112 Matters relevant building surveyor must consider when determining if protection work required For the purposes of making a determination under regulation 111, the relevant building surveyor must have regard to— (a) any allotment plan provided to the relevant building surveyor under regulation 25 or regulation 26; and (b) specifications that describe the materials and methods to be used in the proposed building work; and (c) any demolition required as part of the proposed building work; and (d) any excavation required as part of the proposed building work; and (e) any proposed building work in relation to party walls and retaining walls; and (f) the nature and likely extent of any damage or other adverse effect on the stability or otherwise of an adjoining property that may be caused by the proposed building work; and Reg. 112(g) amended by S.R. No. 73/2021 reg. 6(1). (g) any certificate under section 238 of the Act from a civil engineer, who designed the building work; and Reg. 112(h) amended by S.R. No. 73/2021 reg. 6(2). (h) any certificate under section 238 of the Act from an independent engineer who is a civil engineer, certifying that the structural design of the building work complies with the Act and these Regulations; and (i) any other matter the relevant building surveyor considers relevant.
