113 Costs not generally to be ordered (1) Subject to subsection (2), a conciliator or Hearing Commissioner must not make an order requiring a party to the application to pay an amount by way of costs. (2) If at an inquiry the Hearing Commissioner is of the opinion that the application is frivolous or vexatious or brought otherwise than in good faith, he or she may order the applicant to pay an amount by way of costs to another person appearing at the inquiry. (3) The person in whose favour an order is made under subsection (2) may recover the amount specified in the order from the applicant as a debt due and payable.
