196 Delegation
196 Delegation
(1) The Minister may delegate the Minister’s functions under this Act or the regulations to—
(a) a person employed in the Department, or
(b) a person prescribed by the regulations.
(2) The Secretary may delegate the Secretary’s functions under this Act or the regulations to—
(a) a person employed in the Department, or
(b) a person prescribed by the regulations.
(3) The power of delegation under this section cannot be delegated.
(4) A delegation must be done by a written instrument of delegation.
(5) A person may delegate a function delegated to the person if the instrument of delegation specifically authorises the person to delegate the function.
