38 End of statutory warranties—Act, s 88 (4)
(1) The period for the end of a warranty is—
(a) for residential building work in relation to a structural element
of a building—6 years after the completion day for the work; or
(b) for residential building work in relation to a non-structural
element of a building—2 years after the completion day for the
work.
non-structural element, of a building, means a component of the
building that is not a structural element.
structural element, of a building, means—
(a) a load-bearing component of the building (whether internal or
external) that is essential to the stability of the building or part
of it; or
(b) a component (including weatherproofing) forming part of the
external walls or roof of the building.
