Business Names Registration (Fees) Regulations 2022

The regulations introduce a small set of statutory concepts and reuse others from the governing Acts. The principal concepts, as defined or referenced in the instrument, are:

• Chargeable matter. The instrument treats fees as payable for “chargeable matters” defined in the Act. The regulations do not redefine that term; they operate “for the purposes of section 4 of the Act” by prescribing the amounts payable for particular chargeable matters listed in the table in s 6(1). The instrument explicitly notes that “chargeable matter is defined in the Act” (s 5 Note; s 6(1)).

• Register. The word Register refers to the Business Names Register established and maintained under section 22 of the Business Names Registration Act 2011. The instrument imports that statutory object via its definition (s 5).

• Entity, government body, business name. The instrument declares that a number of expressions have the same meaning as in the Business Names Registration Act 2011, including business name, entity and government body (s 5). That means whether the fees apply, and in what amount, depends on those upstream definitions in the Business Names Registration Act 2011 and the Fees Act.

• Fee items. The schedule in s 6(1) lists discrete chargeable matters and the fixed dollar amounts for each. Items 1-4 address registration and renewal for one and three year terms. Items 5-8 prescribe fees for extracts of the Register distinguishing current vs current and historical information and whether the applicant is a government body or a journalist. Item 9 creates a no fee outcome for government bodies and journalists in specific extract circumstances. Item 10 is an ancillary service charge tied to the physical location of inspection or issue/display at an ASIC Business Centre.

• Indexation. Subsections 6(2)-(7) set a formulaic mechanism to adjust the stated dollar amounts on an annual basis, using an indexation factor derived from the All Groups Consumer Price Index numbers published by the Australian Statistician. Key elements of that mechanism are: the indexation year timing (start of each financial year after 2021-22), the calculation of the indexation factor using index numbers for a reference quarter and a base quarter (s 6(3)), rounding rules to three decimal places for the indexation factor (s 6(4)), a floor that prevents an indexation factor of less than 1 (s 6(5)), and rounding the worked amounts to the nearest whole dollar with 50 cents rounded downwards (s 6(6)). The regulations require calculations to use “only the index numbers published in terms of the most recently published index reference period” and to disregard substituted index numbers, except where substituted to account for changes in the index reference period (s 6(7)(a)-(b)).

• Transitional saving for pre‑commencement debts. The regulations preserve the application of the 2011 regulations to amounts that became due before the 2022 instrument commenced (s 7).

These main concepts determine the arithmetic of fee burdens (the fixed amounts plus CPI adjustments), the actors to whom fees apply (entities as defined upstream), the statutory instrument that governs how fees are administered (the Register under the Business Names Registration Act 2011), and the limited circumstances in which fees are zero or carry an additional charge.

The instrument affects a circumscribed set of persons and administrative actors, as identified in the fee table and the definitions section. Those groups are the payers, the beneficiaries of the exemption, and the administrator of Library/inspection services.

1. Entities registering or renewing business names. The primary group affected are “entities” seeking registration or renewal of a business name on the Business Names Register, as the table prescribes fees for registration and renewal for one year ($37) and three years ($88) (s 6(1), items 1-4). Which legal or natural persons count as an entity follows the definition imported from the Business Names Registration Act 2011 (s 5).

2. Applicants for extracts of the Register. Entities (other than government bodies and journalists) that request extracts of the Register are subject to the fees in items 5-8: $9 for a current-information extract relating to one business name (item 5), $19 for a current-information extract relating to one entity (item 6), $17 for a current-and-historical-information extract relating to one business name (item 7), and $40 for a current-and-historical-information extract relating to one entity (item 8) (s 6(1)). The instrument makes the fee payable “for an application by an entity, other than a government body or journalist” (items 5-8), thereby excluding government bodies and journalists from those fees in those contexts.

3. Government bodies and journalists. Government bodies and journalists are identified as exempt from fees for extracts that relate to the business names currently or previously registered to an entity (item 9). The exemption is phrased as “An application by a government body or journalist for an extract of the Register relating to the business names currently or previously registered to an entity, no fee” (item 9). The exemption is limited to that extract type and class of applicant; it does not purport to exempt government bodies or journalists from registration or renewal fees, which are tied to entities registering business names (items 1-4).

4. Users of ASIC Business Centres. The instrument imposes a $3 additional fee where the inspection of the Register, or the issue or display of a document, “occurs at a Business Centre of ASIC,” and this $3 is payable in addition to the fee under items 5-8 (item 10). That creates a small location‑based surcharge for applicants who use the physical ASIC Business Centre service.

5. The Register and its administrator. While the instrument does not name an administrative entity other than a cross‑reference to the Register established under the Business Names Registration Act 2011 (s 5), the presence of a charge for inspection/issue/display at an ASIC Business Centre indicates that ASIC’s service points collect and take steps to recover the prescribed fees in the situations described (item 10).

6. Persons with amounts due before commencement. The saving provision ensures that persons who incurred fee liabilities under the 2011 regulations before the 1 April 2022 commencement continue to be governed by the 2011 regulations for those amounts, not the 2022 instrument (s 7).

Who pays, therefore, depends on the interaction between the Act’s definition of chargeable matter and entity, and the fee items in the table. The instrument itself delimits the exemption and the $3 surcharge narrowly and prescribes annual CPI‑linked adjustments that will affect these groups in future financial years (s 6(2)-(7)).

The regulations place identifiable, discrete duties on fee‑paying applicants and confer a narrow statutory exemption and procedural specifications. The key duties and rights in the instrument are as follows.

Duties

• Duty to pay prescribed fees when a chargeable matter arises. The instrument prescribes amounts for chargeable matters “for the purposes of section 4 of the Act” and lists those amounts in s 6(1). Where a person performs a chargeable matter within the scope of the Act and the Business Names Registration Act 2011 definitions, the person must pay the fee amount prescribed by the corresponding item in the table (s 6(1)). The regulations do not set payment mechanics, invoicing, timing, or recovery processes; they only set the payable amounts.

• Duty to accept indexation. At the start of each financial year after 2021-22, the dollar amounts in the table are to be replaced by amounts worked out using the indexation formula in s 6(2)-(3). That is an ongoing statutory duty on the administering agency to apply the new indexed amounts.

• Duty to comply with rounding and floor rules. The administering agency must calculate the indexation factor to three decimal places with specified rounding (s 6(4)), apply a minimum indexation factor of 1 (s 6(5)), and round the resulting dollar amounts to the nearest whole dollar with 50 cents rounded downwards (s 6(6)). Calculations must be based on the most recently published index reference period and must usually ignore substituted index numbers except when those substitutions account for changes to the index reference period (s 6(7)).

Rights

• Right to the prescribed exemption. Government bodies and journalists have a statutory right to no fee for “an extract of the Register relating to the business names currently or previously registered to an entity” (s 6(1), item 9). That right is narrowly expressed and applies only to extracts of that nature and to those applicants.

• Right to access fee levels and foresee annual adjustments. The instrument supplies certainty about the initial nominal fees and how they will change over time through a formal, formulaic CPI link (s 6(2)-(3)). Users can model future fees from the starting amounts and the defined CPI methodology.

• Transitional right under s 7. A person who had amounts that became due before the 1 April 2022 commencement retains the regime under the repealed 2011 regulations for those amounts, as if the repeal had not occurred (s 7). That is a substantive saving right preserved by the instrument.

Limitations and operational gaps within the instrument

• The instrument does not stipulate timing, payment channels, or procedures for collection; it prescribes amounts only. The administering agency is required to implement the fee levels and indexation, but the instrument contains no operational rules about invoicing, late payment penalties, remission, or dispute procedures.

• The definitions that determine who is subject to fees and who qualifies for exemption (for example, “entity”, “government body”, “journalist”, and “chargeable matter”) are largely imported from the Business Names Registration Act 2011 and the Fees Act (s 5). Accordingly, an applicant’s rights and duties under the instrument depend on those external definitions.

In sum, the instrument creates a clear duty to pay particular fixed fees for specified services, institutes a defined annual CPI adjustment process that the administering agency must apply, and preserves a narrow exemption while leaving procedural and enforcement detail to other instruments or the administering agency.

The regulations, read in full, do not create new penalty or enforcement provisions. Their text confines itself to prescribing fee amounts, setting an indexation methodology, effectuating a saving provision for pre‑commencement liabilities, and repealing the earlier fees instrument (s 6; s 7; Schedule 1). There are no provisions in the instrument that specify criminal offences, civil penalties, administrative sanctions, or specialised enforcement procedures for non‑payment.

Implications from the instrument’s structure

• Fee-setting only. The instrument’s role is to specify the amounts payable for listed chargeable matters under the Business Names Registration (Fees) Act 2011 (see heading and s 6(1)). It does not itself allocate powers to recover unpaid fees, make payment arrangements, or proscribe penalties for non‑payment within its own text.

• Enforcement resides elsewhere by implication. Because the instrument is made under the Act (s 3) and repeatedly cross‑references definitions in the Business Names Registration Act 2011 (s 5), responsibility for enforcement, collection, remittance or recovery procedures is likely to be set out in the Act or in other administrative rules or departmental processes not included in this instrument. The instrument does not purport to displace those matters.

• Administrative discretion. The instrument leaves operational implementation, including how and when indexed fees are published and applied in administrative systems, to the administering agency. The regulations prescribe calculation rules for indexation (s 6(2)-(7)) but not publication deadlines, user notices or reconciliation practices. Those are administrative activities for which the instrument establishes obligations only in arithmetic terms.

What this means in practice

• From a compliance perspective, the immediate enforcement consequence in the instrument is straightforward: if a person incurs a chargeable matter as defined in the underlying Acts, the instrument fixes the amount that will be payable. The practical sanctions or remedies for non‑payment are not stated here. Practitioners needing the enforcement regime will have to consult the parent statutes and administrative materials of the administering agency.

• The instrument’s preservation of pre‑commencement liabilities under the repealed 2011 instrument (s 7) also preserves whatever enforcement or recovery mechanisms applied under that earlier instrument to amounts that became due before 1 April 2022.

In short, the regulations set fee quantum and the arithmetic for future adjustments, but do not create or modify penalties or enforcement mechanisms within their own text; those matters are out of the instrument’s scope as drafted.

The Business Names Registration (Fees) Regulations 2022 are tightly integrated with two pieces of primary legislation mentioned in the instrument: the Business Names Registration (Fees) Act 2011 and the Business Names Registration Act 2011. The instrument’s own text makes its dependencies explicit and prescribes how it should be read with those Acts.

Statutory basis and cross‑references

• Made under the Fees Act. The instrument is made under the Business Names Registration (Fees) Act 2011 (s 3). The fee prescriptions in s 6 are expressly “for the purposes of section 4 of the Act,” which means the regulations implement and give concrete effect to a power or scheme in the Fees Act.

• Definitions come from the Business Names Registration Act 2011. Section 5 of the instrument states that a number of expressions used in the instrument have the same meaning as in the Business Names Registration Act 2011 (see s 5). Those include business name, entity and government body. The Register is also defined by reference to s 22 of the Business Names Registration Act 2011 (s 5). Therefore, whether a person is an “entity” for fee purposes, whether a matter is a “chargeable matter” under the Act, or what constitutes the “Register,” all depend on those external Acts.

• Link to the Register. The instrument prescribes fees for extracts and for registration actions that are recorded on the Business Names Register (s 6(1) and s 5). The legal effect and availability of extracts and the procedures to obtain them are determined by the Business Names Registration Act 2011 and the Fees Act; the regulations supply the monetary amounts associated with those matters.

Indexation and use of statistical data

• Use of CPI numbers. The instrument depends on published statistics , the All Groups Consumer Price Index numbers published by the Australian Statistician , to operate its indexation mechanism (s 6(3)). The methodology references published index numbers and imposes constraints on which index numbers to use (s 6(7)(a)-(b)). That creates an operational dependence on the Australian Statistician’s publication schedule and reference periods, which are external to both the Fees Act and the regulation.

Transitional interaction with prior regulations

• Repeal and saving. The instrument repeals the Business Names Registration (Fees) Regulations 2011 (Schedule 1) but preserves their application to amounts that became due for payment before commencement (s 7; Schedule 1). That ensures no retroactive change to liabilities already crystallised under the prior instrument.

Other laws and absence of explicit interaction

• No express interaction with taxation, administrative debts or fee remissions. The text does not mention other Commonwealth instruments relating to debts, recoveries or taxation, such as appropriation or remittance frameworks. It also does not provide for remissions, waivers or offsets. Any interaction with such frameworks would therefore depend on provisions in the parent Acts or on administrative practice.

• No procedural or enforcement cross‑reference in the instrument. The regulation sets amounts and the indexation methodology but does not specify collection or enforcement mechanisms. Interaction with recovery procedures, penalty regimes, or dispute resolution will depend on the enabling Acts or separate administrative instruments.

In sum, the regulations operate as the monetary arm of a statutory registrations system, depending on definitional and procedural scaffolding in the Business Names Registration Act 2011 and the Fees Act, and relying on ABS CPI publications to adjust amounts annually. Practitioners should treat the instrument together with those Acts to determine comprehensive rights, duties and administrative processes.

The instrument contains self‑contained statements about its own making, commencement and repeal of the earlier instrument. It does not record any subsequent amendments within the text provided. The salient historical and amendment facts contained in the instrument are as follows.

Creation and signature

• The instrument was made by the Governor‑General acting with the advice of the Federal Executive Council and is dated 17 March 2022, bearing the signature of the Governor‑General and the Minister for Superannuation, Financial Services and the Digital Economy (preamble).

Commencement

• The instrument declares the commencement date in section 2. The whole instrument commenced on 1 April 2022 (s 2(1) and the commencement table). The instrument contains the standard note that the table refers only to the instrument as originally made and that it will not be amended in the instrument to reflect later amendments (s 2(1) Note).

Repeal of prior regulations

• Schedule 1 effects a repeal of the Business Names Registration (Fees) Regulations 2011 by specifying “The whole of the instrument” and directing repeal (Schedule 1). Section 7 supplements the repeal by providing a saving provision that preserves the application of the 2011 regulations to amounts that became due before commencement (s 7). That is the only explicit amendment history recorded: a repeal of the earlier fees instrument and a saving for pre‑commencement liabilities.

Other internal change mechanisms

• Indexation. The instrument itself provides an ongoing, automatic amendment mechanism for the dollar amounts it prescribes via indexation (s 6(2)-(7)). That is not an “amendment” to the instrument by an external party; rather, it is a formula built into the instrument that will change the published fee amounts at the start of each financial year. The regulations thereby create a predictable internal path for future nominal changes without the need for further legislative instruments to be made each year.

Absence of subsequent amendment entries

• The text provided does not record any later amending instruments, variations, or revocations after the original making. Any later changes would appear in subsequent amending regulations or in consolidated published versions, but they are not present in this instrument as supplied.

Procedural notes

• The instrument includes a clause enabling schedules to amend or repeal instruments as set out in the applicable items (s 4). That is a standard drafting device that allows the schedules to operate to effect amendment or repeal as recorded. In this instrument the relevant schedule effect is the repeal of the 2011 instrument.

For practical purposes, the documented amendment history inside the instrument is limited to its making on 17 March 2022, its commencement on 1 April 2022, and the repeal of the 2011 fees regulations with a saving provision for pre‑commencement liabilities. All ongoing adjustments to the fee amounts are to occur automatically under the indexation formula in s 6(2)-(7).

The regulations as provided do not include any references to judicial decisions, cases, or litigation outcomes. The text contains no section citing case law, no judicial interpretative history, and no recorded appeals or challenges within the instrument itself. Therefore, within the document’s own scope there is no litigation history to report.

Potential loci for future disputes (text‑based)

Although the instrument does not record litigation, certain features of the drafting identify interpretive questions that could form the basis of disputes subject to judicial review or administrative appeal. These are areas grounded in the instrument’s wording and therefore plausible triggers for litigation or formal complaints:

• Interpretation of imported definitions. The instrument relies on definitions from the Business Names Registration Act 2011 for key terms such as “entity,” “business name,” “government body” and the expression “chargeable matter” (s 5). Disputes may arise where a person’s status as an entity or a government body is contested for fee purposes, or where the Act’s definition of a chargeable matter is ambiguous in a particular factual matrix. Such disputes would be resolved by reference to the definitions in the parent statute.

• Application of the journalist and government body exemption. Item 9 exempts “an application by a government body or journalist for an extract … relating to the business names currently or previously registered to an entity.” Questions could arise about what qualifies as an application “relating to” business names “currently or previously registered to an entity,” for example whether derivative or aggregate extracts fall within the exemption, or whether a journalist acting through an entity qualifies.

• Whether and when the $3 Business Centre charge applies. Item 10 applies “if the inspection of the Register or the issue or display of a document occurs at a Business Centre of ASIC, in addition to the fee payable under item 5, 6, 7 or 8” (item 10). Litigation or administration disputes could focus on whether the $3 triggers where a third party or agent obtains an extract at a Business Centre, where a hybrid online/physical process occurs, or on the precise meaning of “issue or display” in practice.

• Indexation calculations. The formula in s 6(2)-(3) uses ABS CPI numbers and defines reference and base quarters. Disputes could arise over which published index number is the “index number, for a quarter,” or over the application of s 6(7) where substituted index numbers have been published, or over rounding rules (s 6(4)-(6)). The instrument’s requirement to “use only the index numbers published in terms of the most recently published index reference period” suggests technical issues that could be litigated if the administering agency and a stakeholder diverge on the correct inputs or rounding.

Limitations

• The instrument does not itself offer a record of any proceedings, so the above points are hypothetical and strictly derived from the text. The document does not indicate that any litigation occurred in connection with its making, content, or application.

Practitioners seeking litigation authorities or precedent on these points will need to consult case law arising under the parent Acts or administrative decisions interpreting similar fee instruments; none of that material forms part of this instrument’s text.

The regulation is short but precise, and its drafting contains specific arithmetic and eligibility features that can catch users and administrators if overlooked. The principal practical “gotchas” grounded in the instrument are these.

Indexation floor prevents decreases

• The indexation factor is subject to a floor of 1 (s 6(5)). That means fees cannot be reduced by a negative CPI change. Even if CPI declined in the relevant interval, the instrument requires the administering agency to maintain at least the nominal starting dollar amounts. Users should not expect fee decreases from deflation or low CPI.

Annual timing and the reference/base quarter construct

• The indexation factor uses “reference quarter” and “base quarter” as defined in s 6(3). The instrument defines reference quarter as “the March quarter in the year before the indexation year,” while base quarter is “the last March quarter before the reference quarter” (s 6(3) definitions). That layered definition means the indexation factor will be calculated using CPI numbers from two separate March quarters, the timing of which may be counter‑intuitive to readers who expect a comparison to the immediately preceding quarter. Practitioners and administrators must follow these precise definitions when computing the factor to avoid miscalculation.

Rounding rules and the 50 cents convention

• The instrument requires the indexation factor to be calculated to three decimal places, rounding up if the fourth decimal place is 5 or more (s 6(4)). After multiplying the previous dollar amount by the indexation factor, the result must be rounded to the nearest whole dollar, with 50 cents rounded downwards (s 6(6)). That combination of rounding rules can produce small divergences between manual calculations and administrative outputs if the rules are not implemented in the specified sequence.

Differential per‑year cost for 1‑year and 3‑year terms

• A straightforward arithmetic consequence of items 1-4 is that the three year registration/renewal ($88) is cheaper on an annualised basis than the one year option ($37 per year). The per year cost is approximately $29.33 for the three year option compared with $37 for the one year option (s 6(1), items 1-4). Registrants who fail to compare these options may pay a higher effective annual fee than necessary. The instrument doesn’t mandate any notice to applicants about the cost differential.

Narrow scope of the government/journalist exemption

• The exemption in item 9 applies specifically to “an application by a government body or journalist for an extract of the Register relating to the business names currently or previously registered to an entity” (item 9). The exemption is not a blanket exemption from all fees tied to the Register and does not apply to registration or renewal fees. Parties relying on the exemption must check whether their particular extract request fits the narrow wording.

Item 10 is strictly additional and location dependent

• The $3 charge in item 10 is payable “in addition to the fee payable under item 5, 6, 7 or 8” and only applies when inspection or issue/display occurs at an ASIC Business Centre (item 10). Users who view extracts online or obtain them by other means should not be charged the $3, while those who attend a Business Centre have a marginal extra charge. Disputes could arise where the locus of “issue or display” is ambiguous.

Saving provision for pre‑commencement amounts

• Section 7 preserves the application of the 2011 regulations to amounts that became due before 1 April 2022 (s 7). Organisations that were invoiced, or whose liabilities crystallised, immediately prior to commencement should not assume the new lower or higher fees apply retroactively. Practitioners should verify which regulatory instrument governs any particular past liability.

Calculations depend on ABS publication timing

• The indexation method depends on the published CPI numbers “published by the Australian Statistician” (s 6(3) and s 6(7)). Because the instrument requires the use of “the most recently published index reference period” and restricts reliance on substituted index numbers, administrative timing and which published series to use can materially alter the computed amounts if an implementing agency takes a different interpretive approach. That can be a source of disagreement.

Absence of procedural detail in the instrument

• The regulations do not provide payment timing rules, late payment penalties, remission criteria or the mechanics of applying fees in administrative systems. Those procedural matters are left to the administering agency or to the parent Acts. Stakeholders should not expect to find operational rules in this instrument.

Chargeable matter is defined elsewhere

• The instrument repeatedly assumes the reader will consult the Act for the meaning of chargeable matter (s 5 Note). Practitioners must look to the Business Names Registration (Fees) Act 2011 and the Business Names Registration Act 2011 when determining whether a given activity triggers a fee. This separation of definitions from monetary prescription can create procedural confusion for non‑legal readers.

These specific drafting features are the principal operational and interpretive traps present in the instrument’s text. They are concrete, textually supported risks that practitioners and administrators should address in compliance checklists and system designs.

Complying with the Business Names Registration (Fees) Regulations 2022 requires an operational sequence that aligns the prescribed fee amounts and indexation rules with the facts of a proposed registration, renewal, or extract request. The following steps are grounded in the instrument’s text and are intended as a practical compliance checklist.

1. Confirm whether the activity is a chargeable matter. The regulations prescribe amounts “for the purposes of section 4 of the Act” and note that “chargeable matter is defined in the Act” (s 6(1); s 5 Note). Do not assume a fee applies without first confirming that the action in question is a chargeable matter under the Business Names Registration (Fees) Act 2011 and the Business Names Registration Act 2011. Consult the relevant statutory definitions to establish the trigger.

2. Identify the applicant’s legal status. Check whether the applicant is an “entity”, a “government body” or a “journalist” as those terms are defined in the Business Names Registration Act 2011 (s 5). Items 5-9 differentiate fee liability based on that status. For example, extracts requested by government bodies or journalists may be no fee in the specific circumstance described in item 9.

3. Select the correct fee item. Once the chargeable matter and applicant status are clear, pick the corresponding item in the table in s 6(1). For registrations and renewals, choose between the one year fees ($37) and three year fees ($88) (items 1-4). For extracts, choose among items 5-8 depending on whether the required information is current only or current and historical, and whether the applicant is exempt.

4. Account for the ASIC Business Centre surcharge, if applicable. If the inspection or the issue or display of a document will “occur at a Business Centre of ASIC,” add $3 to the fee applicable under items 5-8 (item 10). Ensure administrative procedures capture the location of the issue/display to determine whether the surcharge applies.

5. Apply the current indexed amount for the relevant financial year. At the start of each financial year after 2021-22, the dollar amounts are replaced by the amounts computed under the indexation formula in s 6(2)-(3). Administrators must calculate the indexation factor using the CPI index numbers as defined, round the factor to three decimal places (s 6(4)), enforce a floor of 1 (s 6(5)), and round resulting dollar amounts to the nearest whole dollar with 50 cents rounded down (s 6(6)). Use the most recently published index reference period and disregard substituted index numbers except as permitted (s 6(7)). Implement these calculations in billing and IT systems to ensure the correct amounts apply on each relevant date.

6. Preserve pre‑commencement rights and obligations. If any amount became due for payment before the instrument’s commencement date of 1 April 2022, the earlier 2011 regulations continue to apply to that amount (s 7). Check invoice dates, liability crystallisation dates and the prior regulatory instrument to determine the governing fee.

7. Maintain documentation and calculation trails. Because the instrument’s indexation depends on published CPI numbers and specified rounding rules, retain a contemporaneous record of the index numbers used, the date of publication relied upon, the numeric computations (including intermediate decimals), and the rounding steps. The instrument requires precise rounding steps which, if not recorded, can lead to disputes (s 6(4)-(6)).

8. Train front‑line staff and update systems. Ensure staff who process registrations, renewals and extract requests can distinguish fee categories, recognise the government/journalist exemption in item 9, determine when the $3 Business Centre surcharge applies (item 10), and apply the current indexed amounts. Update billing and web interfaces to display the correct fees and the effective date of any indexed amounts.

9. Consult the parent Acts for procedural and recovery rules. The instrument prescribes only amounts and indexation. Payment timing, recovery, penalties, remission and dispute resolution are not included. To manage arrears or to challenge fee liability, consult the Business Names Registration (Fees) Act 2011 and the Business Names Registration Act 2011 for statutory remedies, administrative appeal mechanisms or enforcement powers.

10. Review for interpretive edge cases. If an extract request, registration application, or the applicant’s status appears atypical, obtain legal clarification referencing the exact instrument text. For example, ambiguous cases might include whether a person acting on behalf of a journalist qualifies for the exemption in item 9, or whether a hybrid online/physical issue constitutes a Business Centre “display” for the $3 surcharge.

By following these steps and keeping explicit records of indexation inputs and computations as required by s 6(2)-(7), practitioners and administrators will align operational practice with the regulatory text and reduce the risk of misapplication of fees.
