particulars, date offered, date sold, who to whom sold, whether title is guaranteed) and an express note that the register is to be produced on demand by persons referred to in s 25(2b). The regulation therefore imposes both content and tangible record-keeping requirements.
• Notices about title guarantee: reg 6 prescribes two alternative statutory notices required by s 40B(1) of the Act. Form 16 is the “Title Guaranteed” notice; Form 17 is “Title Not Guaranteed.” Reg 6(2) prescribes that the notice shall be printed on white paper 210 mm by 140 mm and “in the type, size and manner to conform with Form 16 or 17 as the case may require.” The forms reproduce, in capitalised headings, the statement “THIS VEHICLE IS SOLD WITHOUT STATUTORY WARRANTY UNDER THE MOTOR VEHICLE DEALERS ACT 1973” and then state whether the car market operator guarantees the vendor’s title or does not.
• Deeming of particulars and completion directions: reg 7 prescribes that particulars inserted into prescribed forms are “prescribed as the particulars or other matters required under the provisions of the Act” for the relevant purposes. Reg 8 requires that any directions on a form are followed. Those two provisions tie compliance with form instructions directly to compliance with the Act’s documentary obligations.
• False information offence: reg 9 creates an offence for making false or misleading statements in “any application” under the regulations, carrying a penalty of $2,000. The regulation was amended in 2002 (see Notes). The phrase “any application” is not defined in the regulations themselves beyond the forms the regulations prescribe (reg 3’s definition of “form” and Schedule references), so the offence applies in practice to applications made using prescribed forms.

Conceptually the regulations operate as a standardisation instrument: they replace uncertain or ad hoc practices with specified templates and physical requirements (bound books, page numbering, notice size and printing). They shift the compliance focus from open textual compliance with the Act to completed, correctly formatted forms and records that are explicitly treated as satisfying the Act’s corresponding requirements.

The regulations primarily affect three groups named or implied by the text: car market operators, vendors of second‑hand vehicles at a car market, and persons who make applications under the regulatory regime using the prescribed forms.

• Car market operators: The regulations expressly govern duties of the car market operator. Reg 5 requires the car market operator to keep the register required by s 25(2a) in the form of a bound book following Form 15 and to ensure consecutive page numbering. Reg 6 requires a car market operator to attach a Form 16 or Form 17 notice to second‑hand vehicles under s 40B(1), printed to specified dimensions and format. The register (Form 15) includes a clear production-on-demand endorsement; the form itself states it is to be produced on demand by persons mentioned in s 25(2b). Therefore operators must maintain accessible physical records and notices that conform to the specifications in the regulations.
• Vendors of second‑hand vehicles at car markets: Vendors’ vehicles must display the prescribed notice under s 40B(1), and the content of Forms 16 and 17 ensures buyers and other parties can see whether the car market operator guarantees the vendor’s title. The text of the forms also contains the statement that the vehicle is “sold without statutory warranty under the Motor Vehicle Dealers Act 1973,” signalling a limitation or qualification set out directly on the notice. Vendors are therefore subject to the documentary consequence of the operator’s choice to guarantee title or not.
• Applicants and prospective licencees: The regulations prescribe licensing forms (Schedule 2 includes Form 14 for the register of car market operators under s 24(1)). Although Forms 1-13 were deleted (1995), Form 14 remains as the registered operators’ register template. Persons completing applications who make false or misleading statements commit an offence under reg 9. The definition of “form” (reg 3) and reg 7 mean that particulars inserted into prescribed forms are treated as the particulars required under the Act for the purposes the form covers; therefore applicants who use the prescribed forms must ensure the particulars meet the Act’s substantive requirements.
• Persons with statutory entitlement to inspect or demand records: Form 15 contains the parenthetical note “To be produced on demand by any person mentioned in section 25(2b).” While the regulation text does not reproduce s 25(2b) itself, the inclusion indicates that particular persons (identified in the Act) have a statutory right to production of the register, and car market operators must be able to produce it in the required physical form.

Other affected actors indirectly include purchasers, vehicle purchasers’ advisers (inspectors, brokers), and regulators enforcing the Act. The regulations create documentary checkpoints that those actors will use: a buyer will see Form 16/17 on a vehicle; an inspector or authorised person under the Act will ask to inspect the bound register in Form 15. The regulations do not themselves set licensing criteria, registration fees, or attack the underlying statutory obligations in the Act; instead they prescribe how some of those obligations are to be evidenced and how certain notices must look.

The regulations prescribe distinct procedural duties and confer documentary rights anchored to provisions of the Act.

Key duties:

• Use of prescribed forms where the Act indicates them: Reg 4 mandates that where an Act provision is specified in Schedule 1, the corresponding form in Schedule 2 is the prescribed form for that provision. This creates a duty to use the prescribed template for the listed statutory matters (reg 4; Schedule 1).
• Maintain the car market operator’s vehicle register in a bound book in Form 15 format: Reg 5 requires the register kept under s 25(2a) to be in the form of a bound book, pages in the form of Form 15, and pages numbered consecutively. The practical duty is to maintain a physical, bound, sequentially numbered record with the entries specified in Form 15.
• Attach the prescribed title‑notice to second‑hand vehicles: Reg 6 prescribes that, pursuant to s 40B(1) of the Act, the notice attached to a vehicle must be Form 16 (if the operator guarantees title) or Form 17 (if not). It also prescribes the physical characteristics of the notice: white paper, 210 mm by 140 mm, and printed to conform with Form 16 or 17 (reg 6(2)). The duty extends to correct selection between the two templates depending on whether title is guaranteed.
• Complete forms as directed and supply required particulars: Reg 8 requires that any directions on a prescribed form be followed. Reg 7 prescribes that the particulars inserted in a prescribed form are the particulars required under the Act for the purposes for which the form is prescribed. Collectively these provisions convert the form-completion task into a statutory duty: to complete prescribed forms in the specified manner and with the particulars required by the Act.
• Produce the register on demand: Form 15 contains the explicit instruction that the register is “To be produced on demand by any person mentioned in section 25(2b).” That places a practical duty on car market operators to make the bound register available for inspection by statutorily identified persons.

Rights and legal effects:

• Deeming effect of completed forms: By reg 7, particulars supplied in prescribed forms are “prescribed as the particulars or other matters required under the provisions of the Act.” That means a correctly completed prescribed form constitutes the statutory documentation required by the Act for the specified purpose; the form’s completion carries legal effect in satisfying the statutory requirement.
• Notice to buyers about warranty and title: The content of Forms 16 and 17 is fixed by Schedule 3. Each form includes the phrase “THIS VEHICLE IS SOLD WITHOUT STATUTORY WARRANTY UNDER THE MOTOR VEHICLE DEALERS ACT 1973.” Buyers therefore have, on the face of the vehicle, the prescribed notice about statutory warranty and a statement as to whether the operator guarantees the vendor’s title. The forms thus create an evidential entitlement for purchasers and third parties to see the status of title guarantees and warranty disclaimers in standardised language.
• Enforcement access: The inclusion of a production-on-demand note on Form 15 and the mapping in reg 4/Schedule 1 implies enforcement and inspection rights created by the Act (s 25(2b) is referenced), which operate in tandem with the documentary duties. While the regulations do not reproduce s 25(2b), they embed the required availability of the register to those persons.

Statutory offence:

• False or misleading statements in applications: Reg 9 creates a direct regulatory penalty for anyone who “in any application makes a false statement or misleading statement or representation.” The penalty is $2,000. The source notes the regulation was amended (Gazette 13 Aug 2002 p. 4152). The regulation therefore criminalises inaccurate or deceptive information in the application processes that use the prescribed forms.

Limits and boundaries:

• The regulations are procedural rather than substantive. They prescribe forms and record-keeping formats and make completion of those forms the statutory method of satisfying identified obligations. They do not, on their face, alter licensing criteria, impose new licensing powers, or change the substantive criminal law contained in the Act. For the full content of statutory rights and enforcement powers, the underlying Motor Vehicle Dealers Act 1973 must be consulted; the regulations implement specified aspects of its documentary and notice regime (reg 3’s definition of “the Act”).

The regulations create one explicit penal provision and otherwise embed compliance obligations that enable enforcement under the Act.

Express penalty:

• False or misleading statements in applications (reg 9): A person who in any application makes a false statement, misleading statement, or representation commits an offence. The regulation prescribes a penalty of $2,000. The reprint notes indicate reg 9 was amended by Gazette 13 Aug 2002 p. 4152. The text of reg 9 is short and unqualified: it applies to “any application” under the regulations. Because “form” is defined in reg 3 as a form in Schedule 2 or 3, and reg 4 prescribes the use of certain forms in relation to provisions of the Act, the practical scope of the offence covers false statements made in the prescribed forms used under the regulatory mapping.

Enforcement mechanisms and expectations implied by the regulations:

• Production-on-demand of register (Form 15): Form 15 contains the express direction that it is to be produced on demand by any person mentioned in s 25(2b). That wording presumes an inspection or production power exists in the Act for persons specified in s 25(2b), and the car market operator must comply by producing the bound register in the Form 15 format. Failure to produce the register when lawfully required would likely engage enforcement under the Act’s inspection and compliance provisions, though those provisions are not repeated in these regulations.
• Deeming of particulars as statutory particulars (reg 7): Because particulars inserted into a prescribed form are “prescribed as the particulars or other matters required under the provisions of the Act,” regulators or courts dealing with the Act will treat the content of completed forms as the statutory particulars. Incorrect or incomplete particulars may therefore be actionable under the Act’s enforcement framework.
• Physical conformity requirements (reg 5 and reg 6): Reg 5 requires bound books and consecutively numbered pages; reg 6 requires notices be printed on white paper 210 mm × 140 mm and in specified type/size/manner. These are mandatory documentary specifications; non-conforming records or notices will not meet the prescribed form requirement and could be treated as non-compliance by an enforcement authority empowered under the Act.

What the regulations do not do in terms of enforcement:

• They do not themselves set out inspection powers, arrest powers, or administrative penalties beyond the single offence in reg 9. Those enforcement powers and penalties are contained in the Motor Vehicle Dealers Act 1973 and must be consulted there for the full enforcement picture (reg 3 defines “the Act” as the Motor Vehicle Dealers Act 1973).
• They do not specify court jurisdictions, timeframes for responding to production demands, or procedural appeal rights. Any such mechanisms will be found in the Act and associated instruments, not in these regulations.

In sum, enforcement under the regulations will proceed by treating properly completed prescribed forms and physically compliant notices/registers as the statutory documentary foundation that the Act requires; the regulations add a standalone offence for false applications and set precise documentary standards that enforcement officers can test against.

The regulations are expressly designed to operate as subordinate instruments to the Motor Vehicle Dealers Act 1973; they do not stand alone. Their interaction with other laws is therefore primarily a mapping from regulatory workmanship into the Act’s substantive framework.

Direct interactions with the Act:

• Operative attachment to the Act: Reg 3 defines “the Act” as the Motor Vehicle Dealers Act 1973. Reg 4 then prescribes the forms to be used “for the purposes” of particular provisions of the Act (Schedule 1 lists s 24(1), s 25(2a), and s 40B(1) as examples). This is a direct subordinate relationship: the regulations determine the documentary mechanism by which specified statutory duties are to be discharged.
• Cross-references to Act provisions: Several of the regulatory obligations are explicit procedural implementations of Act provisions. Reg 5 implements the register required under s 25(2a) of the Act by prescribing the physical format (Form 15). Reg 6 implements the notice required under s 40B(1) by prescribing Forms 16 and 17. Reg 4 links the prescribed forms to s 24(1) and other sections as mapped in Schedule 1.
• Production on demand by persons mentioned in s 25(2b): Form 15’s instruction to be produced on demand by persons mentioned in s 25(2b) explicitly cross-references an Act provision that creates rights of inspection or demand. The regulations therefore rely on inspection/enforcement powers granted by the Act to operationalise the production requirement.

Interactions with amendment Acts and commencement mechanics:

• Motor Vehicle Dealers Amendment Act 1981: Reg 2(2) makes reg 6 and Forms 16 and 17 commence on the day s 15 of the Motor Vehicle Dealers Amendment Act 1981 comes into operation. The regulations therefore are sequenced with that Amendment Act; the regulation text itself ties the effect of the notice provisions to the Amendment Act’s commencement.
• Amendment history: The Compilation table documents further amendments (Car Market Amendment Regulations 1995 and 2002). These amendments altered schedules, deleted prior forms, and amended reg 9’s penalty. The reprint notes and Gazette citations listed in the Compilation table establish historical links to those subordinate instruments. Users must consult the reprint and Gazette entries cited in the Notes for amendment particulars.

Interaction with general administrative and evidentiary law:

• Documentary evidence: By prescribing form content and deeming particulars in prescribed forms to be the particulars required by the Act (reg 7), the regulations affect evidentiary practice in compliance and enforcement proceedings under the Act. Completed prescribed forms will often be treated as primary evidence that the statutory requirements were observed.
• No direct interaction with taxation, consumer law, or registration statutes stated: The regulations do not refer to other statutes (for example, vehicle registration legislation or consumer protection statutes) in the text provided. They do, however, include statements on Forms 16 and 17 that vehicles are sold “without statutory warranty under the Motor Vehicle Dealers Act 1973,” implying a statutory interaction limited to the Act itself. Any interaction with other Commonwealth or State statutes is not set out in the regulations and must be traced in the Act or other relevant laws.

Limitations of the instrument’s cross‑legal reach:

• The regulations do not create new substantive rights beyond documentary procedures and an application offence. They rely on the Act for inspection and enforcement powers, for definitions of offences related to motor dealers, and for licensing powers. Practitioners should therefore treat the regulations as a procedural complement to the Act rather than a standalone statute that alters other legal regimes.

In short, the Car Market Regulations are designed to be read and applied in conjunction with the Motor Vehicle Dealers Act 1973 and associated amending Acts referenced in the compilation notes. For any issue beyond formality or documentary compliance, the Act itself must be consulted.

The regulations include a compact amendment history recorded in the reprint Notes and the Compilation table. The regulations have been amended and reprinted; the reprint notes identify deletions and insertions to schedules and forms. The explicit history confined to this compilation is:

• Original gazettal: Car Market Regulations 1981 were published 31 December 1981 (Gazette p. 5382‑98). Regs other than reg 6 and Forms 16 and 17 commenced 31 December 1981 (reg 2(1) and Gazette 31 Dec 1981 p. 5382).
• Staggered commencement of reg 6 and Forms 16 and 17: Reg 2(2) provides that reg 6 and Forms 16 and 17 take effect on the day on which s 15 of the Motor Vehicle Dealers Amendment Act 1981 comes into operation. The Compilation table records that reg 6 and Forms 16 and 17 commenced on 1 February 1982 (Gazette 31 Dec 1981 p. 5364 shows the commencement linkage).
• Car Market Amendment Regulations 1995: Gazetted 29 December 1995 (p. 6349‑50) and commenced 1 January 1996 (see reg 2). The 1995 amendments deleted Forms 1-13 from Schedule 2 and deleted Schedule 4 (see Schedule 2 notes and brackets). They also inserted the current Schedule 1 (List of forms) mapping to the Act, and Schedule 2 and 3 adjustments reflecting updated form numbering. Schedule 1 is noted as “inserted: Gazette 29 Dec 1995 p. 6349.”
• Car Market Amendment Regulations 2002: Gazetted 13 August 2002 (p. 4151‑52) and commenced 1 September 2002. The 2002 amendment amended reg 9 (the false information offence) , the bracketed note after reg 9 records “Regulation 9 amended: Gazette 13 Aug 2002 p. 4152.” The Compilation table lists the 2002 amendment entry.
• Reprints: The Notes record that a reprint occurred as at 20 January 1997 and a Reprint 2 as at 5 December 2003 that incorporated the amendments listed. The reprint note at the end confirms the compilation date as 5 December 2003 and includes the amendments cited above.

Express deletions and their effect:

• Forms 1-13 deleted: Schedule 2 records that Forms 1-13 were deleted by Gazette 29 Dec 1995 p. 6350. Only Form 14 (Register of Car Market Operators) is retained in Schedule 2 as at the reprint shown.
• Schedule 4 deleted: The regulations’ Notes indicate Schedule 4 was deleted by Gazette 29 Dec 1995 p. 6350.
• Regulation 10 deleted: The text records that reg 10 was deleted (Gazette 29 Dec 1995 p. 6349).

The practical consequence of the amendment history is that earlier versions of the regulations had a larger set of forms (1-13) and schedules which have since been removed; the current operative reprint (as at 5 Dec 2003) reflects a streamlined set of prescribed forms (Form 14 in Schedule 2; Forms 15-17 in Schedule 3) and the consolidated mapping in Schedule 1. Practitioners and compliance officers must therefore ensure they consult the current reprint or the Gazette entries cited for precise historic or transitional obligations. The regulation text itself contains the Gazette citations to the amendment instruments that alter form content, numbering and the penalty in reg 9.

The text of the Car Market Regulations 1981, as supplied and reprinted, contains no reported cases, judicial interpretations, or litigation history. The instrument’s Notes and Compilation table list only gazettal and amendment metadata; they do not identify any appeals, judicial reviews, or case law concerning the regulations themselves.

Practical implications for legal research:

• The regulations are procedural and form‑prescriptive; most contested legal issues about car markets are likely to arise under the Motor Vehicle Dealers Act 1973 or in disputes where the Act’s substantive provisions (licensing, statutory warranties, offences) are invoked. Because the regulations primarily prescribe forms and record-keeping standards (reg 4-8), litigation that directly interprets the content of these regulations would typically concern whether a prescribed form was properly used or whether a required notice/register met the precise regulatory specification.
• To locate litigation that engages these regulations, researchers must search decisions applying provisions of the Motor Vehicle Dealers Act 1973, especially s 25 (car market registers) and s 40B (notice attached to vehicles) because those sections are the ones linked to the regulations by Schedule 1. The regulation text itself hints at inspection and evidence lines (Form 15 production on demand; Form 16/17 notice content), which are the likely focal points in dispute.
• Because the regulations do not list cases, a search in law reports and decisions databases for disputes mentioning Form 15, Form 16, Form 17, or s 25(2a) and s 40B(1) of the Motor Vehicle Dealers Act 1973 is necessary to build a litigation record. The regulation’s reprint notes and Gazette citations provide the statutory timeline relevant to testing whether a notice or register complied with the regulations at a relevant point in time.

In short, the regulations themselves present no litigation history in the text supplied. Any litigation that engages their content will be found in the case law interpreting the Act or applying these procedural prescriptions; the text supplied does not provide those cases.

The regulations appear simple, but they contain several practical and procedural pitfalls that can cause non‑compliance or evidentiary problems if overlooked.

1. Physical formality requirements are mandatory and detailed (reg 5; reg 6):

   • The car market operator’s register must be a bound book with pages in the Form 15 format and pages numbered consecutively (reg 5). Loose-leaf registers, unnumbered pages, or electronic-only registers that do not produce a bound book format could be treated as non‑compliant under the specific prescription. Form 15’s own content is specified, and the form includes a statement that it must be produced on demand by persons identified in s 25(2b).
   • Notices under s 40B(1) must be printed on white paper 210 mm × 140 mm and “in the type, size and manner to conform with Form 16 or 17” (reg 6(2)). Small deviations in paper size, colour, typeface, or layout may make a notice non‑conforming.

2. Choice between Form 16 and Form 17 is material and binary (reg 6; Schedule 3):

   • Form 16 must be used where the car market operator guarantees the vendor’s title; Form 17 must be used where the operator does not guarantee the title. The heading differences (TITLE GUARANTEED / TITLE NOT GUARANTEED) are definitive. Selecting the wrong form may create conflicting statements about whether title is guaranteed and could have evidentiary consequences in disputes about guarantee representation.

3. Deeming of particulars and strict completion requirements (reg 7 and reg 8):

   • Reg 7 prescribes that particulars required by the forms are the particulars required under the provisions of the Act. Reg 8 requires that forms be completed as directed. Practitioners should note that omissions, inaccuracies, or failure to follow directions on the form are not mere drafting slips; they may be treated as statutory failures to comply with the Act’s documentary requirements.

4. Broad wording of the false information offence (reg 9):

   • Reg 9 makes it an offence to make a false or misleading statement “in any application.” Because “form” is defined (reg 3) and prescribed forms map to Act provisions (reg 4), operators and applicants should be cautious when completing any application or prescribed form. The penalty is $2,000; the regulation does not specify alternative penalties or defences within the text supplied.

5. Timing and commencement nuances (reg 2):

   • Reg 6 and Forms 16 and 17 were made dependent on the commencement of s 15 of the Motor Vehicle Dealers Amendment Act 1981 (reg 2(2)). Where circumstances require retrospective or transitional compliance analysis, it is important to use the correct version of the regulations and to check the relevant commencement dates recorded in the Compilation table and Gazette citations. Using a form before it legally came into force could create invalidity or compliance problems.

6. Deleted forms and older practice pitfalls:

   • Forms 1-13 were deleted in 1995 (Schedule 2 note). Older records or legacy procedures referencing those forms may no longer be compliant. Practitioners dealing with historic transactions must check which form was in force at the relevant time.

7. The regulations are procedural, not substantive:

   • Because the regulations primarily prescribe forms, compliance failures will often be framed as documentary non‑compliance rather than substantive defect. However, reg 7 elevates form content to statutory particulars, so a mistake in a form can have substantive legal consequences. Users must therefore ensure accuracy even when the regulation’s appearance seems merely administrative.

8. Reliance on the Act for enforcement and rights:

   • Several important rights and powers are referenced but not reproduced (for example, s 25(2b) and s 40B(1)). A car market operator or purchaser relying only on the regulations without consulting the Act may misunderstand who may demand the register, the precise scope of the operator’s guarantee, or enforcement remedies. The regulations assume the Act’s provisions are consulted in tandem.

9. Production-on-demand phrasing:

   • Form 15 explicitly states “To be produced on demand by any person mentioned in section 25(2b)”. Operators should identify which persons are mentioned in s 25(2b) (for example, inspectors or authorised officials) because refusal or delay in producing the bound register could be actionable.

10. Limited textual content on warranty and guarantee statements:

    • Forms 16 and 17 include the sentence “THIS VEHICLE IS SOLD WITHOUT STATUTORY WARRANTY UNDER THE MOTOR VEHICLE DEALERS ACT 1973,” and either “THE CAR MARKET OPERATOR GUARANTEES THE VENDOR HAS UNENCUMBERED TITLE” (Form 16) or “THE VENDOR’S TITLE TO THE VEHICLE IS NOT GUARANTEED BY THE CAR MARKET OPERATOR” (Form 17). Those are short declaratory statements; their legal effect in a dispute will depend on the Act’s terms and any case law interpreting s 40B(1). The regulations do not elaborate defences, exceptions, or scope of guarantees.

In short, the main “gotchas” are strictness about physical form, the binary selection between guarantee notices, the statutory effect of particulars supplied in the forms, the breadth of the false-information offence, and the need to consult the Act for inspection and enforcement powers.

To comply with the Car Market Regulations 1981 as reprinted, a practical checklist and implementation steps based on the regulations’ text follow. This is a source-grounded operational list: each item references the relevant regulatory provision in parentheses.

1. Use prescribed forms where the Act requires them (reg 4; Schedule 1).

   • Review Schedule 1 to identify which sections of the Motor Vehicle Dealers Act 1973 are linked to prescribed forms. Currently Schedule 1 maps s 24(1) to Form 14, s 25(2a) to Form 15, and s 40B(1) to Forms 16 and 17. Ensure any statutory filing, registration or notice that falls under those sections uses the specified form number.

2. Maintain the car market operator’s register exactly as required (reg 5; Form 15).

   • Keep the register required by s 25(2a) in a bound book format.
   • Ensure every page is reproduced in the layout of Form 15 and pages are consecutively numbered.
   • Record the items shown on Form 15 (vendor, registered owner, vehicle make/type, engine no., identity plate, register number, dates offered and sold, to whom sold, address details, and whether title is guaranteed). Form 15 explicitly states it is to be produced on demand by persons identified in s 25(2b), so make the book available for lawful inspection.

3. Attach the correct title notice to second‑hand vehicles under s 40B(1) (reg 6; Forms 16 & 17).

   • If the car market operator guarantees the vendor’s title, print and attach Form 16 to the vehicle.
   • If the car market operator does not guarantee title, print and attach Form 17.
   • Print notices on white paper 210 mm × 140 mm and conform to the type, size and manner of the respective form (reg 6(2)). Verify layout and wording match Forms 16 and 17 reproduced in Schedule 3.

4. Complete forms strictly as directed (reg 8).

   • Follow any completion directions included on the form itself. Do not alter the form’s prescribed wording or omit required entries. Reg 8 makes completion according to the form’s directions a mandatory requirement.

5. Treat particulars inserted into prescribed forms as statutorily required particulars (reg 7).

   • When completing a prescribed form, recognise that the particulars you insert are the particulars the Act requires for the purposes for which the form is prescribed. Ensure accuracy and completeness.

6. Avoid false or misleading statements in applications (reg 9).

   • Verify all facts before submitting any application or completing any prescribed form. Reg 9 makes it an offence to make false or misleading statements “in any application,” with a penalty of $2,000. Maintain internal verification checks (evidence of identity, chain of title information) prior to submission.

7. Maintain documentary copies and a compliance file for inspections.

   • Because Form 15 must be produced on demand, and Forms 16/17 are attached to vehicles, operators should have a readily accessible compliance file containing a current bound register and spare copies of the prescribed notices for immediate attachment. The regulations do not prescribe retention periods; however, maintaining a contemporaneous bound register and duplicates will assist in demonstrating compliance.

8. Be mindful of commencement and amendment history when dealing with historical transactions (reg 2; Notes).

   • Reg 6 and Forms 16/17 only commenced when s 15 of the Motor Vehicle Dealers Amendment Act 1981 came into operation (reg 2(2)). Consult the Compilation table for amendment dates (1995 deletions of Forms 1-13; 2002 amendment to reg 9). When assessing compliance for past periods, use the version of the form/regulation that was in force at the relevant time.

9. Coordinate compliance with the Motor Vehicle Dealers Act 1973 (reg 3).

   • The regulations implement parts of the Act. For substantive licensing, enforcement powers, and the identity of persons entitled to demand registers (s 25(2b)), refer to the Motor Vehicle Dealers Act 1973. The regulations assume the Act’s provisions provide actual inspection and enforcement powers.

10. Document internal policies and staff training.

    • Put in place written procedures for maintaining the bound Form 15 register, selecting and attaching Form 16 or 17 correctly, and completing Form 14 (where relevant) for registered operators. Train staff handling vehicle listings, title attestations, and applications to verify accuracy and follow the prescribed formats.

11. Where in doubt, consult the Gazette entries and reprint notes.

    • The Notes and Compilation table in the reprinted regulations list the Gazette citations for the original regulations and subsequent amendments (Gazette 31 Dec 1981, 29 Dec 1995, 13 Aug 2002). If a question arises about which form was in force at a particular time, consult the gazetted instrument and the reprint date indicated in the Notes.

12. Retain evidence of compliance with printing requirements for notices.

    • Because reg 6(2) prescribes physical printing dimensions and conformity to the form’s type/size/manner, keep supplier proofs, invoices, and proof prints to demonstrate that notices were printed to required specifications.

Following these steps will align documentary practice with the prescriptions in the Car Market Regulations 1981 as reprinted. Remember that the regulations implement only documentary and notice requirements for specified sections of the Motor Vehicle Dealers Act 1973; substantive legal questions (licensing decisions, statutory warranties beyond the notice language, enforcement powers) require consulting the Act itself.
