BURIAL AND CREMATION REGULATIONS 2022

The Regulations are short and focused; several recurring legal mechanics and technical concepts structure the instrument. This section explains those concepts and where they appear.

• "Have regard to" duties: The Regulations repeatedly require the Minister to "have regard to" particular facts or documents before exercising powers in the Act. Two examples are the requirement to have regard to whether human remains will no longer be part of a cemetery’s land area before changing a cemetery location (linked to s 19(2)(a) of the Act; reg 4), and the requirement to have regard to a plan and its adequacy before declaring a structure or class of structure for interment (linked to s 85; reg 6). The phrase "have regard to" imposes an evaluative obligation on decision makers rather than a prescriptive rule about outcome; the Regulations make explicit which factual matters must be included in that evaluation.

• Spatial and land‑use constraints for undeclared burials: Regulation 5 prescribes a set of technical site criteria for burials in an "undeclared area" under s 37(2) of the Act. These include a minimum parcel size (5 ha), fixed buffers from occupied buildings, bores and bodies of water (100 m), exclusions for land used for public infrastructure including extraction areas, exclusion for floodways, exclusion for wastewater management system vicinities, and a list of prohibited planning zones (M, PM, RW, U, FD, DV, WM) defined under the Planning Act 1999 (reg 5(1) and (4)). The regulation also contains a road exception for unzoned land where the proposed burial site is at least 100 m from the road centre and outside a road reserve (reg 5(2)), and confirms that these site constraints do not apply to interments in structures (reg 5(3)).

• Cross‑referenced technical standards and instruments: Definitions and meanings rely on external technical documents. For example, "decommissioned" bore uses the National Uniform Drillers Licensing Committee's "Minimum Construction Requirements for Water Bores in Australia" (reg 5(4)); "extraction area" uses the Department of Infrastructure, Planning and Logistics' "Standard Specification for Roadworks" (reg 5(4)); "land application area" references the Department of Health's Code of Practice for Wastewater Management approved 4 November 2020 (reg 5(4)); "wastewater management system" cross‑refers to reg 69 of the Public and Environmental Health Regulations 2014 (reg 5(4)). The Regulations therefore import external technical standards as definitional anchors.

• Procedural consultation for new disposal technology: For alkaline hydrolysis, the Regulations require the Minister to consult specified public authorities before granting an operating licence (certification that environmental, public health and trade waste issues have been addressed) (reg 7). This makes environmental and sewerage compatibility preconditions to licensing when the facility intends to provide alkaline hydrolysis.

• Authorisation of a disposal process: The Regulations expressly prescribe alkaline hydrolysis as an authorised disposal process for the purposes of section 137(b) of the Act (reg 8(1)) and set out the essential process elements (pressurised chamber, water and alkali solution, heating to destroy microbes and reduce remains to liquid and ash) (reg 8(2)). The Regulations then link to the Act's offence regime by noting that disposing of remains by an unauthorised process is an offence under s 188 of the Act (note to reg 8).

• Interaction with licences and ongoing regulatory regimes: The Regulations intersect with licensing under the Act (s 123(1) for licences to operate a facility) and with external licensing regimes (sewerage services licence areas under the Water Supply and Sewerage Services Act 2000). The Minister must consult the relevant sewerage services licensee to confirm Trade Waste Code compatibility when alkaline hydrolysis is planned (reg 7(b)).

These concepts convert policy objectives into operational constraints. The Regulations aim to describe minimum technical and procedural parameters for sensitive activities: moving cemeteries, creating new burial sites in undeclared land, declaring structures for interment, and introducing alkaline hydrolysis as a disposal option. The result is an instrument that mixes spatial planning controls, health and environmental safeguards, procedural gatekeeping, and technical authorisation of a particular process.

The Regulations identify a narrow set of decision makers, applicants and third parties that face duties or whose interests must be consulted.

• The Minister responsible for the Burial and Cremation Act 2022. The Minister is the central decision maker. The Regulations impose specific matters the Minister must have regard to before changing a cemetery's location (reg 4), before declaring a structure for interment (reg 6), and require the Minister to undertake particular consultations before granting a licence to operate a facility when alkaline hydrolysis is intended to be available (reg 7). These are obligations on the Minister's decision process, not direct licence conditions on applicants, but they are procedural constraints that will influence outcomes.

• Applicants seeking to change the location of a cemetery under the Act. Regulation 4 requires the Minister, before changing a cemetery location (section 19(2)(a) of the Act), to have regard to whether human remains already buried will cease to be part of the cemetery area if the location is changed. Applicants proposing location changes can expect that this specific factual inquiry will be part of the Minister's assessment (reg 4).

• Applicants wanting to establish burials in undeclared areas. Regulation 5 prescribes strict site criteria. A person or entity proposing an undeclared‑area burial must ensure the parcel is at least 5 hectares, maintain the 100 metre buffers from occupied buildings, non‑decommissioned bores and bodies of water, avoid floodways, avoid specified planning zones, and avoid land used for public infrastructure or within the vicinity of wastewater management systems (reg 5(1)-(4)). The road exception at reg 5(2) is narrowly framed (unzoned land, 100 m from road centre, not within a road reserve).

• Persons or entities proposing interments in structures. The Regulations explicitly state that the site constraints in reg 5 do not apply to interments in structures (reg 5(3)). However, reg 6 requires that before declaring a structure or a class of structure for interment the Minister have regard to a management plan and whether that plan contains adequate layout and burial‑site location information (reg 6).

• Facility operators and prospective licence applicants intending to offer alkaline hydrolysis. Regulation 7 requires the Minister, before granting a licence under s 123(1), to consult the Chief Health Officer about environmental and public health matters and to consult the licence holder for the relevant sewerage services licence area under the Water Supply and Sewerage Services Act 2000 to confirm Trade Waste Code compatibility (reg 7(a)-(b)). This imposes a pre‑licensing consultation requirement that directly affects prospective operators.

• Sewerage services licensees and the Chief Health Officer. Those agencies are statutory consultees under reg 7; their assessments will bear on whether the Minister proceeds to grant a licence where alkaline hydrolysis is to be made available (reg 7).

• Entities administering planning schemes, road reserves and water management regimes. Reg 5 cross‑references planning zones under the Planning Act 1999 (prohibiting certain zones), road reserves, floodways, and extraction areas as defined by external standards (reg 5(1), (2), (4)). Those administering or certifying zoning, road reserve boundaries and flood mapping will therefore be implicated as providers of factual inputs.

• Technical standards custodians. The Regulations rely on industry or departmental standards to define key terms: the National Uniform Drillers Licensing Committee's bore standards, the Department of Infrastructure, Planning and Logistics' roadworks specification, and the Department of Health code of practice for wastewater management (reg 5(4)). Those custodians are not directly regulated by these Regulations, but their documents are imported into statutory meaning.

• The public and nearby landowners. The buffer and exclusion rules (reg 5) define a risk‑area around proposed gravesites; adjacent landowners and occupants will therefore be affected by where burials can be sited. For instance, the 100 metre buffer from occupied buildings (reg 5(1)(b)) protects occupiers as a matter of siting, and the prohibition against burial near wastewater management systems and within floodways (reg 5(1)(e), (g)) has implications for land subject to those designations.

• Manufacturers and suppliers of alkaline hydrolysis equipment. Reg 8 prescribes technical elements of the process: a purpose‑built pressurised chamber, water and alkali solution, and heating to specified ends (destroy microbes and reduce remains to liquid and ash) (reg 8(2)). Suppliers will have to meet that description if their equipment is to be used in an authorised process.

Who does not appear: there are no new criminal penalties or administrative fee regimes in the Regulations themselves; enforcement, licensing powers and penalty provisions are referenced to the Act (for example s 188 and s 123(1)). The Regulations therefore primarily affect licencing applicants, the Minister's decision process, statutory consultees and operational planners responsible for siting and technical compliance.

The Regulations frame a limited number of duties (procedural and technical) and place rights and expectations on applicants and consultees. Below are the main duties, their legal loci and the practical consequences they create.

Duties on the Minister

• Duty to have regard to effects on buried remains before changing a cemetery location. For the purposes of s 19(2)(a) of the Act, reg 4 requires the Minister to have regard to whether any human remains buried in the cemetery will no longer be part of the cemetery land area if the cemetery location is changed. This is a mandatory consideration in the exercise of the Minister's power under the Act; the regulation specifies the factual matter the Minister must include in the decision record or assessment process.

• Duty to have regard to plans and their adequacy before declaring a structure for interment. Regulation 6 requires the Minister, before declaring a structure or class of structure under s 83 of the Act, to have regard to any plan prepared by the person or entity that will manage the structure and to whether that plan includes adequate information on layout and location of burial sites (reg 6(a)-(b)). This imports documentation standards into the declaration process.

• Duty to consult specified authorities prior to granting a licence when alkaline hydrolysis is to be available. Regulation 7 requires the Minister, before granting a licence under s 123(1) of the Act, to consult the Chief Health Officer on environmental and public health matters and the licensee for the relevant sewerage services licence area to confirm whether operation can occur within the guidelines of the Trade Waste Code (reg 7(a)-(b)). This consultation is a precondition when alkaline hydrolysis is intended.

Duties on applicants and operators

• Site compliance for burials in undeclared areas. Regulation 5 prescribes concrete site constraints. An applicant proposing a burial in an undeclared area must ensure the site complies with the 5 hectare minimum parcel size and the 100 metre buffers from any occupied building, non‑decommissioned bore and any body of water; must not be on public infrastructure/extraction area, within the vicinity of wastewater management systems (including land application areas) or within specified planning zones, and must not be located on a floodway (reg 5(1)-(4)). If the applicant seeks to rely on the road exception, the site must be on unzoned land, 100 metres from the road centre and outside a road reserve (reg 5(2)).

• Documentation for structure declarations. Entities that will manage structures for interment should prepare a plan that includes adequate layout and burial‑site location information because the Minister must have regard to the plan and its adequacy (reg 6).

• Pre‑licence engagement for alkaline hydrolysis. A facility that intends to make alkaline hydrolysis available should expect the Minister to consult the Chief Health Officer and the relevant sewerage services licensee prior to licence grant. The facility operator will likely need to demonstrate environmental and public health compliance and compatibility with the Trade Waste Code (reg 7).

Obligations tied to technical definitions and external standards

• Bores, extraction areas, land application areas and wastewater systems are defined by or cross‑referenced to external standards. Compliance therefore requires applicants to engage with those external instruments and potentially obtain evidence or certification that the site meets the definitions (reg 5(4)).

Rights and expectations

• The Regulations do not create a private right of appeal or prescribe compensation rights; they set decision‑making inputs for the Minister and technical thresholds for applicants. Rights to licence or to undertake certain processes remain governed by the Act; the Regulations specify matters that must be taken into account and consultations that must occur but do not themselves grant entitlements beyond clarifying authorised processes (for example, alkaline hydrolysis) (reg 8).

• Clarity on authorised processes. The Regulations authorise alkaline hydrolysis for the disposal of human remains (reg 8(1)) provided the process meets the elements in reg 8(2). That authorisation sets the boundary for lawful use of that process, while linking back to the Act's offence regime for unauthorised disposal methods (note to reg 8).

In sum, the Regulations impose procedural duties on the Minister, prescribe technical and siting duties on applicants for burials in undeclared areas, and create obligatory consultations where alkaline hydrolysis is proposed. They are not a comprehensive licensing code but a set of inputs and thresholds that must be satisfied in the exercise of powers under the Act.

The Regulations themselves do not establish new penalty amounts, enforcement agencies, or administrative sanctioning regimes. Instead, they operate by (1) imposing mandatory procedural steps on the Minister and (2) prescribing authorised process elements, which are linked to offence provisions in the underlying Act.

• Offence link: The Regulations expressly note that disposing of human remains by a process not authorised by the Act or another Act is an offence against section 188 of the Burial and Cremation Act 2022 (note to reg 8). Reg 8 prescribes alkaline hydrolysis as an authorised process (reg 8(1)) and sets out required process components (reg 8(2)). By establishing what constitutes an authorised alkaline hydrolysis process, the Regulations create a definitional boundary; operating outside that definition can expose an operator to prosecution under s 188 of the Act.

• Ministerial obligations as enforceable steps: Regulations 4, 6 and 7 impose duties the Minister must follow when exercising particular powers under the Act. While the Regulations use the phrase "must have regard to" or "must consult", the text of the Regulations does not itself set out sanctions for non‑compliance by the Minister. Any question of remedy for failure to comply with those statutory process obligations will be governed by the Act and by public law principles (judicial review), but the Regulations themselves do not specify enforcement mechanisms directed at the Minister.

• Licensing consequences: Regulation 7 requires consultation with the Chief Health Officer and the relevant sewerage services licensee before the Minister grants a licence to operate a facility if alkaline hydrolysis is to be available (reg 7). The practical enforcement mechanism is therefore the licensing gate: if the Minister declines to grant a licence because consultees identify unresolved public health or trade waste incompatibilities, the operator will be unable to lawfully operate. The Regulations do not specify appeal procedures against licence decisions , those would be in the Act.

• Reliance on external regulatory regimes: Several definitions and constraints invoke external instruments that carry their own regulatory or compliance regimes. For example, whether a bore is "decommissioned" is given the same meaning as in the "Minimum Construction Requirements for Water Bores in Australia" (reg 5(4)); whether a site is within a land application area depends on the Department of Health's Code of Practice for Wastewater Management (reg 5(4)); and sewerage compatibility is assessed against the Trade Waste Code under the Water Supply and Sewerage Services Act 2000 (reg 7(b)). Non‑compliance with those external instruments may have consequences under the instruments or underlying statutory regimes, which can affect the ability to obtain or retain a licence under the Burial and Cremation Act regime.

• No new inspection or auditing powers expressed: The Regulations do not themselves prescribe inspection regimes, record‑keeping standards, certification requirements, or minimum competence for operators of alkaline hydrolysis equipment. They specify process elements and procedural consultations but leave the details of ongoing compliance assessment to the licensing and enforcement architecture of the Act and the other referenced instruments.

For practitioners, the practical enforcement risk is twofold: criminal exposure for undertaking an unauthorised disposal process contrary to s 188 of the Act if the process does not meet reg 8, and the administrative risk that licences will not be granted or will be conditioned if consultees identify public health or trade waste incompatibility during the pre‑licence consultation mandated by reg 7. The Regulations therefore act primarily as definitional and procedural constraints bolted onto the Act’s enforcement framework.

The Regulations are designed to operate within an ecosystem of Northern Territory statutes and external technical standards. The instrument contains multiple cross‑references; understanding these interactions is essential for compliance and decision‑making.

Primary interaction with the Burial and Cremation Act 2022

• The Regulations sit beneath and operationalise multiple sections of the Act. They provide detail for the Minister’s considerations under s 19(2)(a) (reg 4), for burials in undeclared areas under s 37(2) (reg 5), for declarations about structures under ss 83-85 (reg 6), for granting licences to operate facilities under s 123(1) where alkaline hydrolysis is intended (reg 7), and for prescribing authorised disposal processes under s 137(b) (reg 8). The Regulations also reference the offence provision s 188 regarding unauthorised disposal processes (note to reg 8). As a subordinate instrument, they add procedural and technical specificity to the Act’s high‑level provisions.

Planning and land‑use law

• The Regulations prohibit burials in undeclared areas on land that is zoned M (Main Road), PM (Proposed Main Road), RW (Railway), U (Utilities), FD (Future Development), DV (Development) or WM (Water Management) under a planning scheme as defined in the Planning Act 1999 (reg 5(1)(h)). This creates a direct dependency on planning scheme zoning decisions made under the Planning Act 1999. Applicants must therefore obtain and rely on planning records and zoning determinations under that Act to demonstrate compliance.

Water, sewerage and trade waste law and codes

• The Regulations require consultation with the licensee for the relevant sewerage services licence area under the Water Supply and Sewerage Services Act 2000 as part of the licence pre‑grant process where alkaline hydrolysis is to be offered (reg 7(b)). That consultation is to confirm whether the facility can operate within the guidelines of the Trade Waste Code. This links the burial and cremation licensing regime to sewerage licensing and trade waste regulation under the Water Supply and Sewerage Services Act 2000 and any Trade Waste Code administered under that Act.

Public and environmental health instruments

• Regulation 5 cross‑references the Department of Health's "Code of Practice for Wastewater Management" (approved by the Chief Health Officer on 4 November 2020) for the definition of "land application area" and references reg 69 of the Public and Environmental Health Regulations 2014 for the broader term "wastewater management system" (reg 5(4)). Regulation 7 requires consultation with the Chief Health Officer about environmental and public health matters for alkaline hydrolysis (reg 7(a)). These cross‑references integrate public health instruments into siting and licensing decisions.

External technical standards

• The Regulations import the meaning of "decommissioned" in relation to bores from the "Minimum Construction Requirements for Water Bores in Australia", published by the National Uniform Drillers Licensing Committee (reg 5(4)). They also import the meaning of "extraction area" from the "Standard Specification for Roadworks", published by the Department of Infrastructure, Planning and Logistics (reg 5(4)). The Regulations therefore bind stakeholders to standards developed outside the Burial and Cremation Act regulatory framework and require practitioners to consult and apply those standards when assessing site suitability.

Administrative law

• By imposing "must have regard to" and "must consult" obligations on the Minister, the Regulations embed procedural requirements into the exercise of administrative power. Failure to take these prescribed considerations into account may raise public law issues under judicial review principles. The Regulations do not themselves set appeal mechanisms; remedies and challenges to decisions involving these obligations will arise under the Act and general administrative law.

Summary of interaction characteristics

• The Regulations are deliberately integrative: they do not try to create novel regimes but instead channel decisions through existing planning, water, sewerage, and public health frameworks. Practically, applicants and agencies must co‑ordinate across multiple legal instruments and technical standards to establish compliance. The Regulations make licence grants and site authorisations contingent not just on the Act's criteria, but on compatibility with planning zones, water bore standards, roadworks specifications, wastewater management codes and trade waste guidelines.

For practitioners, the key operational consequence is multi‑agency engagement: an application touching on burial siting or alkaline hydrolysis will require assembling documentary evidence and consultative sign‑offs from planning authorities, water/sewerage licensees, and public health officials in order to pass the thresholds the Regulations have prescribed.

The Regulations are recently made and have a concise formal history recorded in the instrument’s endnotes.

• Name and instrument: Burial and Cremation Regulations 2022, Subordinate Legislation No. 19 of 2022 (see endnotes).

• Notification: The Regulations were notified on 22 November 2022 (endnotes, List of Legislation).

• Commencement: The Regulations commenced on 28 November 2022, linked to the commencement of section 195 of the Burial and Cremation Act 2022. The commencement reference is given as (r 2, s 2 Burial and Cremation Act 2022 (Act No. 16, 2022) and Gaz S60, 23 November 2022) in the endnotes.

• Structural stability: The instrument as supplied contains no amending provisions, no prior versions, and no recorded subsequent amendments up to the "as in force at 28 November 2022" date on the face of the text. The endnotes provide a key to abbreviations used in the Territory legislative database (e.g. "amd", "rep") but do not show any amendments applied to the Regulations themselves.

• Entrenchment points: The Regulations rely on the commencement of an Act provision (section 195 of the Burial and Cremation Act 2022) for their own commencement (reg 2). There is no staged commencement in the Regulations themselves; they are tied to that Act commencement event.

• External instruments referenced but not amended: Several external documents are incorporated by reference for definitions and meaning (see reg 5(4)). These external documents are not amended by the Regulations; rather, the Regulations import their definitions "as amended from time to time" in some instances (for example the bore minimum construction requirements and roadworks specification are described as "as amended from time to time" (reg 5(4))). That phrasing creates a dynamic incorporation of those external documents into the meaning of certain terms, so future amendments to those documents will flow through to how the Regulations are applied.

No further amendment record is provided in the text. Practitioners should treat the Regulations as new at the date of commencement and watch for future amending instruments or changes to the external technical documents the Regulations import. The dynamic reference to "as amended from time to time" in reg 5(4) is a mechanism that ensures the Regulations’ technical references will follow future updates to those external instruments unless separately amended.

The provided Regulations text contains no litigation history. There are no cases, decisions or legal challenges recorded in the instrument or in the endnotes. The text does not name any judicial decisions or administrative rulings that interpret or apply the Regulations.

Relevant observations about potential litigation touchpoints

• Procedural obligations on the Minister: The Regulations impose specific statutory considerations and consultation steps the Minister "must" follow (regs 4, 6-7). Challenges to administrative decisions that fail to follow those steps would, in principle, be resolved under administrative law and judicial review principles. The Regulations themselves do not set remedial procedures or appeals; any litigation would therefore proceed against the Act’s decision framework and general public law. The text supplied does not record any actual litigation.

• Definition and boundary of "alkaline hydrolysis": Reg 8 prescribes a technical description of alkaline hydrolysis. Disputes about whether a particular facility’s process meets that description (for example whether a chamber is "purpose‑built", or whether the process "completely reduce[s] the human remains to liquid and ash") would raise questions of factual and expert evidence rather than statutory interpretation alone. The Regulations' note linking unauthorised processes to s 188 of the Act creates a potential enforcement battleground; however, no case law is provided in the Regulations.

• Cross‑referenced instruments: The Regulations import meanings from external technical standards and codes. Litigation might arise over the operative version of an external document, the effect of its amendments "from time to time", or conflicting readings of an external standard. The Regulations themselves do not provide interpretive guidance beyond naming the documents.

Because the instrument is newly made at the date shown, there is simply no recorded litigation history in the text. Practitioners should expect initial litigation risk to crystalise around administrative procedural compliance (Ministerial obligations), the technical sufficiency of plans for structures (reg 6), site compliance under reg 5, and whether particular disposal processes fall within reg 8’s authorised description or breach s 188 of the Act. None of those points has been litigated within the supplied instrument.

The Regulations contain several technical drafting choices and cross‑reference dependencies that create practical pitfalls. The following are concrete "watch outs" drawn from the text.

• "Have regard to" is not the same as prohibition or guarantee. Regulations 4 and 6 require the Minister to "have regard to" specific matters (reg 4; reg 6). That phrase imposes an evaluative duty but does not fix outcomes. Applicants may nevertheless be surprised if a Minister considers those matters and reaches a discretionary decision adverse to them. The Regulations do not prescribe how the Minister must weigh these matters or record them.

• Site constraints apply only to burials in undeclared areas, not to interments in structures. The exclusions, buffers and zoning prohibitions in reg 5 do not apply to interments in structures (reg 5(3)). If proponents assume the site constraints always apply, they may over‑specify requirements; conversely, those attempting to avoid constraints by using structures must still meet the declaration requirements in reg 6, which require a plan and adequate site/burial location information.

• The 5 hectare minimum parcel size is a hard threshold for undeclared area burials. Reg 5(1)(a) prescribes "at least 5 ha in area"; this is a clear numeric minimum that cannot be read down without amendment. Small rural parcels or peri‑urban lots will therefore be ineligible for undeclared burials under the Regulations.

• Multiple 100 metre buffers create compounding constraints. Reg 5(1)(b), (d) and (f) each set 100 metre distances from occupied buildings, non‑decommissioned bores and bodies of water respectively. In many landscapes these buffers will intersect and reduce available land for burials. Applicants must map these multiple buffers against parcel boundaries.

• Dependence on external definitions that are dynamic. Several key terms are defined by reference to external documents and expressly “as amended from time to time” (reg 5(4)). This creates a shifting compliance target: what counts as a decommissioned bore or extraction area may change when the referenced technical documents are updated. Applicants and administrators should track changes to those external documents.

• "Land used for public infrastructure" is broadly defined with examples. Reg 5(4) defines public infrastructure and gives examples including roads, dams, bridges, recreational spaces and corridors for infrastructure, transport and utilities. The breadth of this concept means that a surprising range of land uses may be excluded from burial siting if characterised as public infrastructure.

• Narrow road exception for unzoned land. The road exception in reg 5(2) only applies where the proposed burial site is located on unzoned land and is at least 100 metres from the centre of the road and not within a road reserve. Land that is zoned, or within a road reserve, cannot rely on this exception.

• Alkaline hydrolysis authorised but tightly described. Reg 8 expressly authorises alkaline hydrolysis and then prescribes the essential process elements: purpose‑built pressurised chamber, water and alkali solution, and heating to destroy microbes and completely reduce remains to liquid and ash (reg 8(2)). Operators need to ensure their equipment and process match this description exactly, or they risk running afoul of s 188 of the Act for using an unauthorised process.

• Pre‑licence consultations may block or delay licences. Reg 7 mandates consultation with the Chief Health Officer and the sewerage services licensee before a licence is granted if alkaline hydrolysis is to be made available (reg 7). These consultees are assessing "environmental and public health" and Trade Waste Code compatibility; negative or unresolved assessments may prevent licence grant or require operational modifications.

• Wastewater management system proximity is defined by cross‑reference. Reg 5(1)(e) bars burial "within the vicinity" of an area with an installed wastewater management system including the land application area, and reg 5(4) cross‑references the Department of Health Code of Practice for Wastewater Management for the meaning of "land application area". Determining whether land is in the "vicinity" will require authoritative mapping or certification under that Code.

• No express guidance on record‑keeping, monitoring or technical certification. The Regulations require plans and consultations but do not prescribe minimum documentary formats, retention periods, or inspection frequency. Practitioners should not assume documentary sufficiency standards beyond the general requirement that plans include layout and burial‑site locations (reg 6).

These practical pitfalls are not legal conclusions about the policy. They are explicit consequences of the Regulation text that will affect applicants, administrators and consultees in operationalising the Act.

The Regulations set out a relatively compact compliance perimeter. Below is a practical step‑by‑step compliance checklist for common situations raised by the Regulations, followed by record and engagement recommendations. All references are to the Regulations and their cross‑references.

A. Preparing for a burial in an undeclared area (reg 5)

1. Verify parcel size: confirm the parcel proposed for burial is at least 5 hectares in area (reg 5(1)(a)). Obtain cadastral evidence.

2. Map 100 metre buffers: map and certify 100 metre buffers from any occupied building, any bore that is not decommissioned, and any body of water. If a bore is present, confirm its "decommissioned" status against the "Minimum Construction Requirements for Water Bores in Australia" (reg 5(1)(b), (d), (f) and reg 5(4)). Retain the certifying documents.

3. Check for public infrastructure and extraction areas: confirm the proposed site is not land used for public infrastructure, including extraction areas as defined by the Department of Infrastructure, Planning and Logistics' "Standard Specification for Roadworks" (reg 5(1)(c) and reg 5(4)). Obtain written confirmation from the authority responsible for roadworks or infrastructure where necessary.

4. Confirm wastewater proximity and land application area status: ensure the site is not within the vicinity of land with an installed wastewater management system or a land application area, using the Department of Health's Code of Practice for Wastewater Management (approved 4 Nov 2020) and reg 69 of the Public and Environmental Health Regulations 2014 as necessary (reg 5(1)(e) and reg 5(4)). Obtain mapping or an opinion from the Chief Health Officer where ambiguity exists.

5. Floodplain and floodway check: confirm the site is not on a "floodway" as defined in the Regulations (reg 5(1)(g) and reg 5(4)). Secure flood mapping and evidence.

6. Zoning check: obtain the planning scheme zoning for the parcel and confirm that it is not zoned M, PM, RW, U, FD, DV or WM under the Planning Act 1999 (reg 5(1)(h)). If the parcel is unzoned and the proposal involves a road‑adjacent location, review the road exception carefully (reg 5(2)).

7. Road exception: if relying on the reg 5(2) road exception, confirm the land is unzoned, measure 100 m from the road centre, and ensure the site is outside the road reserve. Obtain or produce a plan showing distances to the road centre and the road reserve boundary.

8. Consider interment in structure: if site constraints create infeasibility, consider whether an interment in a structure is an option; reg 5(3) exempts interments in structures from those site constraints but reg 6 requires the Minister to have regard to an adequate plan for any declared structure.

B. Declaring a structure or class of structure for interment (reg 6)

1. Prepare a management plan: the person or entity that will manage and control the structure must prepare a plan that details layout and identifies portions for specific use and the location of each burial site (reg 6(a)-(b)(i)-(ii)).

2. Ensure plan adequacy: the Minister must have regard to whether the plan includes adequate information about layout and burial site locations (reg 6(b)). Draft the plan with sufficient detail to demonstrate how the structure will be managed over time.

3. Attach supporting documentation: supply plans, site surveys, maintenance protocols and management arrangements as part of the declaration application to facilitate the Minister’s consideration.

C. Licensing and establishing alkaline hydrolysis (regs 7-8)

1. Early engagement with Chief Health Officer: if the facility intends to make alkaline hydrolysis available, initiate pre‑application engagement with the Chief Health Officer to identify environmental and public health matters that will be considered during the Minister’s consultation (reg 7(a)).

2. Early engagement with sewerage licensee: contact the licensee for the relevant sewerage services licence area under the Water Supply and Sewerage Services Act 2000 to confirm whether the facility can operate within the Trade Waste Code guidelines (reg 7(b)). Obtain written confirmation or an agreed list of conditions.

3. Design to the regulatory description: ensure the alkaline hydrolysis process is implemented using a purpose‑built pressurised chamber, placing human remains in a solution of water and alkali, and heating the chamber to a temperature that destroys microbes and completely reduces remains to liquid and ash (reg 8(2)). Keep technical specifications, equipment certificates and manufacturer documentation that demonstrate these elements.

4. Prepare licence submission package: include the Chief Health Officer’s environmental/public health advice and the sewerage licensee’s Trade Waste Code confirmation in the licence submission or be ready to provide them promptly during the Minister’s pre‑grant consultations (reg 7).

5. Avoid unauthorised processes: do not run a process that falls outside the reg 8 description; doing so risks contravening s 188 of the Act (note to reg 8).

D. Record keeping and evidence

1. Assemble cross‑referenced documents: collect copies of the external technical documents cited in reg 5(4) (bore standards, roadworks specification, Code of Practice for Wastewater Management) and any updated versions which may alter definitions.

2. Maintain mapping evidence: keep precise cadastral maps, buffer maps, flood maps and planning scheme extracts that demonstrate conformance with reg 5 criteria.

3. Document consultations: retain records of consultations with the Chief Health Officer and sewerage licensee, including issues raised and any conditions agreed, since reg 7 makes those consults a pre‑licence mandatory step where alkaline hydrolysis is intended.

4. Management plans for structures: maintain the plan and any updates, including layout, burial location diagrams and management arrangements, because reg 6 makes plan adequacy an explicit ministerial consideration.

E. Practical timings and coordination

1. Anticipate sequential steps: for alkaline hydrolysis, the Minister’s licence grant is conditioned on the consultation steps in reg 7. Early engagement reduces the risk of delay.

2. Coordinate multi‑agency evidence: prepare to interface with planning authorities, water and sewerage agencies, and the Chief Health Officer simultaneously to assemble the full package required for site approval or licence grant.

Following these steps aligns operatives and applicants with the Regulations’ prescriptive elements. The Regulations do not specify application forms, timeframes for consultative responses, or detailed technical thresholds (for example, specific temperatures for alkali hydrolysis), so practitioners must use the process elements and external standards referenced in the Regulations to assemble a defensible compliance record.
