#### 75 Persons eligible for appointment as authorised officers 75 Persons eligible for appointment as authorised officers > > (1) Each of the following persons is eligible to be appointed as an authorised officer for the purposes of this Act— > > > > > (a) an employee of the Department, > > > > > (b) an employee of the Environment Protection Authority, > > > > > (c) an employee of the Department of Planning and Environment, > > > > > (d) an employee of Fire and Rescue NSW, > > > > > (e) a member of a permanent fire brigade within the meaning of the [Fire and Rescue NSW Act 1989](/view/html/inforce/current/act-1989-192), > > > > > (f) an employee of a council who is an authorised person under the [Local Government Act 1993](/view/html/inforce/current/act-1993-030), > > > > > (g) a person of a class prescribed by the regulations. > > > (2) A police officer is taken to be an authorised officer under this Act and may exercise all of the functions of an authorised officer under this Act. > > > (3) Nothing in this Act limits the functions of a person who is an authorised officer under any other Act or law. > > **s 75:** Am 2018 No 59, Sch 5.1; 2022 No 59, Sch 3.7; 2024 No 53, Sch 3.4\[3\].
