Division 5 Controls in fire ban areas Bushfires Management Act 2016 39 (b) the fire is lit in a fire ban area during a fire ban period. Maximum penalty: 500 penalty units or imprisonment for 5 years. (2) Strict liability applies to subsection (1)(b). (3) Subsection (1) does not apply if: (a) the fire is lit for cooking or boiling water; and (b) there is not any bush or other flammable material within 4 m of the fire; and (c) the fire is not left unattended at any time while lit; and (d) the fire is extinguished without delay on it ceasing to be used.
