sec.38 Repayment notice

This section applies if— a person contravenes section 35 (3) or 36 (2) or a repayment requirement; or a building boost grant has been wrongly paid to a person because of— a contravention of section 81 ; or a mistake to which the person has not contributed; or an administrative or clerical error another reason. The commissioner may give the applicant or recipient a notice (a repayment notice )— stating— the circumstances under subsection (1) for which the notice is given; and that the person is required to repay the amount of the building boost grant within a stated period of at least 60 days; and including or accompanied by a decision notice for the decision to issue the repayment notice. A repayment notice may also be given under section 115 (3) .
