42 Use of certain land at 901 Appin Road, Gilead

42 Use of certain land at 901 Appin Road, Gilead

(1) This clause applies to part of Lot 10, DP 1261146, 901 Appin Road, Gilead, identified as “42” on the Additional Permitted Uses Map.

(2) Development for the purposes of a single business premises is permitted with development consent if the consent authority is satisfied that the business premises will be used only during the relevant period for the purposes of house and land sales for the Mount Gilead Urban Release Area.

(3) In this clause—

Mount Gilead Urban Release Area means land identified as the “Mount Gilead Urban Release Area” on the Urban Release Area Map.

relevant period means the period—

(a) commencing on the commencement of this clause, and

(b) ending on the earlier of the following—

(i) the day that is 3 years after the day on which an occupation certificate for the premises is issued,

(ii) the day that is 12 months after the day on which 1,200 lots are created on the Mount Gilead Urban Release Area.
