84 Fraudulent allegations

(1) A person who, with the intention of obtaining a financial advantage or causing a financial disadvantage to another person—

(a) provides any false or misleading information about a building product or the use of a building product to the Secretary, or

(b) makes an unsubstantiated allegation about a building product or the use of a building product to the Secretary,

is guilty of an offence.

Maximum penalty—100 penalty units.

(2) In this section—

obtain a financial advantage and cause a financial disadvantage have the same meanings as they have in Part 4AA of the Crimes Act 1900.

Secretary includes an authorised officer or any other person exercising functions under this Act.

unsubstantiated allegation means an allegation or complaint made without reasonable grounds.
