60 Refund for surrendered exclusive rights of burial cemetery must establish a policy for refunds of payments for exclusive rights of burial in relation to the surrender of unexercised exclusive rights of burial under section 59(1) if the responsible entity provides for exclusive rights of burial. (2) The manager of the cemetery must ensure that a person applying for an exclusive right of burial is aware of the refund policy before entering into an agreement for the exclusive right of burial. (3) The refund policy that applies to the surrender of the exclusive right of burial is the policy current at the time the person entered into the agreement for the exclusive right of burial.
