The Campbelltown Local Environmental Plan 1995,Classification of Public Land is a single-purpose planning instrument that reclassifies specified parcels of public land within the Campbelltown local government area from community land to operational land for the purposes of the Local Government Act 1993. Clause 4(1) states bluntly: “The public land described in the Schedule is classified, or reclassified, as operational land for the purposes of the Local Government Act 1993.” This classification change is the entire substantive effect of the plan; clause 2 confirms that the sole aim is to alter the classification “from community land to operational land.”

For land listed in Part 2 of the Schedule, the plan does more than reclassify. Under clause 4(2), to the extent that any parcel in Part 2 is a public reserve, it ceases to be a public reserve on the commencement of the relevant amending plan. That same provision discharges the land “from any trusts, estates, interests, dedications, conditions, restrictions and covenants” affecting it, subject to three categories of preserved encumbrances: those specifically listed in Part 2 for the parcel; any reservations that except land out of a Crown grant; and reservations of minerals within the meaning of the Crown Land Management Act 2016. The practical effect is to strip away most historical legal impediments that would otherwise prevent the council from dealing with the land freely, including selling it or developing it for non-community purposes.

Land in Part 1 is treated differently. Clause 4(5) provides that land described in Part 1 of the Schedule “is not affected by the amendments made by the Local Government Amendment (Community Land Management) Act 1998 to section 30 of the Local Government Act 1993.” This means the version of section 30 that applies to Part 1 land is the pre-1998 version, which likely provided fewer procedural protections for community land or had different rules about discharge of trusts. The plan itself does not explicitly discharge trusts for Part 1 land; it only reclassifies the land. The distinction between Part 1 and Part 2 is therefore critical: Part 2 parcels undergo both reclassification and removal of most encumbrances, while Part 1 parcels undergo only reclassification, with any existing trusts or public reserve status potentially remaining in place under the older legislative regime.

The plan is amended repeatedly by inserting new parcels into the Schedule, each time via a “relevant amending plan” cited at the end of the parcel description. Clause 4(3) requires that before such an amending plan was made, the Governor approved of subclauses (2) and (4) applying to the land. The plan thus operates as a rolling mechanism for converting specific pockets of community land to operational land, often with the simultaneous extinguishment of longstanding public dedications.

The central legal distinction is between community land and operational land under the Local Government Act 1993. Community land is land held by a council that must be used for community purposes such as public recreation, open space, or environmental conservation. It cannot be sold or leased without significant procedural hurdles, and its use is restricted by a plan of management. Operational land, by contrast, is land held for the council’s own administrative or commercial purposes. It may be sold, leased, or developed more freely, and the council’s obligations to maintain public access are far lower. Reclassification from community to operational land therefore removes a bundle of legal constraints that protect public use, transferring discretion to the council to decide the land’s future.

A second key concept is the public reserve. Under the Local Government Act, a public reserve is land dedicated for a public purpose, often subject to specific trusts (for example, a park dedicated for public recreation). Section 30 of that Act provides the mechanism by which a local environmental plan can reclassify public land and simultaneously discharge the land from its status as a public reserve and from the associated trusts, estates, interests, dedications, conditions, restrictions, and covenants. The Campbelltown plan uses that section explicitly for Part 2 land. The power to discharge is not absolute: it preserves Crown grant exceptions and mineral reservations, and the plan itself can specify particular encumbrances that survive.

The relevant amending plan is defined in clause 4(4) as the local environmental plan cited at the end of the description of the parcel in Part 2. This means each addition to Part 2 was itself a separate LEP amendment that operated retrospectively to trigger the discharge of encumbrances under clause 4(2). The plan therefore functions as a receptacle for serial reclassification decisions, each authorised by Governor approval before the amending plan was made. The requirement for Governor approval is a procedural safeguard, but one that is satisfied ex ante by the executive, not by Parliament or the local community.

The 1998 amendments to section 30 of the Local Government Act are a subtle but important backdrop. By excluding Part 1 land from those amendments, the plan preserves the previous legal regime for those parcels. That may mean the power to reclassify Part 1 land under the older law is more limited or subject to different conditions. The plan does not specify what those differences are, but the drafter evidently considered it necessary to carve out Part 1 to avoid the 1998 changes affecting those reclassifications.

The most directly affected entity is Campbelltown City Council, which holds the land and gains the right to manage it as operational land. For Part 2 parcels, the council also gains the ability to sell, lease, or develop the land free from many historical restrictions that would have limited its commercial value. This has financial implications for the council’s balance sheet: operational land can be treated as a revenue-generating asset, whereas community land is a servicing liability. The council’s ratepayers and residents bear the opportunity cost if the land is sold for private development and lost for community use, but they also benefit if the proceeds fund other public services.

Users of the public land are directly affected. Land that was community land - a park, a reserve, a public open space - may be closed to the public, sold, or developed. There is no requirement in the plan for public consultation or compensation to those who lose access. The plan does not create any right for residents to be notified or to object. For Part 2 land, the discharge of trusts means that any legal claim by a community group that relied on a dedication (for example, a trust for recreation purposes) is extinguished unless the trust was preserved in the Schedule. The plan itself is silent on whether any specific trusts are preserved; it says only those “specified in relation to the land in Part 2 of the Schedule” survive. If none are specified, all vanish.

Developers and purchasers of the land benefit from the reclassification and discharge of encumbrances. They acquire land with a clean title or at least with fewer restrictions, reducing due diligence costs and development risk. For Part 2 land, the discharge of interests such as easements (except those preserved) may increase the land’s usable area and development potential. For Part 1 land, the title may still be burdened by trusts, making it less attractive unless those trusts are released by other means.

Holders of easements or other interests that were created before the reclassification are affected. The plan discharges all such interests for Part 2 land unless they are listed in the Schedule. The Schedule does list some specific easements - for electricity, drainage, and water supply - that survive for certain Minto parcels. Those easement holders retain their rights; all other interest holders lose them. This is a significant legal adjustment: a drainage easement benefiting a neighbour may be extinguished without compensation, subject to the usual protections in property law.

The plan confers on Campbelltown City Council the right to treat the land as operational land under the Local Government Act 1993. This is the central right granted. For Part 2 land, the council also has the right to hold the land free from most prior encumbrances, including trusts, dedications, conditions, restrictions, and covenants, except those specifically preserved. The effect is to give the council a relatively unfettered ability to sell, lease, or develop the land, subject only to general planning controls under the Environmental Planning and Assessment Act 1979, the council’s own operational land sale procedures, and the preserved interests.

The council also has the duty to comply with the Local Government Act in dealing with operational land. Section 40 of that Act requires councils to sell operational land at public auction or by tender unless an exception applies, and to achieve the best possible price. The plan does not exempt the council from those requirements, so the reclassification does not confer a right to sell below value or without competition. However, the removal of trust restrictions makes compliance easier because there are fewer legal obstacles to marketing the land.

The plan does not create any duty to maintain public access or to provide alternative community facilities. Once the land is operational, the council may fence it off, lease it, or sell it for private use. Residents and community groups have no enforceable right under this plan to continue using the land for recreational or community purposes.

For Part 1 land, the preservation of the pre-1998 section 30 regime may impose additional procedural duties on the council. The 1998 amendments to the Local Government Act introduced requirements for plans of management and public consultation before reclassification. By excluding Part 1 from those amendments, the plan means that the council reclassified those parcels under the older, less stringent rules. But those older rules may still have required certain steps, such as Governor approval or a public hearing, which were already satisfied at the time of the original reclassification. The plan does not specify what those steps were.

Holders of preserved easements retain their rights. For example, the easements noted on certificates of title for lots on Eagleview Road, Guernsey Avenue, and Pendergast Avenue in Minto are specifically preserved. Those holders have the right to continue using the land for the purpose of the easement (electricity, drainage, water supply). The council must not interfere with those easements. However, the plan does not create a duty on the council to maintain or register those easements; they are deemed to survive by operation of the plan.

The plan does not create any offences or penalties of its own. It is a reclassification mechanism, not a conduct regulation. However, the reclassification has downstream enforcement implications under the Local Government Act 1993. If the council treats land as operational when it has not been properly reclassified - for example, if a parcel described in Part 1 is found not to match the deposited map - the council could be in breach of the Local Government Act’s provisions governing community land. The Act imposes penalties for unauthorised use or disposal of community land. Section 26 of the Local Government Act makes it an offence to use community land otherwise than in accordance with its classification. A council officer who authorises such use could face personal liability.

For Part 2 land, the discharge of trusts removes the basis for many potential enforcement actions by community members. A person who would have had standing to enforce a trust (for example, as a beneficiary of a dedication for public recreation) loses that standing once the trust is discharged. However, the preserved Crown grant reservations and mineral reservations remain enforceable by the state. The Crown could bring proceedings against the council if it develops land in a way that interferes with those reservations, such as extracting minerals without authorisation.

The plan’s effect on easements and other interests could lead to disputes. A neighbour who held a drainage easement that is not preserved in the Schedule might argue that the plan cannot extinguish their property right without compensation, potentially invoking the James v Commonwealth just terms principle. The plan itself provides no compensation mechanism. If a court were to find that the discharge of an easement was invalid for lack of just terms, the reclassification of that parcel might be partially ineffective. No such litigation is recorded in the source, but the risk is inherent in the legislative design.

Enforcement of the plan’s provisions is primarily through the Land and Environment Court of New South Wales, which has jurisdiction over planning instruments and classification disputes. A person who claims that a parcel of land has been incorrectly classified could seek a declaration or order from that court. The court could also enforce the preserved easements or Crown reservations if the council attempts to override them.

The plan also interacts with the registration of title under the Real Property Act 1900. The discharge of trusts and interests under clause 4(2) may need to be recorded on certificates of title to be effective against subsequent purchasers. If the council fails to update the Register, a purchaser for value may still take free of the discharged interests if they are not on title, but there is a risk of competing claims. The plan does not impose a duty on the council to register the discharge.

The plan operates within a complex legislative framework, headed by the Local Government Act 1993 and the Environmental Planning and Assessment Act 1979. The plan is a local environmental plan made under the latter Act, but its substantive effect is defined by the former. Section 30 of the Local Government Act is the critical provision: it empowers a local environmental plan to reclassify public land and, where the land is a public reserve, to discharge it from trusts and other encumbrances. The Campbelltown plan exercises that power for both Part 1 and Part 2, but with the carve-out for Part 1 from the 1998 amendments to section 30.

The Local Government Amendment (Community Land Management) Act 1998 amended section 30 to add protections allegedly for community land, such as requiring consultation and plans of management. The plan expressly excludes Part 1 land from those amendments. This means that the reclassification of Part 1 land was completed under the pre-1998 version of section 30, which may have been more permissive or less procedurally burdensome. The interaction is therefore not one of harmonisation but of layering: Part 1 exists in a legislative time capsule.

The Crown Land Management Act 2016 is referenced in clause 4(2)(b) to define “reservations of minerals”. That Act governs the management of Crown land and the reservation of minerals to the Crown. The plan preserves those reservations, meaning any mineral rights retained by the Crown survive the reclassification. A developer seeking to exploit minerals on the land must still obtain separate consent from the Crown, regardless of the land’s new classification.

The Conveyancing Act 1919 and Real Property Act 1900 govern the creation, transfer, and extinguishment of interests in land. The plan purports to discharge “estates, interests, dedications, conditions, restrictions and covenants” for Part 2 land. This operates as a statutory override of those property laws, but only to the extent the Local Government Act authorises it. The plan does not affect the validity of easements that are specifically preserved, nor does it affect any pre-existing mortgages or charges unless they are within the scope of the words “estates, interests”. Lenders who held a mortgage over community land would find their security affected if the land is reclassified and sold; however, the plan does not address that scenario, and the Local Government Act may not permit the discharge of mortgages without compensation.

The plan as in force records numerous amendments, as shown in the amendment notes to clause 4 and the Schedule. The earliest amendments date from 1995, almost immediately after the plan’s commencement: 19 May 1995, 8 September 1995, then a series in 1996 (16 February, 14 June, 21 June, 16 August, 27 September, and 4 October). This reflects a pattern of adding new parcels, likely driven by individual council decisions to reclassify particular sites as opportunities arose. The rapid succession of amendments in 1996 suggests an active program of converting community land to operational land within the first 18 months of the plan’s life.

Later amendments occurred on 8 September 2000, 29 August 2003, 2006 (two amendments: Instruments 623 and 803), and 2008 (Instrument 172). The 2006 amendment 803 amended clause 4 to update references and add a paragraph, and also amended the Schedule. The 2019 amendment (Instrument 621, Schedule 2.6) updated the reference from the Crown Lands Act 1989 to the Crown Land Management Act 2016. That change was purely mechanical, reflecting the consolidation of Crown land legislation, and did not affect the substance of the reclassification.

The Schedule itself was amended repeatedly, with new parcels added to both Part 1 and Part 2. The amendment notes list: “Am 19.5.1995; 8.9.1995; 16.2.1996; 14.6.1996; 21.6.1996; 16.8.1996; 27.9.1996; 4.10.1996; 8.9.2000; 29.8.2003; 2006 (623), Sch 2; 2006 (803), Sch 2 [2]; 2008 (172), Sch 2.” The expression “Sch 2” refers to the schedule of the amending regulation, not the plan’s own Schedule.

The amendment history reveals that the plan is not a static document but a living instrument that has been expanded over 13 years. The final amendment in 2008 suggests that the council stopped adding parcels after that date. However, newer LEPs may have superseded this plan for later reclassifications. The plan remains in force for the parcels already included.

Importantly, clause 4(3) requires that before each “relevant amending plan” that inserted a description into Part 2 was made, the Governor approved of subclauses (2) and (4) applying to the land. This means each addition to Part 2 required separate Governor approval, adding a layer of executive oversight. The amendment history does not record whether such approvals were obtained, but the validity of each addition depends on it.

The source text provides no information about litigation arising from this plan. No cases are cited in the plan or in its amendment notes. This is consistent with the plan’s nature as a purely mechanical reclassification instrument; it is unlikely to generate high-profile litigation unless a particular reclassification is challenged.

Potential grounds for litigation include: a claim that the plan fails to comply with section 30 of the Local Government Act (for example, if the land was not a public reserve at the time of reclassification, the discharge of trusts might be ultra vires); a claim that the Governor’s approval was not properly obtained; a claim that the plan extinguishes property rights without just compensation contrary to the Commonwealth Constitution (section 51(xxxi)); or a claim that the description of land in the Schedule is insufficiently precise to identify the parcel, making the reclassification void for uncertainty.

The absence of recorded litigation could mean that the plan has operated without controversy, or that disputes were resolved at the administrative level before reaching court. Given the number of parcels involved and the financial stakes, it is plausible that some affected parties (such as community groups or easement holders) considered legal action but either lacked standing, lacked resources, or accepted the outcome. Alternatively, the plan may have been carefully designed to avoid obvious legal defects.

The plan’s relationship with the 1998 amendments to section 30 could also form the basis of a challenge. If a Part 1 parcel was reclassified after 1998 but the plan says it is not affected by those amendments, a challenger might argue that the council should have applied the newer, more protective regime. However, clause 4(5) explicitly states that Part 1 land “is not affected” by the 1998 amendments; this appears to be a transitional or grandfathering provision, likely valid as a matter of legislative draughting.

Any litigation would most likely be in the Land and Environment Court of New South Wales, which has exclusive jurisdiction over planning instruments and classification disputes. The court could issue declarations about the validity of the plan or specific amendment plans, and could order the council to take steps to reinstate community classification if the plan is found invalid.

The first and most significant trap for practitioners is the distinction between Part 1 and Part 2 of the Schedule. A lawyer reviewing a parcel in Part 1 might assume the same legal effects apply as for Part 2, but they do not. Part 2 land is expressly discharged from trusts and public reserve status; Part 1 land is not. Clause 4(5) specifically excludes Part 1 from the 1998 amendments to section 30, which may mean that the reclassification of Part 1 land did not carry with it a discharge of trusts. In practical terms, a purchaser of Part 1 land may still be acquiring land subject to a trust for public recreation or a dedication for a particular purpose, even though it is now classified as operational. The plan does not identify what trusts or interests survive on Part 1 land, leaving the buyer to investigate the original dedication.

A second trap is the dependence on deposited maps. Each parcel is described by reference to a map held by Campbelltown City Council. The maps are not reproduced in the legislation. A misdescription in the map - or a missing map - could make the reclassification ineffective. The plan says the land is “as shown edged heavy black on the map marked … deposited in the office of Campbelltown City Council.” If the map cannot be located or is ambiguous, the parcel may not be validly reclassified. Anyone relying on the plan must inspect the physical maps at the council office.

Third, the discharge of trusts and interests for Part 2 land is not total. It preserves “those trusts, estates, interests, dedications, conditions, restrictions and covenants (if any) specified in relation to the land in Part 2 of the Schedule.” The Schedule does specify some easements - for example, electricity easements on Eagleview Road and Guernsey Avenue. But it is silent for many parcels. A reader might assume that no interests survive if none are listed, but the phrase “if any” suggests that the drafter intended that any interests not listed are discharged. However, the plan also preserves Crown grant reservations and mineral reservations regardless of listing. This means a parcel could still be burdened by an ancient Crown grant that excepted land from the grant, even if not mentioned in the Schedule.

Fourth, the Governor approval requirement in clause 4(3) is a condition precedent for the validity of Part 2 amendments. The plan states that before the relevant amending plan was made, “the Governor approved of subclauses (2) and (4) applying to the land.” If the Governor’s approval was not obtained or was not properly recorded, the reclassification and discharge for that parcel could be void. The plan does not provide evidence of such approval; it merely asserts that it occurred. A due diligence investigation should verify the existence of the Governor’s approval, which would be recorded in the Government Gazette or the amending plan’s explanatory material.

For Campbelltown City Council, compliance begins with maintaining accurate and accessible records of the deposited maps and the relevant amending plans. The council must be able to identify which parcels are covered by the plan and whether they fall in Part 1 or Part 2. Before dealing with any parcel, the council should verify that the reclassification is effective by checking the map description and the amending plan, and confirming that any necessary Governor approval was obtained. For Part 2 land, the council should also confirm whether any trusts or interests are preserved and ensure those are not interfered with.

When selling or leasing operational land, the council must comply with Part 7, Division 2 of the Local Government Act 1993 (sections 37-44). That requires public auction or public tender unless an exemption applies, and the council must obtain the best possible price. The reclassification does not exempt the council from those duties. The council should also update its Register of Land Classification under section 26 of the Local Government Act to reflect the change. Failure to do so could result in the land being treated as community land for administrative purposes.

For holdings of Part 2 land that have had trusts discharged, the council should consider lodging a notice with the Registrar-General to record the discharge on the certificates of title. While the plan operates by force of law, registration provides clarity for future purchasers and reduces the risk of competing claims. The council should keep a register of preserved easements and ensure that development approvals respect those easements.

For developers and purchasers, compliance involves thorough due diligence that goes beyond the plan itself. The plan’s terms must be read alongside the relevant amending plan cited in Part 2. For example, a purchaser of land at Eagle Vale must obtain “Campbelltown Local Environmental Plan No 215” to see if it contains additional conditions. The purchaser should also inspect the deposited maps at the council office to confirm the boundary of the parcel. For Part 1 land, additional title searches are necessary to identify any surviving trusts or dedications that were not discharged by the plan. Relying solely on the plan’s statement that the land is reclassified as operational is insufficient; the purchaser should confirm that any community-related restrictions have been removed by other means if the land is in Part 1.

For owners of easements or interests that are preserved, compliance is passive: they retain their rights and need take no action unless the council interferes. However, they should ensure that the preserved interests are recorded on the title register. If not, they should consider lodging a caveat or registering the easement to protect against dealings by the council that might overlook the preservation.
