23H Meaning of “plan of subdivision for lease purposes”

(1) In this division, plan of subdivision for lease purposes means a plan of subdivision if—

(a) the subdivision is of land within a caravan park or manufactured home estate, and

(b) the plan is marked, in accordance with the regulations, to indicate that development consent to the subdivision—

(i) has been granted under the Environmental Planning and Assessment Act 1979, and

(ii) is subject to the condition that the subdivision is a subdivision for lease purposes.

(2) In this section—

caravan park means land on which caravans, or caravans and other moveable dwellings, are installed or placed.

manufactured home—

(a) means a self-contained dwelling that—

(i) includes at least one kitchen, bathroom, bedroom and living area, and

(ii) includes toilet and laundry facilities, and

(iii) comprises one or more major sections, and

(iv) is not a motor vehicle, trailer or other registrable vehicle within the meaning of the Road Transport Act 2013, and

(b) includes any associated structures that form part of the dwelling.

manufactured home estate means land on which manufactured homes are, or are to be, erected.

moveable dwelling has the same meaning as in the Local Government Act 1993.

plan of subdivision has the same meaning as in Part 23, Division 3.
