55C Safe Transport Victoria may make changes to conditions or restrictions

(1) Subject to this section, Safe Transport Victoria may, at any time, vary or revoke a condition or restriction imposed by Safe Transport Victoria on an exemption granted to an operator of a bus service under this Division or impose a new condition or restriction.

(2) Before taking action under this section, Safe Transport Victoria must—

(a) give the operator written notice of the action that Safe Transport Victoria proposes to take; and

S. 55C(2)(b) amended by No. 34/2023 s. 127(Sch. 1 item 1.41(a)).

(b) allow the operator to make written representations about the intended action within 28 days (or any other period that is agreed between Safe Transport Victoria and the operator); and

(c) consider any representations made under paragraph (b) and not withdrawn.

(3) Safe Transport Victoria must, by written notice given to the operator, provide—

(a) details of any action taken under this section; and

(b) a statement of reasons for any action taken under this section; and

(c) information about the right of review under Part 6.
