Camperdown (Public Park Land) Act 1973

The Act is compact and focused on a small set of legal mechanics. The main concepts are:

• Statutory authorisation to lease reserved park land: section 4(1) supplies the enabling power, overriding conflicting statutory provisions by its opening phrase, notwithstanding anything in any Act. The power is limited to the land delineated in the Schedule and to particular uses, namely sport, recreation, social activities, related purposes, amenities and buildings (s 4(1)).

• Committee of management and actor: “corporation” is defined in section 3 as the Corporation of the Town of Camperdown, which the preamble identifies as the committee of management for the reserved park land. That identifies the local corporate actor that may exercise the leasing power.

• Lease content and limits: Leases may include covenants, conditions, exceptions and reservations as the corporation thinks fit (s 4(2)(a)(i)). They are bounded to a maximum term of 21 years (s 4(2)(a)(ii)) and require approval by the Governor in Council (s 4(2)(a)(iii)). Those three subparagraphs are the principal constraints on the leasing discretion.

• Public-access prescription for golf: Section 4(2)(b) mandates a condition in every lease that members of the public who are of good character shall have the right to use any golfing facilities provided on the leased land, at reasonable times and on payment of any reasonable charge. This creates a statutory right of limited public access when golf facilities are involved, with qualifiers left undefined in the Act.

• Financial direction of rents: Section 4(3) directs how rents must be applied. The money received by way of rent is to be applied by the corporation towards maintenance and improvement of the land permanently reserved by the 1879 Order in Council that is not leased under section 4, or alternatively for any other purpose approved by the Minister. That creates an earmarking rule and a ministerial gate for alternate uses of funds.

• Crown compensation bar: Section 4(4) states that no compensation shall be payable by the Crown in respect of any act, matter or thing done under or arising out of section 4. This is an express statutory exclusion of Crown-funded compensation arising from actions under the leasing power.

• Formalities: The Act contains the short title (s 1) and a commencement clause stating operation from the day of Royal Assent (s 2). The Schedule identifies the parcel in the parish of Colongulac; the preamble records the 1879 Order in Council that created the permanent reservation and the corporation’s role as committee of management.

Together these concepts locate authority in the local corporation, subject that authority to executive approval and ministerial oversight, prescribe public access conditions for golf, direct financial flows from rent to maintenance or minister-approved uses, cap lease length, and exclude Crown compensation. The Act therefore defines a narrow statutory architecture for leasing part of a public park for recreational uses while imposing particular procedural and substantive constraints.

The Act specifies a discrete set of stakeholders by name and by operation. Primary affected parties are:

• The Corporation of the Town of Camperdown, defined as “corporation” in section 3, which the preamble describes as the committee of management for Camperdown Public Park. The corporation is the statutory actor empowered to grant leases under section 4(1). That body decides whether to grant leases, what covenants, conditions, exceptions and reservations to include (s 4(2)(a)(i)), and it receives and applies rents (s 4(3)).

• Potential lessees. Individuals or entities that would seek a lease over the hatched land are affected because the Act creates a statutory route for leases limited by term (not exceeding 21 years, s 4(2)(a)(ii)), by required lease content (public-access condition for golf if applicable, s 4(2)(b)), and by executive approval (Governor in Council approval required by s 4(2)(a)(iii)). Lessees will be contractually bound by whatever covenants and conditions the corporation imposes.

• Members of the public, specifically those who are “of good character” (s 4(2)(b)). Where golfing facilities are provided, such members of the public have an express statutory right to use those facilities at reasonable times and on payment of any reasonable charge. That creates a statutory entitlement for public users, subject to the Act’s qualifiers.

• The Governor in Council. The Governor in Council has an approval role for leases (s 4(2)(a)(iii)), making the executive government a decision point in whether proposed leases proceed.

• The Minister. The Minister has an approval role for alternative uses of rent revenue. Section 4(3) requires that rents be applied to maintenance and improvement of the reserved land not leased, or to any other purpose approved by the Minister. Thus the Minister determines acceptable non-maintenance uses.

• The Crown. Section 4(4) affects the Crown in that it contains an express statement that no compensation shall be payable by the Crown in respect of any act, matter or thing done under or arising out of section 4. This alters the claims space against the Crown for actions taken under the leasing power.

• The broader community using Camperdown Public Park. The leased land is part of a larger area permanently reserved by the 1879 Order in Council; rents must be applied to maintenance of the reserved land not leased (s 4(3)). That redistributive effect of lease revenue affects the maintenance and improvement of the unleased portions of the public park, and therefore park users.

• Local government and administrative actors responsible for implementing the leases. While not named beyond the corporation, administrative personnel will be affected by the duty to ensure leases comply with the Act and to apply rents as directed.

The Schedule locates the affected land in the parish of Colongulac, and the preamble grounds the corporation’s management role in the 1879 reservation. The Act thus concentrates decision power in the corporation with oversight by the Governor in Council and the Minister, creates statutory rights for certain public users of golf facilities, directs financial flows from rent to park maintenance or minister-approved purposes, and excludes Crown compensation for actions under the leasing scheme.

The Act allocates specific duties, discretions and rights. Items of legal force and operational effect are:

• Duty/Power to grant leases: The corporation has the statutory power to grant leases of the hatched land for sport, recreation, social activities and related purposes, including amenities and building erection (s 4(1)). That power is granted “notwithstanding anything in any Act”, indicating a legislative intention to authorise leasing despite contrary statutory provisions elsewhere.

• Discretion on lease terms and content: The corporation may impose covenants, conditions, exceptions and reservations in leases as it thinks fit (s 4(2)(a)(i)). That is an affirmative discretion to shape contractual terms and to reserve rights over leased land.

• Temporal constraint on leases: Any lease must be for a term not exceeding 21 years (s 4(2)(a)(ii)). That is a hard statutory limit on duration.

• Executive approval requirement: Leases require approval by the Governor in Council (s 4(2)(a)(iii)). That makes the exercise of the corporation’s leasing power subject to an executive check.

• Statutory public right concerning golf: Each lease must contain a condition that members of the public who are of good character have the right to use any golfing facilities provided on the leased land at reasonable times and upon payment of any reasonable charge (s 4(2)(b)). That creates a statutory right enforceable against the leasehold as a covenant condition, or at minimum a required lease term. The qualifiers “of good character”, “reasonable times” and “reasonable charge” are left undefined in the Act, which places interpretive burdens on implementers and potentially on courts.

• Financial duty on rent application: Moneys received by way of rent under leases are to be applied by the corporation towards maintenance and improvement of the whole or any part of the land permanently reserved by the 1879 Order in Council and not leased under section 4, or for any other purpose approved by the Minister (s 4(3)). That is an earmarking obligation and a ministerial oversight function; it restricts the corporation’s discretion over rent use unless the Minister approves alternative purposes.

• Exclusion of Crown compensation: Section 4(4) provides that no compensation shall be payable by the Crown in respect of any act, matter or thing done under or arising out of section 4. This is an express statutory bar to Crown-funded compensation for actions taken under the statutory leasing power.

• Procedural formalities: The Act commences on the day of Royal Assent (s 2), so the date of operation is immediate upon assent in 1973 (Endnotes). The short title is authorised by s 1.

• Lease enforceability and remedies: The Act does not itself prescribe enforcement mechanisms or penalties for breach. Enforcement of duties and rights created by leases will therefore operate primarily through the lease terms the corporation imposes and through common law remedies for breach of contract, subject to the Governor in Council’s approval and the Minister’s oversight on rent use. The Act’s express conditions, such as the public-access clause and rent application rule, are statutory constraints that must be reflected in lease documentation and administration.

Collectively, the Act places duties on the corporation to structure leases within statutory bounds and to direct rent revenue to park upkeep or to minister-approved alternatives, entitles certain public users to access golf facilities on defined terms, and removes Crown compensation liability for acts under the leasing scheme.

The Act contains no express penal provisions, fines, or statutory enforcement agency tasked with policing compliance with the leasing power. It does, however, create a statutory regime whose compliance will be enforced by a combination of mechanisms implicit in the text and by other legal processes. Key enforcement and penalty-relevant features in the Act are:

• Contractual enforcement via leases. Section 4(2)(a)(i) authorises the corporation to include covenants, conditions, exceptions and reservations in leases. Any breach of those lease terms will be subject to contractual remedies available under general property and contract law. The Act itself does not prescribe penalties for breach; enforcement will therefore rely on the remedies available to the parties under the lease and relevant common law or statutory regimes outside the Act.

• Executive oversight as a procedural check. Section 4(2)(a)(iii) requires approval of leases by the Governor in Council. That approval step is an executive gate that can prevent non-compliant leases from taking effect and serves as a pre-enforcement control. The Act does not prescribe a process or criteria for such approval, nor does it create an appeals mechanism in the Act itself.

• Ministerial control over the use of rent. Section 4(3) requires rents to be applied to maintenance and improvement of the remaining reserved land, unless the Minister approves other purposes. The Minister’s approval function is an ongoing supervisory mechanism over the application of lease revenue. The Act does not stipulate sanctions for misapplication of rents; potential enforcement would depend on administrative law remedies, statutory duties on public bodies and, where relevant, audit and accountability frameworks external to the Act.

• Statutory public right with potential enforcement implications. Section 4(2)(b) imposes a condition that members of the public of good character shall have a right to use golfing facilities. That creates a statutory entitlement that could be enforced against lessees or the corporation if it is embodied in the lease as required. The Act does not provide a penalty for denying access; remedies would be contractual, equitable or via general legal action asserting statutory breach, but the Act itself is silent on enforcement pathways.

• Crown compensation bar. Section 4(4) declares that no compensation is payable by the Crown in respect of any act, matter or thing done under or arising out of section 4. This is an express limitation on state-funded compensation and affects potential claims for loss related to the application of the Act. It does not prohibit private claims against other parties, but it removes the Crown as a source for compensation obligations that could otherwise arise.

• Absence of administrative sanction provisions. The Act does not set out sanctions such as fines, cancellation powers, or criminal penalties, nor does it create a statutory inspectorate or enforcement office. Compliance and enforcement thus depend on the corporation’s exercise of contractual levers, executive approval processes, ministerial oversight, and external legal or administrative remedies.

In short, the Act establishes substantive duties and rights but leaves enforcement primarily to contractual remedies, executive approval processes and external administrative or legal mechanisms; it contains an express bar to Crown-paid compensation for acts under the leasing power.

The Act contains several express interaction points with existing legal frameworks and leaves room for interplay with external statutes and administrative law, as set out in the text.

• Statutory override. The opening phrase of section 4, “Notwithstanding anything in any Act”, indicates that Parliament intended the corporation’s leasing power to operate despite any contrary provision in other legislation. That language gives section 4 primacy to the extent of any inconsistency, subject to constitutional and other legal limits outside the Act. The Act therefore displaces conflicting statutory constraints that might otherwise prohibit leasing of reserved Crown land, at least insofar as Parliament has the capacity to do so.

• Executive and ministerial mechanisms. The requirement for Governor in Council approval of leases (s 4(2)(a)(iii)) imports executive processes into the operation of the leasing power. The Minister’s approval function over alternative uses of rents (s 4(3)) brings the ministry into the financial administration of rental income. These cross-links mean that processes and criteria in executive or ministerial practice, and any relevant statutory frameworks governing those offices, will affect how leases are authorised and how rent is deployed.

• Property and contract law. Leases granted under section 4 will interact with general property law, conveyancing rules and contract law outside this Act. The Act does not spell out formal conveyancing procedures, registration requirements, or detailed landlord-tenant rules; those will be governed by general law and any applicable land titles or conveyancing statutes. The Act’s 21-year cap intersects with property doctrines that often treat terms of a particular length differently for registration or estate classification purposes.

• Public land reservation and Crown property law. The preamble and section 4(3) refer back to the 1879 Order in Council that permanently reserved the land for a public park. The earmarking of rents to maintenance of the permanently reserved land not leased (s 4(3)) engages the legal framework governing reserved Crown land and public parks. How those broader regimes treat the alienation, leasing and use of reserved land will influence the practical application of the Act. The Act’s “notwithstanding” wording suggests Parliament intended to allow leasing despite prior reservation constraints.

• Administrative law and accountability. The Act’s provisions that create executive approvals and ministerial discretion will interact with administrative-law principles, including procedural fairness, improper exercise of power and judicial review, if and when disputes arise about the Governor in Council’s or Minister’s approvals. The Act does not provide procedural details for those approvals, so external administrative law will supply standards and remedies.

• Compensation and remedial regimes. Section 4(4)’s statement that no compensation shall be payable by the Crown for acts under section 4 interacts directly with statutes and common law rules that might otherwise give rise to compensation claims against the Crown for dispossession or deprivation. The Act removes the Crown’s compensatory liability in relation to acts under this section; the effect on private rights and remedies against other parties is left to general law.

• Local government and statutory powers. The corporation is a local corporate entity empowered by the Act to act as committee of management. The Act interacts with any broader statutory frameworks governing local government powers, though its “notwithstanding” phrasing indicates an intention to authorise an action that might otherwise be inconsistent with such frameworks.

Finally, the endnotes to the Act’s published version note that there have been no amendments to the Act and that the Act commenced on assent (Endnotes). The Interpretation of Legislation Act material included in the publication explains interpretive details that govern how headings and examples are treated in modern terms, but the Act’s operative provisions themselves remain focused on the leasing power and its required approvals and limitations.

The legislative publication provided with the Act includes a Table of Amendments and related endnotes. Those parts of the source show the following concrete facts:

• No amendments recorded. The Table of Amendments states that there are no amendments made to the Camperdown (Public Park) Land Act 1973 by Acts and subordinate instruments (Endnotes, Table of Amendments). The publication therefore records that the Act remains in its original substantive form as enacted in 1973.

• No amendments not in operation. The publication also records that there are no amendments which were Not in Operation at the date of publication (Endnotes, Amendments Not in Operation). That indicates no deferred or staged amendments were recorded in the source.

• Assent and commencement. The endnotes record that the Act was assented to on 7 November 1973 and came into operation on 7 November 1973, by virtue of section 2 and the date of Royal Assent (Endnotes, General information). The Version metadata shows the version as at 1 June 2019, indicating that the text provided is intended to reflect the Act’s status up to that date.

• Explanatory details. The explanatory details at the end of the source identify the Government Gazette reference for the 1879 Order in Council that formed the permanent reservation (Government Gazette 29 August 1879 page 2133). The explanatory note does not record any subsequent statutory changes.

• Interpretation-related editorial changes. The legislative publication includes general notes about the Interpretation of Legislation Act 1984 and style changes relevant to headings, examples and punctuation. These are publication-level interpretive notes and do not record amendments to the substantive provisions of this Act.

Taken together, the source material supplied shows no recorded legislative amendments to the Act since its enactment in 1973, and no amendments awaiting commencement as of the publication date specified. The Act’s operative architecture , including the corporation’s leasing power, the 21-year lease cap, the Governor in Council approval requirement, the public-access clause for golf, the rent-application rule and the Crown compensation bar , therefore stands in its original statutory form in the published version provided.

The source contains no citations to litigation, reported decisions or precedent related to the Camperdown (Public Park) Land Act 1973. The table of contents and endnotes in the version supplied record legislative metadata, commencement and explanatory details, but they do not list any cases, judicial interpretations or litigation outcomes. Accordingly, there is no litigation history recorded within this document to cite.

That absence has practical implications for legal practitioners and administrators reviewing the Act. Several provisions contain terms that could give rise to future dispute and therefore would be likely focal points were litigation to occur, including:

• “Of good character” in s 4(2)(b). The Act conditions public access to golfing facilities on the user being of good character. The phrase is not defined in the Act, and its content will depend on legal interpretation and factual assessment, which could give rise to disputes about exclusion or admission of users.

• “Reasonable times” and “reasonable charge” in s 4(2)(b). Both phrases are standard common law expressions but are fact-sensitive. Litigation could emerge over what constitutes reasonable times for public access and what level of charge is reasonable, particularly if charges are used to restrict access.

• The scope of “purposes connected therewith” in s 4(1). That catch-all phrase could be litigated if a proposed use sits at the margins of sport, recreation or social activity.

• Application of rents under s 4(3). Disputes could arise over whether particular applications of rent qualify as maintenance and improvement of the unleased reserved land, or whether ministerial approval for alternate uses has been properly obtained or exercised.

• Governor in Council approval in s 4(2)(a)(iii). Challenges could be mounted regarding the adequacy of the approval process, procedural fairness, or the lawfulness of an approval decision, bringing administrative-law principles into play.

• Effect of the “notwithstanding anything in any Act” wording in s 4. Litigation could test the extent to which the statutory override operates against other statutory regimes or property reservations, although the Act itself expresses a legislative intention to permit leasing despite contrary Acts.

Given that the Act’s published version does not reference any judicial treatment, practitioners should recognise interpretive uncertainty in the text and the possibility that key terms may require judicial clarification if contested. For the moment, however, the Act’s operative provisions should be read on their face as the governing legal framework for any leases of the hatched land because no case law in the supplied source modifies or interprets those provisions.

The Act is short but contains features that create interpretive, administrative and operational risks for the corporation, prospective lessees and the public. The following are concrete “gotchas” grounded in the text:

• Broad, undefined qualifiers. The statutory public-access condition for golf uses three undefined qualifiers: “members of the public who are of good character”, “reasonable times” and “reasonable charge” (s 4(2)(b)). None of these terms is elaborated in the Act, leaving room for dispute and administrative inconsistency. The corporation must operationalise these terms in leases; without clear, objective criteria, questions of exclusion, scheduling and pricing can become contested.

• “Notwithstanding anything in any Act” does not eliminate other constraints. While section 4 opens with “Notwithstanding anything in any Act”, that wording operates only to the extent Parliament can validly alter or displace other statutory constraints. It does not remove constitutional limits or external legal obligations that lie outside the legislature’s power. Moreover, the Governor in Council approval requirement (s 4(2)(a)(iii)) reintroduces executive oversight, so a proposed lease that is otherwise authorised may still be blocked at the approval stage.

• Rents must be applied off-site. Rents are to be applied towards maintenance and improvement of the reserved land that is not leased under section 4, or to any other purpose approved by the Minister (s 4(3)). This means rents from leasing a portion of the park are directed to upkeep of other parts of the reserved area, which may create political or community friction if local stakeholders expect rents to benefit the leased parcel or fund broader local projects without ministerial approval.

• Ministerial discretion over alternate uses of rent. The Act permits alternative uses only if approved by the Minister (s 4(3)). The Act does not provide criteria or procedure for such approval, increasing the risk of bureaucratic delay or politicisation of decisions about rent deployment.

• Governor in Council approval is a potential bottleneck. Requiring approval by the Governor in Council (s 4(2)(a)(iii)) introduces a centralised decision point. The Act does not prescribe a timeframe or process, which may produce uncertainty or delay for proposed leases.

• The 21-year cap limits longer-term arrangements. Any party seeking longer-term tenure must seek other statutory authorisation. The Act’s cap (s 4(2)(a)(ii)) affects financing and investment calculations, as structures requiring longer terms for security or returns will not be achievable under this Act alone.

• No statutory enforcement or penalty regime. The Act contains no enforcement apparatus or penalties for non-compliance, leaving enforcement to contractual remedies, executive approvals and external legal routes (see Penalties and enforcement). That may complicate monitoring and rectification of breaches.

• Crown compensation bar reduces avenues to public recourse. Section 4(4) states no compensation shall be payable by the Crown for acts under section 4. That eliminates Crown-funded compensation as a remedy for losses arising from authorised actions, which could surprise prospective lessees or third parties who might otherwise assume compensation pathways exist.

• Reliance on the Schedule’s plan. The land subject to leasing is identified by a plan in the Schedule, described as “delineated and hatched”. If the Schedule’s depiction is not precise in text, disputes about the exact area leasable could arise. The Act’s Schedule contains an image placeholder in the published version supplied; implementers must ensure the precise boundaries are recorded in documentation.

• Ambiguity around “purposes connected therewith”. Section 4(1) authorises leasing for “purposes connected therewith”, which is expansive and could be read broadly. That breadth increases the risk of proposals that test the limits of what is connected to sport, recreation or social activity.

Each of these points is rooted in the statute’s language. Parties implementing or relying on the Act should treat these features as areas requiring careful drafting, procedural clarity and, where appropriate, ministerial or executive engagement to reduce operational risk.

For the Corporation of the Town of Camperdown, for prospective lessees, and for public managers, the Act implies a set of minimum compliance steps and practical measures to ensure leases are valid and administratively sound. The following compliance checklist flows directly from the Act’s text.

For the corporation (committee of management)

1. Confirm statutory authority and site. Verify that the portion of land proposed for lease is located within the hatched area in the Schedule and falls within the land permanently reserved by the 1879 Order in Council, as referenced in the preamble and Schedule.

2. Determine permitted uses. Ensure the proposed lease purpose falls within sport, recreation, social activities or purposes connected therewith, and that any amenities or buildings to be erected are consistent with s 4(1).

3. Draft lease covenants and conditions. Use the discretion under s 4(2)(a)(i) to draft covenants, conditions, exceptions and reservations necessary to protect the reserved land, public access rights, and revenue application obligations. Ensure the public-access clause required by s 4(2)(b) is included verbatim or in substance.

4. Include public-access clause for golf. If golfing facilities are to be provided, include a clause that members of the public who are of good character have the right to use those facilities at reasonable times and on payment of any reasonable charge, and consider specifying operational definitions or objective criteria for “good character”, “reasonable times”, and “reasonable charge” to reduce ambiguity.

5. Observe the 21-year term cap. Ensure the lease term does not exceed 21 years (s 4(2)(a)(ii)). For arrangements requiring longer terms, seek separate legislative authority.

6. Obtain Governor in Council approval. Prepare the lease package for submission to the Governor in Council for approval as required by s 4(2)(a)(iii). Anticipate executive requirements and allow time for approval processes.

7. Establish rent application procedures. Implement clear accounting and governance arrangements to ensure rental moneys are applied to maintenance and improvement of the reserved land not leased under section 4, or, if seeking alternative uses for rents, prepare a submission for Ministerial approval per s 4(3).

8. Document communications about Crown compensation. Record that s 4(4) disclaims Crown compensation for acts under the section so stakeholders understand the limited recourse to Crown-funded compensation.

9. Maintain records and reporting. Keep detailed records of lease terms, approvals, rent receipts and expenditure of rent on permitted purposes, and correspondence with the Governor in Council and the Minister to demonstrate statutory compliance.

For prospective lessees

1. Confirm lease legality and approvals. Ensure any proposed lease has been, or will be, approved by the Governor in Council as required by s 4(2)(a)(iii). Do not assume a lease is effective until approval is obtained.

2. Review required public-access clause. Expect the lease to include the public-access condition for golfing facilities where relevant, and assess commercial implications of required access, timing and pricing constraints.

3. Negotiate covenants and reservations carefully. Understand that the corporation can impose covenants, conditions, exceptions and reservations (s 4(2)(a)(i)). Obtain legal advice on the practical effect of these clauses and on remedies for breach.

4. Financial planning within a 21-year term. Structure financing and investment plans to account for the 21-year maximum term (s 4(2)(a)(ii)). Consider whether capital expenditure recovery fits within that horizon.

5. Account for rent application constraints. Be aware that rents will be applied by the corporation to maintenance of unleased reserved land or to other purposes only with Minister approval (s 4(3)). This affects expectations around reinvestment in the leased parcel via cross-subsidisation.

6. Be aware of Crown compensation exclusion. Understand that losses arising from acts under section 4 are not compensable by the Crown (s 4(4)), and plan risk allocation accordingly.

For the Minister and Governor in Council

1. Establish approval procedures. Develop and publish internal processes, timelines and criteria for Governor in Council approval of leases (s 4(2)(a)(iii)) and for Ministerial consideration of alternative uses of rent (s 4(3)), to reduce delay and legal uncertainty.

2. Define standards where possible. Consider issuing guidance on operationalising terms in the public-access clause, for example setting parameters or recommended approaches to “good character”, “reasonable times” and “reasonable charge”, consistent with statutory discretion.

For public and community stakeholders

1. Monitor lease proposals. Review proposed leases for consistency with the Act, including the public-access clause and the allocation of rents to maintenance of the unleased reserved land.

2. Engage early with the corporation. Where community interests exist in maintaining access or in how rent is used, engage with the corporation and Minister to raise concerns prior to lease approval.

Administrative and procedural steps common to all parties

• Legal advice. Obtain targeted legal advice that reads the lease package against the Act to ensure the lease contains the required clauses, does not exceed term limits, and matches the approved purposes.

• Documentation of approvals. Archive Governor in Council approval instruments and Ministerial approvals for rent uses, to provide a compliance trail.

• Draft unambiguous lease language. Where the Act leaves terms undefined, draft objective criteria and procedures into the lease to reduce interpretive disputes.

• Financial controls and reporting. For the corporation, establish transparent accounts demonstrating that rent revenues are applied in accordance with s 4(3), and prepare to justify alternative applications if Ministerial approval is sought.

• Dispute resolution clauses. Given the Act’s silence on enforcement and penalties, include clear dispute resolution mechanisms in leases, including mediation, arbitration and jurisdictional clauses, to streamline resolution.

Following these steps aligns implementation with the Act’s text: powers and limits under s 4(1) and s 4(2), the public-access requirement in s 4(2)(b), the rent application rule in s 4(3), and the Crown compensation bar in s 4(4). Practical compliance depends on the corporation securing required executive approvals and on careful drafting to translate the Act’s broad phrases into workable lease terms.
